Depuis Droit, mythe et raison (1980) écrit avec Jacques Lenoble jusqu’aux récents À quoi sert le droit? Usages, fonctions et finalités (2016) ou Le droit, objet de passions (2018), François Ost ne cesse de questionner les rapports de nos sociétés au droit et la place de celui-ci dans nos sociétés contemporaines. Avec Le droit malgré tout, il s’agit de rendre hommage à l’œuvre et à la carrière d’une figure centrale de la théorie du droit contemporaine et aussi au fondateur, avec (...) le regretté Michel van de Kerchove, de ce que l’on appelle parfois « l’école de Saint-Louis ». Abordant les deux pôles de la dialectique à laquelle François Ost est si attaché - la critique et la reconstruction -, l’ouvrage propose un regard interdisciplinaire sur le droit, à travers les principaux thèmes qui ont nourri la pensée de l’auteur. Du statut épistémologique de la science du droit à un questionnement sur les fondements et l’avenir du droit et de la justice, des liens qu’entretiennent le droit et la littérature jusqu’à l’environnement saisi par le droit en passant par les « communs », les approches de ses collègues et amis sont toutes réflexives et critiques. En ce qu’elles sont soucieuses de soumettre le droit au regard des sciences sociales et, inversement, les normativités extra-juridiques au regard du droit, elles sont fidèles à la démarche de François Ost. Ce Liber Amicorum propose aussi un retour réflexif sur son œuvre par l’auteur lui-même, dans un entretien avec Manuel Atienza. This paper aims to shed new light on Hegel’s rather problematic statements about Asian thinking and Chinese philosophy by disclosing the Orientalist antecedents found in Kant’s anthropological works. First, the notion of Orientalism will be defined with reference to Orientalism and “Orientalism Reconsidered” by Edward Said. Second, an exploration of Kant’s anthropological research will show that this constituted the turning point in the Western Orientalist perception of China which had a strong influence on Hegel Finally, it will be claimed that (...) Hegel’s Orientalist perception of China rests on a definition of culture as the expression of the “spirit of a people” that has recently been revised by contemporary post-colonial anthropologists. Rarely is the problem of the diversity of languages taken into account whenever population groups are formed into States. When the problem does come up, it is later, in a primarily political context which tries to find political solutions, such as we may presently see them in Canada or in Belgium for instance. These solutions are few and they deal with situations that may contain a host of nuances.Certain countries have chosen a vehicular language while keeping their local languages: the (...) common language in the USSR is the language of one of its republics. In Senegal it is French, which is of a totally foreign origin but has the advantage of avoiding the rivalry existing among the native languages, and it also has a place within the international community. Other countries have accepted as official languages the different languages spoken within its borders. Thus Switzerland is officially tri-lingual (French, German, Italian), giving legal status to what somewhere else may simply be an accepted fact. Many Alsatians speak three languages (Alsatian, French, German). As far as it concerns countries with a strong linguistic heterogeneity, whether it be their history or their size making for a centralizing policy, they have adopted, with the resulting neglect of all others, the language or the idiom of the region which was politically or culturally the dominant one at the time of their unification. Pekinese has been extended to all of China, Florentine to Italy, Hindi to India. Some original combinations can be found: in Israel Jewish immigrants who came from more than seventy different countries, have again taken up the nation's old cultural and religious language, which had been out of use for two thousand years, and have placed it on equal footing with Arabic spoken by the local population, while English is being used for international relations. Dans cet article, je propose une analyse des débats récents sur la « justice climati­que », c’est-à-dire les enjeux de justice distributive liés aux phénomènes des changements climatiques. Je me propose d’y faire trois choses : premièrement, je propose une série de distinctions conceptuelles permettant de faire la cartographie des enjeux normatifs en cause et des taches que doivent réaliser nos théories en éthique environnementale. L’accélérationnisme marxiste de Srnicek et Williams semble concerner non seulement une simple accélération catastrophique du capital (comme chez Virilio, Baudrillard, Land), mais une accélération épistémique et une réappropriation du capital fixe comme technologie et connaissance (en une sorte de Singularité Épistémique). L’intelligence collective doit s’organiser elle-même sur le mode d’une intelligence hostile – également dans le sens où elle s’inocule dans son hôte comme un parasite malveillant.

Une rapide prospection a permis de localiser six ateliers amphoriques à Paros et deux à Naxos. Cette découverte a permis de préciser les conditions d'installation de ces poteries, de caractériser les argiles employées, de tenter une première esquisse typologique des amphores de Paros (époque hellénistique et impériale) et de Naxos (IVe siècle) et enfin de se fonder sur les échantillons provenant de ces ateliers pour identifier leur composition par thermoluminescence et les comparer avec d'autres vases provenant de sites de consommation.

