For liberal contractarians, moral and political principles are justified if agreeable to persons as free and equals. But for critics of liberal contractarianism, this justification applies only to those capable of agreement. Understanding why contractarianism suffers from the problem of exclusion helps up understand the distinctive character of contractarianism and the importance of agreement in particular. I suggest contractarianism need not be objectionably exclusive. I first consider why agreement is important in contractarianism, and then introduce the main versions of contemporary (...) contractarianism and their different understandings of agreement. I discuss how agreement results in exclusion in each, and distinguish two kinds of response to the problem of exclusion: differential inclusion and permissive inclusion. Differential inclusion is unsuccessful because it offers those not fully capable of agreement unequal status. Permissive inclusion may either make the circumstances of agreement more open, or characterize the capacities required for inclusion more permissively. I advocate the latter as the most promising response to the problem of exclusion. I outline a more inclusive contractualism based on the capacity to share goals. (shrink)

First published in 1959, this original study argues that the main characteristic of music is that it expresses and evokes emotion, and that all composers whose music has a tonal basis have used the same, or closely similar, melodic phrases, harmonies, and rhythms to affect the listener in the same ways. He supports this view with hundreds of musical examples, ranging from plainsong to Stravinsky, and contends that music is a language in the specific sense that we can identify idioms (...) and draw up a list of meanings. The book's final section analyzes two symphonies, Mozart's Fortieth and Vaughan Williams's Sixth, to explore the nature of musical inspiration and the process whereby the notes actually convey emotion from composer to listener. Michael Cook's classic study, Commanding Right and Forbidding Wrong in Islamic Thought (Cambridge, 2001), reflected upon the Islamic injunction to forbid wrongdoing. This book is a short, accessible survey of the same material. Using Islamic history to illustrate his argument, Cook unravels the complexities of the subject by demonstrating how the past informs the present. At the book's core is an important message about the values of Islamic traditions and their relevance in the modern world.

In this paper I examine the prospects for a successful neo–logicist reconstruction of the real numbers, focusing on Bob Hale's use of a cut-abstraction principle. There is a serious problem plaguing Hale's project. Natural generalizations of this principle imply that there are far more objects than one would expect from a position that stresses its epistemological conservativeness. In other words, the sort of abstraction needed to obtain a theory of the reals is rampantly inflationary. Hospital ethics committees have evolved as a response to complicated legal, ethical, and social dilemmas that accompany modern medicine. In the United States, their growth has been augmented by Joint Commission for the Accreditation of Healthcare Organizations standards and the Patient Self-Determination Act. There appears to be an implicit presumption that all clinical ethics consultation practices are relatively similar. Finally, there is heightened awareness of the needs for quality standards and assessment of the outcomes of ethics consultations.

We are printing, by kind permission of the Law Commission, two sections of the report of the Law Commission on injuries to unborn children. This report was the result of a request to the Law Commission by the Lord Chancellor at the time (Lord Hailsham of Saint Marylebone) to advise on `what the nature and extent of civil liability for antenatal injury should be'. The Law Commission followed its usual practice in such circumstances of consulting various bodies and obtaining expert (...) advice on the subject and then embodying the results in a working paper (Working Paper No. 47 - injuries to unborn children) published on 19 January 1973, which preceded their report (Cmnd 5709). Meanwhile a Royal Commission is considering much wider issues of civil liability for injury (including antenatal injury) but the terms of reference for the Law Commission were much narrower and confined to the position of children injured before birth. In the section relating to the present law the report makes it clear that it is probable that liability under the common law already exists. The Scottish Law Commission has also issued a report (Cmnd 5371). They were given different terms of reference and came to somewhat different conclusions. We are printing from this long report the paragraphs discussing the medical background and the summary of recommendations. As will be evident on reading the paragraphs on the medical background to injuries to the unborn child, events are moving very rapidly, particularly in the study of congenital defects and the effects of drugs but the problems of proof present great difficulty. Other causes of injury to the unborn child are better known to the general public: for example, those following the illness, infection and disease of the mother during pregnancy, injury caused in attempted termination of pregnancy and the risks resulting from the mother's condition. The summary of the recommendations sets out very clearly the legal position of the unborn child, as the Law Commission sees it, arising from injury before birth, the final conclusion being that `legislation is desirable'. These extracts from the report, apart from their intrinsic interest, lead on to the paper by Mr Kennedy and Dr Edwards in which they set out their criticisms of it, and provide quick references to the original document. This educators’ introduction to semiotics describes a communications phenomenon that has permeated and influenced learner attitudes, behaviors and cognition in any learning environment but especially formal mediated learning environments. Relevant semiotic theory is meaningfully integrated into each chapter.

