Neste artigo, usamos a Análise de Discurso Crítica como abordagem teórico-metodológica para analisar argumentos de ministros e ministras do Superior Tribunal de Justiça em um acórdão que afetou o entendimento jurisprudencial brasileiro sobre a Lei Maria da Penha. O principal objetivo neste trabalho é analisar como a Justiça constrói argumentos relativos à violência contra as mulheres em um órgão público notório, como o STJ, que é popularmente conhecido como "Tribunal da Cidadania" por, supostamente, garantir o exercício de vários direitos para (...) a população brasileira. Também buscamos trazer a público diálogos conflitantes, ideologias e jogos de poder inerentes à decisão em análise.This study employs Critical Discourse Analysis as thetheoretical framework to analyze the arguments used by the Superior Court of Justice in decisions related to the Maria da Penha Act, which had significant impact on Brazilian case law. The author's main objective is to discuss how Brazilian Justices construct legal arguments about violence against women in such an important public institution as the Superior Court, popularly known as the "Citizenship Court." Metaphors help us understand a concept by resorting to the imaginary because it is sometimes difficult to do so through the use of words alone. Thinkers have made use of metaphors to not only describe ‘falling in love’, ‘the pain of losing someone dear to us’, but also to describe particular concepts both in arts and sciences. In fact, the use of metaphors in some disciplines, particularly the sciences, is now regarded as something essential for the development of the field. (...) We note that influential philosophers of education, such as Martin Buber, Paulo Freire, Michael Apple, Gert Biesta and Ilan Gur-Ze’ev have also made use of metaphors to discuss education and specific issues in educational contexts. In this article, we do two things: we discuss the methodological importance of metaphors in helping us make better sense of concepts and particular problems; building on this methodological discussion, we critically discuss the problems posed by the current processes of ‘marketisation’ and ‘learnification’ in education. We conclude by arguing that metaphors do not provide us with ultimate answers to the problems we face; rather, they help us unveil a diversity of novel perspectives and a world of new possibilities. O artigo apresenta um estudo teórico sobre o pensamento de Gert Biesta, filósofo e educador holandês, internacionalmente reconhecido como referência no campo da Pedagogia Crítica. Tem como objetivo pôr em discussão o conceito learnification, criado pelo autor e posteriormente traduzido por aprenderismo, considerando ser esse uma importante referência para orientar estudos e práticas na perspectiva de problematizar o discurso educacional dominante. Como método, apresenta um procedimento complementar aos estudos bibliográficos, qual seja, a análise de vídeos referentes a palestras disponibilizadas pelo (...) autor no ambiente virtual YouTube. Com base na Análise Textual Discursiva, foram tomados como objeto de estudo três vídeos, a saber: “Good education in the age of measurement”; “Being home in the world” e “The beautiful risk of education”. Os vídeos correspondem, respectivamente, a palestras realizadas pelo autor, em diferentes eventos educacionais, entre os anos de 2013 e 2017, perfazendo um período de seis anos e contando com um intervalo de dois anos entre cada palestra selecionada. Resulta deste estudo uma compreensão ampliada do conceito, cuja complexidade buscamos expressar a partir de quatro palavras-chave: mensuração, qualificação, mercantilização e egocentrismo. Cada uma das referidas palavras-chave dá pistas para compreender o conceito, bem como para sugerir a continuidade de estudos sobre o pensamento do autor. Nesse sentido, as considerações finais apresentam questionamentos, com vistas ao aprofundamento de estudos, convidando ao diálogo. Como conclusão, reitera-se a importância do pensamento de Gert Biesta e a relevância da compreensão acerca do conceito learnification/aprenderismo, concebendo-o como significativa contribuição para orientar estudos e práticas no campo da Pedagogia Critica, na perspectiva de pensar/fazer uma boa Educação na era da mensuração. The contribution of Jesuits to the different fields of knowledge, including philosophy, is historically well known. In fact, since the foundation of the Society of Jesus, in the 16th century, Jesuits from different generations and cultures have taken part in the philosophical debates of their time and their different contexts. Since the foundation of the Society of Jesus, in 1540, the Jesuits, individually and as a body, have engaged in a fruitful dialogue between the Christian tradition and different dimensions of (...) human culture. During almost five centuries, numerous Jesuits taught philosophy in academic institutions all over the world. Some of them have their names recorded in the history of philosophy. Of course, the majority of them is not anymore remembered, despite their valuable contribution to the development of the Jesuit intellectual tradition up to our times. In