In his fifth eclogue Candidus the Neo-latin poet Baptista Mantuanus, known in the Renaissance as the “second Virgil”, deals with the poverty of writers and the stinginess of patrons. The dialogue between the sincere-minded poet Candidus, who is frustrated by his hopeless situation, and the rich Silvanus, who gives only empty promises of help, turns out, however, to be futile. As can be demonstrated by the quotations taken mainly from the Roman satirists, Mantuanus makes use of the classical texts as (...) far as they serve his purpose and explicitly displays a subtle view of his various sources. Quoting from classical literature he often compares Candidus, his alter ego, with the victims of Horace, Juvenal and Persius, and frequently transforms the positive aspect of the original into its contrary. This technique emphasizes the needy poet’s self-ironical attitude confirmed by his exaggerated complaints describing his calamity. That is why Candidus appears to be a self-pitying and self-centered character, while, on the other hand, Silvanus represents the specimen of a miser giving nothing but flimsy promises, with the result that the dialogue remains stagnant and ultimately ineffective. Emotion is conceptualised as an emergent, dynamic process based on an individual's subjective appraisal of significant events. It is argued that theoretical models of emotion need to propose an architecture that reflects the essential nature and functions of emotion as a psychobiological and cultural adaptation mechanism. One proposal for such a model and its underlying dynamic architecture, the component process model, is briefly sketched and compared with some of its major competitors. Recent empirical evidence in support of the model is (...) reviewed. Special emphasis is given to the dynamic aspect of emotion processes, in particular the sequence of appraisal checks and the synchronisation of response systems, as well as the capacity of the model to predict individual differences in emotional responding. Recently, philosophers have come forth with approaches to chemistry based on its actual practice, imparting to it a proper aim and character of its own. These approaches add to the currently growing movement of pluralist philosophies of science. We draw on recent pluralist accounts from chemistry and analyse three notions from modern chemical practice and theory in terms of these accounts, in order to complement the so far more general pluralist approaches with specific evidence. Our survey reveals that the concept (...) of element indicates conceptual pluralisms in chemistry. that electronegativity illustrates methodological pluralism in determining one and the same concept, and that acidity is an instance of plurality hidden behind ‘one notion’. Appraisal theories of emotion have had a strong impact on the development of theory and experimental research in the domain of the affective sciences. While there is generally a high degree of convergence between theorists in this tradition, some central issues are open to debate. In this contribution three issues have been chosen for discussion: (a) varieties of relevance detection, (b) varieties of valence appraisal, and (c) sequential-cumulative effects of appraisal results. In addressing these issues, new theoretical ideas are suggested (...) and an update of recent research on the sequence of appraisal processes is provided. The author introduces a normative conception of coherence, derived from a pragmatic interpretation of the application of norms to concrete cases. A distinction is made between the justification of a norm and its application. In the case of moral norms, justification and application can be analysed as two different discursive procedures which give rise to different aspects of the principle of impartiality. Impartial justification requires a procedure by which all interests concerned are taken into account whereas impartial application requires a (...) procedure where all features of a situation are considered. The complete description of a concrete case makes necessary a coherent interpretation of all the valid norms which are prima facie applicable. This requirement of an ideal coherent system of norms is restricted to interpretive “paradigms” in the case of legal norms, because it is necessary to produce singular judgments under the restrictive conditions of scarce time and incomplete knowledge. Attention is automatically allocated to stimuli that are opposite in valence to the current motivational focus (Rothermund, 2003; Rothermund, Voss, & Wentura, 2008). We tested whether this incongruency effect is due to affective–motivational counter-regulation or to an increased salience of stimuli that mismatch with cognitively activated information. Affective processing biases were assessed with a search task in which participants had to detect the spatial position at which a positive or negative stimulus was presented. In the motivational condition, positive or negative (...) affective–motivational states were induced by performance feedback after each trial. In the cognitive activation condition, participants memorised the word “good” or “bad” during the search task. The affective incongruency effect was replicated in the motivational condition, whereas an affective congruency effect obtained in the cognitive activation condition. These findings support an explanation of affective incongruency effects in terms of automatic counter-regulation that is motivational in nature. (shrink)

