As the expansion of the Internet and the digital formatting of all kinds of creative works move us further into the information age, intellectual property issues have become paramount. Computer programs costing thousands of research dollars are now copied in an instant. People who would recoil at the thought of stealing cars, computers, or VCRs regularly steal software or copy their favorite music from a friend's CD. Since the Web has no national boundaries, these issues are international concerns. The contributors-philosophers, (...) legal theorists, and business scholars, among others-address questions such as: Can abstract ideas be owned? How does the violation of intellectual property rights compare to the violation of physical property rights? Can computer software and other digital information be protected? And how should legal systems accommodate the ownership of intellectual property in an information age? As Benson Mates puts the worry, ‘if agreement about usage cannot be reached within so restricted a sample as the class of Oxford Professors of Philosophy, what are the prospects when the sample is enlarged?’ (Mates, Inquiry 1:161–171, 1958, p. 165). In this chapter, (...) we evaluate Mates’s criticism alongside Ryle’s and Austin’s specific claims about the ordinary use of these words, assessing these claims against actual examples of ordinary use drawn from the British National Corpus (BNC). Our evaluation consists in applying a combination of methods: first aggregating judgments about a large set of samples drawn from the corpus, and then using a clustering algorithm to uncover connections between different types of use. In applying these methods, we show where and to what extent Ryle’s and Austin’s accounts of the use of the target terms are accurate as well as where they miss important aspects of ordinary use, and we demonstrate the usefulness of this new combination of methods. This special issue grew out of a small conference The Known & the Unknown: Exploring Twelfth-Century Philosophy, which was funded by the Carlsberg Foundation, hosted by the Saxo Institute, and held at the University of Copenhagen in April 2018. Its central topic was the many, mostly unexplored, commentaries on Aristotle, Boethius, and Porphyry that constitute the key textual evidence for a fascinating phenomenon that, although it played a pivotal role in the philosophical revival of Western Europe, remains frustratingly underexplored to (...) this day: the logical schools of the twelfth century. The present introduction has two parts. In the first part, John Marenbon lays out the background to this special issue of Vivarium as a whole, explaining both what the philosophical project pursued by twelfth-century logicians was and how, and how far, the historical project of understanding it has progressed over the last two hundred years. An algebra is effective if its operations are computable under some numbering. When are two numberings of an effective partial algebra equivalent? For example, the computable real numbers form an effective field and two effective numberings of the field of computable reals are equivalent if the limit operator is assumed to be computable in the numberings . To answer the question for effective algebras in general, we give a general method based on an algebraic analysis of approximations by elements of (...) a finitely generated subalgebra. Commonly, the computable elements of a topological partial algebra are derived from such a finitely generated algebra and form a countable effective partial algebra. According to Wilson, rather than becoming the intellectual beacon of hope Emerson envisioned, the American (literary) scholar has become trapped in a kind of intellectual bondage by the very act of writing. If stem cell-based therapies are developed, we will likely confront a difficult problem of justice: for biological reasons alone, the new therapies might benefit only a limited range of patients. In fact, they might benefit primarily white Americans, thereby exacerbating long-standing differences in health and health care.

Professor Robert John Barrett died suddenly, after a long and difficult illness, on January 12th, 2007. At the time of his death, at the age of 57, he was Head of the Discipline of Psychiatry at the Royal Adelaide Hospital, University of Adelaide. His passing was mourned by countless individuals in Australia and internationally. The celebration of his life, held in the University of Adelaide’s Bonython Hall, from which generations of scholars have received their parchments upon graduation, was an (...) emotive ritual of which Rob would have both approved and also enjoyed immensely. The Hall was filled to capacity, with over 1,300 people listening to a collection of his favourite music and tributes delivered by eight of his friends and family members. Dignitaries in full academic regalia, including the Vice-Chancellor, the immediate past and current Deans of Medicine, and the Head of School oversaw proceedings from an elevated position in the Hall, the symbolic meaning of which would have caused Rob to smile wryly. A reflection of his life in pictures, at the conclusion of the ceremony, before the pall-bearers carried his coffin to the hearse, evoked yet more tears and grief at the tragic and untimely loss of this man: an outstanding intellectual, wise mentor, gifted teacher, caring doctor, and true and loyal friend. Experiential evidence shows that pain is associated with common meanings. These include a meaning of threat or danger, which is experienced as immediately distressing or unpleasant; cognitive meanings, which are focused on the long-term