The meaning of justice can be defined according to a juridical, human, theological, ethical, biomedical, or social perspective. It should guarantee the protection of life and health, personal, civil, political, economic, and religious rights, as well as non-discrimination, inclusion, protection, and access to care. In this review, we deal with three theoretical concepts that define justice in all its aspects. (1) The utilitarian theory, which justifies moral statements on the basis of the evaluation of the consequences that an action produces, (...) elaborating a pragmatic model of medical science. (2) The libertarian theory, which considers freedom as the highest political aim, thus absolutizing the rights of the individual; here, the principle of self-determination, with respect to which the principle of permission/consent is the fundamental presupposition, plays a central role in the definition of the person. (3) The iusnaturalist theory, in which man’s moral freedom is identified with the ability to act by choosing what the intellect indicates to him as good; the natural moral law that drives every conscience to do good is therefore realized in respect for the person in the fullness of his rights. In conclusion, different forms and conceptions of justice correspond to different organizations of society and different ways of addressing ethical issues in the biomedical domain. (shrink)

Confirmation of a hypothesis by evidence can be measured by one of the so far known incremental measures of confirmation. As we show, incremental measures can be formally defined as the measures of confirmation satisfying a certain small set of basic conditions. Moreover, several kinds of incremental measure may be characterized on the basis of appropriate structural properties. In particular, we focus on the so-called Matthew properties: we introduce a family of six Matthew properties including the reverse Matthew effect; we (...) further prove that incremental measures endowed with reverse Matthew effect are possible; finally, we shortly consider the problem of the plausibility of Matthew properties. Male-to-female transsexualism manifests itself in the form of a discrepancy between the male sex assigned at birth and the subjective experience of belonging to the female gender, which in many cases also involves a somatic transition by cross-sex hormone treatment and genital surgery. Until now, no studies related to MtF transsexualism have been carried out within the framework of a phenomenological/existential approach. This paradigm would make it possible to better articulate the transsexual experience beyond the simplistic diagnostic criteria by which (...) it is currently defined. In this study, I will reread MtF transsexualism in the light of Ludwig Binswanger’s theories on Mannerism and Jean Paul Sartre’s remarks on the self and the body. I will do this largely by focusing on first-hand accounts of the MtF transsexual’s experience, in other words from a first-person viewpoint. Finally, I will present some considerations on the meaning of psychological intervention in this field. (shrink)

