Leo Strauss was a political philosopher who died in 1973 but came to prominent attention around the beginning of the war in Iraq. Charges began emerging that architects of the war had studied with, or been influenced by, Strauss' works. This volume explores these works.

Bourdieu’s concept of habitus clivé illuminates Indigenous Australians’ experiences in tertiary environments for both Aboriginal students and Aboriginal staff. Habitus formed through family, schooling and social class is also shaped by urban, regional or rural upbringing, creating a durable sense of self. Aboriginal people in Australia live in all of these places, often in marginalised circumstances. Bourdieu’s more specific concept of habitus clivé, or divided self, is less well known than habitus, but offers value in giving expression to Indigenous people’s (...) experiences within a dominant White society. The complexity of participation and educational change is explored here through the experiences of three authors’ intersecting positionalities within the Australian academy. Developing more nuanced scholarly language reduces the imposition of perspectives that see Indigenous people as objects within western frameworks. Scholarly understanding and respect for Australia’s first peoples’ concepts and cultural practices would engage more appropriately and fairly with Aboriginal knowledge and society. Habitus clivé chronicles one version of habitus that can be changed or be reconfirmed but not easily or by fiat. Understanding the concept can be learned, however. Educational opportunity, glorified in today’s higher education, means little for Aboriginal people without long-term strategies addressing existentially and culturally split habitus. (shrink)

Deception has been practiced by sellers since the beginning of the marketplace. Research in marketing ethics has established benchmarks and parameters forethical behavior that include honesty, full disclosure, equity, and fairness. Deception in marketing, however, has not received the same level of attention. This paper proposes to treat deception in marketing within the context of criminology. By examining deception in marketing within the context of criminology, additional insight can be gained into identifying its antecendents and the likelihood of its occurrence. (...) To this end, deception in marketing is interpreted under the empathy/harm matrix, Cressey’s fraud triangle, and the transparency/time-lag matrix. These frameworks are then combined into a diagram detailing antecedents affecting the likelihood of marketing agents participating in deceptive marketing actions. John Fleming , later professor in Aberdeen and Edinburgh, made his combative contribution to natural history between 1812 and 1832. As an Edinburgh student he had followed Robert Jameson's ‘Wernerian’ lead. His earliest publications, from 1813, expressed what was to be a lifelong hostility to the work of James Hutton. Yet his own thinking moved increasingly towards a ‘uniformitarian’ as opposed to a ‘catastrophist’ view of earth history. His Philosophy of Zoology embodied criticism of Cuvier. More dramatically, he became (...) embroiled in controversy with Buckland and later with Conybeare. By then the ‘uniformitarian’ hypothesis had been adopted by Lyell, with whom Fleming was in close touch from the mid-1820s. Fleming may have had some grounds for feeling that his priority in advocating uniformitarianism was later overlooked. His History of British Animals included a preface in which he elaborated his earlier hypothesis as to ‘revolutions … in the animal kingdom’ correlated with six geological epochs. Tension had then developed in Fleming's relationship with Jameson, and the early 1830s found him in a mood of increasing frustration. Reconciliation with Buckland and approval by Sedgwick still left ‘the Zoological Ishmael’ feeling that his advancement in the scientific world was blocked, perhaps permanently. In historical perspective Fleming may be seen as a minor but not insubstantial figure in the scientific landscape of the early nineteenth century. (shrink)

Jeremy Bentham came to know Jacques-Pierre Brissot when he was in London between midwinter 1782–3 and summer 1784. They shared some opinions: Brissot indeed saw Bentham to some extent as his mentor. There was never complete accord, however; and Brissot's increasingly radical political views were not at that stage shared by Bentham. In any case, their ways parted with Bentham's prolonged sojourn with his brother in Russia between 1785 and 1788. It was revolution in France that brought renewed contact, though (...) no further personal encounters. By the winter of 1788–9 Bentham was writing, with France in mind, an increasingly elaborate work on parliamentary procedure; and by the spring Brissot was (much more expeditiously) writing and publishing his account of the subject. One element in that work dealt with an issue on which Bentham vigorously opposed Brissot; for it included a strongly argued case for a declaration of rights – something Bentham had already attacked in 1776. He renewed that attack in a letter to Brissot in the late summer of 1789. By the autumn, however, writing to Brissot again, he raised a subject on which the two could sympathise – the importance of asserting popular sovereignty in the new French constitution. That sovereignty, Bentham insisted, must extend to the administration of justice – royal authority must be rigourously excluded from control of the judiciary. The judicial establishment in France was to be Bentham's predominant concern between the winter of 1789–90 and the following summer, and he now had assistance, especially from Etienne Dumont, in translating and publicizing his work. Brissot was probably – though there is no direct evidence – aware of these efforts. In the autumn Bentham's principal concern was the promotion in France of his scheme for a model prison – the Panopticon. That cause was helped by the cordial reception in the National Assembly of his judicial reform proposals. By then he was again in touch with Brissot, whose support he now sought for the Panopticon project – at first with some success. No progress was made in 1793, however, as Brissot's revolutionary career reached first its apogee and then its disastrous end. Many years later, as Bentham's life drew to a close, Brissot's Mémoires served to remind him of their uneasy partnership in the years of revolution. (shrink)

