This paper focuses on ethics in community-based participatory research (CBPR) from inception to post-publication. Central to CBPR is a collaborative, partnership approach that recognises the strengths of partners and engages their distinctive voice and knowledge in the research process. While the ethical complexities that arise in the course of research practice in CBPR can transcend individual projects, they are also grounded in the particularity of the project, community, and research partners. This paper reflects on the experiences of two participatory social (...) policy research projects on housing in Ireland, conducted over the past three years. These projects involved collaborating with older people living in rural areas nationwide and with residents of small communities on offshore islands. The paper explores the ethics of engagement (regarding methods of involvement and access), and the ethics of representation (incorporating the depiction and sharing of research findings) and argues that researchers must pay attention to the specificity of each project and be alive to generating an organic research ethics in how research is set up, conducted, represented, and disseminated. In so doing, we can better foster agency and authenticity in the relationships developed throughout research processes and reflect on and meet shared values and responsibilities. (shrink)

In the transcendental aesthetic of the Critique of Pure Reason, Kant claims that space and time are neither things in themselves nor properties of things in themselves but mere subjective forms of our sensible experience. Call this the Subjectivity Thesis. The striking conclusion follows an analysis of the representations of space and time. Kant argues that the two representations function as a priori conditions of experience, and are singular "intuitions" rather than general concepts. He also contends that the representations underwrite (...) some non-trivial a priori cognition of the objects of sensible experience. The Subjectivity Thesis is then presented as an immediate consequence: Space represents no property at all of any things in themselves nor any relation of them to each other. . . . For neither absolute nor relative determinations can be intuited prior to the existence of the things to which they pertain, thus [neither] can be intuited a priori. Time is not something which exists of itself, or which inheres in things as an objective determination. . . . For more than 20 years, Western science education has been incorporated into Tibetan Buddhist monastics’ training. In this time, there have been a number of fruitful collaborations between Buddhist monastics and neuroscientists, neurologists, and psychologists. These collaborations are unsurprising given the emphasis on phenomenological exploration of first-person conscious experience in Buddhist contemplative practice and the focus on the mind and consciousness in Buddhist theory. As such, Tibetan monastics may have underappreciated intuitions on the intersection of science, medicine, and ethics. Yet (...) despite their overlapping interests, Buddhist perspectives are largely absent in contemporary neuroethical analysis, apart from conceptual arguments for their relevance. This article attempts to fill this gap by presenting the results of eleven semi-structured interviews with Tibetan Buddhist monastics in India on three issues in neuroethics: identity and authenticity, enhancement, and disorders of consciousness. The results of this empirical study reinforce the conclusions of theoretical work on Buddhism and neuroethics while also identifying future areas of inquiry, including the importance of community, the challenges in acting from compassion, and the value of self-directed mental cultivation. This is a series of reflections on the aesthetic dimensions of law (how it is presented and conveyed to its subjects) and justice (the ways in which justice can be aesthetically satisfying or dissatisfying).

