Der Begriff der Integrität begegnet in Alltag und Beruf häufig: Wir sprechen davon, jemand sei integer oder auch habe Integrität. Manchmal schreiben wir auch nur berufliche Integrität zu. Aber inwiefern sollten diese beiden Auffassungen von Integrität zugeschrieben werden? Anhand dreier Fallbeispiele wird diese Frage diskutiert. Zu diesem Zweck wird das moderne Paradigma der Integrität mit dem neoaristotelischen Paradigma der schwachen Einheit der Tugenden identifiziert und mit diesem argumentiert. Aufbauend auf alltäglichen Intuitionen wird die Problematik der Zuschreibung von Integrität als einzelne (...) Tugend und an einzelne Personen aufgezeigt. Daraufhin wird beispielhaft mit Neera K. Badhwar und Daniel C. Russell für die Kontextualität von Integrität, d. h. für ihre Einbettung in Lebenskontexte oder auch -bereiche wie eben den Beruf, argumentiert. Des Weiteren wird die Relationalität von Integrität aufgezeigt, d. h. deren Abhängigkeit von verschiedenen Rollen und von Bezugspersonen. (shrink)

In this book, Russell Winslow analyzes contemporary discourses in microbiology and evolutionary inheritance theory to foreground the metaphysical prejudices that unreflectively subtend these discourses, highlight and illuminate an emergent prejudice of an ecological ontology in microbiology, and determine what interpretive possibilities it affords.

In this paper we examine how the use of robots in caring for elders can impact the meaningfulness of elders’ lives. We present a framework for understanding ‘meaningfulness in life’, and then apply that framework in discussing ways in which the use of robots to assist in activities of daily living can preserve, enhance or undermine the meaningfulness of elders’ lives. Introduction: Burnout, inertia, meltdown, and shutdown have been identified as important parts of some autistic people’s lives. This study builds on our previous work that offered early academic descriptions of these phenomena, based on the perspectives of autistic adults.Objectives: This study aimed to explore the unique knowledge and insights of eight autistic children and youth to extend and refine our earlier description of burnout, inertia, and meltdown, with additional exploration of shutdown. We also aimed to explore how these youth cope (...) with these phenomena and what others around them do that make things better or worse, with a hope to glean knowledge to design better supports.Methods: One-to-one interviews were conducted with eight children and youth, who shared their experience with BIMS. To match individual communication strengths of children and youth, we took a flexible approach to interviews, allowing for augmentative communication systems and use of visual images to support verbal interviews, as needed. We conducted a reflexive, inductive thematic analysis, using an iterative process of coding, collating, reviewing, and mapping themes.Findings: Our analysis has identified that these youth describe BIMS as a multi-faceted experience involving emotional, cognitive and physical components. Moreover, these multifaceted experiences are often misunderstood by neurotypical adults, which contributes to inadequate support in managing BIMS. Of the four experiences, these youth identified meltdowns as most common.Conclusion: By gaining first-hand perspectives, we have identified novel insights into BIMS and developed a more holistic understanding of these phenomena. These youths’ descriptions of supportive strategies for BIMS stress the importance of compassion and collaboration from trusted adults. This new knowledge will provide a foundation for how to better support autistic children and youth. Further research is required to develop an understanding of BIMS, especially with respect to how it is experienced by children and youth. Future research should leverage the insights and experiential knowledge of autistic children and youth to co-design support tool for BIMS. (shrink)

