The digital age brings with it novel forms of data flow. As a result, individuals are constantly being monitored while consuming products, services and content. These abilities have given rise to a variety of concerns, which are most often framed using “privacy” and “data protection”-related paradigms. An important, oft-noted yet undertheorized concern is that these dynamics might facilitate the manipulation of subjects; a process in which firms strive to motivate and influence individuals to take specific steps and make particular decisions (...) in a manner considered to be socially unacceptable. That it is important and imperative to battle manipulation carries with it a strong intuitive appeal. Intuition, however, does not always indicate the existence of a sound justification or policy option. For that, a deeper analytic and academic discussion is called for. This Article begins by emphasizing the importance of addressing the manipulation-based argument, which derives from several crucial problems and flaws in the legal and policy setting currently striving to meet the challenges of the digital age. Next, the Article examines whether the manipulation-based concerns are sustainable, or are merely a visceral response to changing technologies which cannot be provided with substantial analytical backing. Here the Article details the reasons for striving to block manipulative conduct and, on the other hand, reasons why legal intervention should be, in the best case, limited. The Article concludes with some general implications of this discussion for the broader themes and future directions of privacy law, while trying to ascertain whether the rise of the manipulation-based discourse will lead to information privacy’s expansion or perhaps its demise. We are currently witnessing a sharp rise in the use of algorithmic decision-making tools. In these instances, a new wave of policy concerns is set forth. This article strives to map out these issues, separating the wheat from the chaff. It aims to provide policy makers and scholars with a comprehensive framework for approaching these thorny issues in their various capacities. To achieve this objective, this article focuses its attention on a general analytical framework, which will be applied to a (...) specific subset of the overall discussion. The analytical framework will reduce the discussion to two dimensions, every one of which addressing two central elements. These four factors call for a distinct discussion, which is at times absent in the existing literature. The two dimensions are the specific and novel problems the process assumedly generates and the specific attributes which exacerbate them. While the problems are articulated in a variety of ways, they most likely could be reduced to two broad categories: efficiency and fairness-based concerns. In the context of this discussion, such problems are usually linked to two salient attributes the algorithmic processes feature—its opaque and automated nature. (shrink)

En este artículo se revisa el lugar que ocupa Eckhart en L’essence de la manifestation, a fin de establecer correspondencias y afini­dades entre el místico renano y la peculiar concepción que de la fenomenología sostiene Michel Henry. Se trata de analizar la es­trecha cercanía entre el alma humana y Dios postulada por Meister Eckhart y su vinculación con la conocida noción de Vida presente en el autor francés. Henry es proclive a fundar una filosofía primera asociada a la pura autoafección, (...) describiendo la Vida sea como pura inmanencia, sea como una ipseidad algo problemática. En general, el trabajo teórico de los representantes del “giro teológico de la fenomenología francesa” (Janicaud) cuestiona al sujeto clásico de la Modernidad, sin por eso traer a colación la causa de un Dios Revelado ni el que resulta de una teología natural. Este trabajo, en suma, no es el esfuerzo de pensar a un Dios confesional ni tiene un propósito evangélico. Lejos de ello, se trata de precisar el nexo entre Henry y Eckhart, puesto en escena por aquél, y si tal nexo es coherente con lo que Henry piensa acerca de un modo de manifestación que ya no implica distancia fenomenológica alguna: la manifestación del pathos de la Vida. En este artículo se establece un análisis histórico, axiológico y epistemológico de las condiciones de advenimiento de una filosofía médica abocada al estudio de la enfermedad. El examen de estas condiciones toma en cuenta los estudios clásicos y contemporáneos de la filosofía de la medicina, analizando sus distintas perspectivas y enunciados. La reflexión en torno de los supuestos y conceptos asociados a tal tipo de filosofía, localiza la enfermedad en sus distintas dimensiones: en el ámbito del acontecimiento biológico (disease), del (...) orden social (sickness), y de la experiencia vivida (illness). Tres puntos de deliberación presentan el cuerpo nodular de estos análisis: a) la constitución disciplinaria y conceptual de la enfermedad como un hecho total: variantes epistemológicas de la medicina y la filosofía antigua; b) la psicopatología en la constitución de una filosofía de la enfermedad, el análisis epistemológico de dos conceptos: normal-patológico; y c) la filosofía de la vida de G. On the dominant contemporary accounts of how practical considerations affect what we ought to believe, practical considerations either encroach on epistemic rationality by affecting whether a belief is epistemically justified, or constitute distinctively practical reasons for belief which can only affect what we ought to believe by conflicting with epistemic rationality. This paper argues that Søren Kierkegaard offers a promising alternative view on which practical considerations can affect what we ought to believe without either encroaching on or (necessarily) conflicting with (...) epistemic rationality by determining which among the epistemically permitted outright doxastic attitudes one should all‐things‐considered adopt. Most theories and hypotheses in psychology are verbal in nature, yet their evaluation overwhelmingly relies on inferential statistical procedures. The validity of the move from qualitative to quantitative analysis depends on the verbal and statistical expressions of a hypothesis being closely aligned – that is, that the two must refer to roughly the same set of hypothetical observations. Here, I argue that many applications of statistical inference in psychology fail to meet this basic condition. Focusing on the most widely used (...) class of model in psychology – the linear mixed model – I explore the consequences of failing to statistically operationalize verbal hypotheses in a way that respects researchers' actual generalization intentions. I demonstrate that although the “random effect” formalism is used pervasively in psychology to model intersubject variability, few researchers accord the same treatment to other variables they clearly intend to generalize over. The under-specification of random effects imposes far stronger constraints on the generalizability of results than most researchers appreciate. Ignoring these constraints can dramatically inflate false-positive rates, and often leads researchers to draw sweeping verbal generalizations that lack a meaningful connection to the statistical quantities they are putatively based on. I argue that failure to take the alignment between verbal and statistical expressions seriously lies at the heart of many of psychology's ongoing problems, and conclude with a discussion of several potential avenues for improvement. This work develops an epistemology of measurement, that is, an account of the conditions under which measurement and standardization methods produce knowledge as well as the nature, scope, and limits of this knowledge. I focus on three questions: (i) how is it possible to tell whether an instrument measures the quantity it is intended to? (ii) what do claims to measurement accuracy amount to, and how might such claims be justified? (iii) when is disagreement among instruments a sign of error, (...) and when does it imply that instruments measure different quantities? Based on a series of case studies conducted in collaboration with the US National Institute of Standards and Technology (NIST), I argue for a model-based approach to the epistemology of physical measurement. To measure a physical quantity, I argue, is to estimate the value of a parameter in an idealized model of a physical process. Such estimation involves inference from the final state (‘indication’) of a process to the value range of a parameter (‘outcome’) in light of theoretical and statistical assumptions. Contrary to contemporary philosophical views, measurement outcomes cannot be obtained by mapping the structure of indications. Instead, measurement outcomes as well as claims to accuracy, error and quantity individuation can only be adjudicated relative to a choice of idealized modelling assumptions. (shrink)

