Williamsonian modal epistemology is characterized by two commitments: realism about modality, and anti-exceptionalism about our modal knowledge. Williamson’s own counterfactual-based modal epistemology is the best known implementation of WME, but not the only option that is available. I sketch and defend an alternative implementation which takes our knowledge of metaphysical modality to arise, not from knowledge of counterfactuals, but from our knowledge of ordinary possibility statements of the form ‘x can F’. I defend this view against a criticism indicated in (...) Williamson’s own work, and argue that it is better connected to the semantics of modal language. (shrink)

Understanding what numbers are means knowing several things. It means knowing how counting relates to numbers (called the cardinal principle or cardinality); it means knowing that each number is generated by adding one to the previous number (called the successor function or succession), and it means knowing that all and only sets whose members can be placed in one-to-one correspondence have the same number of items (called exact equality or equinumerosity). A previous study (Sarnecka & Carey, 2008) linked children's understanding (...) of cardinality to their understanding of succession for the numbers five and six. This study investigates the link between cardinality and equinumerosity for these numbers, finding that children either understand both cardinality and equinumerosity or they understand neither. This suggests that cardinality and equinumerosity (along with succession) are interrelated facets of the concepts five and six, the acquisition of which is an important conceptual achievement of early childhood. In this paper I develop a framework for environmental philosophy on the ground of what I call a radical relationalism based on Whitehead’s thought. Accordingly, relations are ontologically prior to and constitutive of entities rather than being conceived as external link(ing) between them. On this ground an alternative, relational axiology can be developed that challenges the current environmental ethics debate and its dichotomy between intrinsic and instrumental values. In the last section, I show how such an axiology can become an (...) important ally for global environmental justice struggles and help support what the anthropologist Arturo Escobar calls a “decolonial view of nature.”. One main issue within environmental ethics is the so-called Demarcation Problem, i.e. the question of which entities are members of the moral community and hold intrinsic value. I argue that the demarcation problem relies mainly on Kantian moral philosophy. While the Kantian framework offers a strong and immediately deontological argument for moral agents holding inherent moral values, it presents problems when stretched beyond its original scope and lacks an adequate ground for addressing relational complexity and the moral significance of collectives. In this paper I outline an alternative axiological framework ('map of moral significance') that relies on a relational ontology and encompasses intrinsic and relational values as the two equipollent axes of a matrix in which to embed the question posited by the Demarcation Problem. I argue for the possibility of posthumous harm based on an account of the harm of murder. I start with the deep-seated intuition that when someone is murdered he (or she) is harmed (over and above the pain of injury or dying), and argue that Feinberg's account that assumes that harm is an invasion of an interest cannot plausibly accommodate this intuition. I propose a new account of the harm of murder: it is an irreversible loss of functions necessary for (...) worthwhile existence. I suggest a (partial) loss analysis of harm in general, and then go on to apply it to posthumous harm and defend the idea that there can be posthumous losses. (shrink)

Socialism and Feminism in the 19th century.

