In this paper we explore the rise of ‘the breast cancer gene’ as a field of medical, cultural and personal knowledge. We address its significance in the Norwegian public health care system in relation to so-called biological citizenship in this particular national context. One of our main findings is that, despite its claims as a measure for health and disease prevention, gaining access to medical knowledge of BRCA 1/2 breast cancer gene mutations can also produce severe instability in the individuals (...) and families affected. That is, although gene testing provides modern subjects with an opportunity to foresee their biological destiny and thereby become patients in waiting, it undoubtedly also comes with difficult existential dilemmas and choices, with implications that resonate beyond the individual and into different family and love relations. By elaborating on this finding we address the question of whether the empowerment slogan, which continues to be advocated through various health, BRCA and breast cancer discourses, reinforces a naïve or an idealized notion of the actively responsible patient: resourceful enough to seek out medical expertise and gain sufficient knowledge, on which to base informed decisions, thereby reducing the future risk of developing disease. In contrast to this ideal, our Norwegian informants tell a different story, in which there is no apparent heroic mastery of genetic fates, but rather a pragmatic attitude to dealing with a dire situation over which they have little control, despite having complied with medical advice through national guidelines and follow-up procedures for BRCA 1/2 carriers. In conclusion we claim that the sense of safety that gene testing and its associated medical solutions allegedly promise to provide proved illusory. Although BRCA-testing offers the potential for protection from adverse DNA-heritage, administered through possibilities for self-monitoring and self-management of the body, the feeling of ‘being in good health’ has hardly been reinforced by the emergence of gene technology. In the debate on whether to ban LAWS, moral arguments are mainly used. One of these arguments, proposed by Sparrow, is that the use of LAWS goes hand in hand with the responsibility gap. Together with the premise that the ability to hold someone responsible is a necessary condition for the admissibility of an act, Sparrow believes that this leads to the conclusion that LAWS should be prohibited. In this article, it will be shown that Sparrow’s argumentation for both premises (...) is not convincing. If one interprets the thesis that responsibility (first premise) is necessary in a descriptive sense, this assertion clashes with military theory and practice. And even if you focus on the normative interpretation, that claim does not stand. The second premise for Sparrow’s conclusion, namely that you cannot hold anyone responsible for LAWS’ (mis)deeds, is based on the idea that control is a necessary condition for responsibility. It will be shown that this idea too is not correct, which means that Sparrow’s control argument does not do the work it should do. From this, we can conclude that Sparrow’s justification for his claim that LAWS should be banned is insufficient, and neither can we conclude that the thesis of a responsibility gap has in any case been undermined. However, it will also be argued that someone may be responsible for the actions of LAWS, or that it cannot be excluded that one can be held responsible. (shrink)

In this essay, I consider how spatial experience is fundamentally connected to the development and maintenance of “existential healthy” agency. More specifically, I examine how our formation as choosing, active, and self-defining persons is dependent upon the spatially-thick and interpersonally-interwoven “gestures” through which we develop a lived sense of space as supportive and cooperative or hostile and threatening. I conclude from this both that existentially healthy agency is always already a relational capacity, and, more central to my focus here, that (...) it depends in significant part upon the cultivation of an appropriately supportive spatial environment. In light of recent studies from the field of moral psychology, however, it could be objected that the promotion of such skills might fail to meet another important objective, namely the moral education of students. In this paper, I will argue against such pessimism by suggesting that the fostering of reasoning skills can still contribute to the aims of moral education. (...) To do so, I will engage with the concept of moral education, point out different ways in which reasoning skills play an essential role in it, and support these considerations by appealing to further empirical studies. My conclusion will be that the promotion of ethical reasoning skills fulfils two important aims of moral education: First, it enables students to critically reflect on their ethical beliefs. Second, it allows them to explore ethical questions in a joint conversation with others. Für die Moralphilosophie ist eine Theorie praktischer Gründe von zentraler Bedeutung. Ein zentraler Streitpunkt ist dabei die Verbindung zwischen Normativität und Motivation. Endres rekonstruiert kritisch die bedeutenden Positionen von B. Williams, J. McDowell und C. Korsgaard. Die Positionen lassen sich als humesch, aristotelisch und kantisch kennzeichnen, so dass ihre Behandlung zugleich auch als eine Auseinandersetzung mit exemplarischen Beispielen der wichtigsten Ansätze der Philosophiegeschichte zu verstehen ist. Kernthese ist, dass es einen signifikanten Aspekt praktischer Gründe gibt, der in der gegenwärtigen Debatte (...) übersehen worden ist: praktische Gründe müssen Personen zugänglich sein. Nur in McDowells Ansatz stellt dies einen endgültigen Einwand dar, da sich die beiden anderen Positionen so umformulieren lassen, dass sie der Zugänglichkeit Rechnung tragen können. (shrink)