Bentham was convinced throughout his adult life that law reform in both theory and practice was his vocation. As a deliberately briefless barrister he set out in the early 1770s to establish jurisprudence on the principle of utility. From the first, however, he was repeatedly diverted from this central task. Confronted by the authority of Blackstone, he wrote, without completing, his Comment on the Commentaries, and turned within that context to the specific theme of his Fragment on Government (1776). Summary The career of Jacques-Pierre Brissot (1754–1793) featured two phases, separated dramatically by the Revolution of 1789. Before the revolutionary crisis and the subsequent political struggle that was to cost him his life, Brissot was an avocet who never practised but sought instead a career as a writer—and indeed as a philosophe, seeing himself as an ally of Diderot. The improbability of such an alliance was not lessened by his early and continuing alliance with Linguet. Before embarking in1778 on what (...) would be a prolific career as a published author, Brissot had written the manuscript on which attention is focused here. This is an uncompleted ‘Plan Raisoné’ for a comprehensive sceptical critique of all systematic claims to certainty in knowledge. There is an evident though problematic relationship here with Brissot's 1782 De la vérité, but it is also clear that the influence of Rousseau and Brissot's increasingly radical political outlook must have entailed a widening divergence from the scepticism he had previously extolled—the ‘Pyrrhonism’ that would protect sensible readers against dogmatic absurdity. Falun Gong is a qi gong group that entered into conflict with the Chinese state around the turn of the century, and gradually transformed into a political movement. Qi gong, in turn, is an ancient system of exercises that have been compared with yoga, though qi gong exercises more closely resemble the gentle, meditative movements of Tai Chi. Falun Gong was founded in the People’s Republic of China by Li Hongzhi in 1992, in the latter part of what has been (...) termed the qi gong “boom.” As the leadership of the PRC became increasingly critical of the traditional folk religion and superstition that was emerging within some of the qi gong groups, Li Hongzhi and his family emigrated to the United States. From the safety of his new country of residence, LHZ directed his Chinese followers to become increasingly belligerent, eventually staging a mass demonstration in front of government offices in Beijing on 25 April 1999. “No man can see farther into a generalization than his knowledge of detail extends.” That saying of William James is true of all the branches of science; but it has a special value for students of social philosophy. Social life is so obviously a matter of personal experience that an academic Robinson Crusoe may easily be less competent in his knowledge of detail than a business man, if the business man thinks at all. This is not a compliment to (...) the business man, nor an insult to the academic scholar; for the majority of those who deal with practical issues seem to be far more incompetent than the majority of scholars. But it is essential for social philosophy that practical experience of some kind should be used. Indeed, just as a student of chemistry nowadays depends at every step upon experiment, so a student of social life should take care to play a part in some form of active social life, whether as directing, co-operating, or obeying. One cannot get chemistry out of books; still less can one find social philosophy there. Therefore the number of books written or read is no criterion of the vigour of social philosophy in any generation—it is so easy to write books about other books, and so easy to read the same material many times. One of the contemporary results of Germany’s memorial conundrum is the rise of its “counter-monuments”: brazen, painfully self-conscious memorial spaces conceived to challenge the very premises of their being. On the former site of Hamburg’s greatest synagogue, at Bornplatz, Margrit Kahl has assembled an intricate mosaic tracing the complex lines of the synagogue’s roof construction: a palimpsest for a building and community that no longer exist. Norbert Radermacher bathes a guilty landscape in Berlin’s Neukölln neighborhood with the inscribed light of (...) its past. Alfred Hrdlicka began a monument in Hamburg to counter—and thereby neutralize—an indestructible Nazi monument nearby. In a suburb of Hamburg, Jochen Gerz and Esther Shalev-Gerz have erected a black pillar against fascism and for peace designed to disappear altogether over time. The very heart of Berlin, former site of the gestapo headquarters, remains a great, gaping wound as