Pornographic speech harms women by playing a key role in sustaining the social conditions through which women's liberty and equality are undercut. Though there is a principled moral and constitutional basis for pursuing a legal strategy in fighting pornography, we should not overestimate the effectiveness of the law or underestimate its potential dangers. The struggle against pornography must be waged through education, expressive exploration, and protest, not through the law.

This paper examines the ‘justice’ and ‘care’ orientations in ethical theory as characterized in Carol Gilligan's research on moral development and the philosophical work it has inspired. Focus is placed on challenges to the justice orientation – in particular, to the construal of impartiality as the mark of the moral point of view, to the conception of moral judgment as essentially principle-driven and dispassionate, and to models of moral responsibility emphasizing norms of formal equality and reciprocity. This essay critically assesses two strategies of accommodation used by defenders of impartialism in ethics to argue that the care orientation represents no genuine challenge to impartialist theoretical paradigms. One strategy focuses on impartiality as a constraint on moral deliberation, the other as a constraint on moral justification. While highlighting respects in which the commitment to impartiality is more consonant with the care orientation than many advocates of care have acknowledged, this essay attempts to clarify crucial ways in which each (...) accommodationist strategy falls, thus locating some of the more important contributions and challenges the care orientation offers to moral theory. We introduce what we call the Emergent Model of forgiving, which is a process-based relational model conceptualizing forgiving as moral and normative repair in the wake of grave wrongs. In cases of grave wrongs, which shatter the victim’s life, the Classical Model of transactional forgiveness falls short of illuminating how genuine forgiveness can be achieved. In a climate of persistent threat and distrust, expressions of remorse, rituals and gestures of apology, and acts of reparation are unable to secure the moral (...) confidence and trust required for moral repair, much less for forgiveness. Without the rudiments of a shared moral world — a world in which, at the very least, the survivor’s violation can be collectively recognized as a violation, and her moral status and authority collectively acknowledged and respected — expressions of remorse, gestures and rituals of apology, or promises of compensation have no authority as meaningful communicative acts with reparative significance. Accordingly, we argue that repair in the wake of traumatic violence involves ‘world-building,’ which supports the ability of survivors to move from despair to hope, from radical and disabling distrust to trust and engagement, and thus from impotence to effective agency. Our Emergent Model treats forgiveness as a slowly developing outcome of a series of changes in a person’s relationship to the trauma and its aftermath, in which moral agency is regained. We argue that forgiveness after grave wrongs and world-shattering harm, when it occurs, emerges from other phenomena, such as cohabitation within a community, gestures of reconciliation, working on shared projects, the developing of trust. On this view, forgiveness is an emergent phenomenon; it entails taking and exercising normative power—coming to claim one’s own moral authority in relation to oneself, one’s assailant, and one’s community. The processes that ultimately constitute forgiving are part and parcel of normative repair more broadly construed. (shrink)

Given dramatic increases in recent decades in the pace of scientific discovery and understanding of the functional organization of the brain, it is increasingly clear that engagement with the neuroscientific literature and research is central to making progress on philosophical questions regarding the nature and scope of human freedom and responsibility. While patterns of brain activity cannot provide the whole story, developing a deeper and more precise understanding of how brain activity is related to human choice and conduct is crucial (...) to the development of realistic, just, and intellectually rigorous models of human agency and moral responsibility. In this special issue, we acknowledge that “free will” and “moral responsibility” are not concepts with which neuroscience can directly engage, and instead focus on self-governance, and the capacities that contribute to self-governance, which are more tractable for scientific investigation and are prerequisites for the presence of moral responsibility. Morally contoured empathy is a form of reasonable partiality essential to the healthy care of dependents. It is critical as an epistemic aid in determining proper moral responsiveness; it is also, within certain richly normative roles and relationships, itself a crucial constitutive mode of moral connection. Yet the achievement of empathy is no easy feat. Patterns of incuriosity imperil connection, impeding empathic engagement; inappropriate empathic engagement, on the other hand, can result in self-effacement. Impartial moral principles and constraints offer at (...) best meager protection against these perils, and hence serve poorly in securing morally contoured empathy. More nuanced and practical guidance should be sought in normatively substantive conceptions of our roles and relationships and their defining moral stakes. These, joined with more abstract moral tools, can facilitate rich, narratively textured interpretations of moralitys demands. While the content of our normative conceptions must be continually debated, engaging in this debate is vital to the achievement of proper empathy, and thus to effective, respectful, morally healthy care of dependents. Moral distress can consist in anxiety or concern