In this paper the author criticizes the way Robert Alexy reconstructs the relationship between legal and practical reasoning. The core of Alexy's argumentation (Alexy 1978) is considered the claim that legal argumentation is a “special case” of general practical discourse. We highlight the need to focus on the underlying determinants and production mechanisms to fully understand the nature of facial expression of emotion and to settle the theoretical debate about the meaning of motor expression. Although emotion theorists have generally remained rather vague about the details of the process, this has been a central concern of componential appraisal theories. We describe the fundamental assumptions and predictions of this approach regarding the patterning of facial expressions for different emotions. We also review (...) recent evidence for the assumption that specific facial muscle movements may be reliable symptoms of certain appraisal outcomes and that facial expressions unfold over time on the basis of a sequence of appraisal check results. In this article we explore the contribution from social anthropology to the medical ethical debates about the use of informed consent in research, based on blood samples and other forms of tissue. The article springs from a project exploring donors’ motivation for providing blood and healthcare data for genetic research to be executed by a Swedish start-up genomics company. This article is not confined to empirical findings, however, as we suggest that anthropology provides reason to reassess the theoretical understanding of (...) autonomy as generally defined by Beauchamp and Childress. Careful consideration of the trust expressed by donors through the act of donation, furthermore, suggests that there is reason to redirect the ethical scrutiny from informed consent to issues concerning institutional arrangements and social responsibility. In particular, we suggest that an anthropological approach could facilitate a reconsideration of the political implications of using informed consent as a regulatory practice in tissue-based research. Multinational corporations (MNCs) are increasingly judged not only on their own social impacts but also on those of their supply chain partners. To reduce this environmental dependence, many MNCs implement social evaluations and codes of conduct which suppliers must follow. But how do MNCs legitimise and implement social evaluations in their supply chains? To address this, we draw on and augment resource dependence and legitimacy theories, to analyse a multinational grocery retailer’s implementation of labour standards for its fruit and vegetable (...) suppliers. The case study utilises interviews, analysis of a database of audits, internal documents, and observational data. It provides the basis for theorizing corporate reputation as a resource dependency, with social evaluations a distinct means to co-opt external actors to preserve the focal organization’s autonomy while reducing environmental contingencies. The legitimacy of social evaluations of supply chain partners depends on processes that reconcile both moral and pragmatic concerns, allowing the focal organization to mitigate resource dependencies without ceding control over enforcement and enabling actions. Wie muss ein ethischer Beratungsdienst strukturiert sein, damit er in moralischen Konfliktsituationen im klinischen Alltag angefragt wird und die Ratsuchenden ergebnisorientiert unterstützen kann? Nach welchen Kriterien lassen sich die Beratungsgespräche auswerten und bewerten? Zur Beantwortung dieser Fragen werden theoretisch fundierte Konzepte ethischer Fallbesprechung aus Nimwegen, Leuven und Basel herangezogen; dies geschieht vor dem Hintergrund der Erfahrungen mit der über zehnjährigen Entwicklung der ethischen Arbeit im Ev. Krankenhaus Bielefeld (EvKB). Als Resultat stellen wir einen strukturierten, multidisziplinären Ansatz vor, mit dem in (...) den Beratungsgesprächen die ethischen Dimensionen unterschiedlicher Vorstellungen herausgearbeitet und möglichst einvernehmlichen Lösungen zugeführt werden. Am Beispiel des EvKB lässt sich zeigen, dass der ethische Beratungsdienst auch in Zeiten knapper Ressourcen implementiert und praktiziert werden kann und eine Gesprächskultur schafft, die zu neuen Zielvariablen führt; hier spielen der Perspektivenwechsel und die Prozessgerechtigkeit eine zentrale Rolle und liefern zugleich Ansatzpunkte für unsere eigene Evaluationsstrategie. Zum aktuellen Stand der Evaluation klinischer Ethikberatung wird die internationale Literatur kritisch gewürdigt. Erste konzeptionelle Ansätze und Ergebnisse einer eigenen Evaluationsstrategie werden vorgestellt. Durch die Offenlegung hoffen wir, die Auseinandersetzung mit diesen Themen zu intensivieren. Methodological problems often arise when a special case is confused with the general principle. So you will find affordances only for ‚artifacts’ if you restrict the analysis to ‚artifacts’. The general principle, however, is an ‚invitation character’, which triggers an action. Consequently, an action-theoretical approach known as ‚pragmatic turn’ in cognitive science is recommended. According to this approach, the human being is not a passive-receptive being but actively produces those action effects that open up the world to us. This ‚ideomotor (...) approach’ focuses on the so-called ‚epistemic actions’, which