American criminal justice has undergone a sad odyssey over the last 175 years. In the early nineteenth_century, when Alexis de Tocqueville arrived to study American prisons, American criminal punishment was regarded as a model for the civilized world. Today, by contrast, America is widely regarded with horror. What happened? This Article focuses on some Tocquevillean themes. The roots of the harsh criminal punishment regime of the contemporary United States have to do with some of the aspects of "Democracy in America" (...) that Tocqueville found most entrancing. These include traditions of popular sovereignty, religious freedom and social equality. It may be painful for Americans to acknowledge the possibility that some of their most cherished ideals may have ugly consequences for criminal punishment, but they must do so. (shrink)

Over the last forty years several historians have drawn attention to aspects of the activities of lecturers on natural philosophy in Britain in the eighteenth century. Hans and others looked at the part these lecturers played in the development of education, particularly adult education. Musson and Robinson considered the possible connection between the work of the lecturers and the growth of industry, and Inkster and others have explored the relationship between lecturers and the institutions set up to support science, especially (...) around 1800.4 More recently, Schaffer has pointed to the parallels between the performances of the lecturers on natural philosophy and other contemporary cultural activities. As a consequence of these studies we know much more about the work of the lecturers, its significance, and, to a lesser extent, their relationship to their audience. (shrink)

At the turn of the twentieth century, biologists such as Oscar Riddle, Thomas Hunt Morgan, Frank Lillie, and Richard Goldschmidt all puzzled over the question of sexual difference, the distinction between male and female. They all offered competing explanations for the biological cause of this difference, and engaged in a fierce debate over the primacy of their respective theories. Riddle propounded a metabolic theory of sex dating from the late-nineteenth century suggesting that metabolism lay at the heart of sexual difference. (...) Thomas Hunt Morgan insisted on the priority of chromosomes, Frank Lillie emphasized the importance of hormones, while Richard Goldschmidt supported a mixed model involving both chromosomes and hormones. In this paper, I will illustrate how the older metabolic theory of sex was displaced when those who argued for the relatively newer theories of chromosomes and hormones gradually formed an alliance that accommodated each other and excluded the metabolic theory of sex. By doing so, proponents of chromosomes and hormones established their authority over the question of sexual difference as they laid the foundations for the new disciplines of genetics and endocrinology. Their debate raised urgent questions about what constituted sexual difference, and how scientists envisioned the plasticity and controllability of this difference. These theories also had immediate political and cultural consequences at the turn of the twentieth century, especially for the eugenic and feminist movements, both of which were heavily invested in knowledge of sex and its determination, ascertainment, and command. Organismal form arises by the coordinated movement, arrangement, and activity of cells. In metazoans, most morphogenetic programs that establish the recognizable body plan of any given species are initiated during the developmental period, although in many species growth continues throughout life. By comparing the cellular and molecular development of the bilaterians (bilaterally symmetrical animals) to the development of their closest outgroup, the cnidarians, it appears that morphogenesis and the cell fate specification associated with germ layer formation during the process of (...) gastrulation are separately controlled by two distinct downstream pathways (canonical and planar cell polarity) of Wnt signaling. Furthermore, a fundamental change in the early developmental program, the positioning of the site of gastrulation, allowed the spatial separation of gene regulatory networks that facilitated the rapid diversification of bilaterian body plans. Contra Jackendoff, we argue that within the parallel architecture framework, the generality of language does not require a rich conceptual structure. To show this, we put forward a delegation model of specialization. We find Jackendoff's alternative, the subdivision model, insufficiently supported. In particular, the computational consequences of his representational notion of modularity need to be clarified.

As the burden of misconduct in medical research is increasingly recognised, questions have been raised about how best to address this problem. Whilst there are existing mechanisms for the investigation and management of misconduct in medical literature, they are inadequate to deal with the magnitude of the problem. Journal editors and publishers play an essential role in protecting the veracity of the medical literature. Whilst ethical guidance for journal editors and publishers is important, it is not as readily enforceable as (...) legal obligations might be. This article questions the legal obligations that might exist for journal editors and publishing companies with respect to ensuring the veracity of the published literature. Ultimately, there is no enforceable legal obligation in Australia, the United Kingdom, or the United States. In light of this, more robust mechanisms are needed to deliver greater confidence and transparency in the investigative process, the management of concerns or findings of misconduct and the need to cleanse the literature. We show that the law disincentivises journals and publishers from ensuring truth in their publications. There are harmful consequences for medical care and public confidence in the medical profession and health care system when the foundations of medical science are questionable. (shrink)