consequences of having chronic pain; and existential meanings such as hopelessness, which are more about the person with chronic pain than the pain itself. This interdisciplinary book - the second in the three-volume Meanings of Pain series edited by Dr Simon van Rysewyk - aims to better (...) understand pain by describing experiences of pain and the meanings these experiences hold for the people living through them. The lived experiences of pain described here involve various types of chronic pain, including spinal pain, labour pain, rheumatic pain, diabetic peripheral neuropathic pain, fibromyalgia, complex regional pain syndrome, endometriosis-associated pain, and cancer-related pain. Two chapters provide narrative descriptions of pain, recounted and interpreted by people with pain. Language is important to understanding the meaning of pain since it is the primary tool human beings use to manipulate meaning. As discussed in the book, linguistic meaning may hold clues to understanding some pain-related experiences, including the stigmatisation of people with pain, the dynamics of patient-clinician communication, and other issues, such as relationships between pain, public policy and the law, and attempts to develop a taxonomy of pain that is meaningful for patients. Since Origen and Chrysostom, John s Gospel has been valued as the most spiritual among the New Testament writings. Although Origen recognizes the Stoic character of John s statement that God is pneuma, an examination of the gospel in light of Stoic physics has not yet been carried out. Instead the Johannine spirit has been absorbed into the Word and lost its distinct character as physical mediator between the divine and humane spheres. During the first half of the twentieth century there was a marked decline in biological conceptions of man and society. This paper describes the development of the views concerning eugenics held by the Norwegian scientific expertise, from open racism before World War I to a moderate nonracist eugenic program in the 1930's. It is claimed that public criticism of the popular eugenics movement by the experts came earlier in Norway than in most other countries, including the United States. The first (...) attack in 1915 was directed at dilettantic and irresponsible handling of scientific ideas, data and arguments. The conflict was over different views of science and its social role rather than over different aims for social development. The strict methodological demands that the scientific expertise wanted to enforce, provided a barrier against extreme eugenic views and proposals, and a source for critical arguments against eugenics in general. The experts differed considerably in their political views, but united in the crusade against dilettantism. They all feared premature applications of science to social problems. John Alfred Mjøen was leader of the popular eugenics movement in Norway. He learned about race-hygiene in Germany and started a public campaign in Norway around 1908. Mjøen formulated the so-called « Norwegian program for racehygiene » and played a prominent role in the international eugenics movement, but he was ostracized by Norwegian genetic scientists. Mjøen's strongest critic was Otto Lous Mohr, medical doctor and biologist, trained in genetics under T. H. Morgan. Mohr led the attack on Mjøen in 1915. Besides being a human geneticist of international prominence Mohr was strongly involved in campaigns for birth control and sexual instruction. Important supporters of a moderate eugenic program were Ragnar Vogt, founder of modern Norwegian psychiatry, and Johan Scharffenberg, psychiatrist and central public figure. Both were clearly on Mohr's side in the conflict with Mjøen. (shrink)

Several psychological experiments have suggested that concepts can influence perceived color (e.g., Delk and Fillenbaum in Am J Psychol 78(2):290–293, 1965, Hansen et al. in Nat Neurosci 9(11):1367–1368, 2006, Olkkonen et al. in J Vis 8(5):1–16, 2008). Observers tend to assign typical colors to objects even when the objects do not have those colors. Recently, these findings were used to argue that perceptual experience is cognitively penetrable (Macpherson 2012). This interpretation of the experiments has far-reaching consequences: it implies that (...) the way we think of objects determines how we see them, thus threatening the role of perception in justifying beliefs. In this paper, I show that the psychological findings can be accounted for without admitting cognitive penetrability. An underestimated but key feature of the experiments is that observers had to judge colors in borderline cases, in conditions of reduced acuity, or on the basis of color-concepts instead of matching. Such judgments are sensitive to the form of bias that Tversky and Kahneman (Science 185:1124–1131, 1974) have termed ‘anchoring’. Adopting a suggestion from Raffman (Philos Rev 103(1):41–74, 1994), I argue that the way subjects in the experiments think of the objects could affect their color judgments without altering their color experiences. Part of a complex of buildings that once included a university library, it affords expansive views of the city in every direction, towering above what surrounds it. The British writer John Wyndham (1903–1969) explored societal effects of surprising or mystical events. A paradigmatic example is _The Midwich Cuckoos_ (1957), which portrays identical-looking children born without sexual intercourse. I propose a reading strategy that focuses on the fictional spatial order and analyses how the construction of the children’s otherness interferes with the village’s demarcation. Furthermore, I interpret