Objective—To explore the opinions of unpaid healthy volunteers on the payment of research subjects.Design—Prospective cohort.Setting—Southern Alberta, Canada.Participants—Medically eligible persons responding to recruiting advertisements for a randomised vaccine trial were invited to take part in a study of informed consent at the point at which they formally consented or refused trial participation. Of 72 invited, 67 returned questionnaires at baseline and 54 at follow-up.Outcome measures—Proportions of persons who agreed or disagreed with three close-ended statements on the payment of research subjects; themes (...) and categories identified by content analysis of responses to an open-ended question.Results—A minority agreed with paying either patient or healthy volunteer participants. Opinions did not change over time. Participants' comments addressed: benefits and drawbacks to research participation; benefits and drawbacks to paying research participants; conditions under which payment of research subjects would be acceptable, and the nature of acceptable recognition. Acceptable conditions were to improve problematic recruitment, to reimburse costs, and to recognise participants, particularly for their time investment. Both non-monetary and monetary recognition of volunteers were thought to be appropriate.Conclusions—Most unpaid volunteers disagreed with paying research participants. The themes arising from their comments are similar to those that have been raised by ethicists and suggest that recognising the time and effort of participants should receive greater emphasis than presently occurs. Corporate psychopathy thrives perhaps as the most significant threat to ethical corporate behaviour around the world. We argue that Human Resources Management professionals should formulate strategic solutions metaphorically by balancing what strategic military planners famously call ‘Search and Destroy’ and ‘Hearts and Minds’ counter-terrorist strategy. We argue that these military metaphors offer creative inspiration to help academics and practitioners theorise CP in richer, more reflective and more balanced and complementary ways. An appreciation of both metaphors is likely to favour the (...) use of hybrid strategies comprising SD and HM elements, which may provide the best HRM solutions to CP for the same reasons as the military now considers parallel hybrid solutions optimal for combating terrorist and guerrilla insurgency. Gender stereotype theory suggests that men are generally perceived as more masculine than women, whereas women are generally perceived as more feminine than men. Several scales have been developed to measure fundamental aspects of gender stereotypes (e.g., agency and communion, competence and warmth, or instrumentality and expressivity). Although omitted in later version, Bem's original Sex Role Inventory included the items “masculine” and “feminine” in addition to more specific gender-stereotypical attributes. We argue that it is useful to be able to measure (...) these two core concepts in a reliable, valid, and parsimonious way. We introduce a new and brief scale, the Traditional Masculinity-Femininity (TMF) scale, designed to assess central facets of self-ascribed masculinity-femininity. Studies 1–2 used known-groups approaches (participants differing in gender and sexual orientation) to validate the scale and provide evidence of its convergent validity. As expected the TMF reliably measured a one-dimensional masculinity-femininity construct. Moreover, the TMF correlated moderately with other gender-related measures. Demonstrating incremental validity, the TMF predicted gender and sexual orientation in a superior way than established adjective-based measures. Furthermore, the TMF was connected to criterion characteristics, such as judgments as straight by laypersons for the whole sample, voice pitch characteristics for the female subsample, and contact to gay men for the male subsample, and outperformed other gender-related scales. Taken together, as long as gender differences continue to exist, we suggest that the TMF provides a valuable methodological addition for research into gender stereotypes. (shrink)

The increasing availability of large cross-national datasets enables researchers to integrate micro and macro levels of relations between human values and behavior. Particularly interesting are interactions between personal and cultural levels which can demonstrate to what extent a specific behavior is affected by individual values and cultural context. In this study, we aimed to shed light on this issue by analyzing data on basic values and drinking behavior from 21 national representative samples of the European Social Survey (2014). The results (...) of multilevel regressions showed that country-level effects of Openness to Change (vs. Conservation) or Self-Transcendence (vs. Self-Enhancement) were not significantly related to frequency of drinking. As expected, individual-level Openness to Change (vs. Conservation) was consistently positively related to drinking frequency, whereas Self-Transcendence (vs. Self-Enhancement) was not. Contrary to our hypothesis, there was a positive association between personal Self-Transcendence (vs. Self-Enhancement) values and frequency of drinking in countries putting higher importance on extrinsic motivations (i.e., Conservation or Self-Enhancement values), while this link was less positive or even negative in countries valuing intrinsic motivations (i.e., Openness to Change or Self-Transcendence values). Moreover, a marginally significant interaction between individual- and country-level Openness to Change (vs. Conservation) values supported the same counter-intuitive result. These findings challenge the widespread idea that more conservative societies attenuate the link between personal values and behavior. In contrast, self-affirmation and cultural rewards theories, as well as culture-specific value instantiations, may explain these results. This study shows that the value-behavior link differs across cultures, yet in a more complex way than was assumed so far. This opens up new possibilities for research on values and behavior in a cross-cultural context. (shrink)

There are many ways that biological theory can inform ethical discussions of genetic engineering and biomedical enhancement. In this essay, we highlight some of these potential contributions, and along the way provide a synthetic overview of the papers that comprise this special issue. We begin by comparing and contrasting genetic engineering with programs of selective breeding that led to the domestication of plants and animals, and we consider how genetic engineering differs from other contemporary biotechnologies such as embryo selection. We (...) go on to consider the implications of genetic engineering for human nature, human evolution, and persistence of the human species. Finally, we question whether genetic interventions warrant the extraordinary ethical scrutiny they are often given, and we show how the misleading “genetic blueprint” metaphor has imposed a faulty structure on the enhancement debate. We conclude by considering the nature of biological development and the sobering limits it places on what genetic engineering can reasonably hope to achieve. (shrink)