Over the last decade, neuroeconomic research has attracted increasing attention by economic modellers and methodologists. In this paper, I examine five issues about neuroeconomic modelling and methodology that have recently been subject to considerable controversy. For each issue, I explicate and appraise prominent neuroeconomists' findings, focusing on those that are claimed to directly inform economic theorizing. Moreover, I assess often-made assertions concerning how neuroeconomic research putatively advances the economic modelling of choice. Over the last decade, several European countries and the Council of Europe itself have strongly supported the use of advance directives as a means of protecting patients’ autonomy, and adopted specific norms to regulate this matter. However, it remains unclear under which conditions those regulations should apply to people who are placed in correctional settings. The issue is becoming more significant due to the increasing numbers of inmates of old age or at risk of suffering from mental disorders, all of (...) whom might benefit from using advance directives. At the same time, the closed nature of prisons and the disparate power relationships that characterise them mean that great caution must be exercised to prevent care being withdrawn or withheld from inmates who actually want to receive it. This paper explores the issue of prisoners’ advance directives in the European context, starting with the position enshrined in international and European law that prisoners retain all their human rights, except the right to liberty, and are therefore entitled to self-determination regarding health care decisions. An important problem in inductive probability theory is the design of exchangeable analogical methods, i.e., of exchangeable inductive methods that take into account certain considerations of analogy by similarity for predictive inferences. Here a precise reformulation of the problem of predictive analogy is given and a new family of exchangeable analogical methods is introduced.Firstly, it is proved that the exchangeable analogical method introduced by Skyrms (1993) does not satisfy the best known general principles of predictive analogy. Secondly, Skyrms's approach — (...) consisting of the usage of particular hyper-Carnapian methods, i.e., mixtures of Carnapian inductive methods — is adopted in the design of a new family of exchangeable analogical methods. The book is divided into three parts. The first, containing three papers, focuses on the characterization of the central tenets of previii sentism (by Neil McKinnon) and eternalism (by Samuel Baron and Kristie Miller), and on the ‘sceptical stance’ (by Ulrich Meyer), a view to the effect that there is no substantial difference between presentism and eternalism. The second and main section of the book contains three pairs of papers that bring the main problems with presentism to the fore and (...) outlines its defence strategy. Each pair of papers in this section can be read as a discussion between presentists and eternalists, wherein each directly responds to the arguments and objections offered by the other. This is a discussion that is sometimes absent in the literature, or which is at best carried out in a fragmented way. The first two papers of the section deal with the problem of the compatibility of Special Relativity Theory (SRT) and presentism. SRT is often considered to be a theory that contradicts the main tenet of presentism, thereby rendering presentism at odds with one of our most solid scientific theories. Christian Wüthrich’s paper presents arguments for the incompatibility of the two theories (SRT and presentism) within a new framework that includes a discussion of further complications arising from the theory of Qauantum Mechanics. Jonathan Lowe’s paper, by contrast, develops new general arguments against the incompatibility thesis and replies to Wüthrich’s paper. The second pair of papers focuses on the problem that presentists face, in providing grounds for past tensed truths. In the first (by Matthew Davidson), new arguments are provided to defend the idea that the presentist cannot adequately explain how what is now true about the past is grounded, since for the presentist the past is completely devoid of ontological ground. The second paper (by Brian Kierland) takes up the challenge of developing a presentist explanation of past truths, beginning by outlining some existing views in the literature before advancing an original proposal. In Metaphysics B 3 Aristotle sets out a famous argument for the thesis that being is not a genus. In his commentary on Metaphysics B, Syrianus criticizes this argument and explains in what sense being is to be regarded as a genus. I reconstruct both Syrianus’ criticisms and his own view. This article seeks to locate Louis Althusser’s late preoccupation with the status of Marxists in philosophy through a survey of archival and marginal texts written on and amid struggles within the French education system. This material evidences that Althusser held a long-term ambition to reconcile the demands of being a Marxist in his professional life with the demands of being a philosopher in his political life. On this basis, this article offers an expanded contextualisation of the stakes that weighed upon (...) Althusser’s shifting understanding and inhabitation of a Marxist position in philosophy. It aims to show that Althusser’s involvement with, and changing attitudes towards, the educational institution (and in particular the teaching of philosophy) played a significant role in forging the discontinuities in his conceptualisation of Marxist philosophy. The article additionally traces the afterlife of this practice in the work of Jacques Derrida and the Groupe de recherches sur l’enseignement de a philosophe (GREPH). (shrink)

This paper explores the epistemological impact of the idea of post-secularism on the concept of public reason. It does so by examining a strand of the Rawls-Habermas debate on the role of religious beliefs within public reason. The paper identifies a difficulty in the liberal solution that depends upon the unwillingness to challenge the proviso-like conception of public reason and contends that this difficulty is overcome neither by Habermas’ “institutional” version of proviso nor by Cristina Lafont’s version of “mutual accountability” (...) proviso. Once acknowledged this blind spot in the theory of public reason, the paper proceeds to show that a pragmatist-based conception of public reason can overcome this shortcoming as it grants to religious beliefs a role that does not compromise the liberal ethics of citizenship while at the same time does not frustrate the communitarian and religious call for a less restrictive conception of the public sphere. The conclusion this paper brings home is that a proviso-free public reason is necessary for tackling the theoretical challenge of defending liberalism in a post-secular society. (shrink)

