The passage of the Patient Protection and Affordable Care Act on March 23, 2010, significantly changes the health care landscape. But even with the considerable expansion of insurance, many people will still lack coverage. When fully implemented, the act is designed only to cover about thirty-two million of the forty-six million uninsured Americans. Illegal aliens are specifically excluded. For others, implementation is not immediate; the so-called individual mandate, for example, does not take effect until 2014, and there are exceptions for (...) people for whom available policies are still too expensive, or who have religious objections. The computer revolution has had an enormous effect on all aspects of the practice of medicine, yet little thought has been given to the role of social media in identifying treatment choices for incompetent patients. We are currently living in the ?Internet age? and many people have integrated social media into all aspects of their lives. As use becomes more prevalent, and as users age, social media are more likely to be viewed as a source of information regarding medical care (...) preferences. The physician-patient relationship has changed over the last several decades, requiring a systematic reevaluation of the competing demands of patients, physicians, and families. In the era of genetic testing, using a model of patient care known as the family covenant may prove effective in accounting for these demands. The family covenant articulates the roles of the physician, patient, and the family prior to genetic testing, as the participants consensually define them. The initial agreement defines the boundaries of autonomy and benefit (...) for all participating family members. The physician may then serve as a facilitator in the relationship, working with all parties in resolving potential conflicts regarding genetic information. The family covenant promotes a fuller discussion of the competing ethical claims that may come to bear after genetic test results are received. (shrink)

Should public health authorities have access to your personal medical information without your permission? The usual justifications for requiring informed consent do not necessarily apply. That is not to say that consent may be avoided in all situations, just that the reasons for requiring consent in public health are different than for traditional medical treatment.

In July, the Department of Health and Human Services and the Office of Science and Technology Policy published an advance notice of proposed rulemaking proposing sweeping changes to the rules governing oversight of research on human subjects—changes aimed at “better protect[ing] human subjects who are involved in research, while facilitating valuable research and reducing burden, delay, and ambiguity for investigators.”1 The process is likely to amend not only the core regulation on human-subjects research , but also regulations governing vulnerable subjects, (...) Bioethicists can make substantial contributions, by ensuring that decision-making and distribution of resources during crises is carried out in a fair and just manner, as well as by examining the assumptions upon which disaster planning are based. Bioethicists should also be aware of potential pitfalls of overly-hasty engagement with this new field.

The protection of human subjects in biomedical research relies on two principal mechanisms: assessing and comparing the risks and potential benefits of proposed research, and obtaining potential subjects' informed consent. While these have been discussed extensively in the literature, no attention has been paid to whether the processes should be different when the objective of an experimental biomedical intervention is to improve individual appearance, performance, or capability rather than to prevent, cure, or mitigate disease . There are two critical steps in determining whether a medical experiment involving human subjects can be conducted in an ethical manner: assessing risks and potential benefits and obtaining potential subjects’ informed consent. Although an extensive literature on both of these aspects exists, virtually nothing has been written about human experimentation for which the objective is not to prevent, cure, or mitigate a disease or condition, but to enhance human capabilities. One exception is a 2004 article by Rebecca Dresser on preimplantation (...) genetic modification — one of the most controversial enhancement technologies — in which she states, “Under existing research ethics principles, it would be unethical for investigators to perform modifications exposing embryos expected to develop into healthy children to significant risk in exchange for a possible physical or mental enhancement.” But Dresser does not explain why such an experiment would be unethical under existing principles, and her conclusion is not self-evident. The United States, along with other nations and international organizations, has developed an elaborate system of ethical norms and legal rules to govern biomedical research using human subjects. These policies govern research that might provide direct health benefits to participants and research in which there is no prospect for participant health benefits. There has been little discussion, however, about how well these rules would apply to research designed to improve participants’ capabilities or characteristics beyond the goal of good health. Advocates for the professionalization of clinical bioethics argue that bioethics professionals play an important role in contemporary medicine and patient care, especially when addressing complex ethical questions that arise in the delivery of reproductive medicine. For bioethics consultants to serve effectively, they need adequate training in the medical and ethical issues that patients and clinicians will face, and they need skills to facilitate effective dialog among all parties. Because clinical ethics consultation is a “high‐stakes endeavor” that can acutely affect patient (...) care, efforts are under way to ensure that bioethics consultants have the competence to provide such guidance. Yet to date, no studies have examined whether the training of bioethics consultants meets the needs of health care professionals who are on the front lines of such issues. In fact, limited information is available on the reproductive health issues that bioethics training programs address or the degree to which these programs meet the needs of patients confronting reproductive health decisions and their clinicians. It is therefore important to answer this key question: What are the primary ethical issues encountered in reproductive medicine that currently affect patient care? Equally important, are bioethics training programs prepared to address those issues?To begin to answer these questions, we conducted parallel surveys of directors of graduate bioethics training programs and obstetrician‐gynecologists. The goal of this project is to lay the groundwork to establish a working partnership between bioethics educators and reproductive medicine practitioners to address the often troubling and frequently complex ethical issues in reproductive medicine. Even a morally good practical agent does not act solely from the recog- nition of the abstract demands of moral duty. Often, she acts to satisfy desires for particular ends that are not intrinsically moral. But if freedom, as Kant claims, consists in acting from universal principles one adopts from respect for the moral law, how can agents freely act to satisfy desires for particular ends? The standard answer to this question, the so-called Incorporation Thesis, is, I argue, unsatisfactory both (...) as an interpretation of Kant and on philosophical grounds. I propose instead that, for Kant, the capacity to act freely for the sake of a particular, non-intrinsically moral end is not exhausted by the ability to step back, reflect and decide whether a desire is or can provide a reason to act. Rather, Kant shows, the place for the pursuit of particular ends is determined by practically rational agents’ spontaneous constitution of their moral character, whereby they subordi- nate the pursuit of material, particular ends to the pursuit of formal, moral ones or vice versa. The World Health Organisation declared COVID-19 a global pandemic on 11th March 2020, recognising that the underlying SARS-CoV-2 has caused the greatest global crisis since World War II. In this chapter, we present a framework to evaluate whether and to what extent the use of digital systems that track and/or trace potentially infected individuals is not only legal but also ethical.