Consequently we see that Socrates assigns to poetry a crucial importance; by their imitation of it, poetry shapes the citizens with an initial formation, casts them within a certain orientation, and places them on a path leading in an already conceived direction, toward some unarticulated good. Over one-third of older adults in many countries have a companion animal, and pets may harbor health-promoting potential. Few studies have considered pet-ownership in relation to economic vulnerability, and pet-ownership has not been often considered within policy efforts to promote ageing-in-place. We conducted a mixed methods case study to understand perspectives of both community agencies that support ageing-in-place and older adults themselves. A shortage of affordable, appropriate pet-friendly housing emerged as a challenge, even when framed as a legitimate choice and (...) preference for many older adults. In this manuscript, we share the trajectories of three economically vulnerable older adults whose affordable housing needs became entangled with commitments to pets. Guided by dialogical narrative methodology, we offer each narrative as a short vignette to illustrate the extent to which older adults will practice ‘more-than-human solidarity’ for a pet, even when their own well-being is compromised as a result; and highlight incongruence between the underlying moral values that shape solidaristic practices of individuals versus solidaristic arrangements that shape affordable housing opportunities. We suggest that housing rules and legislation that disrupt, rather than confirm, more-than-human solidarity may render older adults susceptible to, rather than protected from, deteriorating physical, mental and social well-being. We propose that collective solidaristic practices must reflect and subsume the moral complexity of solidarity practiced by individuals, to enable fair and equitable ageing-in-place. (shrink)

Slaman and Wehner have constructed structures which distinguish the computable Turing degree 0 from the noncomputable degrees, in the sense that the spectrum of each structure consists precisely of the noncomputable degrees. Downey has asked if this can be done for an ordinary type of structure such as a linear order. We show that there exists a linear order whose spectrum includes every noncomputable Δ 0 2 degree, but not 0. Since our argument requires the technique of permitting below a (...) This volume of Bertrand Russell's Collected Papers finds Russell focused on writing Principia Mathematica during 1905–08. Eight previously unpublished papers shed light on his different versions of a substitutional theory of logic, with its elimination of classes and relations, during 1905-06. A recurring issue for him was whether a type hierarchy had to be part of a substitutional theory. In mid-1907 he began writing up the final version of Principia , now using a ramified theory of types, and (...) eleven unpublished drafts from 1907-08 deal with this. Foundational theories of the public sphere prioritize civic speech while distrusting forms of visuality. As a corrective to this model of the public sphere, rhetorical theorists have recently emphasized visuality as a constitutive mode of contemporary public culture, but they nevertheless tend to prioritize the civic actor over the civic spectator. A productive alternative would begin to distinguish an emerging shift from “deliberative publicity” to “photographic publicity.” The bourgeois public sphere innovated verbal communicative practices that produced a specifically deliberative publicity, (...) enabling one resolution to the core political problems of an earlier (feudal) era. Likewise, contemporary publics utilize emerging digital technologies to produce a specifically photographic publicity, allowing them to address fundamental limitations of the bourgeois public sphere. Photographic publicity helps us rethink the problem of the public sphere in terms of theatricality and civic spectatorship. (shrink)