For Martin, the right to free higher education may be claimed only by those ready and willing pursue autonomy supporting higher education. The unready and unwilling, among whom may be counted carers, disabled, and devout, are excluded. This is unjust. I argue that this injustice follows from a tension between three elements of Martin’s argument: (1) a universal right to autonomy supporting higher education; (2) qualifications on entitlements to access this right in order to preserve the value of higher educational (...) goods; (3) luck egalitarian motivations in Martin’s distributive ethics. I consider options for avoiding such injustices and their implications for Martin’s argument. (shrink)

In one of his many metaphorical turns of phrase – a leitmotif in The Philosophical Discourse of Modernity — Jürgen Habermas speaks of the path not taken by modern philosophers, a path that might have led them towards his own intersubjective notion of communicative reason. Habermas is especially critical of his predecessors, Theodor W. Adorno and Max Horkheimer, because, he believes, they repudiated the rational potential in the culture of modernity. Whenever Adorno and Horkheimer heard the word ‘culture’, they apparently (...) reached for their revolvers. By the 1940s, their confidence in modern culture had allegedly succumbed to bitter disillusionment. Indeed, on Habermas's view, the confidence of these early critical theorists had been shaken so badly by the emergence of Nazism and Stalinism that their scepticism finally embraced reason itself, ‘whose standards ideology critique had found already given in bourgeois ideals’. Consequently, Adorno and Horkheimer were forced to call into question their own immanent critique of modernity: ideology critique itself came ‘under suspicion of not producing truths’. These philosophers supposedly had little choice but to render their now suspect critique ‘independent even in relation to its own foundations’. (shrink)

There is broad agreement that child labor is wrong and should be eliminated. This chapter examines the three main moral objections to child labor and considers their limitations: harm-based objections, objections from failing to benefit children, and objections from exploitation. Harm-based objections struggle with baselines for comparison and difficulties with Non-Identity problems. Even if child labor is not harmful, it may be wrong because it prevents children from enjoying other benefits, such as schooling. However, is schooling necessarily more beneficial for (...) children than work? Some kinds of child labor may not be harmful, and may benefit children, but they may still be wrong because they are exploitative. I consider some ways to address exploitative child labor, inspired by campaigns led by child workers. The chapter ends with a surprising conclusion that challenges the broad consensus with which we began: we may have duties to promote child labor. (shrink)

Thus, there is an urgent need for better understanding of these issues.Susan Schneider, in her book Artificial You: AI and the Future of Your Mind, offers an exceptionally careful and insightful examination of key issues entailed in how we understand AI and ourselves. One of her central concerns is how we might test for machine consciousness. Given the variations in design and function among current and projected AIs, Schneider sees no likely one-size-fits-all test. So, she offers a battery of different tests that she believes together will make such testing more reliable. This seems a wise approach, and reflects the conceptual and pragmatic care Schneider takes throughout the book.Similarly, it seems to me that the question of machine consciousness should also include various understandings of consciousness itself. What consciousness is taken to be has varied widely both historically and culturally. No commonly accepted single understanding has emerged, and may never emerge. Just as having a battery of tests might help us better assess possible machine consciousness, having different understandings of consciousness might give us a better understanding of what we are testing for. The two should work in tandem, each gauging and shaping the other.Like the development of computers themselves, the predominant thinking about AI has been shaped, in part, by key presuppositions of a scientific worldview, with its origins in Western thought and culture. Among these presuppositions are materialism, reductionism, and a primary focus on objective behavior. These are reflected in the common concern with observable behavior of physical aspects of the brain in efforts to understand human consciousness, which in turn has become a familiar model for work on machine consciousness. All this is important and valuable work. But, in the spirit of Schneider's cautions, it should not be taken as one-size-fits-all. Accordingly, I offer one view of consciousness from a different perspective.In what follows, I sketch out an understanding of consciousness that draws on Japanese philosophy, particularly that of the highly influential early twentieth-century Japanese philosopher Kitarō Nishida (1870–1945). I then explore how the tests for machine consciousness that Schneider proposes might be viewed from that perspective.Consciousness: A Perspective from Japanese PhilosophyConsciousness was a central concern for Nishida, whose philosophy is deeply informed by Japanese culture and by Zen theory and practice. As one might expect from such a philosopher, Nishida's exploration of consciousness is not concerned with properties of the brain, but with what we might discern through disciplined reflection on the experience of our own consciousness. Ultimately, he views consciousness as an organic whole [End Page 306] of systemically organized interrelationships of activities and sensations within our subjective experience. This may be understood by first considering 'nothingness'.For Nishida, nothingness does not suggest an ultimate and absolute vacuity, as is often understandably assumed. In Nishida's sense, it is a singular "place" that mirrors the multifaceted world of our common experience. In understanding this, I am told by native Japanese speakers that the English word 'nothingness' has an advantage over the Japanese equivalent, 'mu', in that 'nothingness' can usefully be broken down as 'nothing-ness'. This suggests that nothingness is a state of consciousness where what we commonly experience as distinct (self, other, world, blue, ache, joy, etc.) is indistinct, a state of unified experience. This is consciousness without our finding or discriminating in it the myriad "things" of common experience, but rather a "pure experience" of a singular whole.