Les rapports de pouvoir irradient notre société : sont-ils inéluctables? Nous nous apercevons qu'ils ont été construits pour asseoir la domination d'une minorité sur le reste de la population. Cet ouvrage démonte et analyse les mécanismes qui sont à l'origine des relations de pouvoir. Le point de départ de cette étude réside dans la volonté d'interroger la croyance, aussi répandue que massive, selon laquelle la domination serait naturelle aux hommes et aux animaux. En effet, lorsqu'on examine les opinions habituelles portant (...) sur la domination se distingue ordinairement la certitude quasi indéracinable qu'elle ne serait rien que l'expression d'une force naturelle et que, s'il y a des forts et des faibles, c'est parce que force et faiblesse, puissance et soumission seraient inscrites dans un ordre naturel des choses. À la faveur d'une alliance entre philosophie et biologie, il s'agit ici de se demander quelle est l'origine de la domination, et de comprendre les mécanismes des relations de pouvoir. Au fond, y a-t-il une légitimité de nature à poser ou réclamer l'inégalité? Allerdings liess ihn sein reges Interesse fur die Philosophie seine naturwissenschaftlichen Erkenntnisse immer wieder hinterfragen. In seinen Essays, Reden und wissenschaftlichen Abhandlungen trifft man deshalb haufig auf philosophische und theologische Aspekte. Ein Themenkreis, der ihn immer wieder beschaftigte, war der Dialog zwischen Naturwissenschaft und Theologie. Simple heuristics exploit basic human abilities, such as recognition memory, to make decisions based on sparse information. Based on the relative speed of recognizing two objects, the fluency heuristic infers that the one recognized more quickly has the higher value with respect to the criterion of interest. Behavioral data show that reliance on retrieval fluency enables quick inferences. Our goal with the present functional magnetic resonance imaging study was to isolate fluency-heuristic-based judgments to map the use of fluency onto specific (...) brain areas that might give a better understanding of the heuristic’s underlying processes. Activation within the claustrum for fluency heuristic decisions was found. Given that claustrum activation is thought to reflect the integration of perceptual and memory elements into a conscious gestalt, we suggest this activation correlates with the experience of fluency. Newton’s earliest publications contained scandalous epistemological claims: not only did he aim for certainty; he also claimed success. Some commentators argue that Newton ultimately gave up claims of certainty in favor of a high degree of probability. I argue that no such shift occurred. I examine the evidence of a probabilistic shift: a passage from query 23/31 of the Opticks and rule 4 of the Principia. Neither passage supports a probabilistic approach to natural philosophy. Pedagogical situations require white lies: in teaching philosophy we make decisions about what to omit, what to emphasise, and what to distort. This article considers when it is permissible to distort the historical record, arguing for a tempered respect for the historical facts. It focuses on the rationalist/empiricist distinction, which still frames most undergraduate early modern courses despite failing to capture the intellectual history of that period. It draws an analogy with Michael Strevens's view on idealisation in causal explanation to (...) distinguish between myths and caricatures. Myths are distortions of the historical record that undermine students' understanding of the past, despite having other pedagogical benefits. Caricatures are distortions that either increase or are indifferent to understanding of the past. Mythmaking, the article argues, is unjustified. (shrink)

