I explore how gender can shape the pragmatics of speech. In some circumstances, when a woman deploys standard discursive conventions in order to produce a speech act with a specific performative force, her utterance can turn out, in virtue of its uptake, to have a quite different force—a less empowering force—than it would have if performed by a man. When members of a disadvantaged group face a systematic inability to produce a specific kind of speech act that they are (...) entitled to perform—and in particular when their attempts result in their actually producing a different kind of speech act that further compromises their social position and agency—then they are victims of what I call discursive injustice. I examine three examples of discursive injustice. I contrast my account with Langton and Hornsby's account of illocutionary silencing. I argue that lack of complete control over the performative force of our speech acts is universal, and not a special marker of social disadvantage. However, women and other relatively disempowered speakers are sometimes subject to a distinctive distortion of the path from speaking to uptake, which undercuts their social agency in ways that track and enhance existing social disadvantages. In this book, John Dryzek criticizes the dominance of instrumental rationality and objectivism in political institutions and public policy and in the practice of political science. He argues that the reliance on these kinds of politics and to technocracies of expert cultures that are not only repressive, but surprisingly ill-equipped for dealing with complex social problems. Drawing on critical theory, he outlines an alternative program for the organization of political institutions advocating a form of communicatively rational democracy, which he terms (...) discursive democracy, that stresses the importance of active citizenship and public discourse. He draws out the limitations of instrumental rationality and investigates how policy analysis and political science may be reformed to help constitute and comprehend democracy. In this paper, I consider how a general epistemic norm of action that I have proposed in earlier work should be specified in order to govern certain types of acts: assertive speech acts. More specifically, I argue that the epistemic norm of assertion is structurally similar to the epistemic norm of action. First, I argue that the notion of warrant operative in the epistemic norm of a central type of assertion is an internalist one that I call ‘discursive justification.’ (...) This type of warrant is internalist insofar as it requires that the agent is capable of articulating reasons for her belief. The idea, roughly, is that when one asserts that p, one is supposed to be in a position to give reasons for believing that p. Bonjour’s reliable clairvoyant Norman, for example, is not in an epistemic position to make assertions regarding the president’s whereabouts—even if Norman knows the president’s whereabouts. In conclusion, I briefly consider whether a type of skeptical argument—often labeled Agrippa’s Trilemma—is motivated, at least in part, by the fact that responses to it violate the relevant epistemic norm of assertion. Moral and political forms of constructivism accord to people strong, “constitutive” forms of discursive standing and so build on, or express, a commitment to discursive respect. The paper explores dimensions of discursive respect, i.e., depth, scope, and purchase; it addresses tenuous interdependencies between them; on this basis, it identifies limitations of the idea of discursive respect and of constructivism. The task of locating discursive respect in the normative space defined by its three dimensions is partly, (...) and importantly, an ethical task that is beyond constructivism. Interdependencies between these dimensions call into question the possibility of a plausible and coherent form of discursive respect that is deep, inclusive in scope, and rich in purchase. This does not mean that we should reject discursive respect, or constructivism, for that matter. But it suggests that the task of reconciling the dimensions of discursive respect may not allow for widely shareable results. This task needs to be addressed on non-constructivist grounds. Accordingly, we have reasons to concede that constitutive forms of discursive standing are less fundamental in the order of justification than weaker, “derivative” forms, and this is so especially if we take constitutive standing to mark an important good. Political theorists have offered many accounts of collective decision-making under pluralism. I discuss a key dimension on which such accounts differ: the importance assigned not only to the choices made but also to the reasons underlying those choices. On that dimension, different accounts lie in between two extremes. The ‘minimal liberal account’ holds that collective decisions should be made only on practical actions or policies and that underlying reasons should be kept private. The ‘comprehensive deliberative account’ stresses the importance of (...) giving reasons for collective decisions, where such reasons should also be collectively decided. I compare these two accounts on the basis of a formal model developed in the growing literature on the ‘discursive dilemma’ and ‘judgment aggregation’ and address several questions: What is the trade-off between the (minimal liberal) demand for reaching agreement on outcomes and the (comprehensive deliberative) demand for reason-giving? How large should the ‘sphere of public reason’ be? When do the decision procedures suggested by the two accounts agree and when not? How good are these procedures at truthtracking on factual matters? What strategic incentives do they generate for decision-makers? My discussion identifies what is at stake in the choice between minimal liberal and comprehensive deliberative accounts of collective decisionmaking, and sheds light not only on these two ideal-typical accounts themselves, but also on many characteristics that intermediate accounts share with them. Recent feminist philosophy of language has highlighted the ways that the speech of women can be unjustly impeded, because of the way their gender affects the uptake their speech receives. In this chapter, I explore how similar processes can undermine the speech of a different sort of speaker: Indigenous communities. This involves focusing on Indigeneity rather than gender as the salient social identity, and looking at the ways that group speech, rather than only individual speech, can be unjustly impeded. To (...) do this, I make use of the notion of ‘discursive injustice’ that has been developed by Quill Kukla, and, with reference to three case studies, show how discursive injustice can effectively derail the speech of Indigenous communities. In this paper, we develop a theoretical framework for understanding women leaders in working life. Our starting point is in statistics and earlier women-in-management literature, which show that women leaders represent a minority of the managerial population. We assume such underlying mechanisms causing discriminatory practices towards women leaders to exist which have become naturalized and invisible. Our concern is that everyone irrespective of gender should have a fair chance in career progression. This is both a moral and also an economic (...) challenge. The framework we develop in this paper is an alternative approach to studying women leaders compared to traditional women-in-management literature. It aims at revealing the "natural and taken-for-granted" cultural mechanisms behind discriminatory practices. Our framework is based on a critical discursive approach, which draws on ideas of how women''s leadership becomes symbolically represented and constructed in discursive practices. These symbolic constructions, which are mediated through language, often have an ideological loading which positions women leaders and builds their identities in ways that can help to legitimize unequal relations between the genders. However, our framework emphasizes the possibility of multiple discourses and a dynamic view of culture. The cultural constructions of women leaders are, thus, open to change. (shrink)