L’élargissement de l’Union à l’Ukraine se pose en des termes particuliers. Il est devenu le fondement politique d’une solidarité européenne et d’un soutien inconditionnel face à l’agression de Poutine. Bien que le pays se conforme à « l’acquis communautaire » en termes d’État de droit, le principe de l’élargissement se heurte à de nombreuses difficultés et oppositions des États membres : faible soutien militaire et insuffisance des industries de défense, concurrence des produits agricoles ukrainiens en cas d’intégration dans un grand (...) marché libre exempté de droits de douane. On est face à un paradoxe qu’il faudra dépasser. L’élargissement est à la fois indispensable, inévitable pour la sécurité de tout le continent, et complexe du point de vue économique. (shrink)

Le terme de catallaxie a été forgé par F. Hayek pour exprimer l’ordre spontané du marché. Hayek a créé ce terme à partir du mot catallactique, ressorti peu avant de l’oubli par L. Mises, mot venu du verbe grec signifiant « échanger », pour éviter les ambigüités du mot « économie ». Ce papier a pour objet de rechercher la généalogie du terme « catallactique », depuis Richard Whately, qui a été le premier auteur, en 1831, à vouloir rebaptiser « (...) l’économie politique » en « catallactique ». Ce terme était connu et utilisé tout au long du XIX° siècle et on le trouve encore au début du XX° siècle dans divers manuels. L’utilisation de ce terme par Mises, puis Hayek, est donc la reprise d’une tradition remontant à Richard Whately. C’est l’occasion aussi de se pencher sur la vie de Richard Whately, professeur d’économie politique à Oxford jusqu’en 1831, puis archevêque anglican de Dublin. Il a notamment joué un grand rôle dans l’enseignement de cette discipline, en créant 4 000 cours d’économie politique. Un personnage intéressant, un peu trop ignoré aujourd’hui, qui a joué un rôle non négligeable dans la pensée économique. (shrink)

Non-governmental organizations (NGOs) and pressure groups have taken up the mission of counterbalancing the huge power of the multinational corporations. Curiously, while most NGOs have a sincere ethical background and a genuine ethical motivation, the way some activist groups and NGOs themselves act does not always live up to the principles they advocate. Research using a multiple case study methodology is used to provide an illustration of various questionable practices followed by pressure groups revealing a range of tactics. The concerns, (...) the objectives and the legitimacy of NGOs and activist groups will be discussed, along with their strategies and tactics. A framework will be developed as a basis for analysing the ethical aspects of the various NGO actions. The analysis of the cases will reveal some worrisome inconsistencies between the demands and the practices of NGOs and activist groups. Should not the means employed by activists and NGOs be consistent with their own espoused or implied values? As power gives responsibility, NGOs should be seen as having corporate stakeholder responsibility. (shrink)

Recent academic articles point to an increased vagueness and overlap in concepts related to business ethics and corporate responsibility. Further, the perception of these notions can differ in the smallbusiness world from the original academic definitions. This article focuses on the cognition of small-business owner-managers. Given the impact of small-business owner-managers on their ventures, corporate responsibility and ethical issues can take a different route in SMEs. The small-business owner-manager is able to shape the corporate culture and to enact values other (...) than profit. Adopting a cognitive perspective, we have identified how the small-business owner-manager makes sense of notions linked to corporate social responsibility (CSR) and business ethics. The concept of sensemaking has recently been applied to CSR (Basu and Pallazzo, 2008; Cramer et al., 2006). Applying a cognitive perspective to small-business owners may help in explaining specific phenomena found within smallbusiness ownership. For this research, the Repertory Grid Technique (RGT) is used, a method that has not previously been widely applied in the business and society field. Our findings to an extent invalidate the confusion in terminology found in the academic literature. Smallbusiness owner-managers, pragmatically and rather clearly, differentiate among the various concepts related to corporate responsibility and business ethics but, at the same time, they recognise the interrelationships and interdependencies of these concepts. These findings contribute to a better understanding of how small-business owners think and integrate corporate responsibility and ethical issues into their decisionmaking. (shrink)

