‘Pupil voice’ is a movement within state education in England that is associated with democracy, change, participation and the raising of educational standards. While receiving much attention from educators and policy makers, less attention has been paid to the theory behind the concept of pupil voice. An obvious point of theoretical departure is the work of Jürgen Habermas, who over a number of decades has endeavoured to develop a theory of democracy that places strong significance on language, communication and discourse. This paper is an attempt to gauge the usefulness of Habermas’ approach to understanding the theory of pupil voice, in particular how his theory of universal pragmatics lends itself to a ‘philosophy of between’, a philosophy that finds echoes in the conflicted nature of schooling that ‘pupil voice’ is supposed to rectify to some extent. The paper also explores the drawbacks of a Habermasian approach, in particular his overreliance on rationality as a way of understanding communication. Background This study introduces an empirical approach for studying the role of prudence in physician treatment of end-of-life (EOL) decision making.Methods A mixed-methods analysis of transcripts from 88 simulated patient encounters in a multicenter study on EOL decision making. Physicians in internal medicine, emergency medicine, and critical care medicine were asked to evaluate a decompensating, end-stage cancer patient. Transcripts of the encounters were coded for actor, action, and content to capture the concept of Aristotelian prudence, and then quantitatively and qualitatively (...) analyzed to identify actions associated with preference-concordant treatment.Results Focusing on codes that describe characteristics of physician-patient interaction, the code for physicians restating patient preferences was associated with avoiding intubation. Multiple codes were associated with secondary measures of preference-concordant treatment.Conclusions Prudent actions can be identified empirically, and research focused on the virtue of prudence may provide a new avenue for assessment and training in EOL care. We argue that the claim that essence-based causal explanations emerge, hydra-like, from an inherence heuristic is incomplete. No plausible mechanism for the transition from concrete properties, or cues, to essences is provided. Moreover, the fundamental shotgun and storytelling mechanisms of the inherence heuristic are not clearly enough specified to distinguish them, developmentally, from associative or causal networks.

This paper looks at an argument strategy for assessing the epistemic closure principle. This is the principle that says knowledge is closed under known entailment; or (roughly) if S knows p and S knows that p entails q, then S knows that q. The strategy in question looks to the individual conditions on knowledge to see if they are closed. According to one conjecture, if all the individual conditions are closed, then so too is knowledge. I give a deductive argument (...) for this conjecture. According to a second conjecture, if one (or more) condition is not closed, then neither is knowledge. I give an inductive argument for this conjecture. In sum, I defend the strategy by defending the claim that knowledge is closed if, and only if, all the conditions on knowledge are closed. After making my case, I look at what this means for the debate over whether knowledge is closed. (shrink)

A novel argument is offered against the following popular condition on inferential knowledge: a person inferentially knows a conclusion only if they know each of the claims from which they essentially inferred that conclusion. The epistemology of conditional proof reveals that we sometimes come to know conditionals by inferring them from assumptions rather than beliefs. Since knowledge requires belief, cases of knowing via conditional proof refute the popular knowledge from knowledge condition. In _ Psychiatry in the Scientific Image, _Dominic Murphy looks at psychiatry from the viewpoint of analytic philosophy of science, considering three issues: how we should conceive of, classify, and explain mental illness. If someone is said to have a mental illness, what about it is mental? What makes it an illness? How might we explain and classify it? A system of psychiatric classification settles these questions by distinguishing the mental illnesses and showing how they stand in relation to (...) one another. This book explores the philosophical issues raised by the project of explaining and classifying mental illness. Murphy argues that the current literature on mental illness -- exemplified by the Diagnostic and Statistical Manual of Mental Disorders -- is an impediment to research; it lacks a coherent concept of the mental and a satisfactory account of disorder, and yields too much authority to commonsense thought about the mind. He argues that the explanation of mental illness should meet the standards of good explanatory practice in the cognitive neurosciences, and that the classification of mental disorders should group symptoms into conditions based on the causal structure of the normal mind. Anyone taking a class in Modern Philosophy will learn that one of the most important issues in 17th and 18th Century philosophy was the debate between rationalists and empiricists. In 2005, Matthias Steup and Ernest Sosa edited a book entitled Contemporary Debates In Epistemology, which includes a chapter entitled ‘Is There A Priori Knowledge?’