Citizen action in institutions like the jury and restorative justice programs can foster the attunement, reflectiveness, and full-bodied communication needed as foundations for widespread civic responsibility for criminal justice.

What exactly do we do when we try to make sense of other people e.g. by ascribing mental states like beliefs and desires to them? After a short criticism of Theory-Theory, Interaction Theory and the Narrative Theory of understanding others as well as an extended criticism of the Simulation Theory in Goldman's recent version (2006), we suggest an alternative approach: the Person Model Theory . Person models are the basis for our ability to register and evaluate persons having mental as (...) well as physical properties. We argue that there are two kinds of person models, nonconceptual person schemata and conceptual person images , and both types of models can be developed for individuals as well as for groups. I distinguish between two conceptually different kinds of physical space: a space of ordinary material bodies, which is the space of points at which I could imaginably place the tip of my finger, or the center of a billiard-ball, and a space of elementary physical determinables, which is the smallest space of points such that stipulating what is happening at each one of those points, at every time, amounts to an exhaustive physical history of the universe. In all classical physical (...) theories, these two spaces happen to coincide – and what we mean by calling a theory “classical”, and all we mean by calling a theory “classical”, is precisely that these two spaces coincide. But once the distinction between these two spaces in on the table, it becomes clear that there is no logical or conceptual reason why they must coincide – and it turns out that a very simple way of pulling them apart from one another gives us quantum mechanics. Although sociologists conceive obligation as an objective force that compels individuals to act and think according to pre-defined norms of conduct and ways of reasoning, philosophers view it as an imperative that is met through the agent’s deliberation. The aim of this article is to undermine the standard dichotomy between the deterministically sociological and the moral–philosophical views of obligation by way of contending that Wittgenstein’s view on blind obedience bears a conception of the social. I will then argue that Wittgenstein’s (...) notion of forms of life and the sociological notion of situation refer to the same encompassing phenomenon: obligation. I will finally claim that this phenomenon should be re-specified in terms of impersonality to devise a shared dynamic conception of obligation admitting that a plurality of contextual normative orders monitor collective and individual action in ordinary life. These two fronts show interesting doctrinal correlations. The first is Leibniz' concern for the ''decadence of natural religion.'' The dispute with Clarke began with it, and the Discourse is a defense of Chinese natural religion in order to show its agreement with Christian natural religion. The Controversy can be summed up as ''clockmaker God versus idle God.'' (...) Leibniz wants to escape from the perverse consequences that all criticism of divine voluntarism seems to cause. Thus, his elaboration is directed at a distinct concept of a God that rules without interposing, a supramundane intelligence. The various roles proposed for emotion, whether psychological such as preparing for action or serving prior concerns, or biological such as protecting and promoting well-being, are easily shown to have an awkward number of exceptions. This paper attempts to explain why. To this end it undertakes a Husserlian phenomenological examination of first-person experience of two types of responses, the various somatic responses elicited by sensations (pain, cold, pleasure, sudden intensity) and the various personal directed emotions (grief, fear, affection, joy). The (...) analysis brings out the overall close structural symmetry between the two types of response and the strong hedonic, dynamic, and topological similarity between particular members from each of the two groups. The findings strongly suggest that emotions evolved from the more rudimentary involuntary somatic responses. The hypothesis finds further support in the fact that it explains both the biological unsoundness and anomalous archaic features that emotions often display. It also explains why emotions have no tidy function. (shrink)