Purpose. Romanticism as a movement developed in Germany, where, becoming the philosophy of time in the 18th-19th centuries, spread to all European countries. The "mobility" of the Romantic doctrine, its diversity, sometimes contradictory views, attitude to man as a free, harmonious, creative person led to the susceptibility of this movement by ethnic groups, different in nature and mentality. Its ideas found a wide response in Ukraine with its "cordocentric" type of culture in the early nineteenth century. Since the peculiarity of (...) "Ukrainian Romanticism" was its "literary-centric" nature, the purpose of this study is to analyse and comprehend the place of man in the national philosophy and literature of this period. Accordingly, the main tasks of the work are as follows: to determine the main features, the nature of Ukrainian Romanticism; to trace the main vectors of comprehension and image of man in the literature of this time. Theoretical basis. The ideas of European Romanticism were creatively rethought and assimilated during the emergence of new Ukrainian literature. It provided samples of highly artistic works, unique names of talented writers – creators and thinkers, who in their works reflected the philosophy of time. Based on the works of F. Schlegel, partly E. Husserl, M. Heidegger, K. Jaspers, Romanticism in the Ukrainian humanities, in terms of philosophy, culturology, as well as at the intersection with literature, was studied by T. Bovsunivska, Y. Hrybkova, S. Efremov, N. Kalenichenko, S. Kozak, T. Komarynets, D. Nalyvayko, Y. Nakhlik, I. Ogorodnyk, V. Ogorodnyk, A. Sinitsyna, D. Chyzhevsky, M. Yatsenko, E. Kyryliuk, M. Biletsky, D. Dontsov, S. Efremov, G. Kostyuk, S. Krymsky, Y. Sherekh and others. Originality. The authors of the article prove that Romanticism in Ukraine, being "literary-centric" inherently, having absorbed the main ideas and features of European Romanticism, has its own features and vectors of formation and development. Man in this kind of movement, thanks to the means of art, appears very clearly as a spiritually rich, sensitive, vulnerable and strong person. For him or her, the highest value is freedom, the ability to make freely independent fateful decisions. Conclusions. Ukrainian writers, reflecting the philosophical ideas of Romanticism, saw in man a harmonious combination of "natural" and "social", through which he indirectly carries out his own national existence. In addition to the objective realities of the external world, in their works, Romantic writers appeal to the subjective, internal, spiritual, "ideal" world of the hero, who interacts with reality through his own system of values. At each level of development of the humanities and methodology of cognition, this allows a new reading of these works. (shrink)

