Essay on Transcendental Philosophy presents the first English translation of Salomon Maimon's principal work, originally published in Berlin in 1790. In this book, Maimon seeks to further the revolution in philosophy wrought by Kant's Critique of Pure Reason by establishing a new foundation for transcendental philosophy in the idea of difference. Kant judged Maimon to be his most profound critic, and the Essay went on to have a decisive influence on the course of post-Kantian German Idealism. A (...) more recent admirer was Gilles Deleuze who drew on Maimon's Essay in constructing his own philosophy of difference. This long-overdue translation makes Maimon's brilliant analysis and criticism of Kant's philosophy accessible to an English readership for the first time. The text includes a comprehensive introduction, a glossary, translators' notes, a bibliography of writings on Maimon and an index. It also includes translations of correspondence between Maimon and Kant and a letter Maimon wrote to a Berlin journal clarifying the philosophical position of the essay, all of which bring the book's context alive for the modern reader. This article described three heuristics that are employed in making judgements under uncertainty: representativeness, which is usually employed when people are asked to judge the probability that an object or event A belongs to class or process B; availability of instances or scenarios, which is often employed when people are asked to assess the frequency of a class or the plausibility of a particular development; and adjustment from an anchor, which is usually employed in numerical prediction when a relevant value (...) is available. These heuristics are highly economical and usually effective, but they lead to systematic and predictable errors. A better understanding of these heuristics and of the biases to which they lead could improve judgements and decisions in situations of uncertainty. (shrink)

It is commonly maintained that neuroplastic mechanisms in the brain provide empirical support for the hypothesis of multiple realizability. We show in various case studies that neuroplasticity stems from preexisting mechanisms and processes inherent in the neural structure of the brain. We argue that not only does neuroplasticity fail to provide empirical evidence of multiple realization, its inability to do so strengthens the mind-body identity theory. Finally, we argue that a recently proposed identity theory called Flat Physicalism can be enlisted (...) to explain the current state of the mind-body problem more adequately. (shrink)

Traditional state v. state war is largely a relic. How then does a nation-state protect itself - preemptively - against the unseen enemy? Existing international law - the Caroline Doctrine, UN Charter Article 51, Security Council Resolutions 1368 and 1373 - do not provide sufficiently clear guidelines regarding when a state may take preemptive or anticipatory action against a non-state actor. This article proposes rearticulating international law to allow a state to act earlier provided sufficient intelligence is available. After examining (...) international law, this article proposes a process-based "strict-scrutiny" approach to self-defense. Under this approach, the executive will have to convince a court, based on relevant, reliable, viable, and corroborated intelligence, that preemptive action is appropriate. This process leads to a check on the power o the executive by placing a judicial check on preemptive action, consequently establishing objective legal criteria for operational counterterrorism. The protests at the Universiteit van Amsterdam (UvA) that began in November 2014 as a reaction to severe cuts in the department of humanities have sparked a broad debate nationally and even internationally about the future of the university and the values and ideals that should define it. It turned out that dissatisfaction was much more widespread in different parts of the university than some had previously thought, and many turned out to share the concerns first put forward in the (...) humanities department, to extend beyond the borders of the university and the country. Increasing focus on getting as many students as possible to graduate promptly has shifted the attention ever more towards quantitative indicators for the evaluation of education rather than qualitative ones, leading to raising the question of whether the quality of education has suffered from these priorities. How did this come about and what could be done to improve this quality? In this essay we briefly consider the history of the university as an institute that aims to combine research and education, subsequently mentioning some more recent challenges for the university, finishing it with a brief description of a ‘circulation model of education’ that we consider to be a fruitful source for answering some of the challenges we identified from the current discussions. In this model circulation rather than unidirectional traffic occurs between different elements: circulation between research and education, between insights of teachers and of students, between disciplines, between general and contextualized knowledge, between disciplinary and experi- ential knowledge, between doing research and (meta-)reflection upon research, and so on. Maimonides’ Latin translation of Moreh Nevukhim | Guide for the Perplexed, was the most influential Jewish work in the last millennia (Di Segni, 2019; Rubio, 2006; Wohlman, 1988, 1995; Kohler, 2017). It marked the beginning of scholasticism, a daughter of Judaism raised by Jewish thinkers, according to historian Heinrich Graetz (Geschichte der Juden, L. 6, Leipzig 1861, p. xii). Printed by Gutenberg's first mechanical press, its influence in the West went as far as the Fifth Lateran Council (1512 — 1517) (...) "where scholars were encouraged to remove the difficulties which seemed to divide the whole of theology and philosophy (Leibniz, Théodicée, 11)." In Leibniz’ anthology of the Guide, the reader can get a detailed glimpse of Leibniz' impressions of Maimonides. Public law adjudication has grown dramatically in recent decades in many English-speaking countries. In the United States, and increasingly in other countries where it used to be rare for public questions to be decided in court, controversial questions of public policy are tried as constitutional or human rights issues and decided by court order. But in other areas of law - in everyday tort, contract, and property cases - court decisions are typically much less dramatic and seldom if ever announce (...) controversial innovations in public policy. Yet in private law cases too there are implicit questions of social justice.In common law countries, perhaps not surprisingly, tort, contract, and other private law cases are often decided on common law principles. Common law has a style and ethos of its own. It is based on precedent and, although precedent is open to modification, the common law style is anything but radical. With roots in the nineteenth century and earlier, common law often reflects classically liberal ideas, more or less consciously and more or less robustly.Instead of approaching private law cases with a common law mindset, should judges not treat these cases the way they might treat public law cases? Should courts not promote a vision of justice and human rights through private law adjudication, just as they sometimes - and in many countries increasingly - do in notable public law decisions?This article suggests several reasons why they should not. Turning private law more public in such a way would have considerable costs in legal stability, transparency, legitimacy, and judicial habits of neutrality and impartiality. Each of these considerations in turn is associated with what is generally thought of as the Rule of Law. The classically liberal ideas in the common law bloodstream themselves have at least some association with political freedom and the Rule of Law. And even if one is sceptical about classical liberalism and enthusiastic about today's public law, one might consider that public acceptance of ambitious public law adjudication may depend at least in part on the credit that courts build up through morally and politically unambitious day-to-day common law adjudication.