The supervaluationist approach to branching time (‘SBT-theory’) appears to be threatened by the puzzle of retrospective determinacy: if yesterday I uttered the sentence ‘It will be sunny tomorrow’ and only in some worlds overlapping at the context of utterance it is sunny the next day, my utterance is to be assessed as neither true nor false even if today is indeed a sunny day. John MacFarlane (“Truth in the Garden of Forking Paths” 81) has recently criticized a promising solution to (...) this puzzle for falling short of an adequate account of ‘actually’. In this paper, I aim to rebut MacFarlane's criticism. To this effect, I argue that: (i) ‘actually’ can be construed either as an indexical or as a nonindexical operator; (ii) if ‘actually’ is nonindexical, MacFarlane's criticism is invalid; (iii) there appear to be independent reasons for SBT-theorists to claim that ‘actually’ is a nonindexical expression. It has become common, following Stephen Darwall’s “Two Kinds of Respect” (1977), to distinguish between “appraisal respect” and “recognition respect.” I propose, rather, to distinguish between hierarchical and egalitarian respect. The way the two meanings interact and the way they either support or contrast with each other have yet to be made clear. The meanings gathered under the broad rubric of respect can be highlighted by a genealogy that convincingly shows that the hierarchical notion is fundamental and that the definition (...) of an egalitarian meaning is a decisive shift made mainly by the Enlightenment movement, particularly by Kant. Furthermore, the notion of respect is currently being extended beyond persons—to animals, other living beings, and the environment. I argue that we can justifiably do so on the basis of the interaction between the hierarchical and egalitarian notions of respect. (shrink)

The question of rationality and of its role in human agency has been at the core of pragmatist concerns since the beginning of this movement. While Peirce framed the horizon of a new understanding of human reason through the idea of inquiry as aiming at belief-fixation and James stressed the individualistic drives that move individuals to action, it is in Dewey’s writing that we find the deepest understanding of the naturalistic and normative traits of rationality considered as the qualifying attribute (...) of human agency. Recent developments in moral and political philosophy as well as in general pragmatist scholarship have shown a renewal of interest in the role of human reason in agency, both with respect to control of conduct (decisions about how to act) and with respect to normative attitudes (considerations of what is good and right). In this article I will examine some features of Dewey’s epistemology which are particularly promising for the elaboration of a theory of practical rationality based on pragmatist sources. In particular, I will focus on Dewey’s notion of “judgment of practice” in order to frame a distinctively Deweyan approach to practical rationality. In order to point out the specificity of Dewey’s epistemological framework, I will refer to it as an “epistemology of practice”i. The aim of this article is to clarify the epistemological meaning of the concepts of articulation and transformation, that Dewey places at the heart of his theory of inquiry. Part of my argument consists in showing that through these notions Dewey aimed at broadening the conception of rationality, bringing it beyond the reach of the standard notions of analysis and synthesis and of induction, deduction, and abduction. Once the specificity of Dewey’s conception of rationality will have been demonstrated, I will proceed to show some of its implications in the explanation of the rationality of human agency with reference to practical reasoning and value assessment. I will then conclude the article by drawing some implications of Dewey’s theory of judgment for a broader epistemology based upon the acknowledgment of the primacy of practice. (shrink)

I re-examine the starting point of the Philebus’ description of the ‘divine method’ and argue that the vexed phrase τῶν ἀεὶ λεγομένων εἶναι at 16c9 refers to sensibles only. In doing so, I especially stress the significance of the phrase τούτων οὕτω διακεκοσμημένων at 16d1. The proposed interpretation fits the rest of the description of the ‘divine method’, preserves the Forms’ unmixed nature and the consistency of the Philebus.