"Quasi-memories," necessarily presupposing a distinction between an "experiencing" and a "remembering" person, are considered by Parfit and Shoemaker as necessary and/or sufficient criteria for personal identity. However, the concept of "q-memories" is rejected by Schechtman since, according to her, neither "content" and "experience" can be separated from each other in "q-memories" ("principal inseparability") nor can they be distinguished from delusions/confabulations ("principal indistinguishability"). The purpose of the present paper is to demonstrate that, relying on a neurophilosophical approach, both arguments can be (...) rejected. Neuropsychological research shows that "contents" of memories are classified according to the accompanying psychological state such that the same "content" can be classified either as auto- or heterobiographical by the respective "experience." Since "content" and "experience" can be separated from each other, the argument of "principal inseparability" must be rejected on empirical grounds. In addition, as demonstrated in an example of a schizophrenic patient, "q-memories" can be distinguished from delusions/confabulations considering the ability to distinguish between different sources of autobiographical memories as a differential criterion. In conclusion, both arguments by Schechtman against the concept of "q-memories" have to be rejected on the basis of neurophilosophical considerations. Consequently, the concept of "q-memories" can be considered as compatible with current empirical knowledge. (shrink)

Type-B materialists (to use David Chalmers's jargon) claim that though zombies are conceivable, they are not metaphysically possible. This article calls this position regarding the relation between metaphysical and epistemic modality “modal autonomism,” as opposed to the “modal rationalism” endorsed by David Chalmers and Frank Jackson, who insist on a deep link between the two forms of modality. This article argues that the defense of modal rationalism presented in Chalmers and Jackson (2001) begs the question against the type-B materialist/modal autonomist. (...) The argument proceeds as follows. Modal rationalists claim that for all nonphenomenal macro properties, the appropriate supervenience conditional is both necessary and a priori. Hence, type-B materialists must engage in special pleading when they claim that the relevant supervenience conditional for phenomenal properties, expressing the supervenience of the phenomenal on the physical, is necessary but not a priori. However, what Chalmers and Jackson demonstrate, if anything, is that the conditional that includes all the microphysical plus the phenomenal in the antecedent, and nonphenomenal macro facts (such as facts about water and other natural kinds, among other things) in the consequent, is a priori. The question arises why, since facts about water and the like do not metaphysically supervene on the phenomenal facts, is it appropriate to include the phenomenal facts in the antecedent of the relevant supervenience conditional. This article argues for the following claims: First, that it's crucial to the general semantic framework Chalmers and Jackson defend that they do include the phenomenal facts in the supervenience conditional; without them, the conditional would not be a priori. Second, that the only way to argue from the a priori character of these conditionals to the applicability of modal rationalism to the nonphenomenal cases is to rely either on modal rationalism itself or on the denial of type-B materialism. Obviously, in the context of this argument, either way would beg the question. (shrink)

This paper examines potential differences in land use between Q'eqchí Maya and Ladino farmers in a remote agricultural frontier in northern Petén, Guatemala. The research site, the Sierra de Lacandón National Park, is a core conservation zone of Guatemala's Maya Biosphere Reserve. In recent years, much has been written about the dramatic process of colonization and deforestation in Petén, Guatemala's largest and northernmost department. Since the early 1980s a rapid rural transformation has occurred where once remote forested regions have been (...) colonized by small farmers, and lands have been converted to maize fields and cattle pastures. Consequently, less than half of the original forest cover in the department remains. Although approximately half of Petén's rural settlers have been Q'eqchí Maya, their land use, and its subsequent impact on Petenero forests, has been little studied. Results suggest that despite heterogeneous land use systems in migrant origin areas, given similar physical and socio-economic conditions following settlement in this remote frontier, Q'eqchí and Ladino farmer land use is remarkably similar. Only a modest land use difference appears to exist between the two groups: Q'eqchí Maya appear to have more extensive swidden maize rotations while Ladinos dedicate more land to pasture. (shrink)

