In a recent paper, Charles Foster argued that the epistemic uncertainties surrounding prolonged disorders of consciousness make it impossible to prove that the withdrawal of life-sustaining treatment can be in a patient’s best interests and, therefore, the presumption in favour of the maintenance of life cannot be rebutted. In the present response, I argue that, from a legal perspective, Foster has reached the wrong conclusion because he is asking the wrong question. According to the reasoning in two leading cases —Bland (...) and James —the principle of respect for autonomy creates a persuasive presumption against treatment without consent. Therefore, it is the continuation of treatment that requires justification, rather than its withdrawal. This presumption also works as the tiebreaker determining that treatment should stop if there is no persuasive evidence that its continuation is in the best interests of the patient. The presumption in favour of the maintenance of life, on the other hand, should be understood as an evidential presumption on a factual issue that is assumed to be true if unchallenged. However, the uncertainties regarding PDOC actually give reasons for displacing this evidential presumption. Consequently, decision-makers will have to weigh up the pros and cons of treatment having the presumption against treatment without consent as the tiebreaker if the evidence is inconclusive. In conclusion, when the right question is asked, Foster’s argument can be turned on its head and uncertainties surrounding PDOC weigh in to justify the interruption of treatment in the absence of compelling contrary evidence. Both developing and developed countries face an increasing mismatch between what patients expect to receive from healthcare and what the public healthcare systems can afford to provide. Where there has been a growing recognition of the entitlement to receive healthcare, the frustrated expectations with regards to the level of provision has led to lawsuits challenging the denial of funding for health treatments by public health systems. This book analyses the impact of courts and litigation on the way health systems set (...) priorities and make rationing decisions. In particular, it focuses on how the judicial protection of the right to healthcare can impact the institutionalization, functioning and centrality of Health Technology Assessment (HTA) for decisions about the funding of treatment. Based on the case study of three jurisdictions - Brazil, Colombia, and England - it shows that courts can be a key driver for the institutionalization of HTA. These case studies show the paradoxes of judicial control, which can promote accountability and impair it, demand administrative competence and undermine bureaucratic capacities. The case studies offer a nuanced and evidence-informed understanding of these paradoxes in the context of health care by showing how the judicial control of priority-setting decisions in health care can be used to require and control an explicit scheme for health technology assessment, but can also limit and circumvent it. This monograph investigates the temporal interpretation of narrative discourse in two parts. The theme of the first part is narrative progression. It begins with a case study of the adverb ‘now’ and its interaction with the meaning of tense. The case study motivates an ontological distinction between events, states and times and proposes that ‘now’ seeks a prominent state that holds throughout the time described by the tense. Building on prior research, prominence is shown to be influenced by principles of (...) discourse coherence and two coherence principles, NARRATION and RESULT, are given a formally explicit characterization. The key innovation is a new method for testing the definitional adequacy of NARRATION and RESULT, namely by an abductive argument. This contribution opens a new way of thinking about how eventive and stative descriptions contribute to the perceived narrative progression in a discourse. -/- The theme of the second part of the monograph is the semantics and pragmatics of tense. A key innovation is that the present and past tenses are treated as scalar alternatives, a view that is motivated by adopting a particular hypothesis concerning stative predication. The proposed analysis accounts for tense in both matrix clauses and in complements of propositional attitudes, where the notorious double access reading arises. This reading is explored as part of a corpus study that provides a glimpse of how tense semantics interacts with Gricean principles and at-issueness. Several cross-linguistic predictions of the analysis are considered, including their consequences for the Sequence of Tense phenomenon and the Upper Limit Constraint. Finally, a hypothesis is provided about how tense meanings compose with temporal adverbs and verb phrases. Two influential analysis of viewpoint aspect are then compared in light of the hypothesis. In this study Daniel Conway shows how Nietzsche's political thinking bears a closer resemblance to the conservative republicanism of his predecessors than to the progressive liberalism of his contemporaries. It is almost universally agreed that the main business of commonsense psychology is that of providing