about one’s capacity to meet challenges to one’s integrity; it can also consist in the sense that one has failed to meet these challenges, betraying fundamental moral values or commitments. When the sense of moral failure is compounded by feelings of frustration or impotence, of being constrained or impeded in one’s ability to act as one believes one ought, one experiences moral disempowerment. Drawing on narratives of moral distress emerging from work in (...) the clinical context, this essay explores a distinction between cases in which moral distress does, and does not, center around the experience of moral disempowerment. When moral distress is tied to moral disempowerment, the acute personal toll is joined with broader moral costs, for effective moral agency is stymied. If we are to support individuals’ resilience and effectiveness in working constructively with moral distress, we need to understand and redress the social, systemic, and institutional factors contributing to moral disempowerment. Terri Traudt, Joan Liaschenko, and Cynthia Peden-McAlpine’s study contributes to a much-needed reorientation in thinking about and working with the challenges of moral distress. In providing a vital example of nurses able to navigate morally distressing situations in positive and constructive ways, and offering an analysis of the component elements of these nurses’ success, the study helps identify promising directions we might take in addressing the epidemic of moral distress. It also invites important questions, concerning the challenges faced by clinicians (...) who do not who work in healthy “moral communities,” who lack the ethical competencies, and who don’t have the presumptive authority and recognition enjoyed by the seasoned clinicians studied here. Trust is more than mere reliance on another person. To trust someone is to rely on her goodwill for the care of something valuable. It is to have a confident expectation that the other person will take care of the valuable thing because she recognizes its value to you. It is to expect her to take care of it because she recognizes that she should take care of it. Therefore trust is a robustly moral attitude.

This paper examines possible sources of this misconstrual, focusing critical attention on the narrowly crafted, morally loaded notion of “pornography” that figures centrally in the original argument under review. Pornography is not a category of speech that can be characterized as having one crucial meaning or message, nor is the message of pornography easily identifiable in instances of pornographic speech. This raises the problem of (...) interpretive privilege, which haunts many of the antipornography arguments being offered in the contemporary debate, including the author's own earlier argument. Despite over three decades of research into the sources and costs of what has become an “epidemic” of moral distress among healthcare professionals, spanning many clinical disciplines and roles, there has been little significant progress in effectively addressing moral distress. We believe the persistent sense of frustration, helplessness, and despair still dominating the clinical moral distress narrative signals a need for re-orientation in the way moral distress is understood and worked with. Most fundamentally, moral distress reveals moral investment and energy. (...) It is the troubled call of conscience, an expression of fidelity to moral commitments seen as imperiled or compromised.It is crucial that we find ways to empower clinicians in heeding this call—to support clinicians’ moral agency and voice, foster their moral resilience, and facilitate their ability to contribute to needed reform within the organizations and systems in which they work. These objectives must inform creative expansion in the design of strategies for addressing moral distress in the day-to-day of clinical practice. Neuroenhancement involves the use of neurotechnologies to improve cognitive, affective or behavioural functioning, where these are not judged to be clinically impaired. Questions about enhancement have become one of the key topics of neuroethics over the past decade. The current study draws on in-depth public engagement activities in ten European countries giving a bottom-up perspective on the ethics and desirability of enhancement. This informed the design of an online contrastive vignette experiment that was administered to representative samples of 1000 respondents (...) in the ten countries and the United States. The experiment investigated how the gender of the protagonist, his or her level of performance, the efficacy of the enhancer and the mode of enhancement affected support for neuroenhancement in both educational and employment contexts. Of these, higher efficacy and lower performance were found to increase willingness to support enhancement. A series of commonly articulated claims about the individual and societal dimensions of neuroenhancement were derived from the public engagement activities. Underlying these claims, multivariate analysis identified two social values. The Societal/protective highlights counter normative consequences and opposes the use enhancers. The Individual/proactionary highlights opportunities and supports use. For most respondents these values are not mutually exclusive. This suggests that for many neuroenhancement is viewed simultaneously as a source of both promise and concern. (shrink)

Contrary to the popular belief that feminism has gained a foothold in the many disciplines of the academy, the essays collected in Theorizing Backlash argue that feminism is still actively resisted in mainstream academia. Contributors to this volume consider the professional, philosophical, and personal backlashes against feminist thought, and reflect upon their ramifications. The conclusion is that the disdain and irrational resentment of feminism, even in higher education, amounts to a backlash against progress.

