Medical legal partnerships address individual legal needs that can create impediments to health. Little is known about outcomes from medical legal partnerships and their relationship to access to justice. This paper reports outcomes from one medical legal partnership from the perspective of the client, with specific emphasis on impact on health and concepts related to access to justice. We suggest a conceptual model for incorporating medical legal partnerships into a broader framework about access to justice.

In this paper I propose a way of characterizing human agency in terms of the concept of a two‐way power. I outline this conception of agency, defend it against some objections, and briefly indicate how it relates to free agency and to moral praise‐ and blameworthiness.

The last three decades have seen much important work on powers and dispositions: what they are and how they are related to the phenomena that constitute their manifestation. These debates have tended to focus on ‘paradigmatic’ dispositions, i.e. physical dispositions such as conductivity, elasticity, radioactivity, etc. It is often assumed, implicitly or explicitly, that the conclusions of these debates concerning physical dispositions can be extended to psychological dispositions, such as beliefs, desires or character traits. In this paper I identify some (...) central features of paradigmatic dispositions that concern their manifestation, stimulus conditions, and causal bases. I then focus on a specific kind of psychological disposition, namely character traits, and argue that they are importantly different from paradigmatic dispositions in relation to these features. I conclude that this difference should lead us to re-examine our assumption that character traits are dispositions and, by implication, whether we can generalize conclusions about physical dispositions to psychological dispositions, such as character traits and their manifestations. After nearly sixty years, the influence of Peter Strawson’s ‘Freedom and Resentment’ remains strong in discussions of moral responsibility. However, as the paper has become more remote in time and in intellectual climate, some of those influences have turned into amplifications of ideas and claims that are misinterpretations or distortions of the paper, while other notions have been projected onto it. I try to make the case for this charge specifically in relation to what has become accepted as Strawson’s ‘response-dependent’ (...) theory of moral responsibility and to an allegedly problematic conception of blame said to be at the centre of that theory. Euthanasia has become the subject of ethical and political debate in many countries including Mexico. Since many physicians are deeply concerned about euthanasia, due to their crucial participation in its decision and implementation, it is important to know the psychological meaning that the term ‘euthanasia’ has for them, as well as their attitudes toward this practice. This study explores psychological meaning and attitudes toward euthanasia in 546 Mexican subjects, either medical students or physicians, who were divided into three groups: a) (...) beginning students, b) advanced students, and c) physicians. We used the semantic networks technique, which analyzed the words the participants associated with the term ‘euthanasia’. Positive psychological meaning, as well as positive attitudes, prevailed among advanced students and physicians when defining euthanasia, whereas both positive and negative psychological meaning together with more ambivalent attitudes toward euthanasia predominated in beginning students. The findings are discussed in the context of a current debate on a bill proposing active euthanasia in Mexico City. (shrink)

A new theoretical approach to Aristotelian Logic based on three axioms has been recently introduced. This formalization of the theory allowed for the unification of its uncommunicated traditional branches, thus restoring the theoretical unity of AL. In this brief paper, the applicability of the three AL axioms to Propositional Logic is explored. First, it is shown how the AL axioms can be applied to some simple PL arguments in a straightforward manner. Second, the development of a proof method for PL (...) inspired by the AL axioms is presented. This method mimics the underlying mechanics of the proof method from AL, and offers a complementary alternative to proof methods such as truth trees. (shrink)

The negative impacts of agriculture on the environment and the inequity that limits access to healthy food for the entire population impede sustainable development. This article reflects contributions to food security and alternatives for transitioning to sustainable food systems. It is concluded that food, as a human right, is a complex and transdisciplinary issue, which must be integrated as a transversal axis in the economic, social, environmental, governance, and cultural dimensions to contribute to sustainable development and therefore the convenience of (...) making the transition from the concept of food security to that of food sustainability. Rational justification of claims with empirical content calls for empirical and not only normative philosophical investigation. Empirical approaches to bioethics are epistemically valuable, i.e., such methods may be necessary in providing and verifying basic knowledge about cultural values and norms. Our assumptions in moral reasoning can be verified or corrected using these methods. Moral arguments can be initiated or adjudicated by data drawn from empirical investigation. One may argue that individualistic informed consent, for example, is not compatible with the Asian (...) communitarian orientation. But this normative claim uses an empirical assumption that may be contrary to the fact that some Asians do value and argue for informed consent. Is it necessary and factual to neatly characterize some cultures as individualistic and some as communitarian? Empirical investigation can provide a reasonable way to inform such generalizations. In a multi‐cultural context, such as in the Philippines, there is a need to investigate the nature of the local ethos before making any appeal to authenticity. Otherwise we may succumb to the same ethical imperialism we are trying hard to resist. Normative claims that involve empirical premises cannot be reasonably verified or evaluated without utilizing empirical methods along with philosophical reflection. The integration of empirical methods to the standard normative approach to moral reasoning should be reasonably guided by the epistemic demands of claims arising from cross‐cultural discourse in bioethics. The aim of this paper is to show that any process of benefit sharing that does not guarantee the representation and participation of women in the decision-making process, as well as in the distribution of benefits, contravenes a central demand of social justice. It is argued that women, particularly in developing countries, can be excluded from benefits derived from genetic research because of existing social structures that promote and maintain discrimination. The paper describes how the structural problem of gender-based inequity (...) can impact on benefit sharing processes. At the same time, examples are given of poor women’s ability to organise themselves and to achieve social benefits for entire communities. Relevant international guidelines (e.g. the Convention on Biodiversity) recognise the importance of women’s contributions to the protection of biodiversity and thereby, implicitly, their right to a share of the benefits, but no mechanism is outlined on how to bring this about. The authors make a clear recommendation to ensure women’s participation in benefit sharing negotiations by demanding seats at the negotiation table. (shrink)