This article discusses three different conceptions of ethics within contemporary feminist theory and how they depict the connection between ethics and politics. The first position, represented by Wendy Brown, mainly describes ethics as a sort of anti-political moralism and apolitical individualism, and hence as a turn away from politics. The second position, represented by Saba Mahmood, discusses ethics as a precondition for politics, while the third position, represented by Vikki Bell, depicts it as the ‘external consciousness’ of the political, and (...) as destabilising political discourse by confronting it with singularity and ‘radical’ difference. Though they represent distinct positions, the article argues, all three suffer from a tendency to reify ethics by failing to give a contextualised account of it. The article then introduces the ethical perspective of Judith Butler, arguing that she – while offering both a transhistorical and a contextualised dimension – tends to psychologise and individualise ethics and politics. The last part of the article introduces Terry Eagleton and what, in a Marxist vein, could be called a ‘materialist ethics’ or an ‘ethics of socialism’, and argues that this way of framing the relationship between ethics and politics provides a solution to the trap of reification identified in the three described positions. This part also discusses how Eagleton’s theory relates to – but also differs from – arguments made by Butler. One advantage of Eagleton’s work, the article argues, is that it does not psychologise and individualise ethics and politics as Butler’s work does. (shrink)

Reconstructions of quantum theory are a novel research program in theoretical physics which aims to uncover the unique physical features of quantum theory via axiomatization. I focus on Hardy’s “Quantum Theory from Five Reasonable Axioms” (2001), arguing that reconstructions represent a modern usage of axiomatization with significant points of continuity to von Neumann’s axiomatizations in quantum mechanics. In particular, I show that Hardy and von Neumann share similar methodological ordering, have a common operational framing, and insist on the empirical basis (...) of axioms. In the reconstruction programme, interesting points of discontinuity with historical axiomatizations include the stipulation of a generalized space of theories represented by a framework and the stipulation of analytic machinery at two levels of generality (first by establishing a generalized mathematical framework and then by positing specific formulations of axioms). In light of the reconstruction programme, I show that we should understand axiomatization attempts as being context–dependent, context which is contingent upon the goals of inquiry and the maturity of both mathematical formalism and theoretical underpinnings within the area of inquiry. Drawing on Mitsch (2022)’s account of axiomatization, I conclude that reconstructions should best be understood as provisional, practical, representations of quantum theory that are well suited for theory development and exploration. However, I propose my context–dependent re–framing of axiomatization as a means of enriching Mitsch’s account. (shrink)