In “On the Life of thinking in Aristotle’s De Anima,” the author offers an interpretation of the tripartite structure of the unified soul in Aristotle’s text. The principleactivity that unities the nutritive, sensuously perceptive and noetically perceptive parts of the soul into a single, continuous entity is shown by our author to be genesis (or the sexual begetting of offspring). After establishing this observation, the paper provides the textual grounds to understand how both sensuous and noetic perception can be understood (...) as a kind of embodied genesis. A further consequence of this argument will be an interpretation of “thinking,” of noetic perception, as a kind of open and passive reception of the primary forms of other beings. As such, Aristotle’s conception of thinking, qua nous, is a refreshing, if strange, contrast to the more common modern vision of “thinking” as the activity of an agent mentally seizing hold of beings in the service of the mastery of nature. This essay pursues an interpretation of epagôgê in Aristotle in order to challenge the current claims in the scholarship that Aristotle’s method of discovery is, on the one hand, empirical or, on the other hand, a priori. In contrast to these claims, this essay offers a reading of the Analytica in conjunction with the Physics in order to propose the following: if we are to think through Aristotle’s method of discovery, we must first unhinge ourselves from the oppositional paradigm of (...) empirical contra conceptual. Through the example of Aristotle’s inquiry into nature, it is shown that Aristotle’s method of discovery is, at once, one intimately betrothed to “conceptual” (or, more properly, “dialogical”) resources, while also subtended by a comportment itself wakeful and perceptive of the being undergoing inquiry. This article considers current advances in tattooing that are challenging community-held views of authorship and ownership, and the need to address this tension. The key challenge is from AI-generated artworks being used as tattoo designs, but the authorial role of the tattooist is also challenged by body art projects such as tattoo collection. Legal clarity for tattooing is lacking, and in addressing this, this article advocates for an open, community-based form of shared copyright ownership and authorship for projects as tattoo (...) collecting, drawing on Dusollier’s and Mendis’ work. This article contributes to both copyright and cultural heritage legal scholarship, and to tattooing scholarship and the tattooing community. AI-generated art being tattooed on people has not been explored in the literature to date, and this article fills this gap. Furthermore, this article contributes a pilot study of the tattoo community’s views on AI-generated tattoos, which is currently lacking from the scholarly debate on AI-generated art. This article argues that the debate within the tattoo community about AI-generated art being used in tattoos needs to be addressed within the community through agreed extra-legal norms, which may well depart from how copyright law decides to approach AI-generated art globally. This article also asserts that AI should _not_ be regarded as the “author” of tattoo works in the traditional copyright sense, as only a human tattooist can draw from a number of cultural, textual, audiovisual and visual, cultural folklore, history and mythical references in creating their tattoo designs, as well as drawing on the client’s personal stories. This article explores the following: (i) an understanding of tattooing as an artform; (ii) tattoos in UK copyright law; (iii) an exploration of the authorial role of the tattooist within tattooing; (iv) the authorial role of the tattooist within tattoo collecting; (v) AI-generated tattoos—perspectives from the tattoo community, through a pilot study of YouTube videos and viewer comments about this; and (vi) a consideration of whether copyright legal reform is the solution for the tattooing community. Our target article concerns the direction and growth of enactivism, a framework portrayed as a revolutionary shift in understanding cognition. While enactivism continues to be a lively position, it is unclear how its contributions relate to the cognitive sciences. Despite some empirical successes, enactivism remains somewhat insulated as a theoretical position and as a research program. There exists a discrepancy between enactivist aims and delivery. The basis of this problem, we argue, is that the overall objective of enactive theorising is (...) not clear, which has led to diverging strategies for implementation and integration with the cognitive sciences. We review contributions from different strains of enactivism – autopoietic, sensorimotor and radical – and their research goals, both tacit and explicit. We show that enactivism is productively understood as two projects we term utopian enactivism and scientific enactivism. Utopian enactivism aims to develop a philosophically defensible lens through which cognitive science is to be viewed. Scientific enactivism intervenes in scientific practice by contributing to the implementation of enactive ideas. Once disentangled, the utopian and scientific projects have important but independent tasks. Utopian enactivism is useful for building a coherent and defensible enactive philosophy of nature, while scientific enactivism is free to draw upon and contribute to non-enactive approaches in the cognitive sciences. We aim to motivate discussions that will enhance enactivism’s progress, and our reappraisal also offers a clear and explicit roadmap for renewing advances in enactivist philosophy and cognitive science. Graphic justice and the law of aesthetics have in very recent years successfully brought law, aesthetics and comics scholarship into the same space. The culture of copyright infringement within comics (including in the Marvel, DC, and Disney universes) has been extensively