Metaphors used to describe new technologies mediate public understanding of the innovations. Analyzing the linguistic, rhetorical, and affective aspects of these metaphors opens the range of issues available for bioethical scrutiny and increases public accountability. This article shows how such a multidisciplinary approach can be useful by looking at a set of texts about one issue, the use of a newly developed technique for genetic modification, CRISPRcas9.

ABSTRACT This article is a reply to critical commentaries by Rebecca Bamford, Rachel Cristy, and Bernard Reginster on my 2019 monograph, Nietzsche's Moral Psychology, invited by the North American Nietzsche Society for presentation at a book symposium planned for the 2020 Pacific Division Meeting of the American Philosophical Association.

This special thematic issue of The Journal of Medicine and Philosophy brings together a cross-cultural set of scholars from Asia, Europe, and North America critically to explore foundational questions of familial authority and the implications of such findings for organ procurement policies designed to increase access to transplantation. The substantial disparity between the available supply of human organs and demand for organ transplantation creates significant pressure to manipulate public policy to increase organ procurement. As the articles in this issue (...) explore, however, even if well intentioned, the desire to maximize organ procurement does not justify undermining foundational elements of human flourishing, such as the family. While defending at times quite different understandings of autonomy, informed consent, and familial authority, each author makes clear that a principled appreciation of the family is necessary. Otherwise, health care practice will treat the family in a cynical and instrumental fashion unlikely to support social or individual good. (shrink)

Language learning and language typology are often studied separately, and it is common for experts in one area to know rather little about the other. This is not merely an unfortunate historical coincidence; there are some powerful practical reasons why it is so. The detailed study of language learning typically involves the experimental investigation of groups of people who are at various stages in the learning process—i.e., children. Hence it prototypically takes place at university daycares in North America, where (...) the children are usually learning English. In contrast, the study of typology is concerned with probing the full extent of the diversity that natural human languages can exhibit, and with finding and explaining any limits to that diversity that exist. As a result, it prototypically involves doing fieldwork with small numbers of fully competent adult speakers of less-studied languages. This fieldwork is made possible either by the researcher traveling to the often-remote areas of the world where these less-studied languages are spoken, or by finding speakers who have come nearer to the researcher through immigration. As a result, the contexts in which language acquisition can readily be studied and the contexts in which language typology can effectively be studied rarely overlap. Indeed, it is an unfortunate reality of the world as we have made it that a very large number of the “local languages” spoken by aboriginal populations, which are of great interest to typologists, have no children learning them at all (Hale, Krauss et al. The availability of and demand for water in China is an extreme case of uneven distribution in time and space. In response, the South to North Water Diversion project, the largest inter-basin water transfer scheme in the world, channels large amounts of fresh water from the Yangtze River in southern China to the more arid and industrialised north. In order to keep the SNWD project running smoothly, a comprehensive governance system has been implemented and innovative institutional arrangements have (...) been created to facilitate the transfer of water itself. By taking the SNWD project’s Middle Route as one case study and drawing on primary and secondary data, this article examines the project’s emerging institutional arrangements. The article outlines the establishment of new institutions for the SNWD project with high administrative rankings at both central and local levels, the encouragement of inter-department cooperation, the adoption of a market mechanism and the integration of market functions into administrative functions. We argue that these institutional arrangements have to some extent overcome common challenges in water governance in China, including an engineering-heavy approach and what Chinese commentators have traditionally called the problem of water being managed by multiple government ministries and municipal authorities as the common metaphor of ‘nine dragons managing the water’. Our findings have significant implications for understanding the continuing evolution of water governance in China. (shrink)

