Fragmentalism allows incompatible facts to constitute reality in an absolute manner, provided that they fail to obtain together. In recent years, the view has been extensively discussed, with a focus on its formalisation in model-theoretic terms. This paper focuses on three formalisations: Lipman’s approach, the subvaluationist interpretation, and a novel view that has been so far overlooked. The aim of the paper is to explore the application of these formalisations to the alethic modal case. This logical exploration will allow us (...) to study (i) cases of metaphysical incompatibility between modal facts and (ii) cases of modal dialetheias. Data documenting poor understanding among research participants and real-time efforts to assess comprehension in large-scale studies are focusing new attention on informed consent comprehension. Within the context of biobanking consent, we previously convened a multidisciplinary panel to reach consensus about what information must be understood for a prospective participant’s consent to be considered valid. Subsequently, we presented them with data from another study showing that many U.S. adults would fail to comprehend the information the panel had deemed essential. When asked (...) to evaluate the importance of the information again, panelists’ opinions shifted dramatically in the direction of requiring that less information be understood. Follow-up interviews indicated significant uncertainty about defining a threshold of understanding and what should happen when prospective participants are unable to grasp key information. The Polluter Pays Principle (PPP) states that polluters should bear the burdens as- sociated with their pollution. This principle has been highly contested because of the pu- tative impossibility of considering individuals morally responsible for an important amount of their emissions. For the PPP faces the so-called excusable ignorance objec- tion, which states that polluters were for a long time non-negligently ignorant about the negative consequences of greenhouse gas emissions and, thus, cannot be considered morally responsible for their negative consequences. (...) This paper focuses on the concept of moral responsibility as it appears in the excusable ignorance objection. I claim that this objection stems from a narrow notion of moral responsibility and that a more fundamen- tal notion of moral responsibility would pave the way to overcome it. I show that it should be out of the question whether historical polluters should bear some burdens asso- ciated with climate change because of their historical emissions. The relevant question is which kind of burdens they can legitimately be asked to bear. I argue that this notion of moral responsibility allows us to assign burdens of symbolic reparation, which are at the core of ‘Loss and Damage’ policies. (shrink)

The research presented in this paper focuses on business ethical values inChina, a country in which the process of institutional transformation has left cultural values in a state of flux. A survey was conducted in China and the U.S. by using five business scenarios. Survey results show similarities between the Chinese and American decision choices for three out of five scenarios. However, the results reveal significant differences in rationales, even forsimilar decisions. Patient and citizen participation is now regarded as central to the promotion of sustainable health and health care. Involvement efforts create and encounter many diverse ethical challenges that have the potential to enhance or undermine their success. This article examines different expressions of patient and citizen participation and the support health ethics offers. It is contended that despite its prominence and the link between patient empowerment and autonomy, traditional bioethics is insufficient to guide participation efforts. In addition, the turn to (...) a “social paradigm” of ethics in examinations of biotechnologies and public health does not provide an account of values that is commensurable with the pervasive autonomy paradigm. This exacerbates rather than eases tensions for patients and citizens endeavoring to engage with health. Citizen and patient participation must have a significant influence on the way we do health ethics if its potential is to be fulfilled. (shrink)

Despite substantial research on overall decision-making capacity levels in schizophrenia, the factors that cause individuals to make errors when making decisions regarding research participation or treatment are relatively unknown. We examined the responses of 84 individuals, middle-aged or older, with schizophrenia or schizoaffective disorder. We used a structured decision-making capacity measure, the MacArthur Competence Assessment Tool for Clinical Research, to determine the frequency and apparent cause of participants’ errors. We found that most errors were due to difficulty recalling the disclosed (...) information, particularly the study’s procedures, potential risks, and purpose. Errors attributable to concrete thinking, psychotic symptoms, or perceived coercion were rarer. These results suggest that informed consent procedures for this population might be improved by providing information in a way that facilitates learning and memory, such as iterative disclosure of the information, corrective feedback, and emphasis of key points of the study—for instance, its purpose, procedures, and potential risks. Moorean constructions are famously odd: it is infelicitous to deny that you believe what you claim to be true. But what about claiming that p, only to immediately put into question your evidence in support of p? In this paper, we identify and analyse a class of quasi-Moorean constructions, which we label counterevidentials. Although odd, counterevidentials can be accommodated as felicitous attempts to mitigate one’s claim right after making it. We explore how counterevidentials differ from lexicalised mitigation operators, parentheticals, and (...) anaphoric mitigation devices, and consider some cognate non-assertoric constructions. We conclude by exploring the implications of our analysis for theorising about linguistic responsibility, assertion, and lying. (shrink)

