The case (Dawson et al. 2024) describes an Institutional Review Board (IRB) chair who seeks consultation about waiving the requirement that investigators obtain prospective, informed consent for collection of microbiome samples by swabbing the perianal region of severely burned patients shortly after their admission to an intensive care unit (ICU). We argue that it is ethically permissible to waive informed consent requirements for the perianal swab and that the IRB should approve a waiver as permitted by regulations.

Economists tend to view ignorance as “rational,” neglecting the possibility that ignorance is unintentional. This oversight is reflected in economists’ model of “information search,” which can be fruitfully contrasted with “information browsing.” Information searches are designed to discover unknown knowns, whose value is calculable ex ante, such that this value justifies the cost of the search. In this model of human information acquisition, there is no primal or “radical” ignorance that might prevent people from knowing which information to look for, (...) lacking omniscience. Unlike ignorance that is rationally chosen on the basis of an accurate cost/benefit calculation, radical ignorance can explain human error. An account of error as grounded in radical ignorance bypasses the need to appeal to irrationality in order to explain economic (and other) mistakes. (shrink)

George Boolos was one of the most prominent and influential logician-philosophers of recent times. This collection, nearly all chosen by Boolos himself shortly before his death, includes thirty papers on set theory, second-order logic, and plural quantifiers; on Frege, Dedekind, Cantor, and Russell; and on miscellaneous topics in logic and proof theory, including three papers on various aspects of the Gödel theorems. Boolos is universally recognized as the leader in the renewed interest in studies of Frege's work on logic and (...) the philosophy of mathematics. John Burgess has provided introductions to each of the three parts of the volume, and also an afterword on Boolos's technical work in provability logic, which is beyond the scope of this volume. Sometimes you are unreliable at fulfilling your doxastic plans: for example, if you plan to be fully confident in all truths, probably you will end up being fully confident in some falsehoods by mistake. In some cases, there is information that plays the classical role of evidence—your beliefs are perfectly discriminating with respect to some possible facts about the world—and there is a standard expected‐accuracy‐based justification for planning to conditionalize on this evidence. This planning‐oriented justification extends to some cases where (...) you do not have transparent evidence, in the sense that your beliefs are not perfectly discriminating with respect to any non‐trivial facts. In other cases, accuracy considerations do not tell you to plan to conditionalize on any information at all, but rather to plan to follow a different updating rule. In 1971, two years before Roe v. Wade affirmed federal protection for abortion, Judith Jarvis Thomson attempted to demonstrate the wrongs of forced gestation through analogy: you awake to find that the world's most esteemed violinist is wholly, physically dependent on you for life support. Here, the authors suggest that Thomson's intuition, that there is a relevant similarity between providing living kidney support and forced gestation, is realized in the contemporary practice of living organ donation. After detailing the robust analogy (...) between living kidney donation and gestation, we turn to current ethical guidelines incorporated in the United Network for Organ Sharing's requirements for legally authorized organ donation and transplantation. We conclude that if, as we—and Thomson—suggest, organ donation and gestation are relevantly similar, then the ethical framework supporting donation may aid in articulating ethical grounds that will be compelling in informing the legal grounds for a defense of abortion. In this paper, we defend a traditional approach to semantics, that holds that the outputs of compositional semantics are propositional, i.e. truth conditions. Though traditional, this view has been challenged on a number of fronts over the years. Since classic work of Lewis, arguments have been offered which purport to show that semantic composition requires values that are relativized, e.g. to times, or other parameters that render them no longer propositional. Focusing in recent variants of these arguments involving quantification and (...) binding, we argue that a correct understanding of how composition works gives no reason to relativize semantic values, and that propositional semantic values are in fact the preferred option. We take our argument to be mainly empirical, but along the way, we defend some more general theses. Simple propositional semantic values are viable in composition, we maintain, because composition is itself a complex phenomenon, involving multiple modes of composition. Furthermore, some composition principles make adjustments to the meanings of constituents in the course of composition. These adjustments are by triggered syntactic environments. We argue such small contributions of meaning from syntactic structure are acceptable. (shrink)

