Today, the US pursues the global capture of data (understood as a significant engine of growth) by way of bi- and plurilateral trade agreements. However, the project of securing the global free flow of data has been pursued ever since the dawn of digital telecommunication in the 1960s and the US has made significant legal efforts to institutionalise it. These efforts have two phases: In the first 1970s and 80s “freedom of information” phase, the legal justification (and contestation) of the (...) global free flow of data hinged on imagining data as information, and its exchange as a practice of liberty. The second phase began in the late 1990s and continues today. In this phase, the free flow of data is aligned with a free-trade agenda in the context of first e-commerce and, starting in the 2000s, through attempts at creating a global public domain of personal data for the platform economy. The global free flow of data is an intrinsic aspect of informational capitalism. Assuming a constitutive, but not commanding role for law in informational capitalism, we conclude that the US attempt at ensuring free flow for its informational corporations is neither an entirely contingent nor a necessary outcome. Drawing on Security, Territory, Population and The Birth of Biopolitics, this article aims, firstly, to consolidate our understanding of Foucault’s engagement with law by fleshing out his approach to law and by clarifying that he distinguishes between different kinds of law on the basis of the objectives that law serves and the regime of truth that it embodies. Secondly, using this understanding, the article proceeds to illustrate how the objectives and the regime of truth of the EU internal market law (...) have been displaced in the last few decades. It is argued that this body of law has increasingly come to perform the tasks of law in neoliberal government as pointed out by Foucault in these lectures, namely of expanding the domain of market values and mechanisms, and of restricting the exercise of legitimate government by opposing the rule of law to planning. In this regard, particular attention is paid to the way in which justiciable rights function as a technology of neoliberal rule within the internal market. (shrink)

Legal tech is growing, and its growth provokes anxieties about the future of the legal profession as such. In this article, we examine the impact of legal tech on the central role of lawyers at law firms in crafting an imagined ‘right legal answer’ by drawing on Duncan Kennedy’s suggestion that a claim to the rightness of one’s legal propositions is a central characteristic of the legal profession. We first ask how changes in the organisation of legal services affect the (...) ability of lawyers at law firms to produce that ‘right legal answer’. While legal tech only exacerbates already ongoing processes of eradication of routine tasks, we find that it continues to mask the role of ideology in arriving at a right legal answer under a new layer of technological projection. Second, we ask how lawyers’ ability to produce ‘the right legal answer’ is affected by, first, expert systems and, second, a legal tech application named Bryter, representing a no-code system. We find that expert systems do not permit to uphold the unity of the lawyer required for Kennedy’s model of the right legal answer, but that no-code systems as Bryter do so. No-code systems can be reduced to a slogan: Have the lawyer, but evict her ideological temptations more efficiently than before! (shrink)

This article explores Leila Ahmed’s A Border Passage, and Nawal El Saadawi’s Memoirs from the Women’s Prison, A Daughter of Isis, and Walking Through Fire. It contrasts their works and argues that location and genderawareness play an important role in the writing of autobiographies. The focus is on showing how El Saadawi’s positioning as a feminist activist in Egypt and Ahmed’s location in the USA determine the texts’ themes and shape the construction of the autobiographical “I.”.

Unless dignity’s meaning is spelt out it can disappear beneath more tangible priorities. In this article we define dignity and show how this can help health workers to maintain the dignity of people in their care.

Since Xi Jinping has taken office in 2012, China’s political repression has only but intensified so that the regime is definitively turning away from the 1990s legal reforms and the many expectations that followed in terms of rule of law and other rights fostering. In replacing these recent developments in a larger perspective including that of a “socialist harmonious society”, which had already shaded a particular light on Chinese reforms, this article proposes to envisage contemporary Chinese legal culture in an (...) evolutionary and theoretical framework. In doing so, it stresses the tensions between a language of rights now fully integrated by the Chinese citizens and the politics of law used, in a last legal ditch struggle, by the Chinese Communist Party as a tool for social stability in disciplining the people by all means including by the threat of its very legal creations. It then concludes in reflecting upon the legal culture emerging out of this great divide between the people and the State. (shrink)