fact, as an heir of the Roman College, the first academic institution founded by the Society of Jesus, in 1551, the Pontifical Gregorian University, in Rome, is a witness to this tradition, which has been kept alive thanks to the discrete work of both Jesuits and lay intellectuals. Known as the University of the Nations, this institution corroborates not only the capacity of the Jesuit tradition to put faith in dialogue with reason, but also the option to take the concrete reality of each human culture and its historical context as its point of departure. The Jesuits’ willingness to engage in dialogue with different intellectual perspectives is underpinned by one of the most defining traits of the Jesuit charism, namely, the conviction that God can be found and served in all things. Accordingly, Jesuits have adopted, from the beginning, an amenable stance towards the world with its different cultures and intellectual trends. As such, Jesuits have, since the beginning, inhabited the frontiers of human thought. According to the contemporary philosopher Paul Gilbert, SJ, within the institutions under the leadership of the Society of Jesus, it was always possible to maintain an equilibrium between two principles: “intellectual unity” and “openness to the world.” Without detriment to the Jesuit identity, the companions of Ignatius have been willing to dwell in the various dimensions of human reality, in their multiplicity and plurality. Either in the renewal of Aristotle’s and Aquinas’ metaphysics, or in the dialogue with modern philosophers such as Descartes, Kant, or Hegel, and even in the inculturation in non-European contexts, the Jesuits have been able to preserve the Christian tradition through an original development of human culture in all its richness and diversity. With respect to the last century, it has to be acknowledged that a significant number of Jesuits made significant contributions, with recognized competence, to philosophy. Certainly, the 20th century was particularly complex in many respects. It would be enough to recall that this period, which brought with it unprecedented social, scientific, and technological developments, was also the stage for the two World Wars. With the emergence or consolidation of philosophical currents such as Marxism, Phenomenology, Existentialism, Structuralism, and Post-Modernism, the past century was, without any doubt, fascinating from the intellectual point of view. Jesuits such as Karl Rahner, Frederick Copleston, Bernard Lonergan, William Norris Clarke, John F. Kavanaugh, Teilhard de Chardin, Gaston Fessard, Jean Daniélou, Henri de Lubac, Michel de Certeau, Xavier Tilliette, Paul Valadier, Paweł Siwek, Ignacio Ellacuría, Francisco Taborda, Henrique de Lima Vaz and, in the Portuguese context, Diamantino Martins or Júlio Fragata, among many others, were able to engage different philosophical currents, problems and controversies of their times. Faithful to their long tradition of being present in the frontiers of thought, those Jesuits have engaged in a fruitful dialogue with these intellectual trends, offering relevant contributions to different ongoing debates. Within this context, the present volume recalls and discusses the philosophical contribution of some of the most prominent Jesuit protagonists of the intellectual interchange that took place in the 20th century. This volume also intends to celebrate the 75th anniversary of the Revista Portuguesa de Filosofia, which happens just before the inauguration of the Ignatian Year. Decreed by Father Arturo Sosa, the Superior General of the Society of Jesus, this celebratory Year will start on May 20, 2021, precisely 500 years after Ignatius of Loyola, the founder of the Jesuit Order, was wounded at the battle of Pamplona. We are happy that this volume could bring together outstanding specialists in the thought of some of the most prominent Jesuits philosophers of the last century, namely Paul Valadier, Paul Gilbert, Józef Bremer, Jacek Poznański, Alexander Maar, Patrick H. Byrne, M. Ross Romero, Carlos Alvarez, Hélio Pereira Lima, José Gama, Domingos Terra, Gabriel Flynn, Marie-Gabrielle Lemaire, José Sols Lucia, Lorena Zuchel Lovera, Pedro Pablo Achondo Moya, Enzo Solari, Massimo Borghesi, Mendo Castro Henriques, João Barbosa, and Dominique Lambert. In addition, in the celebration of the 100th anniversary of Júlio Fragata’s birth, Maria Teresa Fragata presents a memory of his life and thought. We hope that this volume may be useful to all those interested in the Jesuit philosophical tradition. Hopefully, it will stimulate scholars to pursue a fruitful and creative dialogue with contemporary philosophy, in the footsteps of the Jesuit philosophers featured here. The goal is to analyze the condition of the historian as a subject involved in his own time, the delimitation of history field, its methods and limits. O texto procura realizar uma apresentação do “percurso-pensamento” de Vera Lúcia Gonçalves Felício, professora do Departamento de Filosofia da USP por cerca de vinte anos, a partir de seus escritos, que foram publicados ao longo de décadas em diferentes meios, tais como livros, revistas e jornais.