In the Ethics Spinoza defines certain traditional virtues such as humility and repentance as species of sadness and denies that they are virtues. He nonetheless holds that they can turn out to be useful as a means towards virtue—in fact, the greatest virtue of blessedness—in the life of someone who is not guided by reason. In this paper, I examine Spinoza’s relatively overlooked claim regarding the usefulness of sad passions as a means towards blessedness. In taking up Spinoza’s treatment of (...) humility as my case study, I show that there is a tension between this claim and his other explicit commitments in the Ethics. More specifically, after considering his views regarding the consequences of humility—including, most notably, its susceptibility to envy—and conditions of achieving blessedness, I show that humility cannot effectively be said to bring about cooperation and push “weak-minded” people in the right direction so that, in the end, they may be free and enjoy blessedness. I conclude by suggesting that if we must rely on passions as a means towards virtue in the Spinozistic universe, we must rely not on debilitating sad passions such as humility, but on joy-based social passions such as love. -/- . This essay examines the role that circumstances play in determining the morality of moral acts as presented in ST I-II, q. 18 and argues that q. 18 uses two different sets of principles that are left unreconciled in the text. The paper argues that consequently the text is not coherent but is radically divided; specifically, q. 18 holds both that a circumstance—by virtue of being a true circumstance and accident of the act—can make a good act evil but also that (...) whenever a circumstance renders a good act evil it must cease to be a circumstance and an accident. This paper then shows that in De Malo, q. 2 Aquinas provides a distinct and heretofore unappreciated account of circumstances and that he explicitly used the unique features of this account to reconcile the propositions that were left unreconciled in q. 18. We also show how these results can be applied to provide proofs or new proofs of upper density results in local structures of s-degrees and Q-degrees.

When some P implies some Q, this should have some impact on what attitudes we take to P and Q. In other words: logical consequence has a normative import. I use this idea, recently explored by a number of scholars, as a stepping stone to a bolder view: that relations of logical consequence can be identified with norms on our propositional attitudes, or at least that our talk of logical consequence can be explained in terms of such (...) norms. I investigate the prospects of such a cognitive norm account of logical consequence. I go over the challenges involved in finding a plausible bridge principle connecting logical consequence to cognitive norms, in particular a biconditional principle that gives us not only necessary but sufficient conditions for logical consequence in terms of norms on propositional attitudes. Then, on the assumption that an adequate norm can be found, I consider what the philosophical merits of such a cognitive norm account would be, and what theoretical commitments it would generate. We trace two logical ideas further back than they have previously been traced. One is the idea of using diagrams to prove that certain logical premises do—or don’t—have certain logical consequences. This idea is usually credited to Venn, and before him Euler, and before him Leibniz. We find the idea correctly and vigorously used by Abū al-Barakāt in 12th century Baghdad. The second is the idea that in formal logic, P logically entails Q if and only if every model of (...) P is a model of Q. This idea is usually credited to Tarski, and before him Bolzano. But again we find Abū al-Barakāt already exploiting the idea for logical calculations. Abū al-Barakāt’s work follows on from related but inchoate research of Ibn Sīnā in eleventh century Persia. We briefly trace the notion of model-theoretical consequence back through Paul the Persian and in some form back to Aristotle himself. (shrink)

An enquiry into plant consciousness requires, on the one hand, taking into account recent experiments in plant biology and, on the other hand, refining the theoretical framework of behaviour and the various degrees of cognition. The main goal of this contribution is to advance such a framework by comparing classical animal and human cognition approaches with the theories of minimal cognition. This leads us to interpret more carefully the various plant activities and to highlight the limits of classical theories of (...) zoocentric cognition. In particular, the article shows that the notions of cognition and consciousness are often abusively confused, and with that of behaviour. Once this ambiguity is removed, it is possible to better distinguish several meanings of consciousness and to evaluate their relevance to plant activities. (shrink)

Why is American punishment so cruel? While in continental Europe great efforts are made to guarantee that prisoners are treated humanely, in America sentences have gotten longer and rehabilitation programs have fallen by the wayside. Western Europe attempts to prepare its criminals for life after prison, whereas many American prisons today leave their inhabitants reduced and debased. In the last quarter of a century, Europe has worked to ensure that the baser human inclination toward vengeance is not reflected by state (...) policy, yet America has shown a systemic drive toward ever increasing levels of harshness in its criminal policies. Why is America so short on mercy? In this deeply researched, comparative work, James Q. Whitman reaches back to the 17th and 18th centuries to trace how and why American and European practices came to diverge. Eschewing the usual historical imprisonment narratives, Whitman focuses instead on intriguing differences in the development of punishment in the age of Western democracy. European traditions of social hierarchy and state power, so consciously rejected by the American colonies, nevertheless supported a more merciful and dignified treatment of offenders. The hierarchical class system on the continent kept alive a tradition of less-degrading "high-status" punishments that eventually became applied across the board in Europe. The distinctly American, draconian regime, on the other hand, grows, Whitman argues, out of America's longstanding distrust of state power and its peculiar, broad-brush sense of egalitarianism. Low-status punishments were evenly meted out to all offenders, regardless of class or standing. America's unrelentingly harsh treatment of trangressors--this "equal opportunity degradation"-- is, in a very real sense, the dark side of the nation's much vaunted individualism. A sobering look at the growing rift between the United States and Europe, Harsh Justice exposes the deep cultural roots of America's degrading punishment practices. (shrink)