As artificial intelligence technologies become increasingly prominent in our daily lives, media coverage of the ethical considerations of these technologies has followed suit. Since previous research has shown that media coverage can drive public discourse about novel technologies, studying how the ethical issues of AI are portrayed in the media may lead to greater insight into the potential ramifications of this public discourse, particularly with regard to development and regulation of AI. This paper expands upon previous research by systematically analyzing (...) and categorizing the media portrayal of the ethical issues of AI to better understand how media coverage of these issues may shape public debate about AI. Our results suggest that the media has a fairly realistic and practical focus in its coverage of the ethics of AI, but that the coverage is still shallow. A multifaceted approach to handling the social, ethical and policy issues of AI technology is needed, including increasing the accessibility of correct information to the public in the form of fact sheets and ethical value statements on trusted webpages, collaboration and inclusion of ethics and AI experts in both research and public debate, and consistent government policies or regulatory frameworks for AI technology. BackgroundMoral distress has been described as an emotionally draining condition caused by being prevented from providing care according to one’s convictions. Studies have described the impact of moral distress on healthcare professionals, their situations and experiences. The Measure of Moral Distress for Healthcare Professionals (MMD-HP) is a questionnaire that measures moral distress experienced by healthcare professionals at three levels: patient, system and team. The aim of this project was to translate and make a cultural adaption of the MMD -HP to (...) the Swedish context.MethodsThe questionnaire comprises 27 items, rated according to frequency and intensity on a five-point Likert scale (0–4). The procedure for translating MMD-HP followed WHO guidelines (2020). These entailed a forward translation from English to Swedish, a back translation, expert panel validation, pretesting and cognitive face-to-face interviews with 10 healthcare professionals from various professions and healthcare contexts.ResultsThe Swedish version of MMD-HP corresponds essentially to the concept of the original version. Parts of some items’ had to be adjusted or removed in order to make the item relevant and comprehensible in a Swedish context. Overall, the cognitive interviewees recognized the content of the items which generally seemed relevant and comprehensible.ConclusionThe Swedish version of MMD-HP could be a useful tool for measuring moral distress among healthcare professionals in a Swedish healthcare context. The present article aims to scrutinize publishing ethics in the fields of paediatrics and paediatric nursing. Full-text readings of all original research articles in paediatrics from a high-income economy, i.e. Sweden, and from all low-income economies in Sub-Saharan Africa, were reviewed as they were indexed and stored in Web of Science for the search period from 1 January 2007 to 7 October 2009. The application of quantitative and qualitative content analysis revealed a marked discrepancy in publishing frequencies between the two (...) contrasting economies. Authors from 16 low-income economies in Sub-Saharan Africa, with at least one article stored, were obviously closely linked to co-authorships and foreign funding sources, predominantly from Europe and the USA. Statements concerning conflicts of interest were frequently missing (both regions), even when multiple financial sources, including companies, were involved. It is necessary to be aware of possible systematic bias when using electronic databases to search for certain topics and regions. Further research regarding publishing ethics in paediatrics and paediatric nursing is emphasized. (shrink)

This article discusses findings from a mixed method literature review that investigated cancer patients’ perceptions of what constitutes a good nurse. To find pertinent articles, we conducted a systematic key word search of five journal databases (1998—2008). The application of carefully constructed inclusion criteria and critical appraisal identified 12 relevant articles. According to the patients, good nurses were shown to be characterized by specific, but inter-related, attitudes, skills and knowledge; they engage in person-to-person relationships, respect the uniqueness of patients, and (...) provide support. Professional and trained skills as well as broad and specific nursing and non-nursing knowledge are important. The analysis revealed that these characteristics nurtured patient well-being, which manifests as optimism, trust, hope, support, confirmation, safety and comfort. Cancer patients’ perceptions of what constitutes a good nurse represent an important source of knowledge that will enable the development of more comprehensive and practice-based views on good nursing care for such patients. These perceptions help us to understand how nurses effectively make a difference in cancer patient care. (shrink)

Many organizations must adjust their supply chains and business environments to remain competitive and retain market share. However, despite the benefits of such developments for organizations, they can lead to supply chain disruptions in many cases. An essential aspect of modern organizations is closed-loop supply chain management, which reduces risk by coordinating processes. This paper presents a mathematical model of a closed-loop green supply chain under uncertain conditions. A detailed description of the model and current assumptions for a specific industry (...) are provided. Consequently, the model is developed with several relevant objectives for the design of the network. Our proposed model has the following characteristics: being multiobjective, multiproduct, and multiperiodic. Our analysis indicates that the applied model can be used both to increase profitability and to reduce environmental damage. The problem was made more uncertain using fuzzy logic. Torabi and Hassini method is combined with Jiménez’s proposed method to solve the problem. (shrink)