Early modern experimental philosophers often appear to commit to and utilise corpuscular and mechanical hypotheses. This is somewhat mysterious, for such hypotheses frequently appear to be simply assumed, which is odd for a research program which emphasises the careful experimental accumulation of facts. Isaac Newton was one such experimental philosopher, and his optical work is considered a clear example of the experimental method. Focusing on his optical investigations, Walsh identifies three roles for hypotheses. First, Newton introduces a hypothesis to explicate (...) his abstract theory. The purpose here is primarily to improve understanding or uptake of the theory. Second, he uses a hypothesis as a platform from which to generate some crucial experiments to decide between competing accounts. The purpose here is to suggest experiments in order to bring a dispute to empirical resolution. Third, he uses a hypothesis to suggest an underlying physical cause, which he then operationalises and represents abstractly in his formal theory. The second and third roles are related in that they are both cases of scaffolding: hypotheses provide a temporary platform from which further experimental work and/or theorising can be carried out. In short, the entities and processes included in Newton’s optical hypothesis are not simply assumed hypothetical posits. Rather, they play instrumental roles in Newton’s experimental philosophy. Hélène Cixous is perhaps best known for her paper, ‘The Laugh of the Medusa’ (1976) and her literary contributions outside academia. In this paper, we pick up a lesser known Cixous text, ‘Le Sexe ou la tête?’ that offers an interesting and provocative perspective on the traps associated with being feminine in a masculine environment. As we converse with Cixous, weaving our own words and experiences with hers, we link her work more closely with the feminine in modern-day academia. We (...) suggest that Cixous’s remarks on decapitation and voice offer a way forward for academic women to be; to speak; to recognise the double jeopardy of decapitation in the university; and to use laughter as a strategic, powerful, political act of resistance and subversion against oppressive masculine power structures. We draw on and seek to enact Cixous’s notion of écriture feminine—a disruptive style of writing that provides a mode of being, speaking, and writing that subverts the power of masculine norms in order to be heard and to bring possibilities for change. Algorithms silently structure our lives. Algorithms can determine whether someone is hired, promoted, offered a loan, or provided housing as well as determine which political ads and news articles consumers see. Yet, the responsibility for algorithms in these important decisions is not clear. This article identifies whether developers have a responsibility for their algorithms later in use, what those firms are responsible for, and the normative grounding for that responsibility. I conceptualize algorithms as value-laden, rather than neutral, in that algorithms (...) create moral consequences, reinforce or undercut ethical principles, and enable or diminish stakeholder rights and dignity. In addition, algorithms are an important actor in ethical decisions and influence the delegation of roles and responsibilities within these decisions. As such, firms should be responsible not only for the value-laden-ness of an algorithm but also for designing who-does-what within the algorithmic decision. As such, firms developing algorithms are accountable for designing how large a role individual will be permitted to take in the subsequent algorithmic decision. Counter to current arguments, I find that if an algorithm is designed to preclude individuals from taking responsibility within a decision, then the designer of the algorithm should be held accountable for the ethical implications of the algorithm in use. Firms use algorithms to make important business decisions. To date, the algorithmic accountability literature has elided a fundamentally empirical question important to business ethics and management: Under what circumstances, if any, are algorithmic decision-making systems considered legitimate? The present study begins to answer this question. Using factorial vignette survey methodology, we explore the impact of decision importance, governance, outcomes, and data inputs on perceptions of the legitimacy of algorithmic decisions made by firms. We find that many of the procedural governance (...) mechanisms in practice today, such as notices and impact statements, do not lead to algorithmic decisions being perceived as more legitimate in general, and, consistent with legitimacy theory, that algorithmic decisions with good outcomes are perceived as more legitimate than bad outcomes. Yet, robust governance, such as offering an appeal process, can create a legitimacy dividend for decisions with bad outcomes. However, when arbitrary or morally dubious factors are used to make decisions, most legitimacy dividends are erased. In other words, companies cannot overcome the legitimacy penalty of using arbitrary or morally dubious factors, such as race or the day of the week, with a good outcome or an appeal process for individuals. These findings add new perspectives to both the literature on legitimacy and policy discussions on algorithmic decision-making in firms. (shrink)