Lucia Schwarz urges a reconsideration of the implications of species egalitarianism, which is an essential element of the position in environmental ethics that Paul Taylor calls “respect for nature.” Species egalitarianism’s claim that every living thing has equal inherent worth appears to lead to counterintuitive conclusions, such as that killing a human being is no worse than killing a dandelion. Species egalitarians have generally responded by explaining that species egalitarianism is compatible with recognizing moral differences between killing different types of (...) living things, and that some killing is morally permissible. Schwarz raises doubts about whether this deflationary defensive strategy is philosophically justified, and suggests that taking seriously the supposedly repugnant implications of species egalitarianism may have a salutary effect on the overall debate. RESUMO O objetivo do presente trabalho consiste em explicitar o itinerário ou linha argumentativa de Gilles Deleuze no artigo intitulado "A concepção da diferença em Bergson", de 1954. Postula-se que nesse trabalho de 1954, Deleuze exponha a noção de 'diferença', que está presente na obra de Henri Bergson, por meio da relação entre três dimensões: metodológica, cosmológica e ontológica. Para tanto, caracteriza-se o conjunto do pensamento de Deleuze em relação à História da Filosofia. Em seguida, identifica-se o percurso das pesquisas (...) de Deleuze sobre a obra de Bergson no contexto de sua versão para a História da Filosofia. Por fim, explicita-se o itinerário de Deleuze no artigo de 1954: "A concepção da diferença em Bergson". ABSTRACT The purpose of this paper is to explain the itinerary or argumentative line of Gilles Deleuze in the article named "The conception of difference in Bergson" of 1954. It is postulated that in this work of 1954, Deleuze exposes the notion of "difference", which is present in the work of Henri Bergson, through the relation between three dimensions: the methodological, cosmological and ontological ones. For that purpose, the whole of Deleuze's thought in relation to the History of Philosophy is characterized. Then, we identify the course of Deleuze's research on Bergson's work in the context of his version for the History of Philosophy. Finally, we explain the itinerary of Deleuze in the article of 1954: "The conception of difference in Bergson". (shrink)

The Gift: Forms and Functions of Exchange in Archaic Societies, by Marcel Mauss, is an important reference in Social Sciences for thinking about the theme of the gift, proposed in this congress. This brief work has as goal to present a rereading of The Gift by contemporary authors that try to think today’s society under this perspective. It’s a literature review of books and articles by Allain Caillé, Jacques Godbout and some Brazilian authors: Eric Sabourin, Marcos Lanna, Paulo Henrique Martins (...) and Jorge Luiz Villela. It is important to emphasize, according to Caillé, 1998, that “the paradigm of the gift is not a machine for blowing solutions, but for inspiring questions”. (shrink)

In a recent paper, Trevor Hedberg and Jordan Huzarevich assessed a number of objections against practical apatheism, concluding that they are either unsuccessful or at least very controversial. The aim of this discussion note is to contribute to their discussion by presenting and analysing a short argument for a reason in favor of apatheism; one that appeals to a particular universalist formulation of the thesis of theodical individualism. After briefly introducing a distinction between a particular and a universal version of (...) apatheism, I present the argument, assess its merits in light of some objections to it, I conclude that at least one reason in favor of a particular practical apatheistic position is warranted by it. Finally, I suggest some alternative reasons that could be advanced in favor of apatheism, and I distinguish between strong and weak forms of apatheism. (shrink)

They were asked to respond to a pre-questionnaire concerning the three characters' behaviors and possible actions and a post-questionnaire after writing a report from the points of view of the three characters in the scenario. The students were asked to consider whether the characters should report the possible harasser to their supervisor, and thus engage in whistle-blowing behavior, as well as (...) directly confront the harasser. Hypotheses are formulated for the three NAFTA countries based on Hofstede's cultural dimensions. There were significant differences, but in some cases not in the direction expected. Oftentimes, reality seems to us a chaos that we try to control with our theories. This article starts from the antithetic standpoint, inspired by Antonio Rosmini’s works: reality is intelligible, and originates our thinking. From this perspective, any research that tries to reach the truth is determined by the real, not the contrary. Moreover, interdisciplinarity, far from being a solipsistic enterprise, aims at achieving truth and guaranteeing scientific advancement. Here, we analyze the distinctive character of Rosminian encyclopedism and his principles (...) for preventing human errors. We then clarify why it is impossible to achieve perfection, and why such an impossibility is not problematic for the interdisciplinary dialogue. (shrink)