. In this chapter, Laurence BonJour defends rationalism and Michael Devitt defends empiricism. So, this philosophical debate has been going on for four centuries, and it still has (...) not been settled. This is the kind of thing that gets philosophy a bad reputation. If a dispute can continue for four centuries without resolution, that is surely an indication that nobody knows how to tell a good answer from a bad one. In lieu of an abstract, here is a brief excerpt of the content:Desire and Ethics in Hobbes's Leviathan:A Response to Professor DeighAccording to the "orthodox" interpretation of Hobbes's ethics, the laws of nature are the products of means-end thinking. According to the "definitivist" interpretation recently offered by John Deigh, the laws of nature are generated by reason operating on a definition of "law of nature," where the content of this definition is given by linguistic usage.2 I aim to accomplish two (...) things in this note. First, I want to locate as clearly as possible the point at which the orthodox and definitivist interpretations must disagree. Second, I want to show that once the claim on which these interpretations disagree is made clear, it is the orthodox interpretation that turns out to be the superior.31.Deigh takes as the initial test case for the various interpretations of Hobbes's moral theory the passage in chapter fifteen of Leviathan commonly known as "the reply to the fool." The fool, it will be recalled, argues that the precept that covenants be kept is not a rule of reason; Hobbes argues that the fool's "specious reasoning is neverthelesse [End Page 259] false," for to break a valid covenant is to violate a dictate of reason.4 Deigh summarizes his criticism of the orthodox interpretation of this passage as follows.On [the orthodox] interpretation, the dispute between Hobbes and the Fool concerns the deliverances of reason when reason is exercised in the service of self-interest, that is, when its exercise consists in determining the fittest means to achieving the ends set by egoistic desires. Such an exercise falls outside of the definition of reason that Hobbes gives in chapter five. It exemplifies strategic or means-to-end thinking and not deduction. Indeed, it corresponds to what Hobbes, in chapter three, defines as seeking... Hence, the orthodox interpretation of the laws of nature implies that Hobbes, in expounding the laws of nature, went back on the notion of reason he defined in chapter five. It implicitly attributes a fundamental inconsistency to Hobbes's philosophy.5The laws of nature—among which is the rule requiring the keeping of covenants6 —are held by Hobbes to be precepts of reason.7 Hobbes deems them, collectively, a science,8 by which he means that they are the deliverances of reason that pertain to a specific subject-matter.9 But, argues Deigh, Hobbes understands reason in a very specific way, a way that is distinct from the sort of means-end thinking that Hobbes describes in detail in chapter three and labels "seeking." Thus the orthodox interpretation of Hobbes's moral theory is at odds with Hobbes's own conception of the laws of nature individually as dictates of reason and collectively as the science of the true moral philosophy.It is of course true that the sort of thinking that Hobbes calls "seeking" and the sort of thinking that Hobbes calls "reasoning" are fundamentally different. Seeking takes its origin from experience: we have seen certain events following other events, and we retain a trace of that experience in imagination. Thus when we have some desire, there arises "the Thought of some means we have seen produce the like of that which we ayme at; and from the thought of that, the thought of means to that mean; and so continually, till we come to some beginning within our power."10 Those that are able to engage in this sort of thinking well are prudent,11 and on Hobbes's view, humans with comparable experience will exhibit a comparable degree of prudence.12 And because seeking requires only desire to regulate thought and some experience of events succeeding other events, there is nothing distinctively human about this form of thinking, and indeed Hobbes acknowledges that prudence is common to humans and other animals.13 By contrast, the process that Hobbes calls "reasoning" [End Page 260] is characterized independently of desire. Research in recent years suggests that fairness concerns could mitigate hold-up problems. In this study, we report theoretical analysis and experimental evidence on an opposite possibility: that fairness concerns could also induce hold-up problems. In our setup, hold-up