Context: I extend the enactive account of loving in romantic relationships that I developed with Hanne De Jaegher to the love of nature. Problem: I challenge a universal conceptualization of love of nature that does not account for the differences that are inherent to nature. As an alternative, I offer a situated account of loving a place as participatory sense-making. However, a question arises: How is it possible to communicate with the other-than-human? Method: I use panpsychist and enactive conceptual tools (...) to better define this situated approach to the love of nature and to reply to the research question. In particular, I focus on Mathews’s “becoming native” and the generative tensions that unfold in a dialectic of encounter when a common language is not shared. Results: The fundamental difference experienced in encountering the other-than-human is generative for building up the human-Earth connection if we let each other be listened to. I describe the ethical dimension that permeates this type of “enactive listening” at the core of a situated account of love of nature. Implications: Love of nature is of paramount importance in our current climate crisis characterized by environmental anxiety, despair, and anger. A situated love of nature emphasizes the importance of community-based local interventions to preserve the Earth. Love, thus understood as a fundamental moral and political power, is a catalyst for environmental activism. Constructivist content: My article links to participatory sense-making as defined by De Jaegher and Di Paolo, and De Jaegher’s loving epistemology. It offers a broader understanding of participatory sense-making that includes the other-than-human. It also introduces the new concept of “enactive listening.”. (shrink)

Between 1905 and 1945, 31 states in the Untied States and 2 provinces in Canada enacted sterilization legislation. Over 70 statutes and amendments were enacted to guide, oversee and regulate sterilization practice, while over 24 distinct conditions were offered as grounds for sterilization. Although excellent legal, historical, and philosophical scholarship has investigated the motivations, causes and consequences of this legislation, little work has been done to explicitly systematic analyse the language used in sterilization legislation. This brief study attempts to fill (...) some of the gap by attending to a number of questions that arise in the context of sterilization legislation. Five questions are addressed: Are there any patterns to the eugenic language in sterilization legislation? Does the eugenic sterilization language reflect what is found on other eugenic lists? What can sterilization language tell us about the mechanics of eugenics? What can sterilization legislation reveal about the role of feeble-mindedness or mental deficiency in eugenic history? And finally, what might sterilization language tell us about eugenic thought more generally? In answering these questions, we look to add one more piece to the puzzle that is eugenic history in North America. (shrink)

Vaccine hesitancy is a growing threat to public health. The reasons are complex but linked inextricably to a lack of trust in vaccines, expertise and traditional sources of authority. Efforts to increase immunization uptake in children in many countries that have seen a fall in vaccination rates are two-fold: addressing hesitancy by improving healthcare professional-parent exchange and information provision in the clinic; and, secondly, public health strategies that can override parental concerns and values with coercive measures such as mandatory and (...) presumptive vaccination. It is argued that such conflicting, parallel approaches seriously risk undermining trust that is crucial for sustaining herd immunity. Although public health strategies can be ethically justified in limiting freedoms, a parent-centered approach seldom acknowledges how it is impacted by contemporaneous coercive measures. In addition, the clinical encounter is not well suited to helping parents consider the public dimensions of vaccination, despite these being important for trust formation and informed decision-making. Efforts to address vaccine hesitancy require more consistent engagement of parental and citizen views. Along with evidence-based information, debates need to be informed by ethical support that equips parents and professionals to respond to the private and public dimensions of vaccination in a more even-handed, transparent manner. Efforts to address vaccine hesitancy need to avoid simple reliance on either parental values or coercive public policies. To do this effectively requires increasing citizen engagement on vaccination to help inform a parent-centered approach and legitimize public policy measures. In addition, cultivating a more ethically consistent strategy means moving beyond the current silos of health ethics - clinical and public health ethics. (shrink)

In qualitative interviews with a diverse group of experts, the vast majority believed unregulated researchers should seek out independent oversight. Reasons included the need for objectivity, protecting app users from research risks, and consistency in standards for the ethical conduct of research. Concerns included burdening minimal risk research and limitations in current systems of oversight. Literature and analysis supports the use of IRBs even when not required by regulations, and the need for evidence-based improvements in IRB processes.

For more than 100,000 years, H. sapiens lived as foragers, in small family groups with low reproductive variance. A minority of men were able to father children by two or three women; and a majority of men and women were able to breed. But after the origin of farming around 10,000 years ago, reproductive variance increased. In civilizations which began in Mesopotamia, Egypt, India, and China, and then moved on to Greece and Rome, kings collected thousands of women, whose children (...) were supported and guarded by thousands of eunuchs. Just a few hundred years ago, that trend reversed. Obligate sterility ended, and reproductive variance declined. For H. sapiens, as for other organisms, eusociality seems to be an effect of ecological constraints. Civilizations rose up in lake and river valleys, hemmed in by mountains and deserts. In order to move towards an Ethic of Accounting, one must start by defining the function and role of the accountant. This in turn depends to a great extent on the identity of the client or whatever party the Accountant owes his loyal agency to. The issue is one of cardinal importance, and it is perceived as such by the accountants themselves. Loeb for instance says that the client-identity issue is overriding importance now, and will become even more crucial in (...) the immediate years ahead. The question of what constitutes ethical behaviour on the part of the accountant will depend then upon the relation within which such ethical behaviour will have to be deployed.The main question raised in this paper will therefore be, is the accountant primarily engaged by one client (whether an individual or a corporation) to act as their agent, deal with their problems by loyally advancing their interests to the best of his professional competence, although within the limits imposed by law and morality? Or is the public sector to be considered the principal target of the accountant's resolute professionalism and unswerving loyalty? (shrink)

