In this paper, we present three necessary conditions for morally responsible animal research that we believe people on both sides of this debate can accept. Specifically, we argue that, even if human beings have higher moral status than nonhuman animals, animal research is morally permissible only if it satisfies (a) an expectation of sufficient net benefit, (b) a worthwhile-life condition, and (c) a no unnecessary-harm/qualified-basic-needs condition. We then claim that, whether or not these necessary conditions are (...) jointly sufficient conditions of justified animal research, they are relatively demanding with the consequence that many animal experiments may fail to satisfy them. Many contemporary accounts of moral status consider an individual's status to be grounded in some cognitive capacity, e.g. the capacity to experience certain states, to reason morally, etc. One proposed cognitive capacity significant particularly to killing, i.e. having a status that precludes being killed absent cause, is the capacity to value one's own life. I argue that considering this a condition for moral status is a mistake, as it would lead to the exclusion of some individuals with mental health problems (...) who are generally considered clear cases. -/- While a cognitive capacities approach may turn out to be generally feasible, that particular cognitive capacity is not. In the course of this discussion I address two conceptual issues, the first regarding what it means to 'value ones life' and the second regarding what conditions must obtain for something to count as a capacity. These conceptual issues, when resolved pursuant to this account of moral status, lead the account to exclude individuals with major depressive disorder, i.e. deny that it is morally wrong to kill such individuals based on their moral status. I then argue that this is a decisive reason to reject this particular cognitive capacity as implicated in moral status. (shrink)

This short essay seeks to identify and prevent a pitfall that attends less careful inquiries into “physiosemiosis.” It is emphasized that, in order to truly establish the presence of sign-action in the non-living world, all the components of a triadic sign - including the interpretant - would have to be abiotic (that is, not dependent on a living organism). Failure to heed this necessary condition can lead one to hastily confuse a natural sign (like smoke coming from fire) for (...) an instance of abiotic semiosis. Allusion to a violation of expectations, predictions, desires, preferences, social norms, etc., was confirmed as a necessary condition, but pragmatic insincerity was not. Pragmatically sincere comments can be comprehended ironically. A revised (...) set of conditions was proposed, involving intentional violation of Gricean conversational maxims and the portrayal of a contrast between expectations and reality. :In a recent paper in Cambridge Quarterly of Healthcare Ethics on the necessary conditions for morally responsible animal research David DeGrazia and Jeff Sebo claim that the key requirements for morally responsible animal research are an assertion of sufficient net benefit, a worthwhile-life condition, and a no-unnecessary-harm condition. With regards to the assertion of sufficient net benefit, the authors claim that morally responsible research offers unique benefits to humans that outweigh the costs and harms to humans and animals. (...) In this commentary we will raise epistemic, practical, and ethical challenges to DeGrazia and Sebo’s emphasis on benefits in the prospective assessment of research studies involving animals. We do not disagree with DeGrazia and Sebo that, at the theoretical level, the benefits of research justify our using animals. Our contribution intends to clarify, at the practical level, how we should understand benefits in the prospective assessment and moral justification of animal research. We argue that ASNB should be understood as an assessment of Expectation of Knowledge Production in the prospective assessment and justification of animal research. EKP breaks down into two further claims: that morally responsible research generates knowledge worth having and that morally responsible research is designed and executed to produce generalizable knowledge. We understand the condition called knowledge worth having as scientists’ testing a hypothesis that, whether verified or falsified, advances an important interest, and production of generalizable knowledge in terms of scientific integrity. Generalizable knowledge refers to experimental results that generalize to a larger population beyond the animals studied. Generalizable scientific knowledge is reliable, replicable, and accurately descriptive. In sum, morally responsible research will be designed and carefully executed to successfully test a hypothesis that, whether verified or falsified, advances important interests. Our formulation of EKP, crucially, does not require further showing that an experiment involving animals will produce societal benefits. (shrink)

The concept of person is integral to bioethical discourse because persons are the proper subject of the moral domain. Nevertheless, the concept of person has played no role in the prevailing formulation of human death because of a purported lack of consensus concerning the essential attributes of a person. Beginning with John Locke's fundamental proposition that person is a ‘forensic term’, I argue that in Western society we do have a consensus on at least one necessary condition for (...) class='Hi'>personhood, and that is the capacity for conscious experience. When we consider the whole brain formulation of death, and the most prominent defense of it by the President's Commission for the Study of Ethical Problems in Medicine and Biomedical and Behavioral Research, we can readily identify the flaws that grow out of the failure to define human death as the permanent loss of the capacity for conscious experience. Most fundamental among these flaws is a definition of human death that reduces persons to the capacity of the brain to regulate purely physiological functioning. Such a formulation would, in theory, apply to any member of the animal kingdom. I suggest that an appropriate concept of death should capture what it is about a particular living being that is so essential to it that the permanent loss of that thing constitutes death. What is essential to being a human being is living the life of a person, which derives from the capacity for conscious experience. (shrink)

A socialist health service in a non-socialist society may be forced to stress care and rescue rather than prevention, health maintenance or the promotion of better health and more equal health status. A socialist health service ought to be ‘integrated’. A socialist health service ought to provide universal and comprehensive care.