Dung’s (1995) argumentation framework takes as input two abstract entities: a set of arguments and a binary relation encoding attacks between these arguments. It returns acceptable sets of arguments, called extensions, w.r.t. a given semantics. While the abstract nature of this setting is seen as a great advantage, it induces a big gap with the application that it is used to. This raises some questions about the compatibility of the setting with a logical formalism (i.e., whether it is possible to (...) instantiate it properly from a logical knowledge base), and about the significance of the various semantics in the application context. In this paper we tackle the above questions. We first propose to fill in the previous gap by extending Dung’s (1995) framework. The idea is to consider all the ingredients involved in an argumentation process. We start with the notion of an abstract monotonic logic which consists of a language (defining the formulas) and a consequence operator. We show how to build, in a systematic way, arguments from a knowledge base formalised in such a logic. We then recall some basic postulates that any instantiation should satisfy. We study how to choose an attack relation so that the instantiation satisfies the postulates. We show that symmetric attack relations are generally not suitable. However, we identify at least one ‘appropriate’ attack relation. Next, we investigate under stable, semi-stable, preferred, grounded and ideal semantics the outputs of logic-based instantiations that satisfy the postulates. For each semantics, we delimit the number of extensions an argumentation system may have, characterise the extensions in terms of subsets of the knowledge base, and finally characterise the set of conclusions that are drawn from the knowledge base. The study reveals that stable, semi-stable and preferred semantics either lead to counter-intuitive results or provide no added value w.r.t. naive semantics. Besides, naive semantics either leads to arbitrary results or generalises the coherence-based approach initially developed by Rescher and Manor (1970). Ideal and grounded semantics either coincide and generalise the free consequence relation developed by Benferhat, Dubois, and Prade (1997), or return arbitrary results. Consequently, Dung’s (1995) framework seems problematic when applied over deductive logical formalisms. (shrink)

: In his paper "Explanation of Curiosity the First" Charles Peirce describes Euclid's procedure in proving theorems. Euclid first presents his theorem in general terms and then translates it into singular terms. Peirce pays attention to the fact that the generality of the statement is not lost by that move. The next step is construction, which is followed by demonstration. Finally the ergo-sentence repeats the original general proposition. Peirce lays much emphasis on the distinction between corollarial and theorematic reasoning in (...) geometry. He takes an argument to be corollarial if no auxiliary construction is needed. For Peirce, construction is "the principal theoric step" of the demonstration. Peirce also stresses that it is the observation of diagrams that is essential to all reasoning and that even if no auxiliary constructions are made, there is always the step from a general to a singular statement in deductive reasoning; that means introducing a kind of diagram to reasoning.This paper seeks to argue for two theses. One is that the way of thinking of reasoning which stresses the role of observation is essential to Peirce's discovery of the new logic. The other is that Peirce wants to consider both logical reasoning and philosophical thinking in general via the model of geometry. However, it is argued in this paper that it is the model of problematic analysis in geometry that is the most important for Peirce when he discovers the new structure of propositions. Moreover, this paper seeks to show that this very feature in Peirce's thought connects him with philosophers and logicians who emphasise the role of praxis instead of theoretic contemplation and that one who wants to reconstruct Peirce's metaphilosophical views must pay special attention to the model of problematic analysis.Key-words: construction; demonstration; corollarial and theorematic reasoning; diagrams.Resumo: Em seu artigo "Explanation of Curiosity the First", Charles Peirce descreve o procedimento de Euclides para demonstrar teoremas. Euclides primeiramente apresenta seu teorema em termos gerais, e então o traduz para termos singulares. Peirce presta atenção ao fato de que a generalidade do enunciado não é perdida por esse movimento. O próximo passo é a construção, que é seguida pela demonstração. Finalmente, a sentença-ergo repete a proposição geral original. Peirce dá bastante ênfase à distinção entre o raciocínio corolarial e o teoremático em geometria. Ele considera um argumento como corolarial se nenhuma construção auxiliar se fizer necessária. Para Peirce, a construção é "o principal passo teórico" da demonstração. Peirce também enfatiza que a observação de diagramas é essencial para todo raciocínio e que, mesmo se não são feitas construções auxiliares, há sempre o passo de um enunciado geral para o particular no raciocínio dedutivo; o que significa introduzir um tipo de diagrama no raciocínio.Este artigo procura defender duas teses. A primeira, que a maneira de pensar o raciocínio que enfatiza o papel da observação é essencial para a descoberta da nova lógica por Peirce. A outra, que Peirce deseja considerar tanto o raciocínio lógico quanto o pensamento filosófico em geral pelo modelo da geometria. Entretanto, defende-se neste artigo que o modelo de análise problemática em geometria é o mais importante para Peirce, quando ele descobre a nova estrutura das proposições. Este artigo procura mostrar, ainda, que é exatamente essa característica do pensamento de Peirce que o liga aos filósofos e lógicos que enfatizam o papel da práxis em vez da contemplação teórica, e que quem deseje reconstruir as visões metafilosóficas de Peirce deve prestar atenção especial ao modelo da análise problemática.Palavras-chave: construção, demonstração, raciocínios corolarial e teoremático, diagrama. This paper deals with two opposite metaphilosophical doctrines concerning the nature of philosophy. More specifically, it is a study of the naturalistic view that philosophical, hence also epistemological, knowledge cannot be distinguished from empirical knowledge, and of the antinaturalistic view that philosophical, hence also epistemological, knowledge, is pure, that is, independent of empirical knowledge and particularly of the special sciences. The conditions of the possibility of naturalistic and of pure epistemology are studied in terms of phenomenological philosophy. It is concluded (...) that pure epistemology is possible under relatively strong conditions but that the version of naturalistic epistemology which denies the pure basis leads to contradiction. That, however, does not shake the possibility of cognitive science. Following Husserl, we may argue that studies of human cognition are possible on the condition that a first basis is assumed which is not naturalized. (shrink)