In public reason liberalism, equal respect requires that conceptions of justice be publicly justifiable to relevant people in a manner that allocates to each an equal say. But all liberal public justification also excludes: e.g., it accords no say, or a lesser say, to people it deems unreasonable. Can liberal public justification be aligned with the equal respect that allegedly grounds it, if the latter calls for discursive equality? The chapter explores this challenge with a focus on Rawls-type political (...) liberalism. I suggest that political liberalism’s commitment to equal respect can cohere with the standing of the unreasonable in public justification if that standing is not impermissibly unequal in discursive purchase. I then consider one candidate view of the permissibility of purchase inequality. On this broadly sufficientarian view, purchase inequality is permissible provided relevant people have standing of enough purchase to be able to avoid relevant bads. A plausible variant of this view suggests that political liberalism’s commitment to equal respect does not cohere with the discursive standing of the unreasonable. It emerges that where liberal public justification accords actual people discursive respect but relevantly idealizes at least around its fringes, the permissibility of purchase inequality must be a central concern. This paper presents a longue durée account of the discursive emergence of ‘the market'. It seeks to develop understanding of the ‘crisis system' by showing that the crises of the present have their origins earlier than some critical realist scholars have suggested and can be better understood by the theorization of the generative mechanisms that emerged from the economic and political chaos of the early 1600s. Critical discourse analysis (CDA) is employed to show that in the context of the (...) emergence of capitalism in England, these generative mechanisms resulted in the meaning of the word ‘market’ slipping loose of the geo-spatial semiotic bounds by which it had commonly been delineated – i.e. as a physical space in a town or city where goods were bartered or sold – and being re-semioticised to refer to abstract space where all acts of capitalist economic exchange, including those impacting upon the natural world, take place. List and Pettit have stated an impossibility theorem about the aggregation of individual opinion states. Building on recent work on the lottery paradox, this paper offers a variation on that result. The present result places different constraints on the voting agenda and the domain of profiles, but it covers a larger class of voting rules, which need not satisfy the proposition-wise independence of votes.