politicians, artists, and various committees forever debate the most appropriate memorial for this site.4 4. Thus Walter Kaufmann reads the quotation as showing how the Christian faith enables its adherents “to indulge their lust for revenge by hoping for the eternal torture and destruction of their persecutors.”3 Weaver Santinello echoes this sentiment when she claims that “‘the great teacher and saint [Aquinas]’ had a ‘bloodthirsty vision of Hell.’”4 Even so sensitive a Christian as Merold Westphal reads Nietzsche’s Aquinas in this way. “[I]t is hard to deny that the spirit of resentment and longing for vengeance burns hot in these passages... in them the final judgment makes the Final Solution seem almost moderate.”5 Similar comments and observations so abound in the scholarship that they form a virtual consensus on this Summa passage’s teaching.6This proliferation of such statements on Aquinas’s meaning, however, contrasts sharply with the absence of careful analyses [End Page 426] of the passage. I do not know, in fact, of a single article, book chapter, or study that takes Nietzsche’s quotation of Aquinas for its theme. More generally, despite the vast literature on Nietzsche and Christianity, comparative studies of Nietzsche and Aquinas are rare.7 The absence of substantive studies on the Genealogy’s use of the Aquinas quotation is doubly unfortunate. First, it silences or at least muffles the voice of Nietzsche. He cites Aquinas’s text in the specific context of Treatise I of the Genealogy. The quotation reveals the full meaning that Nietzsche intended it to convey only when it is read in that context. Second, it obscures and distorts the thought of Aquinas: the quotation must be read in its own context in the Summa theologiae to grasp the teaching that Aquinas intended his words to express.In light of Aquinas’s importance as a Christian theologian and the crucial role he plays in the Genealogy’s critique of moral values, I intend to examine Nietzsche’s presentation of this text. Careful study of this matter can shed light on a key question which has long been discussed and debated: Is Nietzsche’s account of Christianity as life-inimical rooted in an extraordinarily perceptive reading of the Christian psyche? Or is it based, rather, on a profound misunderstanding of that psyche? I will argue for two points: (1) that Nietzsche has utterly misconstrued Aquinas’s teaching; and (2) that Aquinas’s Christian morality, far from being life-inimical, is life-affirming. Amid the action of the 2013 Super Bowl aired the usual array of high-priced advertisements. Most ads were original. Some were unusual. One regional ad, however, seemed distantly familiar. The 30-second commercial promoted the NJOY King electronic cigarette1 to at least 10 million viewers in several major markets. It featured an attractive male model taking a drag from what looks like a cigarette. He then slowly blows smoke to the tune of Foreigner’s “Feels Like the First Time.” Of course, the (...) “smoke” does not come from burning tobacco. Rather, it is the water vapor produced by an e-cigarette as part of its nicotine delivery process. This, however, was not evident from the imagery. For those watching the broadcast, including thousands of minors, NJOY’s advertisement depicted what tobacco companies have not portrayed on television for decades: a person engaged in smoking behavior. Considering the play written by Daniel Berrigan about his own civil disobedience (burning hundreds of draft files in Catonsville, Maryland), the author asks whether Catholics have adopted the American dream at the expense of Christianity. How should we live and philosophize in an age of American empire? Philosophy must be both practical and transformative. We need to question our political situation since 2001, and arrive at a liberatory philosophy and social theory “from below” so as to meet Berrigan’s liberatory, prophetic (...) theology “from above,” resulting in a philosophy and theology of liberation of and from the seductive imperialist center. The author further stresses individual self-appropriation and the critique of imperialism through a Marxist understanding of surplus value (as arising from labor time for which workers are not paid). There is a link between capitalistic imperialism and militarism, and President Bush has made illegitimate use of religion in the attempt to legitimate empire. Liberation is the good and the happiness that together result from doing the work of justice, free from capitalist corruption. In challenging capitalist empire, we ought to aim for the “downward mobility” of a simpler lifestyle, where self-appropriation leads to moral, religious, and practical conversion. In lieu of an abstract, here is a brief excerpt of the content:"Not These Sounds":Beethoven at MauthausenJames SchmidtIOn May 7, 2000, the British conductor Simon Rattle led the Vienna Philharmonic in a memorial performance of Beethoven's Ninth Symphony at the site of the former Nazi concentration camp at Mauthausen.1 The concert marked the fifty-fifth anniversary of the liberation of the Austrian camp, which had been established shortly after the Anschluss to receive prisoners who—in the argot of the Third Reich—were classified (...) as "unreformable" and "scarcely trainable."2 Those initially imprisoned included Austrian and German criminals, political prisoners, homosexuals, Jehovah's Witnesses, and Roma. They were later joined by Poles, Spanish civil war refugees who had been interned in France and were turned over to German authorities by the Vichy government, Soviet and other prisoners of war, and Jews, many