In the 1760s, the international debate on the solution to determining longitude at sea is at its acme. Two solutions emerge, the mechanical and the astronomical ones. The Portuguese mathematician and astronomer José Monteiro da Rocha (1734–1819) is well aware of that debate. For him, Harrison’s No. 4 marine timekeeper cannot be seen as a solution. The desirable solution could only be astronomical. In a manuscript from c. 1765, which unfortunately he fails to publish, Monteiro da Rocha (...) is very critical of Lacaille's lunar-distance method (1759) and proposes another one. In this paper, we intend to analyse Monteiro da Rocha’s criticisms and proposals, trying to understand how this manuscript fits into the international longitude debate and the Portuguese scientific scenario at the time. Concurrently, we will re-examine the classical historiography around the English vs. French priority proposal of the lunar-distance method, purging it from its mythologies to shift it towards a more open, less linear history. In philosophical debates on human rights between the East and the West, scholars argue whether rights in the Universal Declaration of Human Rights (UDHR) and other international documents (in short, “international human rights”) are universal or culturally relative. Some scholars who emphasize the importance of East Asian cultures (such as the Confucian tradition) have different attitudes toward civil and political rights (CP rights) than toward economic, social, and cultural rights (ESC Rights). They argue that at least some (...) class='Hi'>international human rights on the list of CP rights are not universal and believe that East Asian cultures can contribute to the moral justification of ESC rights. This chapter introduces a philosophical argument to support a normative account of human rights. This normative account, called “the minimal account of human rights,” is based on the ideas of minimal values, especially essential necessities of dignity. Based on this account, we can explain why international human rights are both universal and justified by East Asian cultures, especially the Confucian tradition. To explain this minimal account and illustrate how it can be applied to debates on international human rights, this chapter focuses on debates on the international human rights to liberty on the list of CP rights and the human rights to health on the list of ESC rights. Official Catholic opposition to contraception has long been portrayed as a stand that is based in antiquated doctrine and “out of touch” with society and its problems. It is argued by Lie et al in the current issue of the Journal of Medical Ethics that an international consensus opinion has formed on the issue of standards of care in clinical trials undertaken in developing countries. This opinion, so they argue, rejects the Declaration of Helsinki’s traditional view on this matter. They propose furthermore that the Declaration of Helsinki has lost its moral authority in the controversy in research ethics. Although the latter conclusion is supported by this (...) author, it will be demonstrated in this paper that there is not such a thing as an international consensus opinion, and that the authorities used by Lie et al as evidence in support of their claim should not be relied upon as authorities or final arbiters in this debate. Furthermore, it will be shown that arguments advanced substantively to show that lower standards of care are ethically acceptable in the developing world, conflate scientific with economic reasons, and ultimately fail to bolster the case they are designed to support. The World Medical Association’s revised Declaration of Helsinki endorses the view that all trial participants in every country are entitled to the worldwide best standard of care. In this paper the authors show that this requirement has been rejected by every national and international committee that has examined this issue. They argue that the consensus view now holds that it is ethically permissible, in some circumstances, to provide research participants less than the worldwide best care. This article reviews and also compares developments within international humanitarian law and human rights law in regard to matters relating to child soldiers. Beginning with the Geneva Conventions and early twentieth century legal developments for children in general, this article identifies the legal and conceptual discrepancies in the child soldiers issue and how they relate to and affect each other. It also includes an overview of the child soldiers issue, followed by summary discussions of the respective strengths and weaknesses (...) of international humanitarian law and human rights law in regard to child soldiers. Following from that, conceptual problems in the field that are problematic in regard to law are also considered, and some concluding observations are then offered. This paper addresses Suárez’s understanding of imagination and phantasy, dealing with it in the general Aristotelian debate on the internal senses. Paragraph 1 sketches Aristotle’s, Avicenna’s and Aquinas’s accounts of imagination, examining especially the boundary between human and animal cognition. Paragraph 2 addresses especially the Jesuits’ understanding of the topology of the internal senses, linking it with the Jesuit strategy for the demonstration of the soul’s immateriality and immortality. When activists or policy-makers decide that one culture’s traditional practice is harmful and needs to be eradicated, does it matter whether they are members of that culture? Given the history of imperialism, many argue that any critique of another culture’s practices must be internal. Others argue that we can appeal to a universal standard of human wellbeing to determine whether or not a particular practice is legitimate or whether (...) it should be eradicated. In this paper, I use the FGC eradication campaigns of the 1980s to show that the internal/external divide is complicated by the interconnectedness of these debates on the international