The present study explores discursive constructions of us- and them-groups within the context of the debates on the placement of the US anti-ballistic missile defence system in Central and Eastern Europe. The study is based on the data collected by the authors in the Polish and Russian press. Using the framework that is informed by Critical Discourse Analysis and Membership Categorization Analysis, the authors define strategies and specific linguistic means used to represent ‘us’ and ‘them’ and provide a picture (...) of chronological transformations that these representations undergo in the investigated newspapers. Conceptions of acceptability-based moral or political justification take it that authoritative acceptability constitutes, or contributes to, validity, or justification. There is no agreement as to what bar for authoritativeness such justification may employ. The paper engages the issue in relation to (i) the level of idealization that a bar for authoritativeness, ψ, imparts to a standard of acceptability-based justification, S, and (ii) the degree of discursive purchase of the discursive standing that S accords to people when it builds (...) ψ. I argue that (i) and (ii) are interdependent: high idealization values entail low discursive purchase, while high degrees of purchase require low idealization values. I then distinguish between alethic conceptions of justification that prioritize ends that commit to high idealization values, and recognitive conceptions that favour high discursive purchase. On this basis, I argue for a moderately recognitivist constraint on idealization. To render the recognitive discursive minimum available to relevant people at the site of justification, S should set ψ low enough so that it is a genuine option for actual people to reject relevant views in ways that S recognizes as authoritative. This paper explores the idea of robust discursive equality on which respect-based conceptions of justificatory reciprocity often draw. I distinguish between formal and substantive discursive equality and argue that if justificatory reciprocity requires that people be accorded formally equal discursive standing, robust discursive equality should not be construed as requiring standing that is equal substantively, or in terms of its discursive purchase. Still, robust discursive equality is purchase sensitive: it does not obtain when (...) class='Hi'>discursive standing is impermissibly unequal in purchase. Corporate social responsibility is a complex discipline that not only demands responsible behavior in production processes but also includes the concepts of communicative transparency and dialogue. Stakeholder dialogue is therefore expected to be an integrated part of the CSR strategy :323–338, 2006). However, only few studies have addressed the practice of CSR stakeholder dialogue and the challenges related hereto. This article adopts a postmodern perspective on CSR stakeholder dialogue. Based on a comprehensive single case study on stakeholder dialogue in a (...) global dairy company, we focus on the complexity of CSR dialogue with multiple stakeholders. Drawing on a critical reflexive methodology :1265–1281, 2007), we develop the research question: How is CSR multi-stakeholder dialogue practiced, experienced, and articulated in an empirical context? The purpose is to understand the underlying assumptions, expectations, and principles guiding CSR multi-stakeholder dialogue in an empirical setting, as we focus on how key stakeholders articulate and anticipate the values of stakeholder dialogue and how the actual stakeholder dialogues are enacted. The findings of the study differ significantly from the ideals of transparent and agenda-free stakeholder dialogue. Rather, the study shows an overall tension between ideal and practice, supporting the progressive importance of the dialogue process in itself as an essential part of the end goal. The implication of this is a growing pressure on creating transparency about the positioning and negotiation of roles throughout the dialogue process. (shrink)