In cases where the claims of different groups of people compete, the Relevance View occupies a middle ground between aggregation and nonaggregation. It allows weaker claims to aggregate to outweigh a stronger claim just when the competing claims, compared pairwise, are sufficiently close in strength. The view has strong intuitive appeal when applied to simple binary choices, but I argue that attempts to extend it to nonbinary choices have been unsuccessful. I propose a new extension of the Relevance View to (...) nonbinary choices based on a “binary contrastive” account of the moral reasons that obtain in the cases of interest. (shrink)

This book explores nature as an integral part of the social worlds conventionally studied by anthropologists. The book demonstrates not only the entanglement of natural and social things, but also the entwinement of analytical perspective and ethnographic material.

Health metaphors are commonly used in a variety of contexts. While war metaphors are common in medicine, there are also other conceptualizations and other metaphors employed in different contexts. In policies, metaphors can play an important role in framing thought and discourse, and have an important effect, and even more so in educational policy. In this article, we analyze the two South African policies regarding HIV and AIDS in the educational context – the first policy from 1999, and the one (...) that replaced it in 2017. The focus is on identifying and categorizing the metaphors directly related to HIV and AIDS. We identified 29 such metaphors in policy 1, and 71 in policy 2, using the principles from the MIPVU, and thematic discourse analysis was used to categorize the metaphors into themes. The most prominent changes in the metaphors from policy 1 to policy 2 regard the focus of the imagery, as well as the conceptualization of HIV itself. These are then interpreted in the Southern African context. (shrink)

Der vorliegende Band enthält Predigten zu 56 Terminen des Jahres 1824 sowie ergänzend 28 dazugehörige Liederblätter Schleiermachers. Mit Ausnahme der zahlreichen Kasualpredigten und zweier im Urlaub gehaltener Kanzelreden ist Schleiermachers Predigttätigkeit damit für das genannte Jahr lückenlos dokumentiert. Die Editionsbasis bilden neben Drucktexten und einem Autograph Schleiermachers mehrheitlich die qualitativ hochwertigen Nachschriften des Theologiestudenten Johann Gottfried Andrae. Zu 22 Terminen existierte bislang keine Predigtveröffentlichung; zu 34 Terminen liegen bereits Drucke vor. Für 12 der insgesamt 15 von Schleiermacher selbst redigierten und (...) publizierten Texte konnte allerdings eine abweichende Vorlage ausgemacht und ediert werden, wodurch ein besonderes Licht auf seine Vorgehensweise bei der Herstellung der literarischen Predigten fällt. Many philosophers and lay people believe that philosophy has an important role to play in times of societal crisis. In this contribution reasons are given to doubt the supposed societal relevance of philosophy.

Here, I propose a new hypothesis: sex originated from an archaic gene transfer process among prebiotic bubbles without the prerequisite for reproduction. This de‐coupling from reproduction might make the thorny problem of accounting for the evolution of sex, despite the apparent advantages of parthenogenicity, more tractable.

Entlang der Verschiebungen des Kollektivbegriffs seit 1989 und seiner Verwendung in den performativen Künsten – und in Gegenüberstellung zu einer eher netzwerkartig organisierten Gesellschaft der Individuen – beschreibt der Beitrag, wie durch den Fokus auf Praktiken, die nicht das abgeschlossene Werk, sondern den gemeinsamen Prozess des Voneinander-Lernens unter Einbeziehung spezifischer Publika (z.B. aktivistischer Initiativen) fokussieren, die dem Kunstbetrieb zugrunde liegenden Infrastrukturen verändert werden können. Am Beispiel der Tanzfabrik Berlin und einer selbst gesetzten Pause as Resistance nach der COVID-Pandemie fragt der Beitrag nach methodologischen Herausforderungen von Praktiken, welche die Möglichkeit einer Unterbrechung von Gewohnheiten durch den Einsatz von alternativen tools, wie z.B. Within the EU, Germany took a pioneering role in the production and promotion of biofuels. To explain this role the article analytically examines public discourses on biofuels. The analysis points out how the subject is interpreted and positioned by relevant actors and thus results in a specific public perception of biofuels in Germany. This perception in turn influences political decision-making processes. Since the analysis of discourses contributes to a better understanding of today's biofuel policy in Germany, the article characterises the (...) biofuel discourse during the genesis of this policy. Additionally, it analytically traces changes of discourse constellations in the course of the biofuel policy path. (shrink)

