Can we coherently conceive of an agent whose practical rationality is limited to merely instrumental reasoning? I argue that we cannot. Existing arguments to this effect have focused on what is required in order to have reasons to take means to our ends-or on what is required in order to be bound by the so-called ‘instrumental principle’. By contrast, I argue that consideration of the special kind of concept-use characteristic of instrumental reasoning reveals that a merely instrumentally rational agent would (...) not be so much as able to identify means to ends in the first place. I then elucidate this line of thought by testing it against three different conceptions of merely instrumentally rational agency found in the literature. I conclude by highlighting a risk associated with remaining agnostic concerning the possibility of merely instrumentally rational agents: namely, that we arrive at a false conception of our own capacity to identify means to ends as somehow isolated from our conceptions of the good. Elizabeth Anscombe introduced the notion of “practical knowledge” into contemporary philosophy. Philosophers of action have criticized Anscombe’s negative characterization of such knowledge as “non-observational,” but have recently come to pay more attention to her positive characterization of practical knowledge as “the cause of what it understands.” I argue that two recent Anscombean accounts of practical knowledge, “Formalism” and “Normativism,” each fail to explain the productive character of practical knowledge in a way that secures its status as non-observational. According to a dominant assumption the truth of instrumental thoughts—thoughts in which one action is identified as a means to another—are not affected by agents’ normative conceptions of their ends. Agents could in principle grasp these thoughts, and thereby the correct means to their ends, without consulting any conception they may have as to the pursuit-worthiness of those ends. I argue this assumption (the ‘Theoretical Conception’) prevents us from explaining how agents can identify means to their ends. I sketch an (...) alternative account according to which the contents of instrumental thoughts are directly determined by agent's reasons for acting. This is explained by the fact that an agent's reasons for action reveal what they take the good of their ends to be. Three experiments investigated the hypothesis that internally generated images and thoughts were driven by meaning complexes, a construct which reflects a synthesis of semantic meaning and personal salience . Experiments 1 and 2 contrasted the mutual inhibition between encoding words and non-words on: the frequency that thoughts and images unrelated to the task were experienced and on the intensity of images generated from long-term memory and maintained under dual task conditions, which whilst familiar were not of particular personal salience . (...) Experiment 3 examined the physiological arousal associated with the experience of TUT in a semantic encoding task. Evidence suggested that, in general, internally generated images and thoughts, irrespective of the personal salience, were suppressed by the co-ordination of information in working memory. In addition, only the experience of spontaneous images and thoughts of personal salience interfered reliably with the encoding/retrieval of semantic information from memory. Finally, in Experiment 3, physiological arousal, as indexed by mean heart rate, was associated with a high frequency of TUT. The results of all three experiments support the notion that the maintenance of spontaneously occurring images and thoughts is simultaneously influenced by both the semantic content and the personal salience of the information held in working memory. Human rights law proclaims that all persons are the same, and have the same rights. Yet this revolutionary claim, which has overturned political regimes and confounded conventions, has itself been criticised. The criticisms have often come from a non-legal disciplinary background - anthropology, philosophy, sociology or others. Sceptics, postmodernists, feminists, cultural relativists and multiculturalists argue that this universalist view is too simple, or even invidious and oppressive and should be rejected. This chapter explores the universalist pretensions of human rights, the (...) criticisms of this universalism, the legal modification of the simple universalist claim and finally discusses a proposal to resolve some of the tensions between these views. Constitutional adjudication straddles law and politics, legal and political theory. Referring to legal controversies in Canada (free expression), Ireland (sexual morality) and Italy (religion), this book examines how constitutional judgements rely upon unarticulated political commitments. This interaction between "law" and "morality" allows us to escape the dichotomy of natural law versus positivism in a time when judges increasingly act as moral guardians.

This article discusses the role of moral argument in the Constitutional case law of the Irish courts. It looks at the debate on the constitutional morality of sexuality in four major cases: a 1973 case protecting the right to use contraceptives; a 1984 case which upholds discrimination against gay men; a 1987 case limiting access to abortion information; and a 1992 case which finds a limited right to abortion in the Constitution. These cases show the role of the courts in (...) contributing to a debate on political morality, both proposing new visions of political morality, and elaborating on the requirements of the current one. This case note discusses the case of Baczkowski v. Poland in the European Court of Human Rights. The Court ruled that, where an elected mayor makes comments disapproving of homosexuality, and officials subsequently ban a Gay Pride march, then courts may be able to infer that the ban was discriminatory under Article 14 ECHR.