The principal argument of the present paper is that the human body is as much a reflective formation of multiple discourses as it is an effect of natural and environmental processes. This paper examines the implications of this argument, and suggests that recognizing the body in this light can be illuminating, not only for our conception of the body, but also for our understanding of medicine. Since medicine is itself a discursive formation, a science with both a history, and (...) a future, it is argued that much can be learned by reflecting on the progression of models, or “paradigm-shifts,”, in terms of which modern medicine has articulated the human body that figures at the heart of its discourse. Four historical periods of medicine will be considered, each one governed by its own distinctive paradigm. It is argued, finally, that, with the emergence of behavioural medicine, and, more particularly, psychoneuroimmunology, a new discursive formation in medicine, one can see a new conceptualization of the human body beginning to take shape; and that this new figure of the body makes it possible for the very first time to conceive the construction of testable hypotheses regarding correlations between the objective body of science and the phenomenological body of experienced meaning. We should seek to justify, from a moral perspective, policies associated with serious and irreversible risks to the health of human beings, their societies, and the environment for these risks may have great impacts on the autonomy of both existing and future persons. The ideal of discursive democracy provides a way of morally justifying such policies to both existing and future persons. It calls for the inclusive, informed, and uncoerced deliberation toward an agreement of both existing and future persons, (...) which can serve as a justificatory basis for such public policies. This agreement best protects their fundamental interests and basic needs, and garners their general acceptance. It does so by upholding their agency in decision-making processes and, more specifically, by counseling a maxim of precaution in their public reasoning. The aim of this maxim is to protect the social and environmental conditions that will enable members of existing and future generations to review and, if necessary, revise decisions made in the past but that impact upon them in the present. Precautionary public reasoning thus serves to uphold the decisional agency of existing and future persons, which is a necessary condition of their democratic involvement in the policies that affect them and thus of their autonomous existence defined by their conceptions of the good. Discursive pluralism, recently fostered by anti-representationalist views, by stating that not all assertions conform to a descriptive model of language, poses an interesting challenge to representationalism. Although in recent years alethic pluralism has become more and more popular as an interesting way out for this issue, the discussion also hosts other interesting minority approaches in the anti-representationalist camp. In particular, the late stage of contemporary expressivism offers a few relevant insights, going from Price's denunciation of “placement problems” to Brandom's (...) inferentialism. This paper attempts to show how these expressivist ideas combine well together, composing a unitary and metaphysically sober metaphilosophical framework. (shrink)

In recent times, phenomena of conversational asymmetry have become a lively object of study for linguists, philosophers of language and moral philosophers—under various labels: illocutionary disablement and silencing, discursive injustice :440–457, 2014; Lance and Kukla in Ethics 123:456–478, 2013), illocutionary distortion. The common idea is that members of underprivileged groups sometimes have trouble performing particular speech acts that they are entitled to perform: in certain contexts, their performative potential is somehow undermined, and their capacity to do things with words (...) is distorted or even annulled. In this paper I will assess this idea, focusing on Rebecca Kukla’s and Rae Langton’s accounts; in particular, I will criticize the role the notion of uptake plays in their accounts, and claim that it may ultimately undermine the very idea of discursive injustice. While, according to Kukla and Langton, members of disadvantaged groups are victims of a kind of uptake failure, leading to illocutionary disablement and even silencing, in the account I present they are victims of a kind of communicative disablement. My overall aim is to develop a notion of discursive injustice that is more plausible and more effective for our broader purposes of criticising the structures of power and oppression. (shrink)

Enactivism has influentially argued that the traditional intellectualist ‘act-content’ model of intentionality is insufficient both phenomenologically and naturalistically, and minds are built from world-involving bodily habits – thus, knowledge should be regarded as more of a skilled performance than an informational encoding. Radical enactivists have assumed that this insight must entail non-representationalism concerning at least basic minds. But what if it could be shown that representation is itself a form of skilled performance? I sketch the outline of such an account (...) from the perspective of Peirce’s pragmatist semiotics, which theorises signs as habits of associating specific cues with appropriate acts and schemas of ensuing experience. Within this framework, I argue, a naturalistic account of propositional structure can be constructed which transcends the symbolic – and in some instances even the linguistic – sphere, and offers new insights regarding the Information Processing Challenge, and the Hard Problem of Content. After three decades of intensive debate in academic and activist circles, intersectionality has progressively been adopted in public policies. Yet, the challenges of its application are still largely unexplored. This article adopts a discursive approach to study the process of policy implementation of an intersectionality-informed plan in Madrid City Council, Spain. The analysis of materials retrieved through interviews, a focus group, and participant observation enables us to explore how the technical staff interpret intersectionality and links it with other established (...) approaches in equality and antidiscrimination law and policy, namely gender and diversity. We argue that preconceptions and positionality within the institutional structure deeply affect the interpretation of intersectionality and the subsequent action or non-action taken by implementing actors. Our study shows the challenges and opportunities to implement intersectionality in public policies that result from its discursive construction through the frames of gender and diversity. (shrink)