Stakeholder theory advocates that firms bear responsibility for the implications of their actions. However, while a firm affects or can affect stakeholders, stakeholders can also affect the corporation. Previous stakeholder theorising has neglected the reciprocal nature of responsibility. The question can be asked whether—in a spirit of reciprocity, loyalty and fairness—stakeholders should treat the corporation in a fair and responsible way. This study based on different definitions of stakeholders argues that various stakeholder attributes differ for different categories of stakeholders. This (...) analysis presumes that the attribute of stakeholder reciprocity can probably be restricted to real stakeholders, labelled stakeowners: genuine stakeholders with a legitimate stake, the loyal partners who strive for mutual benefits. Stakeowners own and deserve a stake in the firm. Stakeholder reciprocity could be an innovative criterion in the corporate governance debate as to who should be accorded representation on the board. Pathologizing ugliness refers to the use of disease language and medical processes to foster and support the claim that undesirable features are pathological conditions requiring medical or surgical intervention. Primarily situated in cosmetic surgery, the practice appeals to the concept of “aesthetic pathology”, which is a medical designation for features that deviate from some designated aesthetic norms. This article offers a two-pronged conceptual analysis of aesthetic pathology. First, I argue that three sets of claims, derived from normativist and naturalistic accounts (...) of disease, inform the framing of ugliness as a disease. These claims concern: (1) aesthetic harms, (2) aesthetic dysfunction, and (3) aesthetic deviation. Second, I introduce the notion of a hybridization loop in medicine, which merges the naturalist and normative understanding of the disease that potentially enables pathologizing practices. In the context of cosmetic surgery, the loop simultaneously promotes the framing of beauty ideals as normal biological attributes and the framing of normal appearance as an aesthetic ideal to legitimize the need for cosmetic interventions. The article thus offers an original discussion of the conceptual problems arising from a specific practice in cosmetic surgery that depicts ugliness as the disease. (shrink)

Niccolò Machiavelli is the most prominent and notorious theorist of violence in the history of European political thought - prominent, because he is the first to candidly discuss the role of violence in politics; and notorious, because he treats violence as virtue rather than as vice. In this original interpretation, Yves Winter reconstructs Machiavelli's theory of violence and shows how it challenges moral and metaphysical ideas. Winter attributes two central theses to Machiavelli: first, violence is not a generic technology (...) of government but a strategy that tends to correlate with inequality and class conflict; and second, violence is best understood not in terms of conventional notions of law enforcement, coercion, or the proverbial 'last resort', but as performance. Most political violence is effective not because it physically compels another agent who is thus coerced; rather, it produces political effects by appealing to an audience. As such, this book shows how in Machiavelli's world, violence is designed to be perceived, experienced, remembered, and narrated. (shrink)

The popularity of surgical modifications of race-typical features among Asian women has generated debates on the ethical implications of the practice. Focusing on blepharoplasty as a representative racial surgery, this article frames the ethical discussion by viewing Asian cosmetic surgery as an example of medicalization, which can be interpreted in two forms: treatment versus enhancement. In the treatment form, medicalization occurs by considering cosmetic surgery as remedy for pathologized Asian features; the pathologization usually occurs in reference to western features as (...) the norm. In the enhancement form, medicalization occurs by using medical means to improve physical features to achieve a certain type of beauty or physical appearance. Each type of medicalization raises slightly different ethical concerns. The problem with treatment medicalization lies in the pathologization of Asian features, which is oppressive as it continues to reinforce racial norms of appearance and negative stereotypes. Enhancement medicalization is ethically problematic because cosmetic surgery tends to conflate beauty and health as medical goals of surgery, overemphasizing the value of appearance that can further displace women’s control over their own bodies. I conclude that in both forms of medicalization, cosmetic surgery seems to narrowly frame a complex psychosocial issue involving physical appearance as a matter that can be simply solved through surgical means. This research explores the relationship between work context and professional ethics. Specifically, we analyze through an online survey of professional accountants the degree to which changing work conditions have altered individual accountants ’ commitment to the core professional value of auditor independence. We argue that certain changes in the condition of work have made some categories of accountants more susceptible to the logic of commercialism rather than the logic of professionalism. We find general support for this argument. We observe that (...) accountants working outside of public accounting have a higher commitment to independence than do accountants working in the context of public accounting firms. We further observe that accountants in large international accounting firms report lower commitment to auditor independence than do others in public accounting. And we observe that older accountants report stronger commitment to auditor independence. One finding, however, contradicts our general thesis. We find that commitment to one’s client does not necessarily result in a loss of commitment to the core professional value of independence. We conclude that changes in the context of work have contributed to the demise of ethics among professional accountants and suggest that further research be done to elaborate the relationship between client commitment and independence commitment. The success of the stakeholder theory in management literature as well as in current business practices is largely due to the inherent simplicity of the stakeholder model-and to the clarity of Freeman's powerful synthesised visual conceptualisation. However, over the years, critics have attacked the vagueness and ambiguity of stakeholder theory. In this article, rather than building on the discussion from a theoretical point of view, a radically different and innovative approach is chosen: the graphical framework is used as the central (...) perspective. The major shortcomings of the popular stakeholder framework are systematically confronted with the graphical scheme to illustrate their visual impact. The graphical illustrations of the imperfections help explain the sometimes-oversimplified generalisation inherent to every graphical model. They also make some interrelationships easier to understand. The analysis demonstrates that, with the tacit but implicit acceptance of simplification of the discussed explanatory elements, Freeman's framework remains a rather good approximation of reality. Only a few minor changes to the stakeholder model are consequently proposed. (shrink)

