The following categories can be found in the analysis of the prehistory of constitutionalism: the early constitutionalism, the ancient constitutionalism, the medieval or canonical constitutionalism. The usage of these categories raises the question: is constitutionalism the product of the Age of Enlightenment or is it an older phenomenon? The author of the article approaches this problem from another point of view: maybe the usage of the mentioned categories is an anachronism? In this case the (...) elements taken form different contexts are combined into a single unit typical to recent reality. This conjunction, when neither the single entirety nor the alterations of contexts are taken into consideration, distorts the understanding of the past, fits the past to the Procrustian bed straining it to the present standards. The existence of separate elements does not allow the consideration of the phenomenon as a whole. It also suits the category of constitutionalism. In author’s opinion, it is necessary to differentiate between: a) the prehistory of constitutionalism; b) the era of written constitutions as the legal acts of supreme power, the essence of which is expressed by the category of constitutionalism and which began in XVIII century. This paper presents a systematic study of the prehistory of the traditional subsystems of second-order arithmetic that feature prominently in the reverse mathematics program of Friedman and Simpson. We look in particular at: (i) the long arc from Poincar\'e to Feferman as concerns arithmetic definability and provability, (ii) the interplay between finitism and the formalization of analysis in the lecture notes and publications of Hilbert and Bernays, (iii) the uncertainty as to the constructive status of principles equivalent to Weak (...) K\"onig's Lemma, and (iv) the large-scale intellectual backdrop to arithmetical transfinite recursion in descriptive set theory and its effectivization by Borel, Lusin, Addison, and others. (shrink)

The world of the Hindi heroes of the 1970s, while decked in battle gear, largely belonged to the official state apparatus, either as members of vigilante self-defence squads – of which Bahadur was a pioneer – or bonafide members of the police force, like Inspector Vikram. The costumed superhero only emerged at the end of the Nehruvian period, gradually coming to defy its signature science and rationality. My article seeks to explore questions of the political economy of the superhero genre (...) and the affective valences of the supernatural in imaging/negotiating the national and transnational, through this conjunctural moment of the late 1970s and early 1980s. Carey leaves unaddressed an important evolutionary puzzle: In the absence of a numeral list, how could a concept of natural number ever have arisen in the first place? Here we suggest that the initial development of natural number must have bootstrapped on a material culture scaffold of some sort, and illustrate how this might have occurred using strings of beads.

이 글은 『계몽의 변증법』에서 서술된 원역사의 개념에 주목한다. 특히 이 글은 전애니미즘 단계에서 자연의 지배 아래 있던 인간이 어떻게 내적‧외적 자연을 미력하게나마 통제하기 시작했는지를 분석한다. 그리고 그러한 지배가 어떻게 외부(타자성)를 추방하여 동질화된 세계로서 내재성을 창출했는지를 해명한다. 나아가, 이 글은 자연‧인간‧사회를 거쳐 끊임없이 전유하는 지배의 운명을 원역사에서 발생한 지배의 변주로 해명한다. 이를 통해, 지배의 원역사가 다름 아닌 현재의 원역사임을 밝힘으로, 이 글은 삶과 죽음이 위태롭게 얽혀 있는 현대적 야만이 개인의 일탈이나 정치 체제의 오작동이 아닌 지배의 원역사에 기초해 있음을 규명할 것이다.

An obsession with constitutional reform characterized Canadian politics between 1987 and 1992. This reflected the failure of traditional mechanisms for bridging linguistic and regional differences in Canada, and the spirit of contentiousness and rightsconsciousness that has been encouraged since the passage of the Charter of Rights and Freedoms in 1982. These efforts to reform the constitution failed. In the 1992 referendum a majority of both French- and English-speaking Canadians, and majorities in 6 of the 10 provinces, rejected proposals supported by (...) the country's political and economic elites. Support for the reform proposals was greatest among the more affluent parts of Canadian society. Despite the fact that both French and English Canada rejected the proposed reforms, their reasons for doing so were quite different. In the wake of this failure, the terms of a reconciliation between the aspirations of French and English Canada are elusive as ever. (shrink)

In this paper we consider the prehistory of quantum gravity (1916–1930) from two perspectives. First, we investigate how this research field constituted itself and we propose for the first time a red thread to trace its evolution in this earliest period. Second, we focus on a case study: the earliest work of Léon Rosenfeld. In 1927 he tried to merge wave mechanics with general relativity in the context of a five‐dimensional universe. We describe how Oskar Klein, Louis de Broglie, (...) and Théophile De Donder influenced Rosenfeld's work and analyze how and why Rosenfeld attempted to reconcile Einstein's theory with quantum phenomena. We argue that Rosenfeld investigated for the first time the corrections to a classical space‐time metric generated by a quantum source. As far as we know, Rosenfeld's approach has been largely ignored until today: he himself considered it “an accident.” After having reconsidered its connection with de Broglie's ideas and Rosenfeld's interpretation of the wave function in 1927, we argue that Rosenfeld's work can be interpreted as a first attempt to introduce the pilot‐wave theory in the context of quantum gravity and we infer that this was one of the reasons that ruled it out. I discuss a textual problem at Cratylus 393bc and, after establishing the correct text, argue that the MSS readings point to the existence of a textual variant in the margin of an ancestor of the common source of our MSS, presumably an ancient edition of the dialogue. Then I make the further hypothesis that both readings originated as alternative attempts to interpret Plato's ambiguous orthography.