generally reliable predictions and explanations of the actions of others. In line with this, it is also generally assumed that we are normally at theoretical remove from others such that we are always ascribing causally efficacious mental states to them for the purpose of prediction, explanation and control. This paper investigates the determinacy of mathematics. We begin by clarifying how we are understanding the notion of determinacy before turning to the questions of whether and how famous independence results bear on issues of determinacy in mathematics. From there, we pose a metasemantic challenge for those who believe that mathematical language is determinate, motivate two important constraints on attempts to meet our challenge, and then use these constraints to develop an argument against determinacy and discuss a particularly popular approach (...) to resolving indeterminacy, before offering some brief closing reflections. We believe our discussion poses a serious challenge for most philosophical theories of mathematics, since it puts considerable pressure on all views that accept a non-trivial amount of determinacy for even basic arithmetic. We propose to analyze well-known cases of "imaginative resistance" from the philosophical literature (Gendler, Walton, Weatherson) as involving the inference that particular content should be attributed to either: (i) a character rather than the narrator or, (ii) an unreliable, irrational, opinionated, and/or morally deviant "first person" narrator who was originally perceived to be a typical impersonal, omniscient, "effaced" narrator. We model the latter type of attribution in terms of two independently motivated linguistic mechanisms: accommodation of a discourse referent (Lewis, Stalnaker, (...) Functional localization has historically been one of the primary goals of neuroscience. There is still debate, however, about whether it is possible, and if so what kind of theories succeed at localization. I argue for a contextualist approach to localization. Most theorists assume that widespread contextual variability in function is fundamentally incompatible with functional decomposition in the brain, because contextualist accounts will fail to be generalizable and projectable. I argue that this assumption is misplaced. A properly articulated contextualism can ground (...) successful theories of localization even without positing completely generalizable accounts. Via a case study from perceptual neuroscience, I suggest that there is strong evidence for contextual variation in the function of perceptual brain areas. I then outline a version of contextualism that is empirically adequate with respect to this data, and claim that it can still distinguish brain areas from each other according to their functional properties. Finally, I claim that the view does not fail the norms for good theory in the way that anticontextualists suppose. It is true that, on a contextualist view, we will not have theories that are completely generalizable and predictive. We can, however, have successful partial generalizations that structure ongoing investigation and lead to novel functional insight, and this success is sufficient to ground the project of functional localization. I make a proposal about what wondering is and how it differs from other mental phenomena like curiosity. I argue that, though it's tempting to analyze wondering as a desire to know the answer to the question one wonders about, that would be wrong, since wondering is an activity rather than a state, i.e., something we do. I also argue that wondering about a question needn't even essentially involve a desire to know the answer to that question, even as a (...) necessary part of what rationalizes the wondering. Instead, on my account, to wonder about a question is to consider various possible answers as possible answers, guided by mechanisms whose function is to make the subject epistemically better off with respect to those answers, and which considering ceases at least when a person is consciously certain of the answer to their question. This allows wondering to not be objectionably metacognitive, and allows us to make sense of cases in which the motivating desire isn't to know an answer but just to wonder itself. (shrink)

In contrast, the authors consider heuristics to be adaptive strategies that evolved in tandem with fundamental psychological mechanisms. The recognition heuristic, arguably the most frugal of all heuristics, makes inferences from patterns of missing knowledge. This heuristic exploits a fundamental adaptation of many organisms: the vast, sensitive, and reliable capacity for recognition. The authors specify the conditions under which the recognition heuristic is successful and when it leads to the counter-intuitive less-is-more effect in which less knowledge is better than more for making accurate inferences. Hybrid metaethical theories attempt to incorporate essential elements of expressivism and cognitivism, and thereby to accrue the benefits of both. Hybrid theories are often defended in part by appeals to slurs and other pejoratives, which have both expressive and cognitivist features. This paper takes far more seriously the analogy between pejoratives and moral predicates. It explains how