This issue of The Journal of Medicine and Philosophy brings together an international group of scholars from Hong Kong, Mainland China, and North America, critically to explore whole-body/head transplantation. The proposed procedure raises significant philosophical, ethical, and social/political questions. For example, assuming transplant is successful, who survives the surgery? Does personal identity necessarily follow the head? The contributors to this special thematic issue explore the nature and ground of personal identity, what it would mean to preserve personal identity, given (...) such a significant set of physical changes, as well as the morality of such a procedure. As the authors make clear, careful conceptual philosophical analysis is essential for understanding whether whole-body/head transplantation is a life-saving/life-enhancing technological innovation, or a bioethical morass that should not be attempted. Process physics2 is, like all physics, a model of reality. However, unlike traditional substance-based versions, process physics implements many process philosophical concepts, perhaps most notably, the notion of internal relations. It argues that the universe can best be understood in terms of selfreferential semantic information that is remarkably similar to mathematical stochastic neural networks research in biology. It argues that information patterns generate new information through causal efficacy and, ultimately, internal integration, generating self-organising patterns of relationships. These patterns or relations (...) have an intrinsic value inherent in their self-actualisation and thereby experience a subjective unity in response to influences from the totality of their past. The result is an internally related self-organising stream of experiences that provides a defining essence objectively distinguishable in abstraction and as exhibiting all the characteristics of a quantum space and quantum matter. In process physics, therefore, quantum phenomena emerge where no prior assumption regarding their existence is made or prescribed at the start. Rather, they are internally generated as an inherent feature of an experientially becoming reality, growing in size over time and thus having an observable key feature — i.e. a ‘defining essence’ — of an expanding universe. Reality itself is now understood — and modeled — as having a primitive form of self awareness. By this we mean that it has, in the process philosopher Alfred North Whitehead’s words, prehensions of other actualities as objects in terms of their ‘provocation of some special activity within the subject’.3 In more biologically complex information systems these ultimately lead to experiential integration as conscious discrimination of contrasts in prior experiences. Reality is, ultimately, not about the identification of isolated individuals through externality, but related individuals through internality. The purpose of this paper is to arrive at a point whereby we might apply these ultimate principles of reality to management. To do this, we shall start by considering Whitehead’s own renderings of management issues, before turning to the use management studies has or has not made of his work. In the light of this discussion, we shall question the principle of deconstructive postmodernism that underpins this body of work. We shall then ask whether and to what extent Whiteheadian principles might help explain organisations as ‘event fields’ 4 within which ‘persons-in-communities’5 reside. This will then allow us to consider organisations in terms of a process reinterpretation of physics. In so doing, we shall uncover a final contradiction, between Whitehead’s understanding of organisation and his principles concerning the application of metaphysics, to which we shall at least indicate a solution. This Special Issue provides a collection of cutting-edge research that examines discourses that serve emancipatory agendas by taking a social justice approach. To this end, the issue draws on data from Africa, Latin America, North America and the Arab Levant to illuminate how members of non-dominant and marginalized (disempowered) groups sculpt a positive image for themselves, engage in solidarity formation for group empowerment and reconstruct their experiences in a manner that gives them voice, agency and a positive identity. The (...) issue argues for a more interventionist stance in ideologically oriented discourse analysis and demonstrates why (critical) discourse analysts must not only expose and resist the inequities or injustices in society but, more crucially, also adopt an activist-scholar posture in order to push for positive social change. Poverty using the United Nations’ criteria refers to denial of choices, opportunities, and the lack of capacity as a result of low income for a person to effectively participate in society. Poverty creates problems such as ill-health, inability to acquire the basic necessities of life, deprivation of full exercise of civic and political rights, and so forth. In spite of the enormous wealth in both human and natural resources in MENA, many people in the region are living in abject poverty. (...) Using phenomenological hermeneutics and existential critical analysis, the paper argues for ethical philanthropy to be used to alleviate the poverty in the region. Poverty is an ethical issue for it affects the quality of lives that humans can live as moral beings and impacts human behaviour. It is unacceptable that the enormous wealth of the region is not used for the benefit of all. Outside government efforts and the imperative of efficient political leadership, wealthy individuals and non-governmental groups have a moral responsibility to help to alleviate poverty in the region. It is this ethical role of individuals and groups in rendering philanthropic help to alleviate and if possible end poverty in the region that is the thrust of this paper. The paper affirms that abject and other forms of poverty are present in the region. The paper concludes that individuals and groups have an ethical duty in philanthropy to alleviate poverty in the region. The people of the region will become better and achieve a higher level of happiness and peace through the practice of ethical philanthropy. (shrink)

