Ludwig Wittgenstein, who died in Cambridge in 1951, is one of the most powerful influences on contemporary philosophy, yet he shunned publicity and was essentially a private man. “Marx did not reject the idea of a human nature. He was right not to do so.” That is the conclusion of this passionate and polemical new work by Norman Geras. In it, he places the sixth of Marx’s Theses on Feuerbach under rigorous scrutiny. He argues that this ambiguous statement—widely cited as evidence that Marx broke with all conceptions of human nature in 1845—must be read in the context of Marx’s work as a whole. The rapidly increasing numbers of elderly people in our society have raised some important moral questions: How should we distribute social resources among different age groups? What does justice require from both the young and the old? Some people will confront Alzheimer's with a measure of resignation, a determination to struggle against the progressive debilitation and to extract whatever comforts and benefits they can from their remaining existence. They are entitled to pursue that resolute path. For other people, like myself, protracted maintenance during progressive cognitive dysfunction and helplessness is an intolerably degrading prospect. The critical question for those of us seeking to avoid protracted dementia is how best to accomplish that objective.One strategy is to engineer one's (...) own death while still mentally competent to do so (even in the stage of mild dementia). If I were to use a preemptive strategy in the face of a dementia diagnosis, I would probably choose to stop eating and drinking, a process known as voluntarily stopping eating and drinking. An alternative tactic for avoiding prolonged dementia would be to allow oneself to decline into moderate dementia—thus losing capacity to perform self‐deliverance or even to make serious medical decisions—but before getting to that point to provide advance instructions rejecting prospective life‐sustaining medical interventions. These advance instructions would authorize palliative but not curative measures. My current personal instructions define the point of intolerable cognitive decline triggering medical nonintervention as “mental deterioration to a point when I can no longer read and understand written material such as a newspaper or financial records such as a checkbook.” These instructions dictate allowing my demise at a point of moderate dementia when I may not be perceptibly suffering, when I may still be getting some rudimentary satisfaction from my debilitated life, and when I no longer recall the preoccupation with personally intolerable indignity that motivated my instructions. Can I expect that my advance instructions will be implemented in those circumstances? Is it lawful, and is it moral for a surrogate decision‐maker and associated caregivers to allow an uncomprehending, ostensibly content but demented individual to die? My analysis herein contends that it is not only lawful and moral but also legally required to implement clear, considered advance instructions even at a stage of moderate dementia. (shrink)

Fenton et al. present a Bayesian‐network analysis of the case, using their previously developed set of building blocks (‘idioms’). They claim that these idioms, combined with their opportunity‐based method for estimating the prior probability of guilt, reduce the subjectivity of their analysis. Although their Bayesian model is less cognitively feasible than scenario‐ or argumentation‐based models, they claim that it does model the standard approach to legal proof, which is to continually revise beliefs under new evidence.

I analyze the hierarchy of large cardinals between a supercompact cardinal and an almost-huge cardinal. Many of these cardinals are defined by modifying the definition of a high-jump cardinal. I organize these cardinals in terms of consistency strength and implicational strength. I also analyze the superstrong cardinals, which are weaker than supercompact cardinals but are related to high-jump cardinals. Among the results, I highlight the following. Vopěnka cardinals are the same as Woodin-for-supercompactness cardinals.There are no excessively hypercompact cardinals.Furthermore, I prove some results relating high-jump cardinals to forcing, as well as analyzing Laver functions for super-high-jump cardinals. The studies that make up this book were written and brought together to honor the memory of Jan Pinborg. His unexpected death in 1982 at the age of forty-five shocked and saddened students of medieval philosophy everywhere and left them with a keen sense of disappoint ment. In his fifteen-year career Jan Pinborg had done so much for our field with his more than ninety books, editions, articles, and reviews and had done it all so well that we recognized him (...) as a leader and counted on many more years of his scholarship, his help, and his friendship. To be missed so sorely by his international colleagues in an academic field is a mark of Jan's achievement, but only of one aspect of it, for historians of philosophy are not the only scholars who have reacted in this way to Jan's death. In his decade and a half of intense productivity he also acquired the same sort of special status among historians of linguistics, whose volume of essays in his memory is being G. L. Bursill-Hall almost simultane published under the editorship of ously with this one. Sten Ebbesen, Jan's student, colleague, and successor as Director of the Institute of Medieval Greek and Latin Philology at the University of Copenhagen, has earned the gratitude of all of us by memorializing Jan 1 in various biographical sketches, one of which is accompanied by a 2 complete bibliography of his publications. _William of Sherwood's Introduction to Logic _ was first published in 1966. Minnesota Archive Editions uses digital technology to make long-unavailable books once again accessible, and are published unaltered from the original University of Minnesota Press editions. The _Introduction to Logic _ by William of Sherwood, of which this is the first English translation, is the oldest surviving treatise which contains a treatment of the most distinctive and interesting medieval contributions to logic and semantics. Sherwood was a master at Oxford (...) and Paris in the thirteenth century and the author of several logical treatises. Besides presenting material of interest in its own right, this volume is useful as an introduction to the study of those aspects of medieval philosophy that are most pertinent to the interests of contemporary philosophers. High-profile corporate scandals earlier in this decade provoked outrage and legislative action; however, corporate executive-level ethical lapses continue to come to light. This article examines the work of Professor Dunfee and his coauthors on corruption, ethical leadership, and social contracts theory, and relates that literature to corrupt activities by corporate executives. Corruption is defined broadly to encompass executive self-dealing, which harms their firms. The specific example of stock options backdating is used to show the harmful impact on shareholders and the (...) lack of managerial integrity though consequentialist, deontological, and legal analysis, as well as a critique of the practice using social contracts principles. Ultimately, this article utilizes the insights of Dunfee and his coauthors, and the lessons from the backdating example, to propose a framework aimed at improving corporate governance and preventing future executive corruption. The framework includes a strategy of identification and prevention, employing detection and eradication mechanisms, and institutional learning from past instances of corporate corruption. (shrink)