Incongruent counterparts are pairs of objects which cannot be enclosed in the same spatial limits despite an exact similarity in magnitude, proportion, and relative position of their parts. Kant discerns in such objects, whose most familiar example is left and right hands, a “paradox” demanding “demotion of space and time to mere forms of our sensory intuition.” This paper aims at an adequate understanding of Kant’s enigmatic idealist argument from handed objects, as well as an understanding of its relation to (...) the other key supports of his idealism. The paper’s central finding is that Kant’s idealist argument from incongruent counterparts rests essentially on his theory of freedom. The surprising result sheds new light on deep and overlooked links among the pillars of transcendental idealism, pointing the way to a comprehensive and unified reading of Kant’s system of idealist arguments. A central doctrine of Kant's Critique of Pure Reason holds that the content of human experience is rooted in an affection of sensibility by unknowable things in themselves. This famous and puzzling affection doctrine raises two seemingly intractable old problems, which can be termed the Indispensability and the Consistency Problems. By what right does Kant present affection by supersensible entities as an indispensable requirement of experience? And how could any argument for such indispensability avoid violating the Critique's doctrine of noumenal (...) ignorance? This essay develops a new solution to both problems, setting out from the continuity between Kant's early and mature views on sensibility and mind-world relations. Kant's early writings subscribe to an interactionist cosmology opposed to both Leibniz's preestablished harmony and Malebranche's occasionalism. The modern debate on mind-world relations shaping Kant's early cosmology points us to a widely recognized motivation for interactionism, turning on a constraint on agency within certain noninteractionist cosmologies. In particular, Kant's early conversion to a libertarian theory of freedom, together with his rejection of occasionalism, provides the basis for a compelling argument for the indispensability of world-mind affection relations. Extended to the transcendental idealist framework, the same argument reveals noumenal affection as an indispensable presupposition of some knowledge claims consistently upheld by Kant. This leads in turn to a satisfying solution to the Consistency Problem, showing that the doctrine of noumenal affection is not merely consistent with, but is partly motivated by, Kant's commitment to noumenal ignorance. The elimination of gatekeepers for scientific publication has been represented as a means to promote the core moral values of open science, including democratic decision-making and inclusiveness. I argue that this framing ignores the reality that gatekeeping is a way of structuring prestige hierarchies, and that without gatekeeping, some other structuring would be needed: the flattening of prestige hierarchies is not possible given scientists’ need to navigate information overload. I consider two potential restructurings of prestige hierarchies, one based on citation (...) count and the other on search algorithm rank. These are shown to simply reintroduce status biases and hierarchies in ways that either do not further the open science ideals of democracy and inclusiveness, or else involve some de facto gatekeeping. Gatekeeper elimination should not be thought of as an intrinsic part of the open science movement. In fact, insofar as gatekeeping is guided by professional ideals of impartiality and diligence, it can be thought of as an ally of open science values. (shrink)

This essay argues that Marcus Garvey held a constructivist theory of self-determination, one that saw nationalism and transnationalism as mutually necessary and reinforcing ideals. The argument proceeds in three steps. First it recovers Garvey’s transnationalist emphasis by looking at his intellectual debts to other diaspora struggles, namely political Zionism and Irish nationalism. Second it argues that Garvey held a constructivist view of national identity, which also grounds his argument that the black diaspora has a right to collective self-determination. Third it (...) explicates Garvey’s further contention that the right to self-determination and the persistence of oppression give the African diaspora a pro tanto claim to an independent state, which he considered essential to vanquishing white supremacy and realizing collective self-rule. Recent studies have explored the effectiveness of open-label placebos for a variety of conditions, including chronic pain, cancer-related fatigue and irritable bowel syndrome. OLPs are thought to sidestep traditional ethical worries about placebos because they do not involve deception: with an OLP, patients or subjects are told outright that they are not given an active substance. As deception is framed as the primary hurdle to ethical placebo use, the door is ostensibly opened to ethical studies of OLPs. In this article, (...) I suggest that even though OLPs seemingly do not involve deception, there are other ethical considerations in their clinical investigation and subsequent use. Research ethics often focusses on informed consent—of which, deception and honesty are a piece—as a means to justify research practices with human subjects. Yet, it is but one of the ethical considerations that should be taken into account. With research into placebo effects in particular, I argue that the history of clinical placebo use grounds special considerations for OLP research that go beyond respect for the autonomy of individual patients through informed consent and encompass structural concerns about the type of patient for whom a placebo has historically been thought appropriate. The relationship between tort law jurisprudence and the ethics and phenomenology of Emmanuel Levinas.