Axiomatic measurement theories are commonly interpreted as claiming that, in order to quantify an empirical domain, the qualitative structure of data about that domain must be mapped to a numerical structure. Such mapping is supposed to be established independently, i.e., without presupposing that the domain can be quantified. This interpretation is based on two myths: that it is possible to independently infer the qualitative structure of objects from empirical data, and that the adequacy of numerical representations can only be justified (...) by mapping such qualitative structures to numerical ones. I dispel the myths and show that axiomatic measurement theories provide an inadequate characterization of the kind of evidence required to detect quantities. (shrink)

There is now considerable evidence that human sentence processing is expectation based: As people read a sentence, they use their statistical experience with their language to generate predictions about upcoming syntactic structure. This study examines how sentence processing is affected by readers' uncertainty about those expectations. In a self-paced reading study, we use lexical subcategorization distributions to factorially manipulate both the strength of expectations and the uncertainty about them. We compare two types of uncertainty: uncertainty about the verb's complement, reflecting (...) the next prediction step; and uncertainty about the full sentence, reflecting an unbounded number of prediction steps. We find that uncertainty about the full structure, but not about the next step, was a significant predictor of processing difficulty: Greater reduction in uncertainty was correlated with increased reading times. We additionally replicated previously observed effects of expectation violation, orthogonal to the effect of uncertainty. This suggests that both surprisal and uncertainty affect human RTs. We discuss the consequences for theories of sentence comprehension. (shrink)

The philosophy of measurement studies the conceptual, ontological, epistemic, and technological conditions that make measurement possible and reliable. A new wave of philosophical scholarship has emerged in the last decade that emphasizes the material and historical dimensions of measurement and the relationships between measurement and theoretical modeling. This essay surveys these developments and contrasts them with earlier work on the semantics of quantity terms and the representational character of measurement. The conclusions highlight four characteristics of the emerging research program in (...) philosophy of measurement: it is epistemological, coherentist, practice oriented, and model based. (shrink)

This book compiles and reviews the most prominent linguistic theories into a single source that serves as an essential reference for future solutions to one of the most important challenges of our age.

As a slew of recent work in epistemology has brought out, there is a range of cases where there's a strong temptation to say that prudential and (especially) moral considerations affect what we ought to believe. There are two distinct models of how this can happen. On the first, “reasons pragmatist” model, the relevant prudential and moral considerations constitute distinctively practical reasons for (or against) belief. On the second, “pragmatic encroachment” model, the relevant prudential and moral considerations affect what one (...) is epistemically justified in believing. The pragmatic encroachment model appears to have several advantages over reasons pragmatism, and this has led many recent philosophers to endorse the former. However, in this paper we argue that a version of reasons pragmatism can be (at least largely) saved from these purported disadvantages once paired with an independently plausible permissivism about epistemically justified outright belief. This hybrid view—“permissivist pragmatism”—holds that when there is more than one epistemically permitted doxastic attitude, practical (including moral) considerations can determine which epistemically permitted doxastic attitude one all-things-considered ought to have. This view avoids both the problems faced by simple versions of reasons pragmatism, and those that distinctively attend pragmatic encroachment, while preserving the advantages of each view. (shrink)

Curiosity and creativity are central pillars of human growth and invention. Although they have been studied extensively in isolation, the relationship between them has not yet been established. We propose that both curiosity and creativity emanate from the same mechanism of novelty seeking. We first present a synthesis showing that curiosity and creativity are affected similarly by a number of key cognitive faculties such as memory, cognitive control, attention, and reward. We then review empirical evidence from neuroscience research, indicating that (...) the same brain regions are involved in both curiosity and creativity, focusing on the interplay between three major brain networks: the default mode network, the salience network, and the executive control network. After substantiating the link between curiosity and creativity, we propose a novelty-seeking model (NSM) that underlies them and suggests that the manifestation of the NSM is governed by one's state of mind. Hering’s opponent-colors theory suggests that our color sensations are produced by three mechanisms: a red–green mechanism, a yellow–blue mechanism, and a white–black mechanism. The first two mechanisms give rise to our sensations of hued colors; the third mechanism gives rise to our sensations of hueless colors. Noticeably, whereas the pair of colors produced by each of the hued mechanisms do not mix to yield a phenomenal intermediate (i.e., there are no greenish reds, reddish greens, yellowish blues, or bluish yellows), the (...) colors produced by the hueless mechanism, white and black, do have a phenomenal intermediate—gray. This different behavior of the white–black mechanism poses a problem for Hering’s theory. Several attempts to fix this problem have been suggested. This paper focuses on the suggestion made by Paul Heggelund a century after Hering proposed his theory. In Heggelund’s amendment of Hering’s theory, the hueless colors are not confined to the one-dimensional gamut between black and white, but rather require two components for their full description: a light–dark (or luminous–black) component, where light and dark are mutually exclusive sensations, and a white component, which doesn’t have an opponent counterpart. Here I show that although Heggelund’s theory indeed provides a solution to the problem that the hueless colors pose to Hering’s theory, it is not self-consistent. I go on to revise Heggelund’s theory to obtain a consistent opponent-colors theory. (shrink)
