Neuroenhancement involves the use of neurotechnologies to improve cognitive, affective or behavioural functioning, where these are not judged to be clinically impaired. Questions about enhancement have become one of the key topics of neuroethics over the past decade. The current study draws on in-depth public engagement activities in ten European countries giving a bottom-up perspective on the ethics and desirability of enhancement. This informed the design of an online contrastive vignette experiment that was administered to representative samples of 1000 respondents (...) in the ten countries and the United States. The experiment investigated how the gender of the protagonist, his or her level of performance, the efficacy of the enhancer and the mode of enhancement affected support for neuroenhancement in both educational and employment contexts. Of these, higher efficacy and lower performance were found to increase willingness to support enhancement. A series of commonly articulated claims about the individual and societal dimensions of neuroenhancement were derived from the public engagement activities. Underlying these claims, multivariate analysis identified two social values. The Societal/protective highlights counter normative consequences and opposes the use enhancers. The Individual/proactionary highlights opportunities and supports use. For most respondents these values are not mutually exclusive. This suggests that for many neuroenhancement is viewed simultaneously as a source of both promise and concern. (shrink)

Overtreatment is when medical or dental services are provided with a higher volume or cost than is appropriate. This study aimed to investigate how a group of dentists in Switzerland, a wealthy country known to have high standards of healthcare including dentistry, evaluated the meaning of unnecessary treatments from an ethical perspective and, assessed the expected frequency of different possible behaviors among their peers.

Drawing on a rich digitalized corpus of early modern texts, Hans-Juergen Diller argues that the concepts expressed by the English words >passion emotion emotion passion emotion<. But there are two concepts of a concept. According to the first, the meaning of a word expressing a concept is not sharply distinguished from the complete discourse in which it figures. According to the second, meaning is more narrow. For instance, it is restricted to the explicit definition an author provides. I show (...) that Descartes provides an explicit definition of passion and emotion in purely physical, a-moral terms. So Diller's method is not apt to trace concepts in the second, more restricted sense which Descartes himself has in mind. (shrink)

Public and intellectual debates have long struggled with the concept of values and the difficulties of defining them. With _The Genesis of Values,_ renowned theorist Hans Joas explores the nature of these difficulties in relation to some of the leading figures of twentieth-century philosophy and social theory: Friedrich Nietzsche, William James, Max Scheler, John Dewey, Georg Simmel, Charles Taylor, and Jürgen Habermas. The first English translation of Hans Reichenbach's lucid doctoral thesis sheds new light on how Kant’s Critique of Pure Reason was understood in some quarters at the time. The source of several themes in his still influential The Direction of Time, the thesis shows Reichenbach's early focus on the interdependence of physics, probability, and epistemology.

A framework for the mind-matter problem in a holistic universe which has no parts is outlined. The conceptual structure of modern quantum theory suggests to use complementary Boolean descriptions as elements for a more comprehensive non-Boolean description of a world without an a priori mind-matter distinction. Such a description in terms of a locally Boolean but globally non-Boolean structure makes allowance for the fact that Boolean descriptions play a privileged role in science. If we accept the insight that there are (...) no ultimate building blocks, the existence of holistic correlations between contextually chosen parts is a natural consequence. The main problem of a genuinely non-Boolean description is to find an appropriate partition of the universe of discourse. If we adopt the idea that all fundamental laws of physics are invariant under time translations, then we can consider a partition of the world into a tenseless and a tensed domain.In the sense of a regulative principle, the material domain is defined as the tenseless domain with its homogeneous time. The tensed domain contains the mental domain with a tensed time characterized by a privileged position, the Now. Since this partition refers to two complementary descriptions which are not given a priori we have to expect correlations between these two domains. In physics it corresponds to Newton 's separation of universal laws of nature and contingent initial conditions Both descriptions have a non-Boolean structure and can be encompassed into a single non-Boolean description. Tensed and tenseless time can be synchronized by holistic correlations. (shrink)

This article explores hamartiological questions at the interface of evolutionary biology and theology. Such questions include the problem of evil, the possibility of a historical fall, and the meaning of human sinfulness in light of biology. First, I examine some of the leading accounts of animal theodicy, including John Schneider's aesthetic theodicy, Christopher Southgate's compound theodicy, and Joshua Moritz's free creatures’ defense. Second, I review several non‐lapsarian accounts of how sin originated within the human story (e.g., Robert Russell's concept of (...) entropy as the physical origin of sin). Then third, I discuss noteworthy attempts to revise the doctrine of original sin in light of evolutionary psychology. Although the quest for a post‐Darwinian doctrine of sin has prompted fascinating areas of research, I conclude that an evolutionary hamartiology remains a remarkably difficult project. (shrink)

Kelsen's 'Pure theory of law' was first presented in his fundamental work Hauptprobleme des Staatsrechtlehre (1911) and continued in both editions of Reine Rechtslehre (1934, 1958). Historically, it has a certain relation to John Austin's 'analytical jurisprudence', although Kelsen became acquainted with Austin's work for the first time in 1940. The 'pure theory of law' is a formal-logical analysis of law, considered as a system of norms, based philosophically on the strict distinction between 'is' and 'ought'. It is a normative (...) and positive doctrine, opposed both to positivism, showing the limitations of the positivistic approach, the whole legal order. His positivism is a formal analysis of the legal norm, of its elements and of the architecture of the legal order. Kelsen's concentration on the form of law recognizes the legitimacy of sociological investigations and the study of values in reference both to the contents and the making of law.