How do tweets reflect the long-standing disparities between the northern and southern regions of Nigeria? This study presents a qualitative analysis of Twitter users' responses (n = 101,518) to the tweets of the Economic and Financial Crimes Commission (EFCC) regarding the production and prosecution of cybercrime. The article uses postcolonial perspectives to shed light on the legacies of British colonial efforts in Nigeria, such as the amalgamation of the northern and southern protectorates in 1914. The results revealed significant discrepancies between (...) Nigeria's northern and southern regions regarding cybercriminal arrest, conviction, and sentencing. Specifically, the results showed that the EFCC's criminalization of Southerners differs substantially from that of Northerners. The contemporary manifestation of inequalities concerning the production and prosecution of cybercrime on Twitter reflects long-standing contestations (e.g., economic, political, cultural, geological) between the northern and southern parts of Nigerian society. Therefore, since the North-South divide in present-day Nigeria originated from British colonization, colonialism is the base that shaped the superstructure comprising political, religious, historical, geological (e.g., crude oil), and economic factors. In turn, the article spotlights that regional differences in educational attainment, originating from differing experiences of Christianization and colonization, interact with regional disparities in the production of cybercrime. More research is required to better understand how these contextual disparities in society interact with the production and prosecution of cybercrime, given that Nigerian cybercriminals defraud victims all over the world. Is Translational Science and Medicine new? Its dramatic expansion has spelled a dizzying array of new disciplines, departments, buildings, and terminology. Yet, without novel theories or concepts, Translational Science and Medicine may appear to be nothing more than an old concept with a new brand. Yet, is this view true? As is illustrated herein, histories of TSM which treat it as merely an old product under a new name misunderstand its essential architecture. As an expressly economic transformation, modern translational approaches (...) are differentiated precisely by a set of semi-permanent architectures which render it an altogether different kind of object when compared to previous attempts by institutions to turn science into medicine. Powered by new software, embedded within campuses that now house companies, and with legal agreements that outline agreed-upon scientific activity, TSM is now powered by a set of robust and durable structures that differentiate it from previous approaches. Based on ethnographic research about translational neuroscience in North America, this paper suggests that the sense of TSM as not being new is a consequence of analytic modes that tend to see scientific enterprises in epistemic terms alone. Analyzing TSM as primarily a scientific object misses the fact that it is a principally a financial one. (shrink)

This collection of essays represents a sample of the work carried out on the various urgent issues arising from the contemporary "war in terror" by researchers in the Department of Politics and International Relations, Swansea University UK and/or who attended the 2005 conference on politics and ethics at the University of Southern Mississippi (Gulf Coast). Certain specific topics are obviously prompted by this general theme; others dealt with in this book are perhaps not as obviously connected to it - though (...) they are no less important for that. This book is therefore intended to cover some ground in both types of topic and it is to be hoped that its contents will stimulate further reflection and writing on the deep controversies that recent events in world politics have stoked. However misguided much of the debate has been, many have contended that the present era is witnessing a "clash of civilisations", in which fundamentally different value-systems confront each other with their mutually opposed and antagonistic views of the world. This position often undergirds a moral relativism, which denies that there are any universal values: all we have, according to this outlook, are the different values of different cultures seeking (insofar as they "clash") to impose themselves on others. In the first essay, James Beard counters this argument with a case for what he calls a "thin universalism", a relatively sparse but powerful set of fundamental values which can credibly be demonstrated to have universal application.Many who supported the 2003 invasion of Iraq now oppose it, not on the grounds that they were wrong at the outset but that hindsight and subsequent events have given them new reasons to revise their judgements. This has led some to think that arguments about whether a war is just, and justified, can very often only be satisfactorily made "down the line", thus excusing initial support for a conflict which thereafter goes badly wrong. In her article, Christine