In this chapter, I focus on the faculties by which we gain knowledge, namely, sensibility and the understanding, as well as on the methodological framework within which Sor Juana Inés de la Cruz examines them. I stress the importance that the author gives to sensibility and the physiological apparatus that grounds and explains sensation.With respect to her conception of understanding, I will show that it is both the sign of man’s filiation with God and a faculty that displays deficiencies and (...) limitations with respect to the difficult task of attaining knowledge.Finally, I examine Sor Juana’s criticism both of the Neoplatonic method, which looks for a vision of the universe as a whole, as well as of the deductive method of the Aristotelian- Scholastic tradition, which attempts to reduce the unmanageable diversity of beings to some specific characteristics and laws.My conclusion is that Sor Juana shares with modern philosophers the critical attitude against tradition; she holds that traditional methods do not enable us to reach knowledge about either the remotest causes or the closest effects. On my view, Sor Juana takes an epistemological approach to philosophy, as do Bacon and Descartes, but she does not propose a new method; this is not because of some radical skepticism on her part, but because of the enormity of the task of the human mind achieving complete knowledge. Although the expression 'intellectual property' is widely used, it could be argued that the very idea of intellectual property is incoherent. After all, ideas are not like land, houses or clothing; surely they are not the sorts of things that can be owned? I shall examine two arguments - one ontological, one jurisprudential - that put pressure on the coherence of the idea of intellectual property, both leading to the conclusion that intellectual property rights are not genuine property rights, but (...) rights to monopolies. In setting up and responding to the first argument, I discuss the applicability of the type/ token distinction to intellectual property law; a distinction I also appeal to as a way of clarifying my response to the second argument. We surveyed IRB chairs' perspectives on offering individual genetic research results to participants and families, including family members of deceased participants, and the IRB's role in addressing these issues. Given a particular hypothetical scenario, respondents favored offering results to participants but not family members, giving choices at the time of initial consent, and honoring elicited choices. They felt IRBs should have authority regarding the process issues, but a more limited role in medical and scientific issues.

ABSTRACTRecent research suggests that impaired emotion regulation may play an important role in the development of youth psychopathology. However, little research has explored the effects of ER strategies on affect in early adolescents. In Study 1, we examined if early adolescents are able to use distraction and whether the effects of this strategy are similar to talking to one’s mother. In Study 2, we compared the effects of distraction, cognitive reappraisal, acceptance, and rumination. In both studies, participants received instructions on (...) how to regulate their emotions after a standardised negative mood induction. In general, the results indicated that distraction, but also cognitive reappraisal and acceptance, had promising short-term effects on positive and negative affect in early adolescents. In this brief excerpt from a forthcoming translation of L’Afrique et ses fantômes and Singe de Kafka, Seloua Luste Boulbina shows how French opposition to the Islamic hijab, as described by Fanon, mirrored British opposition to the Indian practice of sati by claiming to defend women while really defending the interests of European men. This made it difficult, if not impossible, for women to define and assert interests of their own, apart from the perspectives imposed by politically opposed groups of (...) men. Fanon recognized this complex silence. But Fanon also failed to read the perspective motivating the writings of fellow Martinican author, Mayotte Capécia, which prevented him from seeing any independence in women’s capacity for interracial love and prevented him from giving a more complex psychological and political meaning to mixed ancestry. Recent work in animal ethics has advanced principles that are too individualistic to be compatible with a holistic environmental ethic such as the land ethic proposed by Aldo Leopold. J. Baird Callicott, on the other hand, has attempted to reconcile the two ethics by suggesting that sympathy, natural among humanity, as he claims on Humean grounds, does not necessarily terminate at the species barrier. His argument shows minimally that it is not necessary that we abandon ecological ethics in order to (...) view nonhuman animals as morally considerable. I argue instead that it is not sympathy, but hostility/indifference that manifests the reality of life in wild nature, and as such forms a better basis for an all-encompassing ethic. If one accepts that the factual realm suggests the limits of norms and establishes the background and context of normative judgments in this context (as Holmes Roiston, III, for instance, does), then a different line of argument can be developed. I argue that intraspecies and interspecies ethics ought to be different for us because behavior in the wild is different within and without a species. Further, I argue that hostility/indifference coupled with respect form the basis of an approach which embraces a holistic environmental ethic as weil as one concemed with nonhuman animals. (shrink)