Newton described his Principia as a work of ‘experimental philosophy’, where theories were deduced from phenomena. He introduced six ‘phenomena’: propositions describing patterns of motion, generalised from astronomical observations. However, these don’t fit Newton’s contemporaries’ definitions of ‘phenomenon’. Drawing on Bogen and Woodward’s distinction between data, phenomena and theories, I argue that Newton’s ‘phenomena’ were explanatory targets drawn from raw data. Viewed in this way, the phenomena of the Principia and the experiments from the Opticks were different routes to the (...) same end: isolating explananda. (shrink)

The Relevance View, exemplified by Alex Voorhoeve's Aggregate Relevant Claims, has considerable appeal. It accommodates our reluctance to aggregate weak claims in canonical cases like Life for Headaches, while permitting aggregation of claims in a range of other cases. But it has been the target of significant criticism. In an important recent paper, Patrick Tomlin argues that the view suffers from failures of internal logic, violating plausible consistency constraints and generating incoherent combinations of verdicts on cases. And in cases resembling (...) real-world healthcare allocation problems, Tomlin argues that the view offers no guidance at all. In response, I argue that the internal logic of the Relevance View is sound, and the view's core principles, suitably clarified, support a significant extension of the view beyond the simple cases to which it is typically applied. Placing a natural topology on the set ${\operatorname {Sub}({\overline {\mathbb {Q}}})}$ of subfields of ${\overline {\mathbb {Q}}}$, we show that if Z is not thin in ${\mathbb {Q}}$, then $S_Z$ is meager in ${\operatorname {Sub}({\overline {\mathbb {Q}}})}$. Here, thin and meager both mean “small”, (...) in terms of arithmetic geometry and topology, respectively. For example, this implies that only a meager set of fields L have the property that the ring of algebraic integers $\mathcal {O}_L$ is universally definable in L. The main tools are Hilbert’s Irreducibility Theorem and a new normal form theorem for existential definitions. The normal form theorem, which may be of independent interest, says roughly that every $\exists $-definable subset of an algebraic extension of ${\mathbb Q}$ is a finite union of single points and projections of hypersurfaces defined by absolutely irreducible polynomials. This paper argues, against the prevailing view, that consent to privacy policies that regular internet users usually give is largely unproblematic from the moral point of view. To substantiate this claim, we rely on the idea of the right not to know (RNTK), as developed by bioethicists. Defenders of the RNTK in bioethical literature on informed consent claim that patients generally have the right to refuse medically relevant information. In this article we extend the application of the RNTK to online (...) privacy. We then argue that if internet users can be thought of as exercising their RNTK before consenting to privacy policies, their consent ought to be considered free of the standard charges leveled against it by critics. The purpose of this paper is to draw out and make explicit the assumptions made in the treatment of technology within business ethics. Drawing on the work of Freeman (1994, 2000) on the assumed separation between business and ethics, we propose a similar separation exists in the current analysis of technology and ethics. After first identifying and describing the separation thesis assumed in the analysis of technology, we will explore how this assumption manifests itself in the current literature. A different (...) stream of analysis, that of science and technology studies (STS), provides a starting point in understanding the interconnectedness of technology and society. As we will demonstrate, business ethicists are uniquely positioned to analyze the relationship between business, technology, and society. The implications of a more complex and rich definition of lsquotechnologyrsquo ripple through the analysis of business ethics. Finally, we propose a pragmatic approach to understanding technology and explore the implications of such an approach to technology. This new approach captures the broader understanding of technology advocated by those in STS and allows business ethicists to analyze a broader array of dilemmas and decisions. (shrink)