problems will not occur with purely self-interested agents, but theoretically could be induced by demand for distributional fairness among agents without sufficiently strong counteracting factors such as intention-based reciprocity. We observe a widespread occurrence of hold-up in our experiment. Relationship-specific investments occurred less (...) than half of the time, resulting in significant inefficiencies. Moreover, whenever a relationship-specific investment was made: (a) it was typically not reciprocated by the partner; (b) nor did the investor’s offers at the bargaining stage exhibit expectations for reciprocity. Consequently, the partner extracted all the additional expected payoff from relationship-specific investments. Further experimentation suggested that our results were driven by a fundamental lack of intention-based reciprocity in fairness concerns, rather than self-serving bias. (shrink)

This chapter offers a general outline of Schopenhauer’s peculiarly named concept of the 'acquired character’ and explains its basic function in his ethical thought. For Schopenhauer, a person of acquired character is someone who knows the ways of acting (Handlungsweise) that are most expressive of their individuality and who allows that self-knowledge to structure their practical and emotional life. In keeping with certain elements of his psychological determinism, acquired character is not the acquisition of a ‘new’ character; rather, it is (...) the acquisition of self-knowledge of one’s essentially fixed empirical character. It is part of the argument of this chapter that by introducing the acquired character into his reflections on human action and agency Schopenhauer weaves a certain view of individual flourishing (eudaimonia) into his ethics. There are two central ingredients of Schopenhauer’s conception of eudaimonia, and both are linked to the acquired character. The first is self-knowledge; the second is a sense of personal autonomy that follows in the wake of the first. The chapter ends with a brief attempt to connect Schopenhauer’s concept of acquired character to contemporary debates in ethics concerning autonomy, practical identity, and what some call the ‘normative significance of self’. Although many modern philosophers of law describe custom as merely a minor source of law, formal law is actually only one source of the legal customs that govern us. Many laws grow out of custom, and one measure of a law's success is by its creation of an enduring legal custom. Yet custom and customary law have long been neglected topics in unsettled jurisprudential debate. Smaller concerns, such as whether customs can be legitimized by practice or by stipulation, stipulated by (...) an authority or by general consent, or dictated by law or vice versa, lead to broader questions of law and custom as alternative or mutually exclusive modes of social regulation, and whether rational reflection in general ought to replace sub-rational prejudice. Can legal rules function without customary usage, and does custom even matter in society? The Philosophy of Customary Law brings greater theoretical clarity to the often murky topic of custom by showing that custom must be analyzed into two more logically basic concepts: convention and habit. James Bernard Murphy explores the nature and significance of custom and customary law, and how conventions relate to habits in the four classic theories of Aristotle, Francisco Suarez, Jeremy Bentham, and James C. Carter. He establishes that customs are conventional habits and habitual conventions, and allows us to better grasp the many roles that custom plays in a legal system by offering a new foundation of understanding for these concepts. Drawing on our global database of 582 bilateral labor migration agreements, we investigate the extent to which these governing instruments connect and align with relevant international normative frameworks, in particular the extent to which they represent gains, gaps or gaffs in terms of gender equality and the human and labor rights protection of women migrants. In the context of the Global Compact for Safe, (...) Orderly and Regular Migration, which stresses a gender-responsive approach to migration governance as one of its guiding principles, we ask: Do the BLAs which are increasingly being used as instruments to govern labor migration contribute toward sustainable gender equality, decent work and reduced inequalities for women and gender-diverse migrants? This article analyzes the photographic exhibit Yuyanapaq: Para Recordar, which was a product of the Peruvian Truth and Reconciliation Commission. It focuses specifically on the curatorial process and political desires shaping Yuyanapaq, and it examines the ways in which photographs were intended to intervene in and script a national consciousness and shared memory during and after Peru’s transition process. Exploring across the three iterations of Yuyanapaq, I ask how we might attempt to bear witness to past conflict without inadvertently perpetuating (...) its logic. (shrink)