It seems natural to think that there are aesthetic reasons for action and that an artist must be guided by such reasons as he or she begins work on the canvas or poem or symphony or marble. This latter supposition seems at odds, however, not only with classical inspiration theory but also with the views of one of the last century’s most important philosophers of art, R. G. Collingwood. We propose an account of acting for an aesthetic reason inspired by (...) G. E. M. Anscombe’s Intention, specifically by her concept of ‘practical knowledge’, which we believe can accommodate Collingwood’s reservations about the sort of knowledge of their ends, and of the means to those ends, which artists have as they engage in their creative activity. Background: Research activities in sub-Saharan Africa may be limited to delegated tasks due to the strong control from Western collaborators, which could lead to scientific production of little value in terms of its impact on social and economic innovation in less developed areas. However, the current contexts of international biomedical research including the development of public-private partnerships and research institutions in Africa suggest that scientific activities are growing in sub-Saharan Africa. This study aims to describe the patterns of clinical research (...) activities at a sub-Saharan biomedical research center. Methods: In-depth interviews were conducted with a core group of researchers at the Medical Research Unit of the Albert Schweitzer Hospital from June 2009 to February 2010 in Lambarene, Gabon. Scientific activities running at the MRU as well as the implementation of ethical and regulatory standards were covered by the interview sessions. Results: The framework of clinical research includes transnational studies and research initiated locally. In transnational collaborations, a sub-Saharan research institution may be limited to producing confirmatory and late-stage data with little impact on economic and social innovation. However, ethical and regulatory guidelines are being implemented taking into consideration the local contexts. Similarly, the scientific content of studies designed by researchers at the MRU, if local needs are taken into account, may potentially contribute to a scientific production with long-term value on social and economic innovation in sub-Saharan Africa. Conclusion: Further research questions and methods in social sciences should comprehensively address the construction of scientific content with the social, economic and cultural contexts surrounding research activities. L'émission de télévision française Loft Story, diffusée au printemps 2001, peut être interprétée comme le signe de l'aboutissement de la logique de l'audience dans le régime télévisuel. Nous proposons ici de montrer que le diffuseur et le producteur ont agencé une industrialisation de l'audience et orchestré une instrumentalisation de la critique. Industrialisation de l'audience en ce sens que tous les ressorts déjà expérimentés ailleurs ont été utilisés ici pour maximiser le nombre de téléspectateurs réunis devant leur écran et pour optimiser (...) la vente de l'espace publicitaire aux annonceurs. Et surtout, instrumentalisation de la critique car la pluralité des voix qui se sont élevées pour discuter du sens social de ce programme de «télé-réalité» a tout à la fois masqué la finalité strictement économique du dispositif et participé à sa réussite.The French television programme "Loft Story" broadcast in spring 2001 can be interpreted as the ultimate illustration of the drive for high TV audience ratings. We aim to show that the broadcasters arranged an 'industrialization ' of ratings and orchestrated a reaction by critics. The ratings were industrialized in the sense that all methods previously established were used here to maximize the number of the viewers and to optimize the level of exposure of advertisements. More specifically, the orchestration of a critical reaction was illustrated in the abundance of critics ready to raise their voices to discuss the social connotations of this "reality television" programme. This not only masked the financial purpose underlying the programme but also contributed to its success. (shrink)

This empirical study explores the characteristics and degree of implementation of so-called ethics hotlines in transnational companies (TNCs), which allow employees to present allegations of wrongdoing and ethical dilemmas, as well as to report concerns. Ethics hotlines have not received much attention in literature; therefore, this paper aims to fill that gap. Through the analysis of conduct/ethics codes and the compliance programs of the top 150 transnational companies ranked by the United Nations Conference on Trade and Development (UNCTAD) ( 2007 (...) ), we carry out a descriptive and taxonomic study of these companies’ ethics hotlines. We analyze: (1) the basic characteristics of the mechanism, (2) the degree of exigency and the provision of safeguards, (3) the matters reported and the systems for reporting, and (4) the relationships between hotlines and economic characteristics of the firm. Our study compares financial and nonfinancial TNCs as well as North American and European TNCs. Our results show that many firms (especially from North America) have established these procedures. We also find some disparities between European and North American ethics hotlines that suggest differences in the orientation of the procedures. (shrink)

