This essay focuses on how casuistry can become a useful technique of practical reasoning for the clinical ethicist or ethics consultant. Casuistry is defined, its relationship to rhetorical reasoning and its interpretation of cases, by employing three terms that, while they are not employed by the classical rhetoricians and casuists, conform, in a general way, to the features of their work. Those terms are (1) morphology, (2) taxonomy, (3) kinetics. The morphology of a case reveals the invariant structure of the (...) particular case whatever its contingent features, and also the invariant forms of argument relevant to any case of the same sort: these invariant features can be called topics. Taxonomy situates the instant case in a series of similar cases, allowing the similarities and differences between an instant case and a paradigm case to dictate the moral judgment about the instant case. This judgment is based, not merely on application of an ethical theory or principle, but upon the way in which circumstances and maxims appear in the morphology of the case itself and in comparison with other cases. Kinetics is an understanding of the way in which one case imparts a kind of moral movement to other cases, that is, different and sometimes unprecedented circumstances may move certain marginal or exceptional cases to the level of paradigm cases. In conclusion, casuistry is the exercise of prudential or practical reasoning in recognition of the relationship between maxims, circumstances and topics, as well as the relationship of paradigms to analogous cases. What exactly do we do when we try to make sense of other people e.g. by ascribing mental states like beliefs and desires to them? After a short criticism of Theory-Theory, Interaction Theory and the Narrative Theory of understanding others as well as an extended criticism of the Simulation Theory in Goldman's recent version (2006), we suggest an alternative approach: the Person Model Theory . Person models are the basis for our ability to register and evaluate persons having mental as (...) well as physical properties. We argue that there are two kinds of person models, nonconceptual person schemata and conceptual person images , and both types of models can be developed for individuals as well as for groups. When producing a description of a target referent in a visual context, speakers need to choose a set of properties that distinguish it from its distractors. Computational models of language production/generation usually model this as a search process and predict that the time taken will increase both with the number of distractors in a scene and with the number of properties required to distinguish the target. These predictions are reminiscent of classic findings in visual search; however, unlike models of reference (...) production, visual search models also predict that search can become very efficient under certain conditions, something that reference production models do not consider. This paper investigates the predictions of these models empirically. In two experiments, we show that the time taken to plan a referring expression—as reflected by speech onset latencies—is influenced by distractor set size and by the number of properties required, but this crucially depends on the discriminability of the properties under consideration. We discuss the implications for current models of reference production and recent work on the role of salience in visual search. (shrink)

La révolte est souvent légitime, elle est l'expression la plus pure de la liberté et semble revêtir le visage de l'espoir. This article explores emotions and their relationship to ‘somatic responses’, i.e., one’s automatic responses to sensations of pain, cold, warmth, sudden intensity. To this end, it undertakes a Husserlian phenomenological analysis of the first-hand experience of eight basic emotions, briefly exploring their essential aspects: their holistic nature, their identifying dynamic transformation of the lived body, their two-layered intentionality, their involuntary initiation and voluntary espousal. The fact that the involuntary tensional shifts initiating emotions are irreplicatable voluntarily, is taken to show that (...) all emotions have an innate core, a conclusion corroborated by their strong similarities to somatic responses in dynamics, hedonic tone, and topology. The fact that emotions may be culturally reworked, is shown to be explicable in terms of their complex nature: their dependence on belief, their voluntary espousal, and their ready social transmittability. Finally, it is argued that emotions may plausibly be deemed the evolutionary descendants of somatic responses. (shrink)

Although sociologists conceive obligation as an objective force that compels individuals to act and think according to pre-defined norms of conduct and ways of reasoning, philosophers view it as an imperative that is met through the agent’s deliberation. The aim of this article is to undermine the standard dichotomy between the deterministically sociological and the moral–philosophical views of obligation by way of contending that Wittgenstein’s view on blind obedience bears a conception of the social. I will then argue that Wittgenstein’s (...) notion of forms of life and the sociological notion of situation refer to the same encompassing phenomenon: obligation. I will finally claim that this phenomenon should be re-specified in terms of impersonality to devise a shared dynamic conception of obligation admitting that a plurality of contextual normative orders monitor collective and individual action in ordinary life. Tanto es así que se enfatiza, especialmente y siguiendo a Honneth, cómo el hecho de reconocerse recíprocamente ayudará a las personas a sentirse más confiadas, (...) respetadas y estimadas, siendo éstos tres valores fundamentales para la regulación positiva de los conflictos y para la construcción de culturas para la paz. The primary purpose of this paper is to argue that particulars in the actual world are nothing but complexes of universals. I begin by briefly presenting bertrand russell's version of this view and exposing its primary difficulty. I then examine the key assumption which leads russell to difficulty and show that it is mistaken. The rejection of this assumption forms the basis of an alternative version of the view which is articulated and defended.