The European Court of Human Rights ("ECtHR") has a distinguished track record. Established under the European Convention on Human Rights 1950 ("ECHR"), it was the world's first international human rights court. It decides thousands of cases every year, and its opinions are cited world-wide. For most of its history, the Court's jurisprudence on equality was uninspiring, as it was based on a formal conception of equality. In recent years, however, the ECtHR has begun to give equality more substantive content.

This paper discusses how a Platform for Philosophy Education can help to alleviate issues of alienation in the lives of university students. This is done through various personal cultivation and community building activities in the Academic Philosophy Café. The activities draw from philosophical traditions, including traditions with religious or “spiritual” elements. These encourage reflection on one’s place in the world. In addition, students and teachers cooperate to ensure the smooth running of the café and activities, which strengthens the community bond. (...) There is thus a “spiritual contract” formed between participants. In contrast to a written contract that binds parties by means of explicit rewards or sanctions, a “spiritual contract” is built on mutual understanding that higher-level needs will be met through the process of cooperation. Based upon this, a community is established that nourishes the lives of those on campus, benefits their wellbeing and strengthens their capacity to learn effectively. (shrink)

William James’s category of “first-hand religion” allows us to arrive at the religious from an internal and individual perspective, including in those activities and phenomena usually considered secular. B. B. King’s 1972 performance at Sing Sing Prison, documented by David Hoffman, brings both the prisoner audience and the performers to an “additional dimension” distinct from the hollowness of everyday (prison) life. In addition, the presence of this intense experience on the YouTube platform creates a fluid community of second-order observers, bound (...) not by any overarching belief but by observation of the experience itself. King’s performance is in the genre of blues music, which, in turn, has associations with African religious traditions. While the study of diverse religious traditions helps inform our understanding of the kinds of activities that might constitute the religious, this study takes individual experience as primary rather than as a manifestation of a particular tradition. In addition to the classical mode of classroom philosophy education that focuses on the history of philosophical thinking, methods of “doing” and “using” philosophy, including philosophical practice and philosophical drama can also form part of philosophy education. Such thinking and language exercises are introduced into activities of the academic philosophy cafe, Inner Mongolia University’s 1957 Coffee. Based on core activities of the philosophy cafe as well as the concept of “language game”, an additional language training project is being designed for (...) bilingual participants and language learners, especially for students in secondary education. A two-pronged approach of linguistic and philosophical foci encourages learners to sharpen their minds to the use of languages in the academic world. (shrink)