Stender reminds us of many of the considerations that were available in 2003 itself which readily led to just-war arguments against launching the invasion at the time. It may be easy for the passage of time to cause us to forget those factors. But, given that we can only become more adept at making just-war judgements by reflecting on past experience, it is crucial not to let them disappear in the morass of subsequent experience. Arguably, the Abu Ghraib scandal did more than any other single event to undermine what moral credibility the American occupation of Iraq ever had. It certainly raised acute questions about the conception of "virtue" that the role of combatant in war ought to necessitate and, in his essay, J. Joseph Miller subjects this issue to close philosophical scrutiny, with particular focus on the ethics of torture. Traditional just war theory has been composed of two elements: jus ad bellum, which sets out moral criteria which may sanction the resort to war, and jus in bello, which provides moral rules for its actual conduct. Recent events, and in particular the tragically chaotic situation of post-invasion Iraq, have helped to make the case for a third element: jus post bellum, which deals with the rights and responsibilities of just combatants with respect to the pursuit of a just peace once conflict has ended. This remains an under-researched area and, in their article, Mark Evans and Christine Stender introduce a wide-ranging set of considerations towards the construction of an adequate account of jus post bellum. A concept that has surged to the fore in recent times has been that of a "failed state", which has been invoked as part of arguments for "humanitarian intervention." (Afghanistan is perhaps the most obvious and pertinent example.) It is, however, a highly contentious concept and many think it has nothing other than ideological, polemical value. Whilst admitting that it is prone to such (mis)use, Mark Evans argues, in his essay, that it can be given a determinate and useful normative content, even if it does not necessarily sanction the kind of foreign policies which certain Western leaders have thought it does. Most liberal democracies have responded to the "terror threat" by introducing emergency legislation, or by otherwise suspending in some way what they would "ordinarily" have regarded as inviolable basic liberties and legal safeguards. Nazeer Patel argues that this dangerously undercuts the moral authority that these states claim for themselves and urges that we rethink how liberal democracy should appropriately respond to terrorism; it may take courage not to "overreact" against it, but he plausibly suggests a more measured and morally preferable attitude for it to take. Finally, in her essay, Claire Delisle focuses on one of the more bitter conflicts within a liberal democracy of recent times which has, it seems, been resolved in favour of peaceful accommodation: that between the Nationalist and Unionist communities in the north of Ireland/Ulster. The full story of how this peace became possible has yet to be fully told, and she adds a vital element to the tale, of how incarcerated combatants developed attitudes, strategies and a culture which built the foundations for a process that eventually brought "The Troubles" to what, it is to be hoped, is a permanent end. With the exception of the editor's contributions, the research which is published here is the product of the intellectual labours of scholars who are in the early stages of their careers. This volume is, therefore, a compendium of work in progress and the authors hope that this publication will help to further their reflections; certainly, the issues with which they engage are a long way indeed from being exhausted in terms of the scholarly attention they demand. Obviously, their appearance together in the same volume should not be taken to imply that any of the contributors endorse anything of what any of the others argue. (shrink)

Recent developments in South Africa in the field of planning, the domain of plans, and the world of planners, would suggest that planning and plans are viewed in a positive light, the local planning profession is in good shape, and these instruments and actors can play a meaningful role in the development and transformation of the country. In this article, these assumptions were explored through the lens of the attributes and convictions that gave birth to and drove the early 'town (...) planning movement' in the industrial cities of North America and Western Europe. A key theme in this analysis was the role played in the early town planning movement by compassion, passion and care for progressive change, and the conviction that it was possible to do so through the application of reason, technical ability and ingenuity. Based on this analysis, the argument was put forward that, while planning, plans and planners in South Africa could potentially play a crucial part in the crafting of a different country, a number of crucial changes would need to be made. The challenges associated with effecting these changes were subsequently explored, and the article concluded with a proposal for doing so by tapping into the metaphors as deployed, and the drive and passion as displayed by those in the early town planning movement. Padilla reviews their production histories with an eye to classical influences, and then analyzes their links with Greek art, poetry, and philosophy.