This narrative symposium illuminates the problem of clinician moral distress. NIB editorial staff and narrative symposium editors, Cynda Rushton, PhD, RN, FAAN and Renee Boss, MD, MHS, developed a call for stories, which was sent to several list serves and posted on Narrative Inquiry in Bioethics’ website. The request for personal stories from inter–professional healthcare providers asked them to: identify specific clinical situations that give rise to moral distress; discuss the sources of this distress; reflect on how they experienced moral (...) distress—physically, psychologically, socially, or spiritually; assess how they managed their situations; and offer suggestions for avoiding future problems of a similar nature. Twelve stories are found in the print version of the journal and an additional eight supplemental stories are published online only through Project MUSE. The clinicians describe a wide range of experiences with patients, other clinicians, and their own professional and personal identities. Embedded in each of the narratives are deeply felt emotions that accompany their experiences of moral distress. In March 1995, the Kennedy Institute of Ethics devoted its annual Advanced Bioethics Course to an exploration of feminist approaches to bioethics. This special issue of the Kennedy Institute of Ethics Journal, which supplements the September 1995 issue on principlism and several alternative approaches to health care ethics, (...) grew out of that course, containing articles written by those who presented its central lectures.The first article serves as an introduction to the topic. I take seriously the often-asked questions of why and in what way feminism should be thought relevant to bioethics. Appreciating feminism’s distinctive contribution to the field requires appreciating some of the central themes common to virtually all feminist theory. Accordingly, I set out and develop two themes that are basic to feminism; I then give several examples of how various bioethical issues might be framed and analyzed differently when approached with awareness of these tenets. Feminist theory offers a critical tool for bioethics, I argue, both by revealing androcentric reasoning that can affect—sometimes subtly and sometimes crudely—substantive analyses of bioethical issues, and by helping us to re-think and refine aspects of ethical theory that form the conceptual tools of use to bioethicists.In the second article, Alisa Carse and Hilde Lindemann Nelson take up one of the most famous theories associated with feminist philosophy, the “ethic of care,” inspired originally by Carol Gilligan’s work. How we understand the nature and role of grief depends on what we take its object to be and vice versa. This paper focuses on recent claims by philosophers that grief is frequently or even inherently irrational or inappropriate in one or another respect, all of which hinge on assumptions concerning the proper object of grief. By emphasizing the temporally extended structure of grief, we offer an alternative account of its object that undermines these assumptions and dissolves the apparent problems. (...) The principal object of grief, we suggest, is a loss of life possibilities, which is experienced, understood, and engaged with over a prolonged period. Other descriptions of grief's object identify more specific aspects of this loss in ways that do not respect a straightforward distinction between concrete and formal objects. (shrink)

Grief is often thought of as an emotional response to the death of someone we love. However, the term “grief” is also used when referring to losses of various other kinds, as with grief over illness, injury, unemployment, diminished abilities, relationship breakups, or loss of significant personal possessions. Complementing such uses, we propose that grief over a bereavement and other experiences of loss share a common phenomenological structure: one experiences the loss of certain possibilities that were integral to—and perhaps central (...) to—the unfolding structure of one’s life. Grief can thus be conceived of in a broad but still univocal way. To develop this position, we focus on the example of grief over involuntary childlessness, where lack of a concrete, historical object of emotion serves to make explicit the way in which grief concerns future possibilities. We go on to suggest that the phenomenological complexity, diversity, and prevalence of grief are obscured when approached via an abstract, simplified conception of bereavement. -/- . (shrink)