This paper examines the support for diversity from a moral perspective. Combining business ethics theory with a lens of critical discourse analysis, it reconstructs the debates on the ethicality of three disability inclusion practices—positive discrimination, job adaptations, and voluntary disclosure—drawn from multi-stakeholder interviews in disability-friendly organizations. Discursive resistance to disability inclusion practices, otherwise known to work, arises out of moral beliefs characteristic of an ethic of justice, whereas support is more often informed by an ethic of care. This study (...) contributes to the literature by laying bare how ethics fuel ‘resistance to’ rather than ‘support for’ diversity and inclusion. Like prior studies, it links such resistance to the myth of individual merit, noting that some re-appropriation of an ethic of justice becomes possible when legal awareness around issues of disability is raised in the context of work. In addition, it identifies an ethic of care as holding the greatest potential for fostering workplace inclusion yet cautions for two adverse side effects that may arise when promoting corporate care: the potential of paternalism and the inclination to individualise inherent to wellbeing initiatives. This article presents a typology of discursive discrimination, discrimination carried out through the use of language. It is argued that such a typology should fulfil certain criteria in order to be useful for empirical research. The proposed typology consists of four main concepts: (1) exclusion from discourse; (2) negative other-presentation; (3) objectification; and (4) proposals pointing towards unfavourable non-linguistic treatment. The related concept of othering - the creation of a psychological distance to people understood to belong to groups others (...) than ‘us’ - is also presented. The manner in which the different forms of discursive discrimination and othering can be operationalized is demonstrated through examples from empirical studies of discourses of people categorized as mentally deficient, as deaf, and as immigrants in public debate in Sweden in the past 75 years. While online medical consultations have become increasingly popular, not least in times when epidemics make access to medical facilities difficult, research exploring the interactive value of OMC is still in its infancy. This study examines patients’ disalignment with speculative diagnosis and its management by doctors in OMC interactions, which to my best knowledge are not examined. From a discourse analytic perspective, this study adopts Du Bois’s notion of stance-taking to approach text-based interactions collected from a widely used OMC website in (...) China. This study finds that patients’ disalignment is often based on hard evidence, which is different from the major findings of previous studies. When addressing such disalignment, doctors adopt varied discursive strategies, which are hardly mentioned in prior studies, in particular, strategies that address the affective aspect of patients’ disalignment. This study thus provides a different perspective on disalignment and its management in the clinical context. (shrink)

Discursive social psychology is used here to study the reconstruction of an event, a homicide, by lay people. Fourteen propositions are outlined to guide discourse analysis, since the epistemological basis of such analysis is somewhat different from that of formal experimental inquiry. An actual discourse is then analyzed, with special emphasis on the evidence used to support the final conclusion of guilt.

Discursive knowledge is expressed in a conceptual, specialized language, which offers the standardization and rigor necessary to a rational reasoning. For the non discursive knowledge, language, as a means of communication, is inadequate and insufficient.