Driven by population pressures on natural resources, peri-urban pastoralists in the Far North Province of Cameroon have recently intensified livestock production in their traditional pastoral system by feeding their cattle cottonseed cakes and other agricultural byproducts to cope with the disappearance of rangelands typically available through the dry season. Although the crop–livestock interactions in this altered intensive pastoral system seem similar to alterations recently named in mixed-farming systems in West Africa, they are distinctly different and would require a different (...) type of agricultural development support. What points of contact, if any, are there between the current investment in ethics in literary theory, and the elaboration of ethics in contemporary philosophy? In other words, does an interdisciplinarity exist? Second, what reasons might literary theorists have, or have they had, to be aware and take stock of (...) developments in philosophical ethics? That is to say, what might be gained from interdisciplinary work? A third question emanates from the first two: where a cross-disciplinary engagement with philosophy has taken place, has there occurred any transformation of literary theory? I hope to show in what follows that, when we consider ethics in literary theory, no less than in philosophy, it is necessary to attend both to method within each discipline and to the nature of relations between them.The first of my questions begs the question of what contemporary philosophy is. Literary theorists entering into ethics have tended to draw on the work of Emmanuel Lévinas, Jacques Derrida, Michel Foucault, and Luce Irigaray, and more recently that of Giorgio Agamben and Alain Badiou. If the last has, in a spirit of polemic, professed to displace the "other" in the name of the "Same,"1 the dominant paradigm, when it [End Page 3] comes to ethics, remains one of alterity and difference. There are fundamental reasons why this should be the case: operating in figural language, literature, or the literary, differs from itself in response to an other. To borrow, translate, and adapt an Afrikaans term from the South African poet Breyten Breytenbach,2 literature engages in a process of andersmaak, of other-making or making-other: in making-other and, in so doing, inventing others, it makes itself other. Literature is an other-maker. It is to this activity that literary theory must attend. That is why it is natural for it to turn to ethics—not only the nexus Lévinas-Derrida and the other thinkers mentioned above, but also, for instance, to psychoanalysis: what may have begun as the teasing out of hidden meanings (the received idea is that this is what psychoanalysis and literary criticism share) has, following Lacan's "return to Freud," evolved into a consideration of the ethics of psychoanalysis in the context of reading and listening [see, for example, Felman and Laub].Literature may be an other-maker, and reading may be exemplary in the topoi of current theory for responsibility before the other,3 but it is not clear that literary theorists have been equal to setting this responsibility to work fully when it comes to responding to philosophy. There has been relatively little attention among literary theorists to developments in disciplinary philosophy—where, in recent decades, in North America and the Anglophone world generally, the tendency in ethics has been to bring moral reflection to bear on questions in political theory. The pólis in question is, however, no longer only the nation-state; the politics that engages political thought is transnational and global. Whether or not a given thinker subscribes to the idea of world citizenship, the horizon for thought is cosmopolitan.PhilosophyAlthough thinkers have continued to enter into basic questions in ethics,4 the writings of Charles Taylor, Will Kymlicka, Iris Young, Seyla Benhabib, and others attest to a shift from ethics to politics powerfully influenced by John Rawls (1921-2002)—notably in A Theory of Justice (1971) and Political Liberalism (1993)—and the ensuing criticisms of these works. While Roger was an old soul from an older world, this association arises from Roger's adherence to the kind of "become who you are" eccentricity celebrated by Henry David Thoreau and other sages who remind each of us to "step to the music" of "a different drummer."When visiting the bristlecones, one is impressed by the various odd poses struck by each tree. Of course no two are alike; each holds a unique gnarly stance that says, "You are among a community of nonconformists." When, after thirty years, Roger became an emeritus professor at Duke and relocated to the San Francisco Bay Area, he found himself in a much more hospitable setting.It may seem strange to draw out this comparison of Roger and those ancient White Mountain pines, but when I first met those trees in the summer of 1998, they set a standard for authenticity that came to mind whenever Roger and I interacted. His extravagant accomplishments as a teacher, scholar, and person who lived a life of genuine service to others were attained through the real work of daily spiritual