This paper argues that the concept of paternalism is currently overextended to include a variety of actions that, while resembling paternalistic actions, are importantly different. I use the example of Japanese physicians’ non-disclosures of cancer diagnoses directly to patients, arguing that the concept of maternalism better captures these actions. To act paternalistically is to substitute one's own judgement for that of another person and decide in place of that person for his/her best interest. By contrast, to act maternalistically is to (...) decide for another person based on a reasonable understanding of that person's own preferences. The concept of maternalism allows for a more thorough assessment of the moral justification of these types of actions. I conclude that it is possible, at least in principle, to justify Japanese physicians’ non-disclosures, and that this justification must be based on an understanding of these actions as maternalistic. Kant’s Critique of Pure Reason (KrV) presents a priori knowledge of synthetic truths as posing a philosophical problem of great import whose only possible solution vindicates the system of transcendental idealism. The work does not accord any such significance to a priori knowledge of analytic truths. The intelligibility of the contrast rests on the well-foundedness of Kant’s analytic–synthetic distinction and on his claim to objectively or correctly classify key judgments with respect to it. Though the correctness of Kant’s classification is (...) vital to his philosophical project, it has been vigorously challenged since he introduced his famous distinction of judgments. The aim of this essay is to explore several metaphysical motives contributing to Kant’s objective classification claim that have been underemphasized and in part overlooked in the large literature on the topic. ABSTRACT Academic dishonesty has been found to be on the increase globally, affecting the quality of education, ethics of professional practices and career outcome. Substantial literature exists on the role of religious commitment in reducing academic dishonesty, but few or no studies have examined the pathways explaining this link. The present study examined whether self-efficacy mediates the relationship between RC and AD. Undergraduates of the University of Nigeria, Nsukka completed the Academic Dishonesty Scale, Religious Commitment Inventory and New General Self-Efficacy (...) Scale and also provided relevant demographic information. Results of statistical analysis indicated that RC was negatively associated with AD. Self-efficacy was also a partial mediation in the relationship between RC and AD. This implies that self-efficacy contributes to the pathways through which RC influences AD among students. Our findings suggest that consideration of students’ level of self-judgment on their ability to cope with academic demands may be an important target toward enhancing the influence of RC in reducing academic dishonest behaviors among students. Why do we learn some lessons more easily than others - indeed with alacrity and enthusiasm? Often these are not of the most attractive sort. It seems so frequently as if there is a sheer perversity in us.

The presence or absence of consciousness is the linchpin of taxonomy for disorders of consciousness (DOCs), as well as a focal point for end-of-life decision making for patients with DOCs. Focus on consciousness in this latter context has been criticized for a number of reasons, including the uncertainty of the diagnostic criteria for consciousness, the irrelevance of some forms of consciousness for determining a patient’s interests, and the ambiguous distinction between consciousness and unconsciousness. As a result, there have been recent (...) suggestions that perhaps consciousness ought not to play the focal role that it does in decision making for persons with DOCs, and that other considerations, such as patient and family values, ought to take center stage. In this article, I take a step back and reexamine the meaning of consciousness in the DOC taxonomy. I propose that, while consciousness in DOC taxonomy is defined as “wakeful awareness,” this definition, while clinically expedient, occasions ethical misunderstanding. Using resources from non-Western philosophy of mind, I argue that the form of consciousness that is ethically relevant in DOCs is intransitive, or pure. I contrast this pure experience with transitive consciousness to highlight why ethical conclusions ought not define consciousness solely as “wakeful awareness,” even if clinical criteria do. Merleau-Ponty's claim in Phenomenology of Perception (1962) that the anonymous body guarantees an intersubjective world is problematic because it omits the particularities of bodies. This omission produces an account of "dialogue" with another in which I solipsistically hear only myself and dominate others with my intentionality. This essay develops an alternative to projective intentionality called "hypothetical construction," in which meaning is socially constructed through an appreciation of the differences of others.

Members of a National Health Service, or other recognised Research Ethics Committee, in deciding whether or not to withhold their assent for a clinical trial, must obey the law. If they do not do so, then they may become liable to pay personally negligence claims made by injured trials subjects. It could be no defence to say that members had consulted their own lower ethical standards; or merely that they had acted in good faith; or that they had followed Department (...) of Health guidelines, which do not have the force of law. The law requires that the rights, safety, and well-being of clinical trial subjects shall prevail over other interests. REC favourable opinion is a powerful endorsement of a trial, and prospective subjects are invited to rely upon it. REC members are legally bound to exercise their power to withhold assent to any clinical trial which does not give subjects the protection the law requires. (shrink)

This study examines the representation of male and female musicians in world-class symphony orchestras. Personnel of 40 orchestras of three regions, UK, Europe and the USA and distributions of men and women across the four orchestral departments: strings, woodwind, brass and percussion are compared. Significant differences in representation between orchestras of the three regions are reported. Practices adopted by orchestras when appointing musicians to vacant positions are reviewed and numbers of males and females appointed to rank-and-file and Section Principals are (...) compared. Career patterns of male and female musicians are also compared. Increases in numbers of women appointed to orchestral posts in the last three decades are compared with increases in the proportion of women in the general workforce. The data of orchestral membership are then compared with the numbers of young people receiving tuition on orchestral instruments retrieved from a large national database (n = 391,000 students). Implications for the future of male and female representation in orchestral personnel are then considered. (shrink)