The past 25 years have seen a rapid growth of knowledge about brain mechanisms involved in visual mental imagery. These advances have largely been made independently of the long history of philosophical – and even psychological – reckoning with imagery and its parent concept ‘imagination’. We suggest that the view from these empirical findings can be widened by an appreciation of imagination’s intellectual history, and we seek to show how that history both created the conditions for – and presents challenges (...) to – the scientific endeavor. We focus on the neuroscientific literature’s most commonly used task – imagining a concrete object – and, after sketching what is known of the neurobiological mechanisms involved, we examine the same basic act of imagining from the perspective of several key positions in the history of philosophy and psychology. We present positions that, firstly, contextualize and inform the neuroscientific account, and secondly, pose conceptual and methodological challenges to the scientific analysis of imagery. We conclude by reflecting on the intellectual history of visualization in the light of contemporary science, and the extent to which such science may resolve long-standing theoretical debates. In this paper I seek to show how cultural niche construction theory offers the potential to extend the human evolutionary story beyond the Pleistocene, through the Neolithic, towards the kind of very large-scale societies in which we live today. The study of the human past has been compartmentalised, each compartment using different analytical vocabularies, so that their accounts are written in mutually incompatible languages. In recent years social, cognitive and cultural evolutionary theories, building on a growing body of archaeological evidence, (...) have made substantial sense of the social and cultural evolution of the genus Homo. However, specialists in this field of studies have found it difficult to extend their kind of analysis into the Holocene human world. Within southwest Asia the three or four millennia of the Neolithic period at the beginning of the Holocene represents a pivotal point, which saw the transformation of human society in the emergence of the first large-scale, permanent communities, the domestication of plants and animals, and the establishment of effective farming economies. Following the Neolithic, the pace of human social, economic and cultural evolution continued to increase. By 5000 years ago, in parts of southwest Asia and northeast Africa there were very large-scale urban societies, and the first large-scale states. An extension of cultural niche construction theory enables us to extend the evolutionary narrative of the Pleistocene into the Holocene, opening the way to developing a single, long-term, evolutionary account of human history. Canada is caught between two empires and between two constitutional systems. However, neither the British model of a "single sovereign" nor the American people's "sacred fire of liberty" matched the pluralistic identity of Canada, so Canadians engaged in constitutional experimentation. In Canada and the Ethics of Constitutionalism Samuel LaSelva argues that, in order to understand the old Canada of Confederation and the new one that followed the Charter of Rights and Freedoms, it is necessary to see how distinctive Canadian (...) constitutionalism is and how that distinctiveness does not depend on borrowings from the British or American constitutional models. LaSelva supports his argument by exploring different aspects of Canada's contribution to the ethics of constitutionalism including the limits of free expression, the Charter's notwithstanding clause, the origins and functions of judicial review, the Quebec secession debate, Aboriginal self-government, and the conception of Canada as a multicultural and multinational mosaic. Through a careful consideration of how Canadian constitutional pluralism with its focus on the rights of others differs from American and British ideas, Canada and the Ethics of Constitutionalism provides engaging answers to contested questions about how Canada was founded and what it has become. In this article, I critically evaluate the positions of Professors Jeremy Waldron and W.J. Waluchow on the right-based merits of entrenched constitutions and strong judicial review. I support Waluchow in arguing that (i) prohibitions on the constitutional entrenchment of rights and resultant prohibitions of strong judicial review may be only superficially fair or democratic, since fair procedure alone can neither eliminate pre-existing inequalities nor ultimately take the autonomy vital to self-governance seriously (whether individual or collective). Secondly, (ii) if deep dissensus (...) fails to exist on all substantive matters of rights, the constitutional entrenchment of rights combined with strong judicial review can indeed be achieved fairly. I then propose that (iii) the anti-constitutionalist concern about being governed by the ‘dead hand of the past’ is self-refuting, for the alternative is simply another constraint on autonomy. While this is largely consistent with Waluchow's position vis-à-vis Waldron's majoritarianism, I end by expressing serious concerns regarding whether the common law (and the ‘constitutional morality’ that Waluchow claims can be derived from it) can act as a sufficiently robust basis for the protection of liberal and egalitarian rights. During the 1940s, Zhang Junmai was a leader of the China Democratic Socialist Party and an important figure of the socalled third force in the struggle between the Chinese Communist Party and the GMD. Zhang kept himself informed about discussions on human rights in the West and the work in progress in the United Nations on the Universal Declaration of Human Rights. During the 1940s, Zhang discussed human rights in the magazines Zaisheng and Minxian. He introduced and translated discussions on (...) human rights in the West, such as the declaration of human rights adopted by the French organization Ligue des Droits de l'homme in 1936, and a human rights manifesto written by H.G. Wells in 1939. Both these declarations were fairly radical in nature and called for economic rights, including the right to subsistence. (shrink)

This book explores two basic questions regarding constitutional theory. First, in view of a commitment to democratic self-rule and widespread disagreement on questions of value, how is the creation of a legitimate constitutional regime possible? Second, what must be true about a constitution if the regime that it supports is to retain its claim to legitimacy? Howard Schweber shows that the answers to these questions appear in a theory of constitutional language that combines democratic theory with constitutional philosophy. The creation (...) of a legitimate constitutional regime depends on a shared commitment to a particular and specialized form of language. Out of this simple observation, Schweber develops arguments about the characteristics of constitutional language, the necessary differences between constitutional language and the language of ordinary law or morality, as well as the authority of officials such as judges to engage in constitutional review of laws.