guide our perception as conscious and unconscious cognitions. Due to ‚embodied cognition’ the own body is assigned an indispensable role. The action theoretical approach of ‚enactive cognition’ enables that every form can be consistently processualized. Thus, each ‚Gestalt’ is understood as the process result of interlocking cognitions of ‚forward modelling’ and ‚inverse modelling’. As can be shown, these cognitions are fed by previous experiences of real interaction, which later changes into a mental trial treatment, which is highly automated and can therefore take place unconsciously. It is now central that every object may have such affordances that call for instrumental or epistemic action. In the simplest case, it is the body and the facial expressions of our counterpart that can be understood as a question and provoke an answer/reaction. Thus, emotion is not only to be understood as expression/output according to the scheme ‚input-processing-output’, but acts itself as a provocative act/input. Consequently, artifacts are neither necessary nor sufficient conditions for affordances. Rather, they exist in all areas of cognition—from Enactive Cognition to Social Cognition. (shrink)

In a constitutional democracy, the imputation of a legal violation to an individual must be related to the fact that democratic approval of a norm - under limiting conditions - is coupled with the obligation to follow that norm. The neutrality of modern law toward the quality of motives for following a norm, however, challenges the assumption of such a connection. This challenge is overlooked by those who take the position that individual imputation should be based on the morally autonomous (...) individual's self-contradiction. In contrast, deterrence theories fail to see the other relevant aspect, namely that individual imputation cannot be completely divorced from the perspective of the individual as a citizen, who could indeed follow the norm because of his insight into the reasons for its validity. Individual imputation takes account of this double classification of a person subject to law as citizen and as private autonomous legal subject only if the actor is addressed as citizen in the reasoning given to support the determination of culpability without simultaneously requiring him to actually adopt the perspective of a citizen. Die individuelle Zurechnung einer Rechtsverletzung muß in einem demokratischen Verfassungsstaat etwas damit zu tun haben, daß mit der demokratischen Zustimmung zu einer Norm unter einschränkenden Bedingungen - auch die Verpflichtung zur Normbefolgung verbunden ist. Gegen die Vermutung eines solchen Zusammenhangs spricht jedoch die Neutralität des modernen Rechts gegenüber der Qualität der Motive seiner Befolgung. Dies wird von denjenigen Positionen übersehen, die eine individuelle Zurechnung auf den Selbstwiderspruch der sittlich autonomen Person gründen wollen. Dagegen übersehen präventive Schuldtheorien den anderen Aspekt, daß sich individuelle Zurechnung nicht gänzlich von der Perspektive des Staatsbürgers lösen darf, der eine legitime Norm aus Einsicht in die Gründe ihrer Geltung auch befolgen könnte. Der doppelten Codierung der Rechtsperson als Staatsbürger und als privatautonomes Rechtssubjekt entspricht die individuelle Zurechnung nur dann, wenn der Täter durch die Begründung des Schuldurteils als Staatsbürger angesprochen wird, ohne daß ihm ein Wechsel in die Perspektive eines Staatsbürgers auch zugemutet würde. Poor people suffer from far higher levels of ill health, mortality, and malnutrition than do those better off, and their inadequate health is one of the factors keeping them poor or for their being poor in the first place. Health is a crucially important economic asset, particularly for poor people. Their livelihoods depend on it. When poor people (...) become ill or injured, their entire household can become trapped in a downward spiral of lost income and high healthcare costs—a vicious circle of poverty and ill health. We start from the assumption that the real valued observables of a quantum system form a Jordan algebra which is equipped with a compatible Lie product characterizing infinitesimal symmetries, and ask whether two such systems can be considered as independent subsystems of a larger system. We show that this is possible if and only if the associator of the Jordan product is a fixed multiple of the associator of the Lie product. Anthropologische Medizin (AM) i. S. Viktor von Weizsäckers sieht grundlegende Selbsterfahrungen des Menschen (Leiblichkeit, Zeitlichkeit u. a.) für den Umgang von Arzt und Krankem als zentral. Sie ist offen für die leiblich-seelische Betroffenheit, für die mögliche Stellvertretung des Physischen und Psychischen und sieht den Kranken als Subjekt und Objekt, das sich selbst zugleich Subjekt und Objekt ist. „Umgangslehre“ kennzeichnet AM als Handlungswissenschaft, die der „Doppelstruktur sachlicher und personaler Entsprechung von Mensch in Not und Mensch als Helfer bzw. Krankheit und Medizin“ (...) folgt. Sie unterscheidet Krankheit und Kranksein sowie klinische und (natur-)wissenschaftliche Objektivität. Lebensweltliche und psychosoziale Faktoren beeinflussen das Kranksein. Als Umgangslehre setzt anthropologisch-klinische Wissenschaft „an die Stelle der Objektivitätslehre der Erkenntnis eine personalistische […] Erkenntnislehre“, die auch ihre methodischen, handlungslogischen Sach- und Wertbegründungen reflektiert.