Simon, philosophy has an affinity to science, not in the sense that philosophy is a mere metascience, a commentary on the sciences, but rather because it shares the same aim as science: the search for explanation. The philosophy Simon espouses is philosophical realism which, following Jacques Maritain, he prefers to call critical realism. Against the prejudice that only some version of philosophical idealism, be it critical or absolute, is capable of understanding positive science. Simon, in Foresight (...) and Knowledge, develops a philosophy of science form a realistic perspective. Philosophy of science or the critique of science, as it was known in France, is according to Simon, metahphysics in the exercise of its critical function. Simon selects as the central focus of the treatise the problem of determinism, causality, and chance. Simon shows that the concept “determinism” must be understood in different conceptual systems, such as a philosophy of nature and physics; in the latter, determinism is conceived as a possibility of certain and exact prediction. Pathologizing ugliness refers to the framing of unattractive features as a type of disease or deformity. By framing ugliness as pathology, cosmetic procedures are reframed as therapy rather than enhancement, thereby potentially avoiding ethical critiques regularly levelled against cosmetic surgery. As such, the practice of pathologizing ugliness and the ensuing therapeuticalization of cosmetic procedures require an ethical analysis that goes beyond that offered by current enhancement critiques. In this article, I propose using a thick description of the goals of medicine (...) as an ethical framework for evaluating problematic medical practices. I first describe the goals of medicine based on Daniel Callahan's account. I then propose that the goals work best in conjunction with ancillary ethical concepts, namely medical knowledge and skills, standards of practice and medical duties and virtues. Next, I apply the thick description of the goals of medicine in critiquing the practice of framing ugliness as disease. Here, I demonstrate ethical conflicts between aesthetic judgments that underpin the practice of pathologizing ugliness and medical judgments that inform ethical medical practices. In particular, the thick description of the goals of medicine helps reveal ethical conflicts in at least three key domains common to clinical practices, which include (a) disease determination, (b) diagnostic evaluation and (c) establishing clinical indications. My analysis offers a novel way of critiquing the practice of pathologizing ugliness in cosmetic surgery, which tends to be neglected by enhancement critiques. (shrink)

This article provides a critical comparative analysis of the substantive and procedural values and ethical concepts articulated in guidelines for allocating scarce resources in the COVID-19 pandemic. We identified 21 local and national guidelines written in English, Spanish, German and French; applicable to specific and identifiable jurisdictions; and providing guidance to clinicians for decision making when allocating critical care resources during the COVID-19 pandemic. US guidelines were not included, as these had recently been reviewed elsewhere. Information was extracted from each (...) guideline on: 1) the development process; 2) the presence and nature of ethical, medical and social criteria for allocating critical care resources; and 3) the membership of and decision-making procedure of any triage committees. Results of our analysis show the majority appealed primarily to consequentialist reasoning in making allocation decisions, tempered by a largely pluralistic approach to other substantive and procedural values and ethical concepts. Medical and social criteria included medical need, co-morbidities, prognosis, age, disability and other factors, with a focus on seemingly objective medical criteria. There was little or no guidance on how to reconcile competing criteria, and little attention to internal contradictions within individual guidelines. Our analysis reveals the challenges in developing sound ethical guidance for allocating scarce medical resources, highlighting problems in operationalising ethical concepts and principles, divergence between guidelines, unresolved contradictions within the same guideline, and use of naïve objectivism in employing widely used medical criteria for allocating ICU resources. The popularity of the stakeholder model has been achieved thanks to its powerful visual scheme and its very simplicity. Stakeholder management has become an important tool to transfer ethics to management practice and strategy. Nevertheless, legitimate criticism continues to insist on clarification and emphasises on the perfectible nature of the model. Here, rather than building on the discussion from a philosophical or theoretical point of view, a different and innovative approach has been chosen: the analysis will return to the origin (...) of stakeholder theory and will keep the graphical framework firmly in perspective. It will confront the stakeholder model’s graphical representation to the discussion on stakeholder definition, stakeholder identification and categorisation, to re-centre the debate to the strategic origin of the stakeholder model. The ambiguity and the vagueness of the stakeholder concept are discussed from managerial and legal approaches. The impacts of two major shortcomings of the popular stakeholder framework are examined: the boundaries and the level of the firm’s environment, and the ambivalent position of pressure groups and regulators. Working pragmatically, with a focus on the managerial and organisational perspective, an attempt is made to clarify the categorisations and classifications by introducing new terminology with a distinction between stakeholders, stakewatchers and stakekeepers. The analysis will finally lead to a proposed upgraded and refined version of the stakeholder model, with incremental ameliorations close to Freeman’s original model and a return of focus to its essence, the managerial implications in a strategic approach.