Contemporary philosophy of perception is dominated by extremely polarized debates. The polarization is particularly acute in the debate between naïve realist disjunctivists and their opponents, but divisions seem almost as stark in other areas of dispute (for example, the debate over whether we experience so-called ‘high-level’ properties, and the debate concerning individuation of the senses). The guiding hypothesis underlying this volume is that such polarization stems from insufficient attention to how we should go about settling these debates. In general, there (...) is widespread, largely implicit disagreement concerning what philosophical theories of perception are supposed to explain, the claims that we should hold fixed in the course of theorizing, and the methods that such theorizing should employ. The goal of this volume is to move such methodological questions from the background to the fore, in the hope of facilitating progress. The contributions constitute an initial effort to spur more explicit, systematic discussion of methodology in philosophy of perception. The present working paper analyzes the world order in the past, present and future as well as the main factors, foundations and ideas underlying the maintaining and change of the international and global order. The first two sections investigate the evolution of the world order starting from the ancient times up to the late twentieth century. The third section analyzes the origin and decline of the world order based on the American hegemony. The authors reveal contradictions of the current unipolar (...) world and explain in what way globalization has become more profitable for the developing countries but not for the developed ones. The paper also explains the strengthening belief that the US leading status will inevitably weaken. In this connection we discuss the alternatives of the American strategy and the possibility of the renaissance of the American leadership. The last section presents a factor analysis which allows stating that the world is shifting toward a new balance of power and is likely to become the world without a leader. The new world order will consist of a number of large blocks, coalitions and countries acting within a framework of rules and mutual responsibility. However, the transition to a new world order will take certain time (about two decades). This period, which we denote as the epoch of new coalitions, will involve a reconfiguration of the World-System and bring an increasing turbulence and conflict intensity. There are grounds to conclude that in 2011–2012 the World-System experienced to some extent a phase transition to a qualitatively new state of global protest activity. This phase transition is shown to bear some resemblance to the one which the World-System experienced in the early 1960s. The first (after 1919) phase transition of this sort occurred in the early 1960s and was related to the growth of global informational connectivity after the World War II, as well as the improvement of the means of protest self-organization due to the spread of television, portable radio receivers, portable electric loud-speakers and other technologies of the Fourth Kondratieff Cycle. The phase transition of the early 2010s was prepared by a new wave of growth of global informational connectivity, as well as the improvement of the means of protest self-organization due to the spread of various technologies of the Fifth Kondratieff cycle (the Internet, satellite television, Twitter and other social networks, mobile telephony etc.). Similarly to what was observed during the Fourth Kondratieff Wave, during the Fifth Cycle while the spread of these technologies was going on for many years before 2011, their internal colossal potential for generating and spreading protest activity was realized in one leap, as a phase transition. In the 1960s Mancur Olson and Samuel Huntington suggested that the positive correlation between per capita income and the level of sociopolitical destabilization that they detected for low and middle income countries might be partly accounted for by the growth of the inequality associated with the economic and technological development in these countries. The empirical tests we perform generally support this hypothesis, but they also identify certain limits for such an explanation. Our tests reveal for low and middle income countries (...) a statistically significant correlation between GDP per capita and the economic inequality levels, but this correlation is not particularly strong. Earlier we found for the same countries significantly stronger positive correlations between GDP per capita and some important components of sociopolitical destabilization, such as the intensity of political assassinations, general strikes and anti-government demonstrations. It is quite clear that the strong association between the increase in the intensity of these components of sociopolitical destabilization and GDP per capita growth, can be explained by a much weaker tendency toward the growth of economic inequality only partly. In addition, our empirical tests suggest the presence of a certain threshold level of about 40 points on the Gini scale, after crossing which one can expect a radical increase in levels of sociopolitical destabilization in general, and the intensity of terrorist acts / guerrilla warfare and anti-government demonstrations in particular. According to the World Bank, the value of the Gini coefficient for Russia is now just in