This paper examines the concept and moral significance of “childhood interests.” This concept is important in medical decision-making for children and more broadly in the field of pediatric ethics. The authors argue that childhood interests are identifiable components of childhood well-being that carry moral weight. Parents have a special role in protecting and promoting these interests and special obligations to do so. These parental obligations are grounded by the independent interests of the child, as well as the good of society (...) more generally. Because parents have these child-rearing obligations, they must also have the authority and wide discretion necessary to fulfill them. This paper explores a case example of qualitative research that applied productive hermeneutics and the central concept, fusion of horizons. Interpretation of meaning is a fusing of the researchers’ and subjects’ perspectives and serves to expand understanding. The purpose is to illustrate an exemplar of qualitative research without establishing a rigid recipe of methodology. The illustration is based on in-depth observational and textual data from an applied anthropological study conducted in western Alaska with Yup’ik hunters and fishers and government agency (...) employees as they worked towards collaborative management. The metaphor of the hermeneutical circle is showcased to help the reader understand the philosophical underpinnings and the analytical processes used to realize a meaningful interpretation. A series of organizing systems for the interpretation is described, culminating in a final organizing system to communicate a fully realized understanding of collaborative management at the time. From the early 1960s until his death, French philosopher Gilles Deleuze wrote many influential works on philosophy, literature, film, and fine art. One of Deleuze's main philosophical projects was a systematic inversion of the traditional relationship between identity and difference. This Deleuzian philosophy of difference is the subject of Jeffrey A. Bell's Philosophy at the Edge of Chaos. Bell argues that Deleuze's efforts to develop a philosophy of difference are best understood by exploring both Deleuze's claim to be a (...) Spinozist, and Nietzsche's claim to have found in Spinoza an important precursor. Beginning with an analysis of these claims, Bell shows how Deleuze extends and transforms concepts at work in Spinoza and Nietzsche to produce a philosophy of difference that promotes and, in fact, exemplifies the notions of dynamic systems and complexity theory. With these concepts at work, Deleuze constructs a philosophical approach that avoids many of the difficulties that linger in other attempts to think about difference. Bell uses close readings of Plato, Aristotle, Spinoza, Nietzsche, Heidegger, Derrida, and Whitehead to illustrate how Deleuze's philosophy is successful in this regard and to demonstrate the importance of the historical tradition for Deleuze. Far from being a philosopher who turns his back on what is taken to be a mistaken metaphysical tradition, Bell argues that Deleuze is best understood as a thinker who endeavoured to continue the work of traditional metaphysics and philosophy. Richard Rorty is famous, maybe even infamous, for his philosophical nonchalance. His groundbreaking work not only rejects all theories of truth but also dismisses modern epistemology and its preoccupation with knowledge and representation. At the same time, the celebrated pragmatist believed there could be no universally valid answers to moral questions, which led him to a complex view of religion rarely expressed in his writings. In this posthumous publication, Rorty, a strict secularist, finds in the pragmatic thought of John Dewey, (...) John Stuart Mill, William James, and George Santayana, among others, a political imagination shared by religious traditions. His intent is not to promote belief over nonbelief or to blur the distinction between religious and public domains. Rorty seeks only to locate patterns of similarity and difference so an ethics of decency and a politics of solidarity can rise. He particularly responds to Pope Benedict XVI and his campaign against the relativist vision. Whether holding theologians, metaphysicians, or political ideologues to account, Rorty remains steadfast in his opposition to absolute uniformity and its exploitation of political strength. (shrink)