Este artigo tem como objetivo geral comentar o estatuto do conhecimento da coisa em si na metafísica de Schopenhauer. De modo mais específico, visa analisar como se inserem neste debate, tradicionalmente enfrentado por estudiosos da filosofia schopenhaueriana como Julian Young, Paul Lauxtermann e David Cartwright, duas correntes interpretativas bastante discutidas neste ciclo, principalmente na última década; ambas lidam com o problema da coisa em si a partir de uma interpretação da transição analógica que Schopenhauer empreende do mundo da representação para (...) o da Vontade. Ao disputarem que tipo de conhecimento, metafórico ou metonímico, esse autor pode almejar da coisa em si, é possível apontar como De Cian e Marco Segala, bem como Jorge Prado, por um lado, e Sandra Shapshay, de outro, se distanciam da tradição exegética que lhes antecede; e, mais ainda, em que medida eles são precursores no esforço de apontar uma espécie de “método” específico, alternativo ao método transcendental kantiano, a partir do qual Schopenhauer realizaria sua empreitada metafísica. A fim de situar nossa própria interpretação entre a desses comentadores, focaremos na análise de passagens de O mundo como vontade e como representação e da Crítica da filosofia kantiana, em que Schopenhauer especifica com mais ênfase como deve ser entendida sua abordagem metafísica. The general question to be considered in this paper points to the nature of the world described by chemistry: what is macro-chemical ontology like? In particular, we want to identify the ontological categories that underlie chemical discourse and chemical practice. This is not an easy task, because modern Western metaphysics was strongly modeled by theoretical physics. For this reason, we attempt to answer our question by contrasting macro-chemical ontology with the mainstream ontology of physics and of traditional metaphysics. In particular, (...) we introduce the distinction between stuff-ontology, proper of chemistry, and individual-ontology, proper of physics. These two ontologies differ from each other in the basic categories of their own structures. On this basis, we characterize individual-ontology in such a way that the features of stuff-ontology will arise by contrast with it. (shrink)

This paper describes a practice innovation: the addition of formal weekly discussions of patients with prolonged PICU stay to reduce healthcare providers’ moral distress and decrease length of stay for patients with life-threatening illnesses. We evaluated the innovation using a pre/post intervention design measuring provider moral distress and comparing patient outcomes using retrospective historical controls. Physicians and nurses on staff in our pediatric intensive care unit in a quaternary care children's hospital participated in the evaluation. There were 60 patients in (...) the interventional group and 66 patients in the historical control group. We evaluated the impact of weekly meetings to establish goals of care for patients with longer than 10 days length of stay in the ICU for a year. Moral distress was measured intermittently and reported moral distress thermometer scores fluctuated. "Clinical situations" represented the most frequent contributing factor to moral distress. Post intervention, overall moral distress scores, measured on the moral distress scale revised, were lower for respondents in all categories, and on three specific items. Patient outcomes before and after PEACE intervention showed a statistically significant decrease in PRISM indexed LOS, a statistically significant increase in both code status changes DNR, and in-hospital death, with no change in patient 30 or 365 day mortality. The addition of a clinical ethicist and senior intensivist to weekly inter-professional team meetings facilitated difficult conversations regarding realistic goals of care. The study demonstrated that the PEACE intervention had a positive impact on some factors that contribute to moral distress and can shorten PICU length of stay for some patients. (shrink)

People sometimes explain behavior by appealing to an essentialist concept of the self, often referred to as the true self. Existing studies suggest that people tend to believe that the true self is morally virtuous; that is deep inside, every person is motivated to behave in morally good ways. Is this belief particular to individuals with optimistic beliefs or people from Western cultures, or does it reflect a widely held cognitive bias in how people understand the self? To address this (...) question, we tested the good true self theory against two potential boundary conditions that are known to elicit different beliefs about the self as a whole. Study 1 tested whether individual differences in misanthropy—the tendency to view humans negatively—predict beliefs about the good true self in an American sample. The results indicate a consistent belief in a good true self, even among individuals who have an explicitly pessimistic view of others. Study 2 compared true self-attributions across cultural groups, by comparing samples from an independent country and a diverse set