this zone, which suggests that the further growth of inequality in Russia could lead to an abrupt increase in political destabilization. If the discourse of manners and customs aspires to a stable fixing of subjects and systems of differences, however, its project is not and never can be complete. This is true if only for the seemingly trivial reason that manners-and-customs descriptions seldom occur on their own as discrete texts. They usually appear embedded in or appended to a superordinate genre, whether a narrative, as in travel books and much ethnography, or an assemblage, as in anthologies and magazines.6 In the case (...) of travel writing, which is the main focus of this essay, manners-and-customs description is always in play with other sorts of representation that also bespeak difference and position subjects in their own ways. Sometimes these other positioning complement the ideological project of normalizing description, and sometime they do not.In what follows, I propose to examine this interplay of discourses in some nineteenth-century travel writing chiefly about Africa. While Barrow’s work is not prominent on anybody’s mental bookshelves these days, readers will recognize such names as David Livingstone, John Speke, James Grant, Richard Burton, Mungo Park, or Paul Du Chaillu. During the co-called opening up of central and southern Africa to European capitalism in the first half of the nineteenth century, such explorer-writers were the principal producers of Africa for European imaginations—producers, that is, of ideology in connection with the European expansionist project there. What I hope to underscore in these writings is not their tendency towards single, fixed subject positions or single, fixed systems of difference. Rather, I wish to emphasize the multiplicity of ways of codifying the Other, the variety of fixed positions and the variety of given sets of differences that they posit. European penetration and appropriation is semanticized in numerous ways that can be quite distinct, even mutually contradictory. In the course of examining discursive polyphony in these travel writings, I hope to stress the need to consider ideology not only in terms of reductive simplification but also in terms of the proliferation of meanings. 6. This volume is the first to focus specifically on experimental studies of the semantics of gradability, scale structure and vagueness. It presents support for and challenges to current formal analyses of these phenomena in view of experimentally collected data, highlighting the ways semantic and pragmatic theory can benefit from experimental methodologies. The papers in the volume contribute to an explicit and detailed account of the use, representation, and online processing of gradable and vague expressions using various kinds of controlled speaker (...) judgment tasks, eye tracking, and ERP. The aim is to strengthen the foundations of experimental semantics and promote interaction between linguists, psycholinguists, psychologists, and philosophers who are interested in the semantics of natural language. Princeton. It examines the unprecedented visual language adopted in a female Franciscan context to authorize their way of life, and places the manuscript in context, exploring how it relates to other early representations showing Saints Francis and Clare together and documenting the production of this and comparable early rule manuscripts, including a previously unpublished copy now in Venice.2Thousands of manuscript copies of rules of life were produced in and for late medieval religious houses and their members, good numbers of which remain extant, though these are scarce remnants of what must originally have been produced. Rules do sometimes appear in extant library inventories,3 but unlike individual books destined for personal [End Page 75] prayer or study and ultimately deposit in a conventual library, their primary purpose was as legal texts binding all who professed them.4 In their iterative function, read and reread, alone or aloud in the community, they were comparable to liturgical books, though they were not for use in church nor kept in the sacristy.5 In the rule of Urban IV for the Order of Saint Clare investigated here, chapter twenty-four required that the rule be read and explained annually by the visitator, while the final chapter emphasized that it be read once each fortnight lest the sisters neglect it.6 This sort of repetition must have ensured most nuns knew the rule by memory, having first encountered its details as novices, with no need to own the text. Copies were perhaps in the hands of the abbess, a visitator, or other monastic superior, or kept in the chapter room or refectory, ready for routine use.7 Nonetheless, wealthier women may have had a copy prepared or received one as a gift, either on entering the religious life or on becoming a superior responsible for its observance.8Princeton University Library, Manuscripts Division, Department of Rare Books and Special Collections, MS 