: As the fifth national bioethics commission has concluded its work and a sixth is currently underway, it is time to step back and consider appropriate measures of success. This paper argues that standard measures of commissions' influence fail to fully assess their role as public forums. From the perspective of democratic theory, a critical dimension of this role is public engagement: the ability of a commission to address the concerns of the general public, to learn how average citizens resolve (...) moral issues in healthcare, and to monitor public opinion on the topics addressed in the commission. Such a public forum role is supported by the critical literature within bioethics, which has deemed some commissions successful, supported more generally by the history of bioethics as a reform discourse that has brought socially important values into the medical domain, and supported more generally still by the example of the great social issues commissions of the 1960s. I distinguish between two conceptually different kinds of physical space: a space of ordinary material bodies, which is the space of points at which I could imaginably place the tip of my finger, or the center of a billiard-ball, and a space of elementary physical determinables, which is the smallest space of points such that stipulating what is happening at each one of those points, at every time, amounts to an exhaustive physical history of the universe. In all classical physical (...) theories, these two spaces happen to coincide – and what we mean by calling a theory “classical”, and all we mean by calling a theory “classical”, is precisely that these two spaces coincide. But once the distinction between these two spaces in on the table, it becomes clear that there is no logical or conceptual reason why they must coincide – and it turns out that a very simple way of pulling them apart from one another gives us quantum mechanics. The various roles proposed for emotion, whether psychological such as preparing for action or serving prior concerns, or biological such as protecting and promoting well-being, are easily shown to have an awkward number of exceptions. This paper attempts to explain why. To this end it undertakes a Husserlian phenomenological examination of first-person experience of two types of responses, the various somatic responses elicited by sensations (pain, cold, pleasure, sudden intensity) and the various personal directed emotions (grief, fear, affection, joy). The (...) analysis brings out the overall close structural symmetry between the two types of response and the strong hedonic, dynamic, and topological similarity between particular members from each of the two groups. The findings strongly suggest that emotions evolved from the more rudimentary involuntary somatic responses. The hypothesis finds further support in the fact that it explains both the biological unsoundness and anomalous archaic features that emotions often display. It also explains why emotions have no tidy function. (shrink)

In the dialogue Plato portrays a confrontation between Euthyphro, a self-appointed expert on matters divine, who is about to charge his own father with impiety for alleged mistreatment and eventual death of a slave, and Socrates, already charged with impiety, who exploits the coincidence to elicit from Euthyphro certain complexities of the concept of 'piety'.

The sources to which one has to turn for information about the lives of Hasidic masters belong to the hagiographical tradition. During its first stage of compilation in the early nineteenth century, this tradition preserved much authentic historical and biographical material, in spite of the explicit disavowal of any historiographical intent by its editors. They were apologetic about the publication of "mere tales and histories" whose value lay not in the preservation of historical records but rather in their capacity for (...) moral and religious edification. Up until then, this material had been circulating orally but, in contrast to speculative-homiletical works, was not recognized as a legitimate and useful tool for the propagation of Hasidism. However, from the second half of the nineteenth century, in response to the challenges of Jewish Enlightenment, secularization, and most directly in response to the scornful critique of Hasidism and its hagiography which was emanating from the new school of modern Jewish historiography, Hasidic authors, like the exponents of other nineteenth-century ideologies, were beginning to appeal to history for validation. They were adopting the scholarly mannerisms if not quite the historical methodology of their critics. Since the hagiographical tales, and the chain of oral transmission which had traditionally preserved and authenticated them, were both losing their credibility in the new atmosphere of rationalistic skepticism and scientific rigor, Hasidic hagiographers were now eager to present their morally edifying oral traditions as reliable historical records by anchoring them in concrete documentary evidence. The forgeries of the Kherson Genizah supplied what appeared to be incontestable "archival" verification of the tales. The Admor Joseph Isaac Schneersohn exploited the Kherson "documents" in his extensive histories of early Hasidism which reveal his anachronistic, typological thinking and are often incompatible with the facts. As a leader of HaBaD Hasidism at a time of crisis, he saw it as his duty to harness the powerful historiographical idiom to the tasks of rehabilitating the HaBaD movement and of campaigning for the preservation of Orthodox Jewish life in conditions of unprecedented adversity. : Leibniz was writing his Discourse on the Natural Theology of the Chinese as the Leibniz-Clarke Controversy developed. Both were terminated by his death. These two fronts show interesting doctrinal correlations. The first is Leibniz' concern for the ''decadence of natural religion.'' The dispute with Clarke began with it, and the Discourse is a defense of Chinese natural religion in order to show its agreement with Christian natural religion. The Controversy can be summed up as ''clockmaker God versus idle God.'' (...) Leibniz wants to escape from the perverse consequences that all criticism of divine voluntarism seems to cause. Thus, his elaboration is directed at a distinct concept of a God that rules without interposing, a supramundane intelligence. And the Leibnizian interpretation of the natural theology of the Chinese can be viewed the same way: it emphasizes a First Principle, Li, which rules without interposing. (shrink)

Une des grandes différences tient à ce qu’elle institue un droit d’entrée à la citoyenneté : ne peuvent prétendre au titre de « vrais » citoyens que ceux qui adoptent et se plient sincèrement aux valeurs de la « nation ». Au contraire de cette définition exclusionniste de la République, accomplir la démocratie, c’est avoir le courage de refuser (...) de n’exclure aucune des multiples voix qui s’expriment – même les plus odieuses.