practice, critical reflection, and adherence to the truths—always plural for Roger—of which he had been convinced. In what sense might the authoritarian practices and suspension of legal norms as means to combat the supposed threat of “terrorism,” within and by contemporary western democratic states, be understood as a problem of and not for democracy? That question lies at the heart of this article. It will be explored through the theoretical frame offered in the work of Giorgio Agamben on the state of exception and the example of British state collusion in non-state violence in the North (...) of Ireland. The North of Ireland provides a particularly illuminating case study to explore how the state of exception—the suspension of law and of legal norms and the exercise of arbitrary decision—has increasingly become a paradigm of contemporary governance. In so doing it brings into question not only the traditional conceptualization of the “democratic dilemma” of liberal democratic states “confronting terrorism” but also challenge dominant paradigms of transitional justice that generally fail to problematize the liberal democratic order. After outlining Agamben’s understanding of the state of exception the article will chart the development of “exceptional measures” and the creation of a permanent state of emergency in the North, before critically exploring the role of collusion as an aspect of counter-insurgency during the recent conflict. The paper will argue that the normalization of exceptional measures, combined with the need to delimit the explicitness of constitutional provision for the same, provided a context for the emergence of collusion as a paradigm case for the increasing replication of colonial practices into the core activity of the contemporary democratic state. Obituaries represent a prominent way of expressing the human universal of grief. According to philosophers, obituaries are a ritualized way of evaluating both individuals who have passed away and the communities that helped to shape them. The basic idea is that you can tell what it takes to count as a good person of a particular type in a particular community by seeing how persons of that type are described and celebrated in their obituaries. Obituaries of those killed in conflict, (...) in particular, are rich repositories of communal values, as they reflect the values and virtues that are admired and respected in individuals who are considered to be heroes in their communities. In this paper, we use natural language processing techniques to map the patterns of values and virtues attributed to Australian military personnel who were killed in action during World War I and World War II. Doing so reveals several clusters of values and virtues that tend to be attributed together. In addition, we use named entity recognition and geotagging the track the movements of these soldiers to various theatres of the wars, including North Africa, Europe, and the Pacific. (shrink)

We are living during a period in which the unequal concentration of wealth—which is to say, the unequal concentration of the resources that make human existence, development, and fulfillment possible—has (...) never been greater.1 The World Bank reports that almost “1.3 billion people remain below the extreme poverty line with an income of US $1.25 or less a day. Close to 2.5 billion—more than one-third of the world’s population—live on less than US $2 a day, another common measurement of deep deprivation,”2 and a staggering 80 percent of the world’s population struggles to survive on less than US $10 dollars a day.3 Credit Suisse’s 2012 Global Wealth Report indicates “the bottom half of the global population [or more than 3.5 billion persons] possess barely 1 percent of total wealth... In sharp contrast, the richest 10 percent own 86 percent of the world’s wealth, with the top 1 percent alone accounting for 46 percent of global assets.”4 Given the history of international colonial and neocolonial relations, it comes as no surprise that wealth is highly concentrated in Western Europe and North America, while the overwhelming majority of individuals living in poverty are concentrated in Africa, India, Asia, and Central and South America.5The wealth gap between the top 10 percent and the bottom 90 percent is, however, also reaching record levels in developed nations. While in 2012, the United States had the seventh highest average wealth holdings per adult in the world, “among nations with at least a quarter-million adults, only Russia, Ukraine, and Lebanon are more unequal” than the United States.6 A Reuters investigative report published in 2012 reveals that “inequality has risen not just in plutocratic hubs such as Wall Street and Silicon Valley, but also in virtually every corner of the world’s richest nation: Inequality has increased in 49 of 50 states since 1989,” with Mississippi being the only exception, even as it still “ranks worst in the nation on both counts.”7 In 2010, “the top 1 percent of households (the upper class) owned 35.4 percent of all privately held wealth, and the next 19 percent (the managerial, professional, and small business stratum) had 53.5 percent, which