The paper examines Kant’s views on divine foreknowledge of contingent truths, in particular truths concerning free actions of creatures. It first considers the shape this traditional philosophical problem takes in the transcendental idealist context. It then situates Kant’s views relative to three competing theories of foreknowledge discussed by Leibniz. These are Molina’s theory of middle knowledge, the Thomist theory of foreknowledge through divine predeterminations, and Leibniz’s own ‘possible worlds’ theory. The paper concludes that no consistent theory of divine foreknowledge emerges (...) in Kant’s philosophy. His discussions alternate between two inadequate and incompatible models. One is a post-volitional model suggested by his conception of the intuitive intellect’s relation to creation. Extended to creaturely free action, it is incompatible with his commitment to the relative autonomy of free action. The other is a version of Leibniz’s possible worlds solution; it cannot underwrite certain foreknowledge of determinate outcomes in a libertarian setting. (shrink)

Here scholar, poet, and statesman take their stand; the philosopher and the theologian have long had theirs, while relative newcomers are the psychologist and sociologist. As long as they speak in harmony, fine. But when discord arises, and the humble teacher finds his work the focus of conflicting theories as to both the aims and methods of education whom should he listen to? Dr Barral is in (...) no doubt whatever. The philosophy of Plato, Socrates and Aristotle, with the theology of St. Augustine and Aquinas are her polar stars. At the same time she does occasionally concede a voice to others, but rather grudgingly. So little indeed that she may well win the argument while failing to win our sympathy. (shrink)

How do physicians handle informing patients of their diagnoses and how much information do patients really want? How do registered nurses view both sides of this question? Three questionnaires were constructed and administered in a mid-size hospital in New York state. Physicians and nurses underestimate the number of patients who want detailed information. Patients who earn more than average, have a college education, and who are under age 60 are more likely to want information, and state that their physician should (...) give it to them. Only 42% of physicians state that patients want a detailed description of their diagnosis and treatment options. Physicians educated outside the USA appeared to be more likely to change their criteria for informing patients and, along with American-educated nurses, were more willing to participate in formal discussions of the issue. Physicians should comply with the wishes of patients for information and include them in the team deciding on diagnosis and treatment. (shrink)

Much of this confusion may be due to Isocrates' famous description of his program as being a philosophia (Panegyricus 10, 47; Evagoras 8, 81; Panathenaicus 9; Against the Sophists 1, 11-18, 21; Antidosis 30, 42-50, 162, (...) 176, 181-92).1 Over the years, the issue has exercised a large number of scholars who have tried to specify what Isocrates meant by the term and what matters he considered to be within his purview.2 Recently, the idea has been advanced that Isocrates and Plato consciously struggled over the use of the term (Nehamas 1990, 4; Timmerman 1998, 145). In Nehamas's very useful formulation, Isocrates thought philosophy to be "the ability to speak well, which in turn reflects and is the product of thinking well and shrewdly about practical affairs" (1990, 4). Timmerman's review of the relevant literature shows how Isocrates' conflation of philosophia and hê tôn logôn paideia has hurt his reputation among modern disciplinary philosophers: "This confusion and resultant devaluation of Isocrates' philosophy is predicated on a platonically colored view of what constitutes philosophy" (1998, 147). ABSTRACT Recent police brutality has reminded people in the United States of America that racism and discrimination toward Black Americans is still prevalent. Evidence supports the claim that many Black Americans experience racial trauma due to the relatively common occurrence of discriminatory racial encounters in their life. Racial traumas are events of danger related to real or secondary experiences of racial discrimination that may cause psychological, emotional, or physical injury. The goal of this article is to identify the ethical complexities (...) for psychologists in addressing racial trauma among Black Americans. First, the article describes examples of racial traumas for Black Americans and their impact on overall mental health. Second, there is an in-depth analysis of ethical issues for psychologists relevant to racial trauma in areas such as competency, discrimination and harassment, bias, assessment, training programs, and harm. Finally, recommendations for psychologists are provided to address racial trauma among Black American clients, students, supervisees, and colleagues. (shrink)