level. EverCrack case. In a traditional Oxford style debate, two debaters take opposing viewpoints and the third debater argues the neutral position. At the Conference, the modified format featured the two debaters presenting diametrically opposing views – corporate (...) responsibility versus personal responsibility. This modified format was also used during the Ethics Awareness Week, with University professors presenting the debate before the student body. Over the last few decades an increasingly pressing social demand for access to assisted reproductive technologies (ART) has emerged. ABSTRACT In this article the development of the thought of two important twentieth-century legal theorists is compared. Although Hans Kelsen is primarily known for his Pure theory of law and Hermann Kantorowicz is one of the founders of the Free law movement, the article will revolve around their respective proposals for the post-War restoration of the international legal order. It is argued that these are based on their respective conceptions of ‘law’ and ‘the state’. By virtue of this comparison, (...) it is possible to shed light on the basic thinking behind their complex ideas, as well as show how these were formulated and influenced by the political circumstances of their times. Lastly, the article shall concern the concrete post-War influence of Kantorowicz and Kelsen, as a result of the shared and different philosophical, methodological and scientific convictions of both scholars. Online service providers —such as AOL, Facebook, Google, Microsoft, and Twitter—significantly shape the informational environment and influence users’ experiences and interactions within it. There is a general agreement on the centrality of OSPs in information societies, but little consensus about what principles should shape their moral responsibilities and practices. In this article, we analyse the main contributions to the debate on the moral responsibilities of OSPs. By endorsing the method of the levels of abstract, we first analyse the moral (...) responsibilities of OSPs in the web. These concern the management of online information, which includes information filtering, Internet censorship, the circulation of harmful content, and the implementation and fostering of human rights. We then consider the moral responsibilities ascribed to OSPs on the web and focus on the existing legal regulation of access to users’ data. The overall analysis provides an overview of the current state of the debate and highlights two main results. First, topics related to OSPs’ public role—especially their gatekeeping function, their corporate social responsibilities, and their role in implementing and fostering human rights—have acquired increasing relevance in the specialised literature. Second, there is a lack of an ethical framework that can define OSPs’ responsibilities, and provide the fundamental sharable principles necessary to guide OSPs’ conduct within the multicultural and international context in which they operate. This article contributes to the ethical framework necessary to deal with and by endorsing a LoA enabling the definition of the responsibilities of OSPs with respect to the well-being of the infosphere and of the entities inhabiting it. Philosopherd have long stressed a distinction between theory justification and theory discovery based on a belief that justification and discovery are essentially different processes. What makes these two processes essentially different, it was assumed, is that the process of justification is guided by criteria which are expressable as rules, while the processes involved in discovery are not rule-guided. The question of whether time is its own best representation is explored. Though there is theoretical debate between proponents of internal models and embedded cognition proponents (e.g. Brooks R 1991 Artificial Intelligence 47 139–59) concerning whether the world is its own best model, proponents of internal models are often content to let time be its own best representation. This happens via the time update of the model that simply allows the model’s state to evolve along with the state of (...) the modeled domain. I argue that this is neither necessary nor advisable. I show that this is not necessary by describing how internal modeling approaches can be generalized to schemes that explicitly represent time by maintaining trajectory estimates rather than state estimates. Though there are a variety of ways this could be done, I illustrate the proposal with a scheme that combines filtering, smoothing and prediction to maintain an estimate of the modeled domain’s trajectory over time. I show that letting time be its own representation is not advisable by showing how trajectory estimation schemes can provide accounts of temporal illusions, such as apparent motion, that pose serious difficulties for any scheme that lets time be its own representation. This paper intervenes in debates on Chinese higher education and social (re)production strategies in the contemporary African diaspora, developing the link between ‘Chinese’ capitals, social status and spatial mobility. Drawing on semi-structured interviews with both disadvantaged and middle-class African international students, I unpack how migration to China will enable them to accumulate prized forms of capital and position advantageously in different spheres of African society. The paper focuses on two ‘Chinese’ capitals – specifically high proficiency in the Chinese language, (...) and exposure to and internalisation of Chinese lifestyles and practices – which are convertible to profit, distinction and secure coveted jobs in their respective home countries. By exploring how China’s ‘in the middle’ position within the global political economy and exercising its soft power over peripheries are reflected in the ways these African students and their families play the ‘class game’ and make higher education choice, this paper moves beyond the ‘West’ vs. ‘the Rest’ gaze and nuances an emergent mobility pattern within the Global