means that just 20 percent of the people owned a remarkable 89 percent, leaving only 11 percent of the wealth for the bottom 80 percent [End Page 125] (wage and salary workers).”8 In The Price of Inequality (2012), Nobel Prize–winning economist Joseph E. Stiglitz indicates that the “six heirs to the Walmart empire command wealth of $69.7 billion dollars, which is equivalent to the entire wealth of the bottom 30 percent of U.S. society.”9 In short, six individuals possess more wealth than do ninety-six million individuals—though this figure is misleading inasmuch as most of the ninety-six million own almost nothing but mounting debt. Most significantly, the top 10 percent own between 81 percent and 94 percent of all stocks, bonds, trust funds, and business equity, and almost 80 percent of non-home real estate.10 G. William Domhoff makes the vital point that inasmuch as “financial wealth is what counts as far as the control of income-producing assets,” that is, control of the means of producing wealth, “we can say that just 10 percent of the people own the United States of America.”11 Meanwhile, according to the latest census, fifty million Americans qualify as poor and another 100 million qualify as low income.12The concentration of the lion’s share of wealth in the hands of a tiny fraction of humanity is devastating for the majority of people living on the planet and ultimately for everyone. Research ethics regulation in parts of the Global North has sometimes been initiated in the face of biomedical scandal. More recently, developing and recently developed countries have had additional reasons to regulate, doing so to attract international clinical trials and American research funding, publish in international journals, or to respond to broader social changes. In Taiwan, biomedical research ethics policy based on ‘principlism’ and committee- based review were imported from the United States. Professionalisation of research ethics displaced other longer-standing (...) ways of conceiving ethics connected with Taiwanese cultural traditions. Subsequently, the model and its discursive practices were extended to other disciplines. Regulation was also shaped by decolonizing dis- courses associated with asserting Indigenous peoples’ rights. What are the driving forces of cultural macroevolution, the evolution of cultural traits that characterize societies or populations? This question has engaged anthropologists for more than a century, with little consensus regarding the answer. We develop and fit autologistic models, built upon both spatial and linguistic neighbor graphs, for 44 cultural traits of 172 societies in the Western North American Indian (WNAI) database. For each trait, we compare models including or excluding one or both neighbor graphs, and for the (...) majority of traits we find strong evidence in favor of a model which uses both spatial and linguistic neighbors to predict a trait’s distribution. Our results run counter to the assertion that cultural trait distributions can be explained largely by the transmission of traits from parent to daughter populations and are thus best analyzed with phylogenies. In contrast, we show that vertical and horizontal transmission pathways can be incorporated in a single model, that both transmission modes may indeed operate on the same trait, and that for most traits in the WNAI database, accounting for only one mode of transmission would result in a loss of information. There are surely few writers who have had a more profound impact on European culture, and in the broadest range of fields, than St. Augustine, and this despite the fact that he was North African. Nonetheless, while Augustine is still called upon in debates on interfaith dialogue and in theological and philosophical disputes, one area of his large corpus has received scant attention—his philosophy of education. Although there are references throughout Augustine’s writings to his philosophy of education, he devotes (...) only a single text to its elaboration—De Magistro—On the Teacher. The fact that this work has been largely overlooked by scholars is disappointing, because the De Magistro, despite its use of theological language, retains a very modern and contemporary thematic with interesting insights for any contemporary theory of education. This study assesses the extent to which job application forms violate the New Zealand Human Rights Act. The sample for the study includes 229 job application forms, collected from a variety of large and small, public- and private-sector organizations that together employ approximately 200,000 workers. Two hundred and four or 88% of the job application forms contain at least one violation of the Act. One hundred and sixty five or 72% contain two or more and 140 or 61% contain three (...) or more violations. The most common violations concern age, gender, nationality, and disability. The least common concern political opinion, ethical belief, religious belief, and sexual orientation. Despite widespread violations, many forms do have non-discriminatory questions that yield the same kind of useful information as discriminatory questions. Employers could incorporate these into their job application forms to bring themselves into compliance with the law. The same lessons also generally apply to North American employers, given the high degree of comparability between American, Canadian, and New Zealand anti-discrimination laws. (shrink)