pejoratives work, identifies the features that allow pejoratives to do that work, and models a theory of moral predicates on those features. The result (...) is an expressivist theory that, among other advantages, is immune to embedding difficulties and avoids an overlooked difficulty concerning attitude ascriptions that is lethal to most other hybrid theories. This article aims to advance the discussion of how multinational companies manage the tension between global integration and local responsiveness in their corporate social responsibility. In particular, it studies the relationships between headquarters and subsidiaries in a transnational CSR strategy and the types of coordination mechanisms used. Building on a qualitative study of a multinational bank, we find that in addition to formal and informal coordination mechanisms, a transnational CSR strategy cannot be fully understood without considering lateral learning and participatory (...) decision making. Further, we suggest that discussions about the transnational approach to CSR should not be disentangled from the question about a company's CSR orientation. Finally, we propose some characteristics of transnational CSR and discuss its theoretical and practical implications. (shrink)

The book suggests a new perspective on the essence of human language. This enormous achievement of our species is best characterized as a communication technology - not unlike the social media on the Net today - that was collectively invented by ancient humans for a very particular communicative function: the instruction of imagination. All other systems of communication in the biological world target the interlocutors' senses; language allows speakers to systematically instruct their interlocutors in the process of imagining the intended (...) meaning - instead of directly experiencing it. This revolutionary function has changed human life forever, and in the book it operates as a unifying concept around which a new general theory of language gradually emerges. Dor identifies a set of fundamental problems in the linguistic sciences - the nature of words, the complexities of syntax, the interface between semantics and pragmatics, the causal relationship between language and thought, language processing, the dialectics of universality and variability, the intricacies of language and power, knowledge of language and its acquisition, the fragility of linguistic communication and the origins and evolution of language - and shows with respect to all of them how the theory provides fresh answers to the problems, resolves persistent difficulties in existing accounts, enhances the significance of empirical and theoretical achievements in the field, and identifies new directions for empirical research. Care theorists have made significant gains over the past twenty-five years in establishing caring as a viable moral and political concept. Nonetheless, the concept of caring remains underdeveloped as a basis for a moral and political philosophy, and there is no fully developed account of our moral obligation to care. This article advances thinking about caring by developing a definition of caring and a theory of obligation to care sufficient to ground a general moral and political philosophy.

One may then define the revision of a theory K by a formula α as the theory defined by the set of all those models of α that are closest, by d, to the set of models of K. Background Our objective was to evaluate whether the description of a machine learning (ML) app or brain imaging technology to predict the onset of schizophrenia or alcohol use disorder (AUD) influences healthcare professionals’ judgments of stigma, empathy, and compassion. Methods We randomized healthcare professionals (N = 310) to one vignette about a person whose clinician seeks to predict schizophrenia or an AUD, using a ML app, brain imaging, or a psychosocial assessment. Participants used scales to measure their judgments of stigma, (...) empathy, and compassion. Results Participants randomized to the ML vignette endorsed less anger and more fear relative to the psychosocial vignette, and the brain imaging vignette elicited higher pity ratings. The brain imaging and ML vignettes evoked lower personal responsibility judgments compared to the psychosocial vignette. Physicians and nurses reported less empathy than clinical psychologists. Conclusions The use of predictive technologies may reinforce essentialist views about mental health and substance use that may increase specific aspects of stigma and reduce others. (shrink)

In Setting Limits, Daniel Callahan advances the provocative thesis that age be a limiting factor in decisions to allocate certain kinds of health services to the elderly. However, when one looks at available data, one discovers that there are many more elderly women than there are elderly men, and these older women are poorer, more apt to live alone, and less likely to have informal social and personal supports than their male counterparts. Older women, therefore, will make the heaviest (...) demand on health care resources. If age were to become a limiting factor, as Dr. Callahan suggests it should, the limits that will be set are limits that will affect women more drastically than they affect men.