This essay focuses on A Brief Response on the Controversies over Shangdi, Tianshen and Linghun by Niccolò Longobardo (1559–1654), a text that played a crucial role in the formation of European understanding of Chinese philosophy. Taken historically, the text is an important vehicle for the transmission of Chinese concepts into early modern European philosophy as well as a key intervention in the debate shaping the ideological premises of the Jesuit mission in China. It contains one of the first systematic accounts (...) of Chinese philosophy written by a European author. More importantly, it presents a narrative that links Mediterranean and Chinese intellectual history into a single historical current. In this way Longobardo plays a role analogous to the mapmaker who distorts three-dimensional spaces in order to project them together onto a two-dimensional plane. We present some of the peculiar shifts and emphases made by Longobardo in his reading of what seems to him a transhistorical current linking the Chinese and ancient Mediterranean philosophical milieus. In particular, we examine (1) the relationship between Longobardo’s attempt to situate Chinese thought in a global context and the choice to place special emphasis on the philosophy of Shao Yong 邵雍, treating him as a figure of primary importance among Song 宋 Neo-Confucian authors, and (2) the focus on the monist and cosmogonic aspects of Chinese thought, summarized by the “ten thousand things forming one body” (wanwuyiti 萬物一體) “axiom.”. Philosophy is presented in a wide range of forms, none of which can be convincingly claimed to be the “genuine” one. Historically speaking, there is not one “proper” way of doing philosophy, evidencing what may be called the social contingency of philosophy. This paper aims to provide a “critical” philosophy of today, in the Kantian sense of a philosophy that reflects on the conditions of its possibility, and thereby acknowledges the limitations they impose. Conceptually, our approach is grounded in Niklas (...) Luhmann’s social systems theory, in which “functional differentiation” and “second-order observation” are two crucial characteristics of modern society. The paper discusses how presentations of philosophy align themselves with the second-order observation mechanisms of the specific social systems in which they are “hosted.” This paper deals in particular with two such systems: academics and social media. The title of Gao Xinhua's 高新華 work contains two somewhat distinct elements: "Huang-Lao thought" (huanglao sixiang 黃老思想) and "Warring States to Early Han" (zhanguo zhi Han chu 戰國至漢初). They are distinct insofar as "Huang-Lao" takes on a different meaning when described based on the works of political philosophy--the task of roughly the first half of the book--and when traced through history in the thought of the political elite, as is the focus of the second half. Of course, they are not (...) entirely distinct and to some extent the historical Huang-Lao is a manifestation of the philosophical works. As Gao shows, however, the relationship between the two is far from simple. The book consists of an Introduction, four chapters--each containing three to five sections--and a short Conclusion. Two experiments employed experience sampling to examine the factors associated with a prospective and retrospective focus during mind wandering. Experiment One explored the contribution of working memory and indicated that participants generally prospect when the task does not require continuous monitoring. Experiment Two demonstrated that in the context of reading, interest in what was read suppressed both past and future-related task-unrelated-thought. Moreover, in disinterested individuals the temporal focus during mind wandering depended on the amount of experience with the topic matter—less (...) experienced individuals tended to prospect, while more experienced individuals tended to retrospect. Together these results suggest that during mind wandering participants’ are inclined to prospect as long as the task does not require their undivided attention and raise the intriguing possibility that autobiographical associations with the current task environment have the potential to cue the disinterested mind. This paper examines the role of the United Kingdom in the process of drafting the Universal Declaration of Human Rights (UDHR); and proceeds to discuss the impact the UDHR has had on UK law, politics and society.

In this article, I explain Aquinas' approach to philosophy and theology. I then discuss how Aquinas thought the universe having a beginning is a matter of faith, not reason. I then argue that Aquinas' position is still correct despite the cosmological model of the big bang. Men of faith, I argue, ought to have a notion of God that is based on metaphysics, not a physical model, which at best brings us to a Deistic God.

Three experiments investigated the relationship between subjective experience and attentional lapses during sustained attention. These experiments employed two measures of subjective experience to examine how differences in awareness correspond to variations in both task performance and psycho-physiological measures . This series of experiments examine these phenomena during the Sustained Attention to Response Task . The results suggest we can dissociate between two components of subjective experience during sustained attention: task unrelated thought which corresponds to an absent minded disengagement from the (...) task and a pre-occupation with one's task performance that seems to be best conceptualised as a strategic attempt to deploy attentional resources in response to a perception of environmental demands which exceed ones ability to perform the task. The implications of these findings for our understanding of how awareness is maintained on task relevant material during periods of sustained attention are discussed. (shrink)