Similarly, there is a reading of (1b) describing a crack-widening event, as well as a reading describing the dimensions of the crack, increasing in width along an axis extending from the north tower to the gate; and readings of (c) and (d) describing movement events as well as readings describing the configuration of the storm front and the snow respectively. The origins of tattooing are very ancient, and the modern fascination with the practice serves to remind us that it has been an enduring fixture in human history. Its functions are many and often overlap, but the particular focus here is on the tattoo as an aspect of punishment. Comparative evidence, however, is welcomed whenever it proves useful. This article first marshals and examines the late antique literary evidence extending from North Africa in the third century to Constantinople in (...) the ninth. Then that evidence is put in its legal context. From at least the time of Augustus, the penal tattoo, which was generally placed on the face or forehead, had been associated with degradation. Such remained the case in late antiquity, and it also becomes clear that the tattoo accompanied a sentence of exile and hard labor, usually in mines or quarries. The deeper meaning of the tattoo and its placement on the forehead is considered in the light of modern understandings. There follows a discussion of the actual form taken by the tattoo, which normally displayed the name of the crime, the name of the emperor, or the name of the punishment. Based on the available data, the last option appears to have been the most common penal tattoo in this period. Finally, the article hypothesizes that the Christians effected a transformation of the tattoo and subverted its original intent, so that, rather than being a sign of punishment, it became a sign of glory in which one could take pride. Thus the penal function, in some settings at least, was overtaken by a primarily religious one. (shrink)

This sharp, erudite work discusses and also takes its place in the "Schmittean revival" which, the author argues, is emerging today in Western Europe, and, to a lesser extent, in North America. The author takes a stance as someone not only interested in Schmitt, but also wishes to bring Schmitt's insights into the koinë of modern American political and philosophical discourse.

After outlining arguments for the general epistemological presumption in favour of taking into consideration alternative perspectives from other cultures, the article details several examples in which such an examination yields epistemic benefits and challenges. First, our example of alternative conceptions of art demonstrates that a western conception of art as disinterested contemplation cannot be accepted as a general characterization in that it does not adequately characterize the practice of many traditional societies. Second, the case of aboriginal justice reveals assumptions embedded (...) in the North American criminal justice system regarding justice as fairness, and suggests an alternative based on restorative justice. The third example is from Traditional Chinese medicine. While alternative herbal remedies can be tested according to shared standards of health improvement, practices such as acupuncture are more epistemologically challenging in that they cannot readily be explained by current scientific theories. The final example deals with the failed attempts to replace the traditional Balinese agricultural methods with modern farming practices, and shows how the traditional methods yielded practical insights which were ignored by western experts because of their spiritual origins. Obstetric Fistula is an abnormal opening between the vagina and rectum resulting from prolonged and obstructed labour. Studies indicate that delays in accessing maternal care and home birth contribute to the development of fistula. Survivors are usually women of low socioeconomic status residing in rural locations. This study explores the birthing experiences of 15 fistula survivors through a narrative inquiry approach at a repair centre in North‐central Nigeria. Using structural violence as a lens, it describes the role of social, (...) political and health systems in the inequitable access to care for women. For women opting for home births, preference for home delivery was mainly due to lack of finances, poor health systems and cultural practices. Rural location inhibited access as women seeking facility delivery faced transfer delays to referral centres when complications developed. Inequitable maternal health services in rural locations in Nigeria are inherently linked to access to health care, and these contribute to the increased incidence of fistulae. Structural intervention is a health policy priority to address poor health systems and achieve universal health coverage to address maternal health issues in Nigeria. (shrink)