in the literature by scholars including Saval. How copyright law is portrayed within the graphic novels and comics themselves is the focus (and contribution of) this article. This article will explore several comics and graphic novels, as well as included (...) this author’s reflections of portraying copyright visually within zines for public dissemination. Throughout this article, the discourses of ghosts and spectres that are interwoven with copyright law and haunt the texts will be seen, as will the discourses of oppression and warfare that are involved for anyone seeking to make use of copyright works. As Gómez Romero and Dahlman note, comics offer “an alternative legal discourse” and we can see these alternative legal discourses through their aesthetic graphic form. This article will consider: the aesthetic portrayal of copyright law in A Gift for a Ghost and Josie and the Pussycats No. 6; as well as Bound by Law, Theft! A History of Music, and Pictures within Pictures. These comics and graphic novels have been chosen as they aesthetically portray copyright law and copyright infringement (referred to in some of the comics as “plagiarism”), and others aesthetically portray the public domain and fair use. In viewing these aesthetic manifestation of copyright law, the reader understands the limiting nature of copyright on creative freedoms, and that copyright law’s power is absolute. This article will explore the following: (i) copyright’s aesthetic portrayals and the impact of this; (ii) comics haunted by copyright law, considering A Gift for A Ghost and Josie and the Pussycats; (iii) comics about the necessity of the public domain and fair use, considering Bound by Law, Theft! A History of Music, and Pictures within Pictures; and (iv) self-reflections on portraying copyright aesthetically in publicly disseminated research zines. This article has not set out to determine that certain visual aesthetic portrayals are “correct” or “better”, but rather to explore how legal discourses and narratives about copyright law are circulated through the comics medium. These visual depictions hold considerable weight, and it is striking to see similar narratives used across a range of comics works, with different intended audiences. What is clear is that the visual depiction of copyright law enables a greater ability to convey the multiple copyright law discourses that can be felt at once, and also to highlight that some of these discourses are contradictory to one another. Globally, nationally and locally men's violence against women is an endemic social problem and an enduring human rights issue within all societies and cultures. Challenging attitudes that condone violence both at the individual and community level is a key priority in its prevention. This paper brings together findings from two separate studies based on children's and young people's understandings of men's violence against women. Both studies were located in Glasgow, Scotland, and used qualitative methods to explore children's and young people's (...) views of men's violence against women. The two studies, conducted nearly ten years apart, involved children aged 11 and 12 and young people aged 15 to 18. Despite the differences in age and the interval between them, there are remarkable similarities identified within both studies centring around children and young people's normalisation of men's violence against women. This paper presents a discussion of three of the key themes identified from these studies: the construction of men's violence; gender roles and the naturalisation of difference; and the normalisation of men's violence. In both studies the techniques of normalisation were employed by the participants to minimise both the seriousness of the violence and the significance of it to the victims. The findings clearly illustrate the widespread justification of gendered violence by both boys and girls. Thus, while the development and implementation of domestic violence/abuse education programmes need to take into account gender differences, targeting only boys’ attitudes fails to acknowledge an important component in reducing domestic violence/abuse: the internalisation of patriarchal norms by girls and women. The physical distancing measures necessitated by COVID-19 have resulted in a severe withdrawal from the patterns of daily life, necessitating significantly reduced contact with other people. To many, such withdrawal can be a major cause of distress. But, to some, this sort of withdrawal is an integral part of growth, a pathway to a more enriching life. The present study uses a sequential explanatory QUAN-qual design to investigate whether people who felt that their lives had changed for the better after (...) being forced to engage in physical distancing, what factors predicted such well-being, and how they spent their time to generate this sense of well-being. We invited 614 participants who reported closely following physical distancing recommendations to complete a survey exploring this topic. Our analyses, after controlling for all other variables in the regression model, found a greater positive association between presence of meaning in life, coping style, and self-transcendent wisdom and residualized current well-being accounting for retrospective assessments of well-being prior to physical distancing. An extreme-case content analysis of participants' personal projects found that participants with low self-transcendent wisdom reported more survival-oriented projects (e.g., acquiring groceries or engaging in distracting entertainments), while participants reporting high self-transcendent wisdom reported more projects involving deepening interactions with other people, especially family. Our findings suggest a more nuanced pathway from adversity to a deeper sense of well-being by showing the importance of not merely coping with adversity, but truly transcending it. (shrink)