Pp. xiii, 197. isbn: 978-0230 -20116-3. £50; us$85. ver the past decade, Graham Stevens has built his reputation as a lucid, durable, and oftentimes ground-breaking historian of analytic philosophy. His latest book, entitled (...) TheTheory of Descriptions: Russell and the Philosophy of Language, will only add to that burgeoning scholarly legacy. If it has not been established already, this book will doubtless cement Stevens’ place amongst the leading Russell scholars in the world today. It may very well herald Stevens ’ arrival on the scene as a noteworthy contributor to contemporary philosophy of language as well. The central goal of the book is “to bring the historical and purely philosophical analyses of [Russell’s] work into closer alignment” (p. 3). Stevens hopes to overcome a “striking disparity” (p. 2) in the ways that Russell’s contributions to the philosophy of language have been conceived by expositors of his philosophy, on the one hand, versus philosophers of language, on the other. In particular, though contemporary philosophers of language would tend to view Russell’s enormous contribution to that subject as being “undeniable” (p. 1), and to be “bewildered” (p. 94) by any suggestion to the contrary, expositors of Russell’s philosophy have nevertheless been at pains to emphasize that Russell “was not engaged in the philosophical study of language” (p. 2). As Stevens notes, this situation is especially puzzling since “these two groups [of scholars] overlap to a considerable extent” (p. 2). Stevens’ strategy for overcoming this disparity is two-pronged. First he aims to tackle, head on, the fallacious arguments of Monk,1 Dummett,2 and others, to the effect that Russell was not engaged in the philosophy of language. In regards to (1), Stevens argues in a word that “[o]rdinary language philosophy has had its day” (p. 176). Over the past several decades, in other words, leading philosophers of language have come to agree with Russell in viewing ordinary language philosophy as “an outdated, and rather eccentric, relic of mid-twentieth century British philosophy” (ibid.).The classic Russell– Strawson debate over the question whether ordinary language lacks an exact logic3 has been settled decisively in Russell’s favour, as philosophers of language have transformed “the attempt to systematically specify the semantics of large regions of natural language” (ibid.) into a “central project” (ibid.). In regards to (2), moreover, Stevens notes that by this line of reasoning, absurdly, David Kaplan would not qualify as a philosopher of language since he “explicitly invokes the Russellian non-linguistic conception of a proposition as the conception appropriate for providing the content of properly context-situated indexical sentences” (p. 170). And, of course, Kaplan is not at all unique amongst contemporary philosophers of language in appealing to a Russellian conception of propositional content, as the examples of Nathan Salmon,4 Scott Soames,5 and many others show. In regards to (3), finally, Stevens argues that Russell’s dim view of natural language was grounded in his conception of logical form as non-linguistic, and that that conception, in turn, derives simply from the poverty of syntactic theory available to Russell, prior to the Chomskyian revolution in linguistics during the second half of the twentieth century. Joint attention occurs when two (or more) individuals attend together to some object. It has been identified by psychologists as an early form of our joint engagement, and is thought to provide us with an understanding of other minds that is basic in that sophisticated conceptual resources are not involved. Accordingly, it has also attracted the interest of philosophers. Moreover, a very recent trend in the psychological and philosophical literature on joint attention consists of developing the suggestion that it holds (...) partially in virtue of communication: it is because we share our thoughts or feelings about an object that our individual attention becomes joint. Examination of the many factors that have shaped ecological thought over the ages and in challenging the basic assumptions of the Western worldview, exposes the fundamental flaws in a system that believes in unlimited economic growth within a finite world and has confused financial worth with the real wealth of the natural systems upon which we are all dependent. Recent research into the evolution of higher cognition has piqued an interest in the effect of natural selection on the ability of creatures to respond to their environment (behavioral plasticity). It is believed that environmental variation is required for plasticity to evolve in cases where the ability to be plastic is costly. We investigate one form of environmental variation: frequency dependent selection. Using tools in game theory, we investigate a few models of plasticity and outline the cases where selection would (...) be expected to maintain it. Ultimately we conclude that frequency dependent selection is likely insufficient to maintain plasticity given reasonable assumptions about its costs. This result is very similar to one aspect of the well-discussed Baldwin effect, where plasticity is first selected for and then later selected against. We show how in these models one would expect plasticity to grow in the population and then be later reduced. Ultimately we conclude that if one is to account for the evolution of behavioral plasticity in this way, one must appeal to a very particular sort of external environmental variation. (shrink)

What do the terms “profession, professional, professionalism” mean in 2002? One dictionary defines profession as “a calling requiring specialized knowledge and often long and intensive academic preparation,” and it defines professionalism as “the conduct, aims, or qualities that characterize or make a profession or professional person.” These definitions are appealingly simple. Complexity arises when we add the term “medical” as in the medical profession, a medical professional, or medical professionalism; and, here a specific understanding of “the conduct, aims, and qualities (...) that characterize” the field of medicine is required. To complicate matters, professionalism applies to both the profession as a whole as well as the individual professional persons, such as the physicians. (shrink)