Aquinas's views about the morality of lying are well known and often discussed by commentators. But his views about the nature of lying have yet to receive the attention they deserve. In this article, I take some of the first steps necessary to correct this state of affairs by clarifying and offering a limited defense of the account of lying that Aquinas presents in in his Summa Theologiae—more specifically, in that portion of it known as the treatise on truth (Part (...) 2-2, Questions 109–113). There is one critical way we honor great tragedies: by never forgetting. Collective remembrance is as old as human society itself, serving as an important source of social cohesion, yet as Jeffrey Andrew Barash shows in this book, it has served novel roles in a modern era otherwise characterized by discontinuity and dislocation. Drawing on recent theoretical explorations of collective memory, he elaborates an important new philosophical basis for it, one that unveils profound limitations to its scope in relation (...) to the historical past. Crucial to Barash’s analysis is a look at the radical transformations that symbolic configurations of collective memory have undergone with the rise of new technologies of mass communication. He provocatively demonstrates how such technologies’ capacity to simulate direct experience—especially via the image—actually makes more palpable collective memory’s limitations and the opacity of the historical past, which always lies beyond the reach of living memory. Thwarting skepticism, however, he eventually looks to literature—specifically writers such as Walter Scott, Marcel Proust, and W. G. This essay concerns the extent to which quantitative research in management and organizational studies is divorced from ethics, as alleged in a recent JBE editorial by Zyphur and Pierides. After carefully examining the criticisms set forth by Zyphur and Pierides and the merits of the alternative they propose, I conclude that the problems with QR and the researchers who conduct it are arguably much less extreme that Zyphur and Pierides claim. This conclusion is informed by a sampling of QR studies (...) recently published in management journals, which could be further corroborated by a more thorough review and evaluation of QR studies using principles drawn from the ethics literature. I believe this assessment would indicate that, despite room for improvement, QR and ethics can and do peacefully coexist, and quantitative researchers are largely aware of the problems and opportunities associated with integrating their work with ethics. This article considers how a generalized signalling game may self-assemble as the saliences of the agents evolve by reinforcement on those sources of information that in fact lead to successful action. On the present account, generalized signalling games self-assemble even as the agents co-evolve meaningful representations and successful dispositions for using those representations. We will see how reinforcement on successful information sources also provides a mechanism whereby simpler games might compose to form more complex games. In this paper I argue that the hoary theological doctrine of divine concurrence poses no deep threat to Leibniz’s views on theodicy and creaturely activity even as those views have been traditionally understood. The first three sections examine respectively Leibniz’s views on creation, conservation and concurrence, with an eye towards showing their sys­tematic compatibility with Leibniz’s theodicy and metaphysics. The fourth section takes up remaining worries arising from the bridging principle that conservation is a continued or continuous creation, and argues (...) that they can be allayed once two readings of the prin­ciple are distinguished. What emerges from the discussion as a whole is, I hope, a clearer picture of Leibniz’s views on the nature of monadic causation, his understanding of the relationship between divine and creaturely activity, and his position with respect to later medieval and early modern debates over secondary causation. Some theories of goodness are descriptively rich: they have much to say about what makes things good. Neo-Aristotelian accounts, for instance, detail the various features that make a human being, a dog, a bee good relative to facts about those forms of life. Famously, such theories of relative goodness tend to be comparatively poor: they have little or nothing to say about what makes one kind of being better than another kind. Other theories of goodness—those that take there to be (...) absolute goodness—are comparatively rich: they offer grounds for judging some types of things better than others because they have more absolute goodness. Moorean accounts, for example, can tell us that humans and human experiences are superior to bees and blades of grass. But such theories tend to be descriptively poor: they struggle to tell us in virtue of what this is so. In this essay we motivate and flesh out a view that splits the difference between accounts of goodness as relative and accounts of goodness as absolute. Such a view holds promise only if the mechanics of this kind of metaphysics of goodness can be worked out. Here we present a view on which the paradigm for absolute goodness is God and the paradigm for each kind of relative goodness is a divine idea. (shrink)

Empirical research is largely supportive of the assertion of instrumental stakeholder theory that a positive relationship exists between “managing for stakeholders” and firm performance. However, despite considerable debate on the subject, the amount of variation across firm investments in stakeholders (stakeholder management performance) has not been adequately investigated. We address this gap using a sample of more than eighteen thousand firm-level observations over ten years. We find evidence to support an inverted U–shaped relationship between variation in stakeholder management performance and (...) Tobin’sq, suggesting that firms that have some imbalance in their stakeholder management, but not too much, perform best. We discuss the implications of our study for instrumental stakeholder theory and managerial practice. (shrink)

The Spirit of Montesquieu’s Persian Letters explores Montesquieu’s careful treatment of the spiritual, ethical, and civic dilemmas France encountered in the early 18th Century. In examining Montesquieu’s response to Bourbon France’s commercial and political culture of this time, it will help deepen our understanding of his political philosophy.