I present a “reduced” version of the fifteen Pragma-dialectical rules and inquire into their theoretical status as necessary conditions for a critical discussion. Questions: In what respect is PD’s non-sufficiency a deficiency, can and must it be remedied? Brief answers: with respect to defining the concept ‘critical discussion,’ possibly, yes, if, and only if, one seeks to identify the concept ‘critical discussion’; no, if PD is for fallacy-detection.

Eleven primary social needs are defined, which if attained, fulfil the generic needs of all societies. Balanced attention to all these needs is the key to sustainability. Based on an analysis of constitutions, media content, citizen surveys, and participant observation, such balance is compared in 28 countries. The dangers of prioritization in China, Japan, the former Soviet Union, and the United States are explored in great detail. What is it for an object to be a physical object? Here I provisionally take up the idea that spatial extension is at least a necessary condition for being a physical object, whether or not it is also sufficient. I then argue for the following conditional proposition: if spatial extension is a necessary condition for being a physical object, then metaphysical naturalism is false. Given that all religious systems affirm the falsity of metaphysical naturalism, this conditional carries obvious (...) significance for philosophy of religion. And if it holds, two possible consequences ensue: for those committed to the idea that spatial extension is a necessary condition for being a physical object, a new disproof of metaphysical naturalism results. By contrast, for those committed to metaphysical naturalism, a new disproof of any extension-based account of the physical results. Either way, we obtain a significant conclusion. (shrink)

By using the general investigation framework offered by the cognitive science of religion (CSR), I analyse religion as a necessary condition for the evolutionary path of knowledge. The main argument is the "paradox of the birth of knowledge": in order to get to the meaning of the part, a sense context is needed; but a sense of the whole presupposes the sense (meaning) of the parts. Religion proposes solutions to escape this paradox, based on the imagination of sense (meaning) (...) contexts, respectively closures of these contexts through meta-senses. What is important is the practical effectiveness of solutions proposed by religion, taking into account the costs of faith and the costs of the absence of religious belief. The hypothesis has the following consequences: religion is a necessary condition for the initial evolution of knowledge and the emergence of religion is determined by the evolution of knowledge. The continuation of the solving of paradox is a Bayesian one, using explorations: a sense of the whole allows cognitive arrangements of the parties, which in turn open the possibility of a rearrangement of the whole. The contribution of religion to the emergence of sense (meaning) could be governed by the rule: any map of the world is more useful than no map; any meaning (of life) is better than no meaning. The human mind fills the perceptual and cognitive gaps, some (religious) filling solutions being true vault keys of the entire cognitive construction called the world. Knowledge is conditioned by the existence of an organized context, as the cosmos created by religion by means of explanatory meta-theories supports knowledge by closing the cognitive context and using meaning networks. The proposed analysis is consistent with a redefinition of rationality from the perspective of evolution: the importance and relevance of knowledge is determined by its practical outcome - survival. In the context of useful fictions, it does not matter what God actually does, but what we have done by believing in God. Existence has provided a pragmatic verification of the cognitive solutions that underlie the survival strategies promoted by religions. (shrink)

In this paper, we motivate, propose and defend the following two conditions as individually sufficient and disjunctively necessary for moral responsibility: PODMA —originally proposed by Coren, Acta Analytica, 33, 145–159,, now cast as sufficient rather than necessary—and the TWC*, which amends versions presented by Young, 961–969, 2016; Philosophia, 45, 1365–1380, 2017). We explain why there is a need for new necessary and sufficient conditions, how these build on and improve existing ideas, particularly in relation to (...) Frankfurt-style counterexamples and the continuing discussion on their effectiveness, and why PODMA and the TWC* are good candidates. Finally, we defend the proposal against anticipated objections in order to clarify why we think these individually sufficient and disjunctively necessary conditions are plausible and able to inform the ongoing debate on the role of alternate possibilities in the ascription of moral responsibility. Two notable limitations exist on the use of personhood arguments in establishing moral status. Firstly, although the attribution of personhood may give us sufficient reason to grant something moral status, it is not a necessary condition. Secondly, even if a person is that which has the ‘highest’ moral status, this does not mean that any interests of a person are justifiable grounds to kill something that has a ‘lower’ moral status. Additional justification is needed to overcome a (...) basic wrongness associated with killing something possessing moral status. There are clear arguments already available in this regard in the case of a foetus that are not available in the case of a newborn infant. Hence, there is scope to consistently hold that abortion may be permissible but that after-birth abortion may not be permissible. (shrink)