Physical entities are not fundamentally mental (that is, do not individually possess or bestow mentality) Here I explore the extent to which the appeals to fundamental physics and to the NFM (“no fundamental mentality”) constraint are appropriate for characterizing the physical, (...) especially for purposes of formulating physicalism. Ultimately, I motivate and defend a version of an account incorporating both components: The physics-based NFM account: An entity existing at a world w is physical iff (i) it is treated, approximately accurately, by current or future (in the limit of inquiry, ideal) versions of fundamental physics at w, and (ii) it is not fundamentally mental (that is, does not individually either possess or bestow mentality). Research groups around the world are currently busy trying to invent new life in the laboratory, looking for extraterrestrial life, or making machines increasingly more life-like. In the case of astrobiology, any newly discovered life would likely be very old, but when discovered it would be new to us. In the case of synthetic organic life or life-like machines, humans will have invented life that did not exist before. Together, these endeavors amount to what we call the emerging plurality of (...) lives because we see a future where we are surrounded by, and interact with, life of many different origins, as well as entities that we have not traditionally seen as being alive. In the future these entities will likely possess properties that we so far have only associated with living beings, thereby transcending and perhaps blurring the borders between life and non-life. In the Statesman, Plato seems to be advocating that in the absence of a true king who will rule independently of laws, the next best thing as far as just rule is concerned is to ad here rigidly to existing laws, whatever they are. The rule of the true king is given as an example of virtuous rule in the sense that virtue politics or jurisprudence holds that laws cannot always deal justly with particular cases. But Plato’s view of what (...) we must do when there are no true kings forthcoming seems to preclude a virtue theoretical understanding of politics and laws. In this paper I will investigate the view that the image of the true king, who relies on written laws for convenience only, provides a model for a more realistic appeal to virtue in jurisprudence, that is, a respect of laws that is compatible with equity, in the sense understood by Aristotle.Čini se da Platon u Državniku zagovara shvaćanje prema kojemu u odsutnosti istinskog kralja koji će vladati neovisno o zakonima druga najbolja stvar, što se tiče pravedne vladavine, jest strogo pridržavanje postojećih zakona, što god oni bili. Uloga istinskog kralja navodi se kao primjer vrle vladavine u tom smislu što politika ili jurisprudencija koje se zasnivaju na vrlini drže da zakoni ne mogu uvijek pravedno izlaziti na kraj s pojedinačnim slučajevima. No čini se da Platonovo shvaćanje toga što moramo činiti kada ne postoje istinski kraljevi sprječava razumijevanje politike i zakonâ koje se zasniva na teoriji vrline. U ovom članku ispitujem shvaćanje prema kojemu slika istinskog kralja, koji se na pisane zakone oslanja samo iz praktičnih razloga, pruža model za realističnije pozivanje na vrlinu u jurisprudenciji, to jest poštivanje zakonâ koje je spojivo s nepristranošću u onom smislu u kojem to razumije Aristotel. This paper explores the various ways Aristotle refers to and employs “heat and cold” in his embryology. In my view, scholars are too quick to assume that references to heat and cold are references to matter or an animal’s material nature. More commonly, I argue, Aristotle refers to heat and cold as the “tools” of soul. As I understand it, Aristotle is thinking of heat and cold in many contexts as auxiliary causes by which soul activities (primarily “concoction”) are carried (...) out. This, as I argue, is what it means to call them “tools” of soul. An upshot of this investigation is the fuller picture of Aristotle’s conception of efficient causation it provides in general, and the better understanding of the efficient causal operation of an organism’s nature or soul it provides in particular. Imaginative resistance refers to a perceived inability or unwillingness to enter into fictional worlds that portray deviant moralities (Gendler, 2000): we can all easily imagine that dragons exist, but many people feel incapable of imagining fictional worlds in which morality works differently. Although this phenomenon has received much attention from philosophers, no one has attempted to operationalize the construct in a self-report scale. In Study 1, we developed the Imaginative Resistance Scale (IRS), investigated its relationship to theoretically related constructs, and (...) confirmed its structure and reliability (rα = 0.92) in a large sample. In Study 2, we asked participants to rate scenarios expected to provoke imaginative resistance and predicted these ratings from the IRS and its validity measures. IRS scores accounted for variability in ease of imagining these scenarios over and above gender, political orientation, and three related measures. The results are discussed in terms of theories of imaginative resistance and directions for future research. (shrink)

This chapter presents an overview of the contributions to the section on Experimental Mathematics by focusing in particular on how they characterize the phenomenon of “experimental mathematics” and its origins. The second part presents two case studies illustrating how experimental mathematics is understood in contemporary analysis. The third section offers a systematic presentation of the contributions to the section.

Fallibilists claim that one can know a proposition on the basis of evidence that supports it even if the evidence doesn't guarantee its truth. Jessica Brown offers a compelling defence of this view against infallibilists, who claim that it is contradictory to claim to know and yet to admit the possibility of error.

Drawing on recent work in formal pragmatic theory, this paper shows that the manipulation of discourse structure—in particular, by way of shifting the Question Under Discussion mid-discourse—can constitute an act of epistemic injustice. I argue that the “All Lives Matter” response to the “Black Lives Matter” slogan is one such case; this response shifts the Question Under Discussion governing the overarching discourse from Do Black lives matter? to Which lives matter? This manipulation of the discourse structure systematically obscures the intended (...) meaning of “Black lives matter” and disincentivizes future utterances of it. (shrink)