the mysterious pregnancies as a reference to basic embryo research in the 1950s – cloning. The family moved from there to California, and Kingsley grew up in Berkeley. He earned his B.A. with highest honors from University of California, Berkeley (1938) and went on there for his M.A. (1942) and Ph.D. (1946). His dissertation was on Locke’s theory of knowledge. Kingsley taught first at the University of Washington, then at the University of Nevada and Sarah Lawrence College (where he became a good friend of Susanne Langer) before becoming an assistant professor of philosophy and education at Hopkins in 1953. He retired from Hopkins in 1986. In the meantime he published books and articles, presented invited papers, and traveled extensively, especially to England, France, Italy, and Greece. This article reviews John Dewey and Our Educational Prospect, A Critical Engagement with Dewey's Democracy and Education, edited and spearheaded by David T. Hansen, with contributions by Gert Biesta, Reba N. Page, Larry A. Hickman, Naoko Saito, Gary D. Fenstermacher, Herbert M. Kliebard, Sharon Fieman-Nemser and Elizabeth Minnich. This review will not only praise and evaluate the merits of this book, but will also attempt to frame this new study of Dewey within the challenges that continue to engage (...) education in the realms of democracy, as the latter continues to strive for its own survival. While highlighting salient aspects of Hansen et al.'s rereading of Dewey's great work, this review seeks to frame both Dewey's text and this Deweyan study within the breadth of those other challenges by which education—and in turn philosophy of education—has come to take on issues such as: the nexus between theory and practice, the prevalent domination of the social scientific paradigm in education and the continuous threat of the standardisation and institutionalisation of human learning. It will be argued that, to meet this challenge, philosophy of education must sustain a continuous engagement with Dewey's work. A rereading of Dewey also involves a revaluation of his pragmatic theory of education and its lineage, moving from Emerson's metaphilosophy to Cavell's ethics. As Hansen et al. invariably engage with the latter, this review will question, through Adorno and Horkheimer's critique of pragmatisation, whether Deweyan pragmatism can still challenge the current state of affairs by which education is not only systematised away from learning, but also subsumed into a more institutionalised state—a condition that immediately jars with Dewey's own philosophical instincts and pedagogical labours. HansenMy point of departure in this essay is the idea that creativity in teaching often has less to do with inventiveness per se than it does with responsiveness. To draw on terms from John Dewey, creative teachers "rise to the needs of the situation" presented in the educational setting.1 They respond well to circumstances not because (...) they necessarily have the pedagogical equivalent of Twyla Tharp's talent for choreography or B.B. King's brilliance on the blues guitar; rather, I want to suggest that creative teachers, at least in many cases, "rise" and do what is needed because they have learned to pay attention both to students and to the subject(s) at hand. In other words, I propose that we consider the idea that creativity in teaching often manifests itself most vividly, if also subtly, in a kind of ongoing attentiveness, by which I mean a dynamic combination of patience, listening, and initiative.I will begin the discussion by first sketching a conception of creativity in teaching centered around the idea of attentiveness. Then I address two [End Page 57] consequences of this conception. The first is that the most suitable models of good practice for new teachers to start with are not the profession's versions, presuming such exist, of Pablo Picasso, Marie Curie, or Michael Jordan. I do not mean that it is uniformly inappropriate to place such models in front of teacher candidates, any more than it would be wrong to put before art students the work of a Cassatt or Rembrandt. However, I will argue that among the best and most consequential initial models are those experiences in which teacher candidates themselves truly listened to the doings of the world around them and heeded what was said, whether the latter "spoke" in the form of a work of art, a human voice or gesture, or the play of wind in the trees. If new teachers take seriously this kind of experience, they can gain a valuable perspective for approaching the long and often difficult process of appreciating teaching's details and engaging them in educational settings. I illustrate these claims by examining a field-based activity that was part of a teacher education program I used to direct.The second consequence of the conception of creativity in teaching I will put forward points to the title of this essay. If new teachers deepen their ability to pay attention and to engage in creative work, they position themselves to receive one of teaching's primary offerings to its practitioners, namely, a life of meaning."Ordinary" Pedagogical CreativityCreativity in teaching can take many forms. We witness it in the structuring of an artful lesson plan; in the logic, flow, and pacing of a dynamic lecture; or in a timely and evocative example or illustration the teacher employs to clinch a point in the midst of a class. All of this is familiar and an important, indeed indispensable, way to think about good teaching. Creativity in practice is associated here, among other things, with notions of expertise and of knowledge gained through experience.However, I want