The concept offreedom in Heidegger’s sense of truth or unconcealedness of beings may be applied to future generations without thereby reducing the status of other elements within the environment to mere means, since Da-sein’s approach as one who is a caring and concernful, anxious and aware of its own death in an authentic manner, does not place man in any sense “above” other things. This care (Sorge), concern, favor can be captured in Heidegger’s remark that man is not the lord (...) of beings, but rather is “the Shepherd of Being.” Accordingly. we may be able to learn to moderate our ordering andcommanding attitude and learn to “listen” and free beings. letting them be what they truly are. If so, we might then require no special justification in order to extend toward earth, sky, and future persons the same understanding and freeing concern we normally give to, and wish for ourselves. In his Letter on the Blind, Denis Diderot describes, based on mathematical physics, a method for evaluating hypotheses in situations where certainty cannot be reached. This article's thesis is that the author of the Letter extends this method to metaphysical questions of finalism and idealism. Diderot presents each pair of antagonistic positions (finalism-antifinalism and idealism-realism) in such a way that readers are invited to carefully weigh the arguments and to choose the one that appears to be the best, or most (...) probable, position. In fact, there can be no autonomy for anyone without a loving and caring social environment that actively promotes independent thinking and capacity empowerment among people. This social dimension of autonomy has often been ignored by traditional theorists, who have considered autonomy to be an individual accomplishment that is a function (...) of an individual's will power, intellectual ability, or self-discipline and virtue. The automation of many repetitive or dangerous human activities yields numerous advantages. In order to automate a physical task that requires a finite series of sequential steps, the translation of those steps in terms of a computational procedure is often required. Even apparently menial tasks like following a cooking recipe may involve complex operations that can’t be perfectly described in formal terms. Recently, several studies have explored the possibility to model cooking recipes as a computational procedure based on a set (...) of instructions. This vision is the foundation for the construction of robotics kitchen, as Moley. These kitchen robots have shown promising results. Moley, for instance, is the very first example of a new generation of bioinspired robotics, based on the reproduction of particular movement, cooking, through artificial arms and hands. It is entirely different from the current appliances present in our domestic domain because Moley is able to manipulate ingredients and interact with kitchen equipment in order to prepare a dish autonomously. Nonetheless, they have also shown several limitations. In particular, Moley is an entirely autonomous robot in a structured environment in which it knows precisely the object position and manipulates the ingredients based on a list of instructions and a training phase made by Machine Learning. In this contribution we contend that these limitations arise from an essential mismatch between computational procedures, as originally described by Turing in his seminal 1936 paper, and recipes. Computational procedures have been originally created to observe and modify formal symbols with formal operators. Thus, they are independent from time and they are ideally executed in a closed environment, in which the computer directly produces all the relevant changes required to produce the intended result. Recipes, instead, are followed in an open environment, in which, while time goes by, changes happen independently from the cook’s intervention: the cook puts the butter on the pan, starts the fire and then waits until the butter is melted. To operate effectively in the open environment a kitchen robot must couple computational procedures with sensors, e.g a sensor which provides a time signal. These sensors are de facto oracles for the procedures and yet are required to bridge the gap from the formal to the physical world. (shrink)

Animals are hand-raised in a variety of contexts, including experimental research. This has been criticized frequently as producing animals with species-untypical behaviour. Here we compare life histories of 330 hand-raised and 631 gooseraised Greylag geese from a free-flying flock to determine whether hand-raising affected life history, reproductive variables and behaviour. We found little differences in life histories or reproductive variables of hand-raised and goose-raised geese. However, hand-raised females had lower life expectancies than goose-raised ones, mainly due to predation during breeding. (...) Hand-raised geese were stressed significantly less during social, handling and predator stress, were attacked less by conspecifics and were less vigilant than goose-raised geese. We conclude that hand-raising resulted in geese with species-typical life histories but reduced stress responses. This makes hand-raised geese cooperative partners for research, but also more vulnerable when exposed to predators. One of the foremost objections to theological voluntarism is the contingency objection. If God’s will fixes moral facts, then what if God willed that agents engage in cruelty? I argue that even unrestricted theological voluntarists should accept some logical constraints on possible moral systems—hence, some limits on ways that God could have willed morality to be—and these logical constraints are sufficient to blunt the force of the contingency objec­tion. One constraint I defend is a very weak accessibility requirement, related to (...) (but less problematic than) existence internalism in metaethics. The theo­logical voluntarist can maintain: Godcouldn’t have loved cruelty, and even though he could have willed behaviors we find abhorrent, he could only have done so in a world of deeply alien moral agents.