La ciudad es entendida desde el rapport del ámbito urbano, al descubrir su tópica urbana y subordinar su configuración esencial al urbanismo, en relación con la conciencia colectiva, para explicar y comprender los fenómenos que coadyuvan a (...) entender la identidad, la marginación y la violencia como fenómenos urbanos. Urban reason, defined under psychoanalytic concepts transcended through the use of complex topologies in the generation of urban problems, develops our understanding of the paradoxes of the anti-city within the city, identity and non-identity, and marginalization and inclusion. The city is understood from the rapport of the urban environment, as its urban topology is discovered and its essential configuration subordinated to urbanism, in relation to collective consciousness. This understanding leads to an explanation and comprehension of the phenomena that help to understand identity, marginalization, and violence as urban phenomena. (shrink)

For this open issue of the _Etikk i Praksis: Nordic Journal of Applied Ethics_, we put together a broad mix of different articles tackling current important issues in the field.

A number of recent writers have expressed scepticism about the viability of a specifically moral concept of obligation, and some of the considerations offered have been interesting and persuasive. This is a scepticism that has its roots in Nietzsche, even if he is mentioned only rather rarely in the debate. More proximately, the scepticism in question receives seminal expression in Elizabeth Anscombe's 1958 essay, ‘Modern Moral Philosophy’, a piece that is often paid lip-service to, but—like Nietzsche's work—has only rarely been (...) taken seriously by those wishing to defend the conception of obligation under attack. This is regrettable. Anscombe's essay is powerful and direct, and it makes a forthright case for the claim that, in the absence of a divine law conception of ethics, any specifically moral concept of obligation must be redundant, and that the best that can be hoped for in a secular age is some sort of neo-Aristotelianism. Anscombe is right about this, we think. And, among those who disagree, one of the very few to have taken her on at all explicitly is Christine Korsgaard, whose Kantianism of course commits her to the view that the concept of moral obligation is central, with or without God. Here, we try to show that Korsgaard loses the argument. (shrink)

How well can institutional guidelines help ensure the dignity, rights, safety and well being of research participants in an underdeveloped country? In this paper I describe the limits of informed consent as an instrument for the protection of participants in the context of the Philippines. I bring to this paper my experiences as an advocate of rights, a member of an ethics review board, a researcher on the ethics of research and as an observer of the dynamics of clinical practice (...) in an academic public teaching hospital of the University of the Philippines where I am professor. Siendo esto así, se afirma que es incapaz de responder (correctamente) a nuestros problemas morales más importantes y que, de hecho, se convierte en una doctrina inútil. Sin embargo, debemos matizar esta acusación diciendo, por un lado, que las emociones tienen, de algún modo, un significativo papel en la teoría de Bentham y que, por otro lado, tienen, indudablemente, un papel (...) central en el utilitarismo de Mill. En este artículo tratamos de mostrar cuál es ese papel y si el uso de las emociones en la teoría de Mill puede ser visto como una especie de desviacionismo de la versión estándar. (shrink)

El argumento constituye un desafío al antiexcepcionalismo lógico, en la medida en que este último debe poder justificar su afirmación de que la teoría lógica en ejercicio puede revisarse. El propósito de este artículo es responder al desafío, utilizando como unidad de análisis el concepto de Taxonomía Lexical propuesto por Kuhn. Como mostraremos, una visión sociológicamente enriquecida de las teorías científicas y la naturaleza de sus cambios (...) permite dar cuenta de un antiexcepcionalismo lógico que evita el Problema de la Adopción. As the year 2022 ends, we continue to face challenging issues and uncertainties about what should be the right approach to various ethical problems society face. In approaching these problems we reflect on our existing guiding values but also discover new ones. We then try to figure out how our actions and decisions could align with our well-considered judgments until we achieve some degree of reflective equilibrium.

The Cybersyn project has lately received increased attention. In this article, we study the local technical antecedents of Stafford Beer's Cybersyn project in Chile, particularly regarding Cybernetics and Systems ideas and local computing and networking developments. We show that the Cybersyn project in Chile was hosted by a rich intellectual environment that understood Cybernetics and Systems ideas; that it found a mature computer community and infrastructure whose high point was the State Computing Enterprise EMCO/ECOM, and an advanced networking experience whose (...) flagship was the automation of the State Bank that involved a pioneering network of teleprocess. In summary, this paper attempts to unveil the deep historical background over which the globally unique cybernetic experiment called Cybersyn flourished. (shrink)

Auf diesem Hintergrund entfaltet der zweite Teil die anthropologisch-theologische Bedeutung von rationalitas fur das Weltbild Hildegards.