Most discussions in epistemology assume that believing that p is a necessary condition for knowing that p. In this paper, I will present some considerations that put this view into doubt. The candidate cases for knowledge without belief are the kind of cases that are usually used to argue for the so-called ‘extended mind’ thesis.

In philosophy, the criteria for personhood (PH) at a specific point in time (synchronic), and the necessary and sufficient conditions of personal identity (PI) over time (diachronic) are traditionally separated. Hence, the transition between both timescales of a person's life remains largely unclear. Personal habits reflect a decision-making (DM) process that binds together synchronic and diachronic timescales. Despite the fact that the actualization of habits takes place synchronically, they presuppose, for the possibility of their generation, time in (...) a diachronic sense. The acquisition of habits therefore rests upon PI over time; that is, the temporal extension of personal decisions is the necessary condition for the possible development of habits. Conceptually, habits can thus be seen as a bridge between synchronic and diachronic timescales of a person's life. In order to investigate the empirical mediation of this temporal linkage, we draw upon the neuronal mechanisms underlying DM; in particular on the distinction between internally and externally guided DM. Externally guided DM relies on external criteria at a specific point in time (synchronic); on a neural level, this has been associated with lateral frontal and parietal brain regions. In contrast, internally guided DM is based on the person's own preferences that involve a more longitudinal and thus diachronic timescale, which has been associated with the brain's intrinsic activity. Habits can be considered to reflect a balance between internally and externally guided DM, which implicates a particular temporal balance between diachronic and synchronic elements, thus linking two different timescales. Based on such evidence, we suggest a habit-based neurophilosophical approach of PH and PI by focusing on the empirically-based linkage between the synchronic and diachronic elements of habits. By doing so, we propose to link together what philosophically has been described and analyzed separately as PH and PI. (shrink)

In the Western theist tradition, the conception of a person tends to be understood as an intrinsic property. Hence, the classification of someone as a person does not depend on relational aspects of that person. From this, Western theists often understand that their conception of God as a person does not clash with the idea of immutability. In this article, I challenge the idea that being a person and being immutable are compatible properties by using Afro-communitarian philosophy and, more specifically (...) Afro-communitarian metaphysics of personhood. Afro-communitarian metaphysics is fundamentally relational, i.e. it understands that most properties of the world depend on the existence of other entities. More precisely, personhood is a property that depends on the existence of relatable beings. But if this is true, then it is not possible to hold that an entity that has the property of personhood also has the property of immutability. More specifically, an entity that is a person has to change due to the fact that personhood is a relational property. This is because it is a necessary condition for being a person that one relates to others, i.e. one only becomes a person when this relation occurs. Hence, the process of becoming a person requires a moment before the relation with another and one after; thereby, the feature of being a person requires the feature of change. With respect to the Christian conception of God, what this implies is that if theist philosophers wish to understand Him as a person, they have to also accept that God is not immutable. For if other beings besides Him are not eternal, then it is only possible that He can be a person when these other beings first started existing. This is the case because the kind of relationality needed to be a person is not simply to relate to something (like emptiness), but to do something that makes Him addressable (which requires that the thing He relates to has the capacity to address Him). This means there are two moments of existence where He has distinct properties and, therefore, is mutable. (shrink)

Built-in privacy has for too long been neglected by regulators. They have concentrated on reacting to violations of rules. Even imposing severe fines will however not address the basic issue that preventative privacy protection is much more meaningful. The paper discusses this in the context of the International Working Group on Data Protection in Telecommunications (“Berlin Group”) which has published numerous recommendations on privacy-compliant design of technical innovations. Social network services, road pricing schemes, and the distribution of digital media content (...) have figured prominently in the group’s latest working papers. More recently, a judgment of the European Court of Human Rights has thrown light on weaknesses in the protection of patients’ data in hospitals that requires urgent action by designers of IT systems. Built-in privacy is no magic button, no panacea, but it has turned out to be a necessary condition for meaningful privacy protection. (shrink)