In the long line of French Sade studies, Deleuze's essay Coldness and Cruelty marks out a special place. By discussing Masoch both in addition to and in contrast to Sade, Deleuze reveals the stakes of his book: he wants to unmask the concept of sadomasochism as a clinical nonentity. In their paper, the authors explain the arguments supporting this project and show their relation to Deleuze's reading of Bergson. They then argue that there is a second, similarly Bergsonian criticism of (...) Freudian psychoanalysis operating in the background of Coldness and Cruelty. This more wide-ranging criticism takes Freud to task for conceiving perversion, like neurosis, in Oedipal terms. This conception, Deleuze holds, forgets that perversion and neurosis represent two different worlds that essentially have nothing to do with each other despite crossing in clinical experience. Illegally downloading music through peer-topeer networks has persisted in spite of legal action to deter the behavior. This study examines the individual characteristics of downloaders which could explain why they are not dissuaded by messages that downloading is illegal. We compared downloaders to non-downloaders and examined whether downloaders were characterized by less ethical concern, engagement in illegal behavior, and a propensity toward stealing a CD from a music store under varying levels of risk. We also examined whether downloading or individual (...) characteristics of downloaders were similar for men and women. Findings revealed downloading was prevalent (74.5% of the student sample downloaded), men and women were equally likely to download and the factors characterizing downloading were similar for men and women. The comparison between downloaders and nondownloaders revealed downloaders were less concerned with the law, demonstrated by less ethical concern and engagement in other illegal behaviors. Downloaders were also more likely to indicate that they would steal a CD when there was no risk of being caught. Given these results, messages regarding illegality are unlikely to perturb downloaders and alternative recommendations are offered for targeting illegal downloading. (shrink)

Using the Aristotelian virtue of friendship and concept of practical wisdom, this paper argues that engaging in political discourse with friends on social media is conducive to the pursuit of the good life because it facilitates the acquisition of the socio-political information and understanding necessary to live well. Previous work on social media, the virtues, and friendship focuses on the initiation and maintenance of the highest form of friendship (Aristotle’s ‘ideal friendship’) online. I argue that the information necessary to live (...) well can come from non-ideal, civic friends in addition to ideal friends. In order to acquire this information successfully via social media, users should practice inclusive engagement, self-control, discretion, and audience-sensitivity in their cyber interactions. This argument is salient given the current concerns about ‘echo chambers’ or ‘filter bubbles’, in which users ignore or block out friends and news sources that support political perspectives different from one’s own. Employee monitoring has raised concerns from all areas of society – business organizations, employee interest groups, privacy advocates, civil libertarians, lawyers, professional ethicists, and every combination possible. Each advocate has its own rationale for or against employee monitoring whether it be economic, legal, or ethical. However, no matter what the form of reasoning, seven key arguments emerge from the pool of analysis. These arguments have been used equally from all sides of the debate. The purpose of this paper is to (...) examine the seven key arguments that have been made with respect to employee monitoring. None of these arguments is conclusive and each calls for managerial and moral consideration. We conclude that a more comprehensive inquiry with ethical concern at the center is necessary to make further progress on understanding the complexity of employee monitoring. When animal ethicists deal with welfare they seem to face a dilemma: On the one hand, they recognize the necessity of welfare concepts for their ethical approaches. On the other hand, many animal ethicists do not want to be considered reformist welfarists. Moreover, animal welfare scientists may feel pressed by moral demands for a fundamental change in our attitude towards animals. The analysis of this conflict from the perspective of animal ethics shows that animal welfare science and animal ethics highly (...) depend on each other. Welfare concepts are indispensable in the whole field of animal ethics. Evidence for this can be found by analyzing the structure of theories of animal ethics and the different ways in which these theories employ welfare concepts. Furthermore, the background of values underneath every welfare theory is essential to pursue animal welfare science. Animal ethics can make important contributions to the clarification of underlying normative assumptions with regard to the value of the animal, with regard to ideas about what is valuable for the animal, and with regard to the actions that should follow from the results of animal welfare science.