This article identifies and compares meanings of wildfire risk mitigation for stakeholders in the Front Range of Colorado, USA. We examine the case of a collaborative partnership sponsored by government agencies and directed to decrease hazardous fuels in interface areas. Data were collected by way of key informant interviews and focus groups. The analysis is guided by the Circuit of Culture model in communication research. We found both shared and differing meanings between members of this partnership (the ‘‘producers’’) and other (...) stakeholders not formally in the partnership (the ‘‘consumers’’). We conclude that those promoting the partnership’s project to mitigate risk are primarily aligned with a discourse of scientific management. Stakeholders outside the partnership follow a discourse of community. We argue that failure to recognize and account for differences in the way risk mitigation is framed and related power dynamics could hamper the communicational efforts of the collaborative partnership and impact goals for fuels reduction. We recommend ways that both groups can capitalize on shared meanings and how agency managers and decision makers can build better working relationships with interface communities and other external stakeholders. In this conceptual article, the authors explore the possibilities of another approach to examining the human dimensions of wildland fire. They argue that our understanding of this issue could be enhanced by considering a cultural studies construct known as the ‘‘circuit of culture.’’ This cross-disciplinary perspective provides increased analytic power by accounting for the meaningful role of 5 cultural processes in terms of their location and interrelation within social experience. The authors compare the circuit of culture approach with a body (...) of recent literature focused on wildland fire. The authors make the case that this research has moved in a positive direction since wildland fire first ignited social scientific interest in the 1980s, but it is still missing key cultural processes. Ultimately, following the circuit allows us to make more nuanced statements about meaning, something much needed in the face of the wicked problem of wildland fire. (shrink)

Mention of the name of Friedrich Schiller among both critics and defenders of Kant's moral philosophy has most often been with reference to the well known quip:“Gladly I serve my friends, but alas I do it with pleasure.Hence I am plagued with doubt that I am not a virtuous person.““Sure, your only resource is to try to despise them entirely,And then with aversion to do what your duty enjoins you.''This attention, however, has served to obscure the fact that Schiller truly (...) intended his remark as a joke, representing a serious, if understandable, misinterpretation of Kantian morality. Though Schiller's various attempts to articulate a theory of moral motivation include important divergences from Kant's account, they represent a response to a set of problems that arise in the context of Kantian moral theory. As such, they may be of greatest interest to moralists who are working within the Kantian tradition. In this paper, I clarify certain points of Schiller's critique of Kant's account of moral motivation and place them in the context of his broader project of reconciling Kantianism and an ethics of virtue. Integrating the concept of place meanings into protected area management has been difficult. Across a diverse body of social science literature, challenges in the conceptualization and application of place meanings continue to exist. However, focusing on relationships in the context of participatory planning and management allows protected area managers to bring place meanings into professional judgment and practice. This paper builds on work that has outlined objectives and recommendations for bringing place meanings, relationships, and lived experiences to the forefront of (...) land-use planning and management. It proposes the next steps in accounting for people’s relationships with protected areas and their relationships with protected area managers. Our goals are to 1) conceptualize this relationship framework; 2) present a structure for application of the framework; and 3) demonstrate the application in a specific protected area context, using an example from Alaska. We identify three key target areas of information and knowledge that managers will need to sustain quality relationship outcomes at protected areas. These targets are recording stories or narratives, monitoring public trust in management, and identifying and prioritizing threats to relationships. The structure needed to apply this relationship-focused approach requires documenting and following individual relationships with protected areas in multiple ways. The goal of this application is not to predict relationships, but instead to gain a deeper understanding of how and why relationships develop and change over time. By documenting narratives of individuals, managers can understand how relationships evolve over time and the role they play in individual’s lives. By understanding public trust, the shared values and goals of individuals and managers can be observed. By identifying and prioritizing threats, managers can pursue efforts that steward relationships while allowing for the protection of experiences and meanings. The collection and interpretation of these three information targets can then be integrated and implemented within planning and management strategies to achieve outcomes that are beneficial for resource protection, visitor experiences, and stakeholder engagement. By investing in this approach, agencies will gain greater understanding and usable knowledge towards the achievement of quality relationships. It represents an investment in both place relationships and public relations. In my “Creatures of Fiction, Objects of Myth” (2014), I present and defend an argument for thinking that mythical creationism—the view that mythical objects like phlogiston and Vulcan are abstract artifacts—is false. One intriguing sort of objection to my argument has been recently put forth by Zvolenszky (2016); she claims that a crucial premise is seen to be unjustified once one considers the phenomena of inadvertently created abstracta—specifically, inadvertently created fictional characters. I argue here that even if we admit inadvertently (...) created abstracta into our ontology, my argument survives. I ultimately defend a view on which fictional characters (if real) may be countenanced as created abstracta whether purposefully created or not, yet mythical objects are best taken to be discoverable, Platonic abstracta (if real). We can see that such a hybrid ontology is justified once we take proper note of the nature of the sorts of authorial activities involved in fictional storytelling and scientific hypothesizing. To understand the ethical issue of gender inequality in entrepreneurial financing, we examine the effect of angel investors’ political ideology, the conservatism–liberalism continuum, on their investments in women-owned ventures. We propose that more conservative angel investors tend to have a lower percentage of investments in women-owned ventures in their portfolios. Moreover, drawing on the gender role congruity theory, we show that when investing in women-owned ventures, more conservative angels favor women-owned ventures with a higher percentage of male co-founders and operating (...) in women-dominated industries. Our analysis, based on a longitudinal sample of 172 angels from 2010 to 2019, supports these hypotheses. Our study contributes to the literature by highlighting angel political ideology as a critical antecedent of the gender disparity in entrepreneurial financing. (shrink)