Eleonore Stump argues in her article in this volume that Aquinas’s theory of knowledge is not classical foundationalism, as it has sometimes seemed to be, but, instead, a version of reliabilism. I'm convinced that her thesis is important and well-supported, and it has led me to begin a re-examination of one aspect of Aquinas’s theory of knowledge from the new viewpoint Stump’s work provides. I think the results tend to confirm her account while revealing further details of Aquinas’s reliabilism.My topic (...) is not reliabilism itself. Instead, I am focusing on Aquinas’s account of the reliability of the fundamental operations of the two human cognitive faculties, sense and intellect. Accounts of cognitive reliability have a place in most theories about the justification of belief, of course, and so they are found in more than one sort of epistemology; but reliabilism might be said to need them most. Richard Kilvington was an obscure fourteenth-century philosopher whose Sophismata deal with a series of logic-linguistic conundrums of a sort which featured extensively in philosophical discussions of this period. Originally published in 1990, this was the first ever translation or edition of his work. As well as an introduction to Kilvington's work, the editors provide a detailed commentary. This edition will prove of considerable interest to historians of medieval philosophy who will realise from the evidence presented here that Kilvington deserves to (...) be studied just as seriously as Duns Scotus or William of Ockham. Contemporary Islam presents Europe in particular with a political and moral challenge: Moderate-progressive Muslims and radical fundamentalist Muslims present differing visions of the relation of politics and religion and, consequently, differing interpretations of freedom of expression. There is evident public concern about Western “political correctness,” when law or policy accommodates censorship of speech allegedly violating religious sensibilities. Referring to the thought of philosopher Baruch Spinoza, and accounting for the Universal Declaration of Human Rights, the Universal Islamic Declaration of Human Rights, (...) and various empirical studies on the religious convictions of Muslims, it is argued here that: (1) sovereign European state powers should be especially cautious of legal censorship of speech allegedly violating Muslim religious sensibilities; and (2) instead of legal moves to censorship, European states should defer to the principle of separation of religion and state (political authority). Further, a reasonable interpretation of Islamic jurisprudence allows that matters of religious difference may be engaged and resolved by appeal to private conscience and ethical judgment, rather than by appeal to public law per se. In so far as they are 1 representative of contemporary scholarship, the interpretative positions of Ziad Elmarsafy, Jacques Derrida, and Nasr Abū Zayd are presented in illustration of this latter point. Here is the final volume of Norman O. Brown's trilogy on civilization and its discontents, on humanity's long struggle to master its instincts and the perils that attend that denial of human nature. Following on his famous books _Life Against Death_ and _Love's Body_, this collection of eleven essays brings Brown's thinking up to 1990 and the fall of Communism in Eastern Europe. Brown writes that "the prophetic tradition is an attempt to give direction to the social structure precipitated (...) by the urban revolution; to resolve its inherent contradictions; to put an end to its injustice, inequality, anomie, the state of war... that has been its history from start to finish." Affiliating himself with prophets from Muhammad to Blake and Emerson, Brown offers further meditations on what's wrong with Western civilization and what we might do about it. Thus the duality in his title: crisis and the hope for change. In pieces both poetic and philosophical, Brown's attention ranges over Greek mythology, Islam, Spinoza, and _Finnegan's Wake_.