to add to this portrait the notion that creativity in practice can also spring from responsiveness. Rather than issuing solely from what the teacher brings to the educational setting — consider again terms such as expertise and knowledge — creativity can point to what the teacher is capable of deriving or drawing from it. Creativity as responsiveness denotes a form of openness to the setting, which may or may not complement or fit harmoniously with what is preset, prefigured, or anticipated. Experienced teachers would be the first to say that there are times when it becomes educationally vital to shelve a preset plan. There are times when one form of creativity in teaching, embodied in a well-wrought lesson plan, must give way to another form, embodied in what I am calling responsiveness. During the years leading up to World War I, America experienced a crisis of civic identity. How could a country founded on liberal principles and composed of increasingly diverse cultures unite to safeguard individuals and promote social justice? In this book, Jonathan Hansen tells the story of a group of American intellectuals who believed the solution to this crisis lay in rethinking the meaning of liberalism. Intellectuals such as William James, John Dewey, Jane Addams, Eugene V. Debs, and (...) W. E. B. Du Bois repudiated liberalism's association with acquisitive individualism and laissez-faire economics, advocating a model of liberal citizenship whose virtues and commitments amount to what Hansen calls cosmopolitan patriotism. Rooted not in war but in dedication to social equity, cosmopolitan patriotism favored the fight against sexism, racism, and political corruption in the United States over battles against foreign foes. Its adherents held the domestic and foreign policy of the United States to its own democratic ideals and maintained that promoting democracy universally constituted the ultimate form of self-defense. Perhaps most important, the cosmopolitan patriots regarded critical engagement with one's country as the essence of patriotism, thereby justifying scrutiny of American militarism in wartime. The printed program fittingly called it a “Memorial Celebration,” because that is what it was. Fine wine and savory hors d’oeuvres were (...) served, a woodwind quartet of Bienen School of Music graduate students played Reimer favorites, and Beth Hebert, Bennett’s life partner of 27 years, greeted every person as they entered the hall. Reimer would have approved of the exuberant tastefulness of the event. He would probably have blushed and demurred, however, when in the formal part of the program his colleagues, daughters, and former students praised him in recalling specific occasions of his mentoring, inspiring, modeling, guiding, collaborating, and originating. (In his writing Reimer loved such extensive discriminatory lists.) He earned a B.S. in music education in 1954 at SUNY at Fredonia and an M.S. (1955) and Ed.D. (1963) at the University of Illinois, Urbana-Champaign. His teaching career started at the Richmond Professional Institute of the College of William and Mary (1955–57) and continued at Madison College (Harrisburg VA) (1958–1960) and the University of Illinois (1960–65). At Case Western Reserve University (1965–1978), he became chair of the Music Education Department and holder of the Kulas Endowed Chair in Music. Then at Northwestern University he held the John W. Beattie Chair in Music from 1978 until his retirement in 1997. He chaired the Music Education Department there, directed the doctoral program in music education, and founded and directed the Center for the Study of Education and the Musical Experience—a weekly research forum for graduate students and faculty. Although Reimer had started out as an instructor in clarinet and oboe, musical theory, conducting, and music appreciation, he became a scholar, teacher, and lecturer in the new field of philosophy of music education with a worldwide following and reputation.Reimer was most noted for his seminal A Philosophy of Music Education (1970), which can fittingly be described as the founding document of the discipline. Typically he made revisions for the second edition in 1989 and more radical ones for the third edition in 2003, retitled as A Philosophy of Music Education: Advancing the Vision. This work has been translated into French, Japanese, and Chinese, and, forthcoming, Greek. He was associated with PMER and the International Society for Philosophy of Music Education (ISPME) from their beginnings in 1990.Besides his seminal works, Reimer wrote or co-wrote another twenty books and more than 150 articles, reviews, and book chapters. HansenSix days before he delivered his Second Inaugural Address, Abraham Lincoln strode into his White House office. Greeting him were G. B. Lincoln, John A. Bingham, and Francis Carpenter, the last of whom had been living with Lincoln in the White House for six months, painting a portrait of the president reading the Emancipation Proclamation to the cabinet. It is (...) Carpenter's delineation of the president's entrance that contains the "only known description of the preliminaries of the Second Inaugural" (Barondess 1954, 62). "Mr. Lincoln came in through the side passage which had lately been constructed," Carpenter writes, "holding in his hand a roll of manuscripts." Lincoln turned to his guests and quipped, "Lots of wisdom in that document, I suspect; it is what will be called my 'second inaugural' " (quoted in Barondess, 62).The content and modesty of Carpenter's description of the "preliminaries of the Second Inaugural" give the rhetorical critic a telling preview of what might be