of whom were transferred from camps abandoned in the face of advancing Soviet troops during the last year of the war.3The function of Mauthausen was to work inmates to death. It proved to be ruthlessly efficient in carrying out its mission. Estimates of the total number killed range upward from 119,000 and the mortality rate was surpassed only by the extermination camps established in occupied Poland in 1941 and 1942 (Horowitz, p. 10). The camp was built around a working quarry, and prisoners were compelled to carry loads of stones [End Page 146] up the 186 steps that led from the base of the quarry to the surface. Inmates were regularly killed in falls or struck by falling rocks. But not all of the deaths at Mauthausen were the result of these horrific working conditions. Guards regularly forced prisoners outside the boundaries of the camp and then shot them on the pretense that they were attempting to escape. Between October 1941 and January 1942 prisoners were driven en masse into bathing areas where they were subjected to extended showers in frigid water: the weaker inmates collapsed and were drowned, their bodies clogging the drains, while guards forced others beneath the rising waters. Still other prisoners seized the only means of escape they could find and jumped to their death from the top of the quarry, prompting civilian laborers employed at the camp to complain to authorities about having to work amidst gore and pieces of brain (Horowitz, pp. 52–53).Authorities responded to epidemics of typhus and dysentery—the result of overcrowding in the camp—by shooting the sick. With the arrival of POWs from the Russian front, mass executions by firing squads began, and in 1941 the first gassing chamber was built at the nearby Castle Hartheim. As the slaughter increased, the municipal crematorium south of the camp was supplemented by three new crematoria constructed within the boundaries of the camp itself. When they were operational, tufts of human hair flew out of their chimneys onto the streets of Mauthausen itself, a peaceful town of about 1,800 residents who—while annoyed by the stench of burning flesh and not insensitive to the coarsening of life that the presence of so many soldiers brought to the region—generally kept to themselves and tried not to raise too many questions about what was going on at the camp (Horowitz, pp. 60–62). There is a link between capitalistic imperialism and militarism, and President Bush has made illegitimate use of religion in the attempt to legitimate empire. Liberation is the good and the happiness that together result from doing the work of justice, free from capitalist corruption. In challenging capitalist empire, we ought to aim for the “downward mobility” of a simpler lifestyle, where self-appropriation leads to moral, religious, and practical conversion. An inhumane, capitalist society is fundamentally at odds with us as human beings, as philosophers, and as Christians. (shrink)

When this volume was first published by Oxford University Press in 1967, it was hailed as a superb historical study of an intellectual current that died in Russia with the defeat of the Constitutional Democratic Party and the ascendancy of the Bolsheviks, namely, the later nineteenth- and early twentieth-century thinking of those Russian philosophers who championed the liberal values of democracy, individual rights, and a state based on the rule of law. Now reissued in a changed world by the University (...) of Notre Dame, the book takes on additional, highly contemporary significance: the destruction of Soviet totalitarianism has given new life to liberal values, and the ideas of these forgotten thinkers are now relevant to the most burning political issues of the day in Russia. Not surprisingly, a Center for the Study of Russian Liberalism has been established within the Russian Academy of Sciences, and a Russian translation of Walicki's book is in preparation. (shrink)

Historically, entities with a vested interest in a product that critics have suggested is harmful have consistently used research to back their claims that the product is safe. Prominent examples are: tobacco, lead, bisphenol A, and atrazine. Research literature indicates that about 80–90 % of studies with industry affiliation found no harm from the product, while only about 10–20 % of studies without industry affiliation found no harm. In parallel to other historical debates, recent studies examining a possible relationship between (...) mercury exposure and autism spectrum disorder show a similar dichotomy. Studies sponsored and supported by industry or entities with an apparent conflict of interest have most often shown no evidence of harm or no “consistent” evidence of harm, while studies without such affiliations report positive evidence of a Hg/autism association. The potentially causal relationship between Hg exposure and ASD differs from other toxic products since there is a broad coalition of entities for whom a conflict of interest arises. These include influential governmental public health entities, the pharmaceutical industry, and even the coal burning industry. This review includes a systematic literature search of original studies on the potential relationship between Hg and ASD from 1999 to date, finding that of the studies with public health and/or industry affiliation, 86 % reported no relationship between Hg and ASD. However, among studies without public health and/or industry affiliation, only 19 % find no relationship between Hg and ASD. The discrepancy in these results suggests a bias indicative of a conflict of interest. (shrink)