Mind wandering refers to a state when attention shifts from the task at hand or current situation toward thoughts, feelings, and imaginations. This state is often accompanied by a decline in mood, and patients suffering from major depression exhibit more perseverative MW. Hence, although the directionality of the relationship between mood and MW is still under investigation, it may be useful to explore possible avenues to reduce MW. In an earlier pilot study, we investigated MW during auditory beat stimulation in (...) healthy subjects using thought-probes during a sustained attention to response task. We found evidence for reduced MW during monaural 5 Hz beats compared to silence, sine tones, and binaural 5 Hz beats. Moreover, the data tentatively suggested that this reduction was particularly pronounced in subjects with high levels of MW during silence. In the current study, we therefore asked whether MW can be reduced by monaural theta beats in subjects with high trait-levels of MW, as indicated by an online MW questionnaire. Preselected subjects performed a SART task with thought-probes assessing the propensity to mind wander, meta-awareness, and the temporal orientation of MW. Stimulation conditions comprised monaural theta beats, as well as silence, and sine tones as control conditions. Our main hypothesis stating that the propensity to mind wander during monaural theta beats is reduced compared to both control conditions was only partly confirmed. Indeed, MW was significantly diminished during exposure to the theta beats compared to sine tones. However, reduced MW during theta beats versus silence was only observed in a subgroup using stricter inclusion criteria. Considering possible reasons for this outcome, our data suggest that the preselection procedure was suboptimal and that beat effects are modulated by the individual responses to auditory stimulation in general. ABSTRACT Iran is the only Muslim country that has legislation on embryo donation, adopted in 2003. With an estimated 10–15% of couples in the country that are infertile, there are not any legal or religious barriers that prohibit an infertile couple from taking advantage of Assisted Reproductive Technologies (ARTs). Although all forms of ARTs available in Iran have been legitimized by religious authorities, there is a lack of legislation in all ARTs except embryo donation. By highlighting ethical issues in embryo (...) donation, the paper presents a critical review of the Act of Embryo Donation in Iran. The paper argues that the Act does not provide enough safeguards for the future child and assurance for the safety of the donated embryos. It also does not restrict embryo donation to surplus embryos from infertile couples and is silent about the number of embryos that could be donated by each couple as well as the number of recipients for donated embryos by a couple. The Act is also silent about the issues of genetic linkage (nasab) and heritage which are challenging issues, especially in a conservative Islamic society. As a result, the future child may not inherit from their birth parents, as it is not required by the Act, or from the genetically related parents under the anonymity policy. Finally there is no standard national protocol or guidelines to evaluate the safety of the donated embryos. The paper concludes that despite its benefits, the Act lacks clarity, and it is subject to misunderstanding and confusion. (shrink)

In consequence, we shall have in such a logic two kinds of forbideness of premission, and of indifference, but obviously definable in terms of the two obligation operators and negation.

No presente artigo, interessa-nos apontar algumas possibilidades acerca da presença, no século X, da obra Formula Vitae Honestae, escrita por Martinho de Braga, que viveu na Galiza no século VI, na biblioteca de San Millán de la Cogolla, mosteiro localizado em La Rioja. De acordo com nossas conclusões, ainda parciais, vinculamos tal presença à identificação dos dois momentos históricos, o da Galiza no século VI e por La Rioja no X, marcados pela reorganização eclesiástica e monárquica.

This chapter gives a survey of the field of philosophy where the philosophical foundations of modern logic were discussed and where such themes of logic were discussed that were on the borderline between logic and other branches of the philosophical enterprise, such as metaphysics and epistemology. The contributions made by Gottlob Frege and Charles Peirce are included since their work in logic is closely related to and also strongly motivated by their philosophical views and interests. In addition, the chapter pays (...) attention to a few philosophers to whom logic amounted to traditional Aristotelian logic and to those who commented on the nature of logic from a philosophical perspective without making any significant contribution to the development of formal logic.