Companies are increasingly singing up to a range of corporate responsibility codes and other voluntary commitments. Using evidence from the mining industry’s experience with the Australian Greenhouse Challenge, the Minerals Council’s Code for Environmental Management and the ISO14001 Specification for Environmental Management Systems, this article examines whether the outcomes from the adoption of multiple voluntary approaches differ from those outcomes that would be expected if each voluntary approach was adopted in isolation. The article demonstrates that it is feasible for companies (...) to participate in multiple voluntary approaches and to derive benefits such as reduced transaction costs, improved data quality and enhanced implementation. However, there is limited evidence that the voluntary approaches in combination have enhanced environmental performance, economic efficiency, innovation or competitiveness beyond that which would be achieved from each of the approaches in isolation. Furthermore, many of the limitations of voluntary approaches (in particular, environmental performance, acceptability to NGOs) remain. (shrink)

This chapter presents Connecting Scotland as a case study, highlighting the correlation between current research into digital inequality to identify those most in need of support, and the practical application of work to address this at scale through third sector organisations working directly with those at greatest risk of digital exclusion. The chapter also considers the vital role of the ‘trusted intermediary’ acting as digital champion for device recipients, and, using the data gathered via sessions with hundreds of frontline staff, (...) explore immediate challenges and opportunities for engagement. It will also reflect on the application of research in the creation of training and resources to support the programme. Finally, the chapter will reflect on some of the many lessons learned, and consider implications for both policy-makers and fieldworkers seeking to address digital inequality at scale. Shadmehr and Ahmed cogently argue that vigor of appetitive movements is positively correlated with their value, and that value can therefore be inferred by measuring vigor. Here, we highlight three points to consider when interpreting this account: (1) The correlation between vigor and value is not obligatory, (2) the vigor effect also arises in frameworks other than optimal foraging, and (3) the term vigor can be misinterpreted, thereby affecting rigor.

Both advocates and opponents of the animalist view that we are fundamentally biological organisms have typically assumed that animalism is incompatible with intuitive verdicts about cerebrum isolation and transplantation. It is argued here that this assumption is a mistake. Animalism, developed in a natural way, in fact strongly supports these intuitive verdicts. The availability of this attractive resolution of a central puzzle in the personal identity debate has been obscured by a range of factors, including the prevalence in contemporary metaphysics (...) of a certain conception of the nature of organisms. I end by explaining how the animalist can use intuitive verdicts, usually thought to present a difficulty for the view, as positive evidence for claims about the persistence conditions of the relevant kind of organism. An extensive body of research details the lack of discussion and collaboration occurring in K12 classrooms in the United States. This study seeks to examine this issue by exploring the associations preservice social studies teachers make between the underlying principles of democratic education and the use of discussion in the social studies classroom. The present qualitative multi-case study uses a collection of field-based data and university coursework to examine how six preservice social studies teachers at a large southeastern university conceptualize (...) and value discussion as a pedagogical approach. Findings suggest that preservice social studies teachers do see value in the use of discussion and associate it with broad themes of democratic education. However, because their understandings of democratic education are often vague and unclear, the associations being made often do not reflect the work being conducted within academia in regards to social justice. This paper explains how an assertion may be understood despite there being nothing said or meant by the assertion. That such understanding is possible is revealed by cases of the so-called ``felicitous underspecification'' of demonstratives: cases where there is understanding of an assertion containing a demonstrative despite the interlocutors not settling on one or another object as the one the speaker is talking about (King 2014a, 2017, 2021). I begin by showing how Stalnaker's ([1978] 1999) well-known pragmatic principles adequately permit (...) and constrain the felicitous underspecification of demonstratives. I then establish a connection between the satisfaction of Stalnaker's principles and understanding, and show how that connection sheds further light on the relevant cases. After developing and motivating my proposal, I address some objections to it, then briefly discuss the felicitous underspecification of expressions other than demonstratives alongside contrasting my proposal with a similar one from Bowker (2015, 2019) that concerns definite descriptions. In this paper, I explore the relationship between naturalism and transcendental idealism in Fichte. I conclude that Fichte is a near-naturalist, akin to Baker, Lynne Rudder (2017). “Naturalism and the idea of nature,” Philosophy 92 (3): 333–349. A near-naturalist is one whose position looks akin to the naturalist in some ways but the near-naturalist can radically differ in metaphilosophical orientation and substantial commitment. This paper is composed of three sections. In the first, I outline briefly what I take transcendental idealism (...) to be, as well as some differences in types of naturalism, and how this maps on to Fichte. In the second, I give an exegesis of Fichte’s key arguments in the Later Jena period, which are important for the question of his relationship to naturalism.