discovered in a reading of Lincoln's composition of that manuscript. The understatement in the length and simplicity of the address subtly and poignantly charms the reader. And there is "lots of wisdom" in the Second Inaugural: along with the Gettysburg Address, it contains the words of Lincoln that most abide. In a letter to an admiring Thurow Weed, who had penned Lincoln that his inaugural was "the neatest but the most pregnant and effective use to which the English Language was ever put," Lincoln wrote that he "expected" the Second Inaugural to "wear as well as—perhaps better than—anything I have ever produced" (quoted in Barondess 1954, 78).Underscoring Lincoln's perspicacity when he wrote to Weed that he "expected" the speech to "wear well," Carl Schulz's designation of the address as a "sacred poem" and the frequency with which that epithet is quoted by other critics confirm Lincoln's assessment of the oratorical endurance [End Page 223] of the piece. The estimation of the rhetorical durability of the address is perhaps best proven by its ability to withstand the polemics of its detractors, both immediately after its delivery and in successive generations, and the encomia of its admirers, both the obscure journalists and the renowned poets.1 Lately, only praise surrounds the Second Inaugural. Ronald C. White's thorough overview of the Second Inaugural's basic stylistic characteristics and how the oration resonates within Lincoln's social, political, and intellectual context is modestly entitled Lincoln's Greatest Speech (2002). In the last line of Lincoln at Gettysburg, Wills concludes that the Second Inaugural "is the only speech worthy to stand with" the Gettysburg Address (1992, 189) and later argues in the Atlantic Monthly that Lincoln "was at the peak of his creativity when he wrote the Second Inaugural Address" (1999, 70). The Second Inaugural seemingly speaks beyond its content and situation.Contained within the aura of adoration that surrounds the Second Inaugural is a significant charge to the rhetorical critic: what is it particularly about the address that sustains its agency and permits it to escape the evanescence accorded to most rhetorical efforts? When the agency of discourse helps to eliminate or extenuate the immediate exigency that calls forth that speech, it usually becomes remanded to the annals of history and is examined by the public or by scholars only when that historical nidus forces itself back upon the public's or the scholar's attention. The speech is exhausted by its situation and swallowed by its surrounding and future events. There are, however, those speeches like the Gettysburg Address and the Second Inaugural that practice their persuasion on audiences beyond the immediate exigency. They persist, they talk to us still, and their agency endures. Why is this true of Lincoln's Second Inaugural? This is the question that motivates my close reading of Lincoln's speech; and, as I hope to demonstrate, it is only through a close reading that such a question even makes sense. There is another set of entities that needs to be brought into the conversation about the ethical, legal, and social implications of scientific conduct. This widely varied group includes not‐for‐profit educational, academic, public‐service, and philanthropic organizations other than the type mentioned above as well as for‐profit businesses. Despite their major differences, these organizations may all be in a position to make decisions, directly or indirectly, about the conduct of scientific research. And those decisions may have a significant impact on the (...) parties normally involved in thinking and talking about obligations and concerns—the researchers, the subjects, and the general public. Yet there are few if any conceptual frameworks to help organizations address the ethical, legal, and social issues related to conducting scientific research. There are also few resources to help organizations find and develop the expertise required to make responsible decisions or communicate those decisions in ways that could support and advance the ethical conduct of research.In what follows, we try to identify and explore the duties, rights, and interests of one such organization, the Center for Talented Youth at Johns Hopkins University, when asked to play a supporting role in research on the genetics of intelligence. As central agents in this case, we hope to demonstrate why organizations like CTY cannot be neglected in the broader effort to ensure trustworthy research into the genetics of intelligence. (shrink)

Bearing witness is a familiar if diversely employed concept. On the one hand, it concerns the accuracy and validity of practical affairs, for example in a court of law, at a wedding, or in a law office. On the other hand, the term can embody powerful religious, social, and/ or moral meaning, whether in bearing witness to historical trauma and human suffering, or in paying heed to everyday, seemingly ordinary aspects of nature and of human life. In this article, we (...) address the question of what renders a witness trustworthy. We characterize ethical and epistemic constituents of witnessing. We examine the work of several exemplary witnesses: W. G. Sebald, Saidiya Hartman, Jonathan Lear, Etty Hillesum, and John Berger alongside Jean Mohr. These sources help us think about the education of a person who aspires to bear witness, whether it be to traumatic events or to quotidian life in educational or other settings. We present criteria of trustworthiness that can support reflection on what we take to be the important place of bearing witness in educational inquiry and practice. (shrink)