of interdependent countries. Results indicated that the direction and magnitude of the effect are comparable across all groups we tested. The belief in a good true self appears robust across groups varying in cultural orientation or misanthropy, suggesting a consistent psychological tendency to view the true self as morally good. Although the literature on corporate social responsibility has discussed the scope and meaning of CSR extensively, confusion still exists regarding how to define the concept. One controversial issue deals with the changing legal status of CSR. Based on a review of CSR definitions and meta-studies on CSR definitions, we find that the majority of definitions leans toward voluntary CSR. However, some recent regulatory amendments toward mandatory CSR have called into question the established idea of CSR as merely a managerial tool (...) of self-regulation. In this paper, we juxtapose the evolution of CSR in India against the scholarly literature discussing voluntary-versus-mandatory CSR to understand the recent shift toward a new conceptualization of CSR as a form of co-regulation that includes elements of both voluntary and mandatory regulation. The Indian Companies Act 2013 is a remarkable example in that it replaced an older version from 1956, taking a bold step toward the integration of voluntary and mandatory aspects in the application of CSR. We present practical implications of the Indian case for businesses and discuss implications for CSR theory development; we particularly consider the evolution of the business and society relationship from a voluntary soft law approach to CSR to an increasingly hard law approach and transitory hybrid forms in-between like soft–hard law and hard–soft law. La investigación propuesta indagó las relaciones que existen entre el derecho a la memoria y el derecho a la ciudad. Para ello se analizaron desde una teoría crítica de los derechos humanos y teniendo como punto de contacto entre ambos derechos las inscripciones espaciales que materializan la memoria colectiva en la ciudad de Madrid. Es así que se buscó comprobar, desde una dimensión jurídica basada en un enfoque de derechos y con perspectiva espacial, si aquellos lugares que materializan y garantizan (...) la memoria pueden a su vez garantizar el acceso al derecho a la ciudad en virtud de que colaboran en la creación de una ciudad más democrática. La metodología empleada consistió en un análisis crítico de textos, relevamiento y estudio exhaustivo de las normas y estándares nacionales e internacionales, políticas públicas locales, observación y registro de los lugares y, por último, una entrevista en profundidad mediante la técnica de muestra de caso sumamente importante para el problema analizado. A growing body of research has examined how people judge the persistence of identity over time—that is, how they decide that a particular individual is the same entity from one time to the next. While a great deal of progress has been made in understanding the types of features that people typically consider when making such judgments, to date, existing work has not explored how these judgments may be shaped by normative considerations. The present studies demonstrate that normative beliefs do (...) appear to play an important role in people's beliefs about persistence. Specifically, people are more likely to judge that the identity of a given entity remains the same when its features improve than when its features deteriorate. Study 1 provides a basic demonstration of this effect. Study 2 shows that this effect is moderated by individual differences in normative beliefs. Study 3 examines the underlying mechanism, which is the belief that, in general, various entities are essentially good. Study 4 directly manipulates beliefs about essence to show that the positivity bias regarding essences is causally responsible for the effect. (shrink)

A recent Carnegie Report on Nursing Education – Educating Nurses: A Call for Radical Transformation challenges the nursing profession to embrace an education model that integrates knowledge, skilled know how and ethical comportment. Placing ethics in such a prominent position in nursing education is a radical transformation. Teaching ethics must be intentional and it is integral to the development of individual nurses and the profession as a whole. The development of moral imagination has a prominent place in this new education (...) model. The moral imagination is the ability to ponder and wonder about the inherent rightness or wrongness of decisions, choices and behaviors. This paper will review some key issues relevant to teaching ethics and then explore what nurturing the moral imagination could do for nurses as they learn to apply abstract ethics concepts to their clinical practice. Considering Rosmini’s political works in comparison with his metaphysical and anthropological essays, and starting from Rosmini's project of a code of law that, in the author’s opinion, can guarantee fundamental human rights, this article discusses the concept of justice between citizens and outsiders. Its first part is an analysis of Rosmini’s juridical fundaments, which takes into account also some objections historically moved against it.