83, contains a Latin, [End Page 76] professionally made and illuminated copy of the text designed to substitute existing rules, including the 1219 Forma Vitae issued by Cardinal Hugolino and the rule of Innocent IV from 1247.9 Clare's own hard-fought for rule, approved in 1253, was initially for the San Damiano community alone and was followed in subsequent decades by a very small group of houses.10 The making of Urban IV's rule, adopted instead by hundreds of communities, has been much discussed, but the survival of this early illuminated copy has gone unnoticed outside the library catalog.11 The manuscript includes the earliest extant sequence known to us showing Clare of Assisi receiving the rule from the pope and in turn taking the profession of her sisters, images designed to legitimize the new order by building ties to its "founder" while yet acknowledging its papal origins. Among extant imagery it is pioneering. The large, illuminated initials have been recognized as painted by Nerius da Rimini and his workshop but the case has never been set out and PUL MS 83 has [End Page 77] not been included in accounts of this artist's production.12 Better known as "Neri," he is a comparatively well-documented manuscript illuminator whose signatures sometimes survive on his work, a rare practice at this date.13Historians of medieval women religious are by now familiar with books produced by women themselves.14 A beautiful manuscript, for example, containing Bonaventure's Legenda Maior of Saint Francis, the Vita beati Antonii and documents relating to the Portiuncula indulgence was written in Latin in 1337 by two sisters, Elspet von Amberk and Katerina von Purchausen, perhaps living in the Paradies convent in Diessenhofen (Switzerland).15 Other women have been identified as skilled illuminators.16 The prolific activity of... More and more frequently, the general question whether there is an identifiable feminist methodology for investigating historical and philosophical writings about ‘the problem of women’ is raised. As of yet, there is no general, let alone systematic answer to this question, and many would claim it to be unanswerable. Ultimately, indeed, nothing short of the creation of an entirely new form of rationality would seem to be required, if the issue is to replace the so-called phallocentric grammar of our culture.My (...) suggestion here is that a significant way to provide elements of answers to this general question is to analyze works already done in this field with the view of delineating some of the conditions under which an adequate treatment of the women issue can be made. One such condition will be discussed here. It will be claimed that unless one is clear about the issue of equality, one cannot address the central issue raised by most writings on women. (shrink)

Though I doubt it has put a Rolls Royce in anybody’s garage, the criticism industry is a reality not to be overlooked. Academics have a responsibility to stay self-aware and self-critical about their own and their profession’s interests. All academic activity has a careerist dimension, but it obviously cannot be explained by that dimension alone, and in this sense Fromm’s point is simply reductive. But of course it is not all academic activity that Fromm is objecting to, only some and (...) notably mine.The image of academic colonization suggests one has stepped beyond some legitimate borders and laid claim to territory rightfully inhabited by others. Whose world was invaded by my essay, or by the “Race,” Writing, and Difference issue in general? Mr. Fromm’s, evidently. Fromm wants a world where words stand still and refer, and don’t get changed. In particular, to use his own examples, he wants a world where blacks are blacks, whites are whites, Americans are Americans, knives are knives, brothers are brothers, and Indians are Indians . The prominent call to legalise same-sex marriage in Australia raises questions concerning whether its achievement will result in amplified societal acceptance of lesbian, gay, bisexual, and transgender (LGBT) people, and on what grounds this acceptance will take place. Same-sex marriage may not challenge heteronormative and patriarchal features typically associated with marriage, and may serve to reinforce a hierarchy that promotes traditional marriage as the ideal relationship structure. This may result in only assimilationist acceptance of LGBT people. However, the consequence of (...) inclusion to marriage ought to reflect social acceptance of LGBTs as people worthy of equal treatment in dignity and in rights, regardless of perceived differences or similarities to a supposed majority standard. This article argues that justice would be best served by introducing and promoting a variety of State-sanctioned unions whilst simultaneously introducing same-sex marriage. This ‘pluralisation strategy’ would increase awareness and legitimacy of other relationship-recognition options, promoting respectful acceptance of LGBT and heterosexual people alike. (shrink)