In recent years, marriage migration as a form of family reunification has become a growing policy concern for migration governance in European member states and is seen as ‘the last loophole’ in EU migration policy in the face of a supposedly large and increasing number of sham marriages through which the non-European spouse is granted a residency permit. Several European nations have therefore legislated legal-administrative measures to battle marriages of convenience by investigating cross-border marriage applications prior to celebrating or recognising (...) the marital union. In this article, I draw on a linguistic ethnographic empirical study of legal-administrative investigations conducted by Belgian municipal authorities to determine whether cross-border marriage applications to their civil registry office are ‘genuine’ or ‘fake’. In particular, I examine how the legal framework and guidelines for investigation are bureaucratically implemented in practice in Belgian civil registry offices with a particular focus on the role of a discursively constructed notion of genuine cross-border love and a bureaucratically acceptable relationship in both policy documents and interviewing practice. In taking up these issues within the context of a conference convened to consider "Fragmentation and the Desire for Order/Unity" play off each other relationally, or symbiotically but how so inevitably and incidentally in the West that play-off has a neurotic tail-chasing character that is inspired precisely by Desire. The realm of discursivity is in truth heteroclite, submitted to metamor-phoses that testify the various correspondences between the axis of being and that of the existent is testified. Discursivity “pre-sentifies” in a manifested manner a referent that at the same time is not able to determine its existence without associating itself with a situation of knowledge, implicitly with a form of rendering and representation. Be-ing articulated as a conceptual hypostatisation of reason, or a form that creates significance, a textual and (...) socio-historical device, as a closing up of the circle of interpretations or as resignation in silence, discourse itself emerges as a reflection of conscience about things, that is, it acts, produces, searches for affirmation, thus and ultimately crafting out a possible world. This study examines the dual discursive articulation in the Instagram posts of the street library community, Literasi Trotoar (LIAR), in Purwakarta, Indonesia. The study focuses on two groups of posts: those directed towards the LIAR community and the general public, and those aimed at the Indonesian government. To analyse the posts, this study adopts ‘Multimodal Critical Discourse Analysis (MCDA),’ which focuses on both the language and visual elements of the posts. The findings reveal the presence of two integrated and (...) inseparable types of articulation within the posts. Firstly, articulation serves as a discursive tool to persuade the public to embrace the ideology of anarchism within the context of in-group power relations. This articulation is strategically employed for positive in-group representation, in-group ideological glorification, subject interpellation, ideological legitimation, and power formation. Secondly, articulation functions as a discursive mechanism to challenge the authority of the government within the context of out-group power relations. This articulation is strategically utilized for negative out-group representation using a narrative model of populism, out-group ideological debasement, subject resistance, ideological delegitimization, and power exertion. Psychotherapy is inherently discursive, yet, only recently, has the role that discourse plays in therapy been recognized as a focus in itself for analysis and intervention. Discursive Perspectives in Therapeutic Practice presents a overview of discursive perspectives in therapy, along with an account of their philosophical underpinnings.

In this article, I examine a narrative that on the surface could be backlash to gender equality efforts: that after years of policy attention to girls, Kenya’s “boy child” has been neglected. Through a content analysis of Kenyan online newspaper texts spanning the past two decades, I chart the evolution of this discourse, finding that it was present as early as 2000, intensified around 2010, and began to produce concrete actions around 2013. I argue that the narrative is a reaction (...) to expanded women’s rights, but not always in the sense of negative backlash. Some boy child claims-makers were indeed concerned with a decline in men’s power. However, others, mostly women, used the boy child narrative to redirect attention to issues that profoundly affect the well-being of women such as violence and the struggle to find a partner. These results point to the value of a discursive spectrum approach for analysis of potential backlash to gender equality as well as discussions around policy attention to boys and men. (shrink)

Coherence with a background system yields justification which, when undefeated by error, becomes knowledge. Undefeated justification is knowledge. So I have argued. I have, however, changed my conception of the details of the background system, justification in terms of it and undefeated justification even if the intuitions that drive the analysis are the same. The background system, which I call an evaluation system, contains not only acceptances, as I originally proposed, but also preferences concerning acceptance and reasoning based on acceptance. (...) Justification consists of the capacity to meet objections to a target acceptance, including those an externalist might raise, in terms of the evaluation system. Undefeated justification is justification that remains when the evaluation system is cleansed of error. The expression of fragility has always been a difficult and complex matter for African Americans, for the discourse of mainstream media is set up to sustain their fragility while at the same time misrecognizing it. Even though the black public sphere split off from the dominant public sphere after the Civil War to enable distinctive forms of expression, the “practiced habits” of which Coates speaks continued in the structures of the dominant discourse. My essay will analyze the structure of America’s (...) indifference to fragility in three parts. In the first section, I will introduce a normative problematic that can track how the hegemonic public sphere uses the rhetoric of formal equality to subordinate and silence African Americans speech while it also opens a space for black speech to be heard rather than dismissed. I then will trace the silencing structures back to the Brown v. Board of Education Supreme Court decision of 1954, for this “progressive” decision provided a template for what can be said and cannot be said. The next second section examines how Ralph Ellison thematizes and revises the encounter between the black and dominant public spheres. In the last section of the essay, I analyze the ways that Ta-Nehisi Coates exposes the contemporary forms of these discursive structures. (shrink)