This article suggests first that the concept of interpersonal recognition be understood in a multidimensional (as opposed to one-dimensional), practical (as opposed to symbolic), and strict (as opposed to broad) way. Second, it is argued that due recognition be seen as a reason-governed response to evaluative features, rather than all normativity and reasons being seen as generated by recognition. This can be called a response-model, or, more precisely, a value-based model of due recognition. A further suggestion is that there is (...) a systematic basis for distinguishing three dimensions of recognition, depending on whether recognition is given to someone qua a person, qua a certain kind of person, or qua a certain person. Finally, it is argued that recognition is a necessary condition of personhood, but whether it is of direct or indirect relevance depends on our theories of personhood (social vs. capacity-theory) and practical identity (dialogical definition model vs. feature-model). Despite the apparent opposition, it is shown that interpersonal recognition is both a response to value and a precondition of personhood. (shrink)

In this article we review the discussion over the thesis that language serves as an integrator of contents coming from different cognitive modules. After presenting the theoretical considerations, we examine two strands of empirical research that tested the hypothesis — spatial cognition and mathematical cognition. The idea shared by both of them is that each is composed of two separate modules processing information of a specific kind. For spatial thinking these are geometric information about the location of the object and (...) the information about the object’s properties such as color or size. For mathematical thinking, they are the absolute representation of small numbers and the approximate representation of numerosities. Language is said to integrate the two kinds of information within each of these domains, which the reviewed data demonstrates. In the final part of the paper, we offer some comments on the theoretical side of the discussion. (shrink)

Many neuroscientific experiments, based on monitoring brain activity, suggest that it is possible to predict the conscious intention/choice/decision of an agent before he himself knows that. Some neuroscientists and philosophers interpret the results of these experiments as showing that free will is an illusion, since it is the brain and not the conscious mind that intends/chooses/decides. Assuming that the methods and results of these experiments are reliable the question is if they really show that free will is an illusion. To (...) address this problem, I argue that first it is needed to answer three questions related to the relationship between conscious mind and brain: 1. Do brain events cause conscious events? 2. Do conscious events cause brain events? 3. Who is the agent, that is, who consciously intends/chooses/ decides, the conscious mind, the brain, or both? I answer these questions by arguing that the conscious mind is a property of the brain due to which the brain has the causal capacity to interact adaptively with its body, and trough the body, with the physical and sociocultural environment. In other words, the brain is the agent and the conscious mind, in its various forms - cognitive, volitional and emotional - and contents, is its guide of action. Based on this general view I argue that the experiments aforementioned do not show that free will is an illusion, and as a starting point for examining this problem I point out, from some exemplary situations, what I believe to be some of the necessary conditions for free will.Key-words: Agent brain, conscious mind, free will, Libet-style experiments. This article invokes the idea of personhood (which it takes to be at the heart of Afrocommunitarian morality) to give an account of corrective/rectification justice. The idea of rectification justice by Robert Nozick is used heuristically to reveal the moral-theoretical resources availed by the idea of personhood to think about historical injustices and what would constitute a meaningful remedy for them. This notion of personhood has three facets: (1) a theory of moral status/dignity, (2) an account of (...) historical conditions and (3) the achievement of moral excellence by the agent (personhood). This article argues that a just society is a function of (1) and (2), and it further argues that the aim of rectification justice is to correct these two facets of a society, which are necessary for (3) to be possible. The aim of correcting history just is to make personhood a possibility for all humanity, particularly of those who were victims of past injustices. (shrink)

Bioethics as a branch of professional ethics has rapidly expanded in recent years. The growth of interest in bioethics is the result of its focus on life, its value, as well as the questions about health, medicine and problems which are involved. Bioethics is included within the lessons of ethical education in primary and secondary schools in Slovakia. As an independent subject it creates part of the compulsory curriculum in the study programme of ethics at university. It is noteworthy that (...) bioethics also keeps an important place in the education of future doctors at Medical Faculties. It gives rise to an interesting question; what about doctors’ long-term performance in their profession? Do they need knowledge of medical ethics when performing their job? This article tries to answer these questions. It points out that teaching medical ethics is relevant/necessary at primary schools, secondary schools, for students of ethics, medical students and other health care professionals as well as for practising physicians. We applaud the authors' basic message. We note that the negative research emphasis is not special solely to social psychology and judgment and decision-making. We argue that the proposed integration of null hypothesis significance testing (NHST) and Bayesian analysis is promising but will ultimately succeed only if more attention is paid to proper experimental design and implementation.