Human pain experience and expression evolved to serve a range of social functions, including warning others, eliciting care, and influencing interpersonal relationships, as well as to protect from physical danger. Study of the relatively specific, involuntary, and salient facial display of pain permits examination of these roles, extending our appreciation of pain beyond the prevalent narrow focus on somatosensory mechanisms.

Since the 1990s, glycated haemoglobin (HbA1C) has been the gold standard for monitoring glycaemic control in people diagnosed as having either type 1 diabetes mellitus (T1DM) or type 2 diabetes mellitus (T2DM). Discussions are underway about diagnosing diabetes mellitus on the basis of HbA1C titres and using HbA1C tests to screen for T2DM. These discussions have focused on the relative benefits for individual patients, with some attention directed towards reduced costs to healthcare systems and benefits to society. We argue that (...) there are strong ethical reasons for adopting HbA1C-based diagnosis and T2DM screening that have not yet been articulated. The rationale includes the differential impact of HbA1C-based diabetic testing on disadvantaged groups, and what we are beginning to learn about HbA1C vis-à-vis population health. Although it is arguable that screening must primarily benefit the individual, using HbA1C to diagnose and screen for T2DM may promote a more just distribution of health resources and lead to advances in investigating, monitoring and tackling the social determinants of health. La réglementation européenne prévoit une évaluation des risques par les entreprises qui souhaitent (continuer de) produire et mettre sur le marché des pesticides et des substances chimiques industrielles. Cette information est produite par les industriels eux-mêmes et soumise à une évaluation par les agences nationales et européennes qui sont responsables de la mise en œuvre de ces réglementations (en France, l'ANSES , en Europe, l'EFSA et respectivement l'ECHA ). L'accès à ces informations soumises par les industriels et analysées par les (...) agences est essentiel pour s'assurer de la meilleure qualité de l'évaluation de ces risques. Les conséquences des évaluations du risque chimique touchent potentiellement des parties importantes de la population, car de nombreuses substances chimiques sont présentes dans nos vies. Il est donc important d'être capable d'assurer, par une veille collective, que ces évaluations soient réalisées de la meilleure manière possible et sur la base de données et méthodes scientifiques vérifiables. L'accès à l'information est fondé sur des principes généraux de transparence et de responsabilité des administrations de manière à faciliter la participation du public au processus démocratique et au contrôle des activités qui les concernent directement. Limiter l'accès à l'information revient à donner le pouvoir à certains acteurs d'influencer ces évaluations et pas à d'autres. Des questions de contrôle démocratique, d'équité et de justice évidentes se posent si l'exercice de ce pouvoir est d'une part donné aux acteurs industriels qui deviennent juges et parties (leur activité doit être régulée sur la base des informations qu'ils produisent eux-mêmes) et est d'autre part rendu difficile voire refusé aux acteurs de la société civile qui peuvent subir les effets des substances chimiques. Malheureusement aujourd'hui, différents facteurs restreignent l'effectivité du droit à l'information environnementale sur les risques chimiques et facilitent dans certains cas une telle injustice : * l'éclatement et le manque de lisibilité des textes encadrant cet accès à l'information, * les limitations juridiques au principe de liberté d'information qui ont été intégrés dans ces mêmes textes afin de défendre les intérêts des industriels, * les réticences administratives et la difficulté pratique des procédures et des recours, * et enfin les limitations pratiques à la compréhension et à l'utilité des données. La réutilisation des données en dehors de la plateforme Facebook a été beaucoup discutée selon l'angle de la vie privée et de la nécessité d'un consentement préalable à la circulation et au traitement des informations personnelles. Les changements de réglages ont révélé au grand public que les conditions d'utilisation du réseau permettent de transférer les données des utilisateurs à des entreprises, la licence octroyée à Facebook étant transférable. A force d'abus répétés sur le terrain de la vie privée, le débat (...) à propos de Facebook ignore largement la question de l'appropriation des données et de leur partage volontaire. Le contrôle du partage s'effectue de manière restrictive dans les réglages de la plateforme, en vue de ne pas autoriser l'accès et la réutilisation par certaines personnes et applications extérieures. Mais le choix de permettre leur rediffusion en dehors du profil personnel semble absent. En effet, le contrôle peut également être envisagé de manière positive, comme le fait d'autoriser d'autres personnes et applications à réutiliser les données. Adverse events that harm patients can also have a harmful impact on health care workers. A few health care organizations have begun to provide psychological support to these Second Victims, but there is uncertainty over whether these discussions are admissible as evidence in malpractice litigation or disciplinary proceedings. We examined the laws governing the admissibility of these communications in 5 states, and address how the laws might affect participation in programs designed to support health care workers involved in adverse events. (...) We found that privilege is uneven from stateto- state, and also unclear. Ambiguity alone could have a chilling effect on Second Victim programs. We propose legislation to protect volunteer and health care worker communications provided by peer counselors, or failing this, updating of statutory provisions to explicitly include these communications within the ambit of existing protections. Enhancing protections could help to foster an environment of healing for both patients and caregivers. (shrink)

The harmful impact of an adverse event ripples beyond injured patients and their families to affect physicians, nurses, and other health care staff that are involved. These “Second Victims” may experience intense feelings of anxiety, guilt, and fear. They may doubt their clinical competence or ability to continue working at all. Some go on to suffer post-traumatic stress disorder and depression.Medical institutions long ignored this problem, preferring to believe that adverse events, or “errors,” occur due to incompetence — the unfortunate (...) work of a few “bad” practitioners who deserve, if anything, a reprimand for their negligence. Study after study has rejected this attribution and shown that adverse events in health care stem primarily from systemic flaws, not “bad apples.” Devastating errors, in other words, can, do, and always will happen in the care of competent, well-trained, and caring practitioners.