South. I conclude by presenting an argument that in seeking these ‘Chinese’ capitals, the students and their families may enhance China’s geopolitical standing and facilitate its movement towards the ‘core’ within the arena of the world (knowledge) system. The relationship between power, law and consent is a key feature of the Western debate on criminal law. On the one side, defining the legitimate ways of exercising the punitive power has been a critical question since the Enlightenment thought onwards and especially as to the rule of law doctrine. On the other side, the role played by public punishment in shaping consent and its communicative potential have been crucial questions for critical, as well as non-critical approaches to criminal (...) law in contemporary thought. These questions gain in strength and radicalism when it comes to international criminal law (ICL). In this case the filter of the state is not present anymore to mediate between power, law and consent, and the power to punish individuals is directly exercised by international institutions. This means, on the one hand, that traditional justifications of the power to punish and which are elaborated on in the domestic sphere are not useful anymore in legitimating international punishment. International criminal norms are not framed by an international democratically elected parliament, and their exercise is not controlled by the complex system of checks and balances typical of the rule of law. On the other hand, having not being created by a sovereign, international criminal law cannot be conceived as an instrument to build or consolidate consent around the sovereign. A double-sided dilemma therefore arises: traditional explanations are no longer apt to answer the question whether ICL is legitimate, while ICL itself can no longer be considered an instrument to build consent around the traditional power exercising it, namely the state. Although I consider both sides of the dilemma equally interesting and stimulating, I will focus here only on one side of the coin: the ability to build consent of the ICL institutions, and in particular the International Criminal Court (ICC). In other words, instead of asking whether the consent around the ICC is broad enough for the Court to be considered legitimate, I shall ask whether the ICC is able to build consent around the world order it embodies. International institutions such as UNESCO are deliberating on a new standard setting instrument for neurotechnologies. This will likely lead to the adoption of a soft law document which will be the first global document specifically tailored to neurotechnologies, setting the tone for further international or domestic regulations. While some stakeholders have been consulted, these developments have so far evaded the broader attention of the neuroscience, neurotech, and neuroethics communities. To initiate a broader debate, this target article puts (...) to discussion twenty-five considerations and desiderata for recognition by a future instrument. They are formulated at different levels of abstraction, from the big picture to technical details, seek to widen the perspective of preparatory reports and transcend the narrow debate about “neurorights” which overshadows many richer and more relevant aspects. These desiderata are not an exhaustive enumeration but a starting point for discussions about what deserves and what requires protection by an international instrument. (shrink)

However, a thorough analytical comparison of the different existing international regulations, their terminologies and their ethical principles concerning placebo, is still missing. The central issue in the ongoing controversy is the justification of placebo‐use, if proven treatment exists. All present versions of the examined guidelines propose such justifications, but each guideline differs from the others in relevant details. Therefore the (...) conditions justifying placebo‐use according to each guideline are the focus of our attention. We will first propose a formalized general principle that defines the ethical acceptability of placebo‐use. Then we will analyse three categories of conditions put forward by the different documents: the risk of harm or burden, compelling scientific reasons, and the availability of proven treatment. The analysis shows important normative discrepancies and contradictions between the examined guidelines. Especially striking is the fact that some guidelines allow the participants in clinical trials to be exposed to a risk of serious harm, while others do not. Finally, we try to show how the normative difference of each guideline could influence the decision of researchers or IRBs concerning the ethical acceptabililty of placebo‐use. (shrink)

Health research has been identified as a vehicle for advancing global justice in health. However, in bioethics, issues of global justice are mainly discussed within an ongoing debate on the conditions under which international clinical research is permissible. As a result, current ethical guidance predominantly links one type of international research (biomedical) to advancing one aspect of health equity (access to new treatments). International guidelines largely fail to connect international research to promoting broader aspects of (...) health equity – namely, healthier social environments and stronger health systems. Bioethical frameworks such as the human development approach do consider how international clinical research is connected to the social determinants of health but, again, do so to address the question of when international clinical research is permissible. It is suggested that the narrow focus of this debate is shaped by high-income countries' economic strategies. The article further argues that the debate's focus obscures a stronger imperative to consider how other types of international research might advance justice in global health. Bioethics should consider the need for non-clinical health research and its contribution to advancing global justice. (shrink)