This book describes the mathematical aspects of the semantics of programming languages. The main goals are to provide formal tools to assess the meaning of programming constructs in both a language-independent and a machine-independent way, and to prove properties about programs, such as whether they terminate, or whether their result is a solution of the problem they are supposed to solve. In order to achieve this the authors first present, in an elementary and unified way, the theory of certain topological (...) spaces that have proved of use in the modelling of various families of typed lambda calculi considered as core programming languages and as meta-languages for denotational semantics. This theory is now known as Domain Theory, and was founded as a subject by Scott and Plotkin. One of the main concerns is to establish links between mathematical structures and more syntactic approaches to semantics, often referred to as operational semantics, which is also described. This dual approach has the double advantage of motivating computer scientists to do some mathematics and of interesting mathematicians in unfamiliar application areas from computer science. (shrink)

Legal discourse is, admittedly, a rational message. As such, it presupposes some kind of logical structure. Nevertheless, legal theorist are not agreement as concerns the adequate logic law requires. A proposal to develop a specific logic, called “idiomatic legal logic”, is discussed as regards its consequences for an understanding of the rationality of law. Further, linguistic models adopted for the explanation of legal concepts are also considered, inasmuch as they imply that law is somehow isomorphic with Iinguistic structures.

In this paper I offer a first account of a practice-based conception of normativity for the political domain. This standpoint is used to relocate the most sophisticated normative practices of justification and critique within an experience-based framework, that of the human being as a “normative creature.” I begin by discussing the two major paradigms in political theory, showing that their neglect of this broad framework of normativity is a serious drawback. I then proceed to articulate the central elements of a (...) practicebased account of normativity: the notions of normative practices and normative orders, and an account of the rationality potential of normativity as practice. Theo AF Kuipers THE THREEFOLD EVALUATION OF THEORIES A SYNOPSIS OF FROM INSTRUMENTALISM TO CONSTRUCTIVE REALISM. ON SOME RELATIONS BETWEEN CONFIRMATION, EMPIRICAL PROGRESS, AND TRUTH APPROXIMATION (2000) ABSTRACT.

This article argues that, to distinguish between “critical” and “uncritical” solidarity, the normative concept of solidarity must be grounded on the principle of respect for persons. I start analyzing the principle of respect for persons from a modified Kantian perspective, arguing that it must be interpreted as a normative relation of power in which each person must recognize the autonomy of the other as a source of power. In this perspective, the principle of respect offers a foundation for an ethical (...) assessment of situations in which ethical solidarity is required. By drawing on the distinction between passive and active respect, I argue that solidarity is grounded on the duty of active respect in the face of danger or oppression and that this foundation allows us to distinguish between critical (i.e. appropriate) and uncritical (i.e. inappropriate) solidarity. Reconfigures classic aesthetic concepts in relation to the novelty introduced by virtual bodies.

Kant was never satisfied with the version of his “Refutation” published in 1787 (KrV, B 275-279). His dissatisfaction is already evident in the footnote added to the preface of the second edition of the Critique in 1787. As a matter of fact, Kant continued to rework his argument for at least six years after 1787. The main exegetical problem is to figure out who is the target of the “Refutation”: a non-sceptic idealist or a global sceptic of Cartesian provenance or (...) both. In this last case, a related problem is to know whether either of them is the Cartesian sceptic of the first Meditation, the idealist sceptic of the second Meditation and first part of the third Meditation, or some other non-sceptic idealist. I present and defend a new reconstruction of Kant’s “Refu­tation” as a successful argument against Mendelssohnian idealism of Cartesian provenance. This defence is based on a simple logical sketch of the proof provided by Dicker, but essentially modified in the light of Dyck’s insight about Kant’s opponent. How shall I support my reading? First, by appealing to overwhelming textual evidence according to which the proof is of the existence of mind-independent things, showing that Kant’s main opponent is Mendelssohn’s idealism of Cartesian provenance. Finally, I support my reading by showing that Kant’s “Refutation” is doomed to fail against all forms of global scepticism, but is quite successful against Mendelssohn’s idealism. (shrink)