This is an open access book which explores phenomenology as both an exceptionally diverse movement in philosophy as well as an active research method that crosses disciplinary boundaries. The volume brings together lively overviews of major areas and schools of phenomenology, as well as the most recent applications across a range of fields. The first part reviews the state-of-the-art in various areas of contemporary phenomenology, including several distinct schools of Husserl and Heidegger scholarship, as well as approaches derived from Merleau-Ponty, (...) de Beauvoir, Fanon, and others. An innovative quantitative analysis of citation networks provides rich visualizations of the field as a whole. The second part showcases phenomenology as a living discipline that can advance research in other areas. While some areas of interaction between phenomenology and other disciplines are by now well established (e.g. cognitive science), this volume sheds light on newer areas of application. The goal is to move beyond discussions of philosophical method and highlight scholars who are actually doing phenomenology in a variety of areas, including: Embodiment and questions of gender, race, and identity, The arts (visual art, literature, architecture), and Archaeology and anthropology. Critics have recently argued that reliabilists face trade-off problems, forcing them to condone intuitively unjustified beliefs when they generate lots of true belief further downstream. What these critics overlook is that reliabilism entails that there areside-constraintson belief-formation, on account of which there are some things you should not believe, even if doing so would have very good epistemic consequences. However, we argue that by embracing side-constraints the reliabilist faces a dilemma: she can either hold on to reliabilism, and with it (...) aforementioned side-constraints, but then needs to explain why we should allow the pursuit of justification to get in the way of the acquisition of true belief; or she can deny that there are side-constraints – and in effect give up on reliabilism. We'll suggest that anyone moved by the considerations that likely attract people to reliabilism in the first place – the idea the true belief is good, and as such should be promoted – should go for the second horn, and instead pursue a form ofepistemic utilitarianism. According to an existing “environmental” narrative, the financial crisis of 2007-2009 was due in part to executive compensation packages in the financial services industry that incentivized excessive risk-taking. Also according to this narrative, those who have a duty to protect society – principally, government regulators, but also firms themselves – are open to blame for how executives were paid, and must take steps to change executive compensation. This narrative is important but incomplete. I offer a supplementary “agential” narrative. According to (...) this narrative, executives are open to blame for the financial crisis for taking socially excessive risks. Moreover, since executives can play a role in shaping their compensation, they have an obligation to ensure that it does not incentivize them to take such risks. (shrink)