How should biological behaviour be modelled? A relatively new approach is to investigate problems in neuroethology by building physical robot models of biological sensorimotor systems. The explication and justification of this approach are here placed within a framework for describing and comparing models in the behavioural and biological sciences. First, simulation models – the representation of a hypothesis about a target system – are distinguished from several other relationships also termed “modelling” in discussions of scientific explanation. Seven dimensions on which (...) simulation models can differ are defined and distinctions between them discussed: 1. Relevance: whether the model tests and generates hypotheses applicable to biology. 2. Level: the elemental units of the model in the hierarchy from atoms to societies. 3. Generality: the range of biological systems the model can represent. 4. Abstraction: the complexity, relative to the target, or amount of detail included in the model. 5. Structural accuracy: how well the model represents the actual mechanisms underlying the behaviour. 6. Performance match: to what extent the model behaviour matches the target behaviour. 7. Medium: the physical basis by which the model is implemented. No specific position in the space of models thus defined is the only correct one, but a good modelling methodology should be explicit about its position and the justification for that position. It is argued that in building robot models biological relevance is more effective than loose biological inspiration; multiple levels can be integrated; that generality cannot be assumed but might emerge from studying specific instances; abstraction is better done by simplification than idealisation; accuracy can be approached through iterations of complete systems; that the model should be able to match and predict target behaviour; and that a physical medium can have significant advantages. These arguments reflect the view that biological behaviour needs to be studied and modelled in context, that is, in terms of the real problems faced by real animals in real environments. ABSTRACT Amidst trends that emphasize languishing patterns in teen mental health, there is a bright spot: social science research indicates that adolescents who develop relationships with adult mentors demonstrate increased signs of flourishing. This social science research on mentors, though limited to school performance outcome goals, offers a lifeline to character educators. I offer a theoretical framework based on Aristotelian principles, informed by anecdotal case studies of authentic moral dilemmas that emerged from the direct experiences of mentees, to suggest a (...) framework to explain why adolescents with adult mentors have an advantage. Patterns of conversation in trusted mentoring relationships developed over time, and in a school context that provides sufficient professional development for mentors, support the youth: (1) to advance in practical wisdom (phronesis) by honing skills for emotional regulation as well as cognitive skills to recognize goods in conflict and (2) to learn how to engage in civic friendship through these friendships of inequality with mentors. Dworkin's theoretical disagreement argument, developed in Law's Empire, is presented in that work as the motivator for his interpretive account of law. Like Dworkin's earlier arguments critical of legal positivism, the argument from theoretical disagreement has generated a lively exchange with legal positivists. It has motivated three of them to develop innovative positivist positions. In its original guise, the argument from theoretical disagreement is presented as ‘the semantic sting argument’. However, the argument from theoretical disagreement has more than one version. (...) This article briefly discusses two versions and the leading replies to them, then focuses on the most influential version, directed at Hartian positivism. The article surveys the leading positivist rejoinders to the recast version, indicating key Dworkinian replies or assessing the strength of these rejoinders, and concludes with a rejoinder of its own, making a new case that the argument from theoretical disagreement isn't fatal for Hartian legal positivism. A familiar jurisprudential view is that a judicial decision functions as a legal precedent by laying down a rule and that the content of this rule is set by officials. Precedents can be followed only by acting in accordance with this rule. This view is mistaken on all counts. A judicial decision functions as a precedent by being an example. At its best, it is an example both for officials and for a target population. Even precedents outside of law function (...) as examples when they have conduct-guiding significance. Examples may be rule-like in their scope, but need not be. Their import is independent of their justification; this point has implications for coherence theories of precedent meaning. The content and scope of a legal decision’s extension is not set exclusively by officials. It is socially set and depends upon social salience. (shrink)

A lengthy debate in the philosophy of the cognitive sciences has turned on whether the phenomenon known as ‘systematicity’ of language and thought shows that connectionist explanatory aspirations are misguided. We investigate the issue of just which phenomenon ‘systematicity’ is supposed to be. The much-rehearsed examples always suggest that being systematic has something to do with ways in which some parts of expressions in natural languages (and, more conjecturally, some parts of thoughts) can be substituted for others without altering well-formedness. (...) We show that under one construal this yields a grossly weak claim that is not just compatible with a narrow version of associationist psychology but essentially coincides with a formalization of its descriptive power. Under another construal we get a claim (apparently unintended) that requires natural languages to fall within the context-free class, a claim that most linguists regard as too strong. Looking more closely at this proposed reconstruction of systematicity leads us to endorse, with further illustrations, the suggestion of Johnson (2004) that systematicity as a matter of substitutability of co-categorial constituents for one another does not appearto hold of natural languages at all. The appeal of the ill-delineated notion of systematicity may lie in the fact that within certain subclasses of lexical items mutual intersubstitutability does seem to hold, and theexplanation for that lies in a limitation on human memory: we simply cannot learn separate privileges of syntactic distribution for all of the huge number of words and phrases that we know. Everyone agrees that law is a constituent of social reality. Law seems to be a system by which conduct is governed and guided. Its usefulness consists, in part, on its ability to govern and guide conduct in its characteristic way. If laws guides the conduct of lay law subjects, then it must be (really) possible for the content of the laws governing their conduct to be known by them under standard social conditions. Moreover, if some degree of efficacy in guiding (...) and governing the conduct of lay law subjects is an existence condition for a legal system, then in existing legal systems enough of the content of directive law is epistemically accessed by enough law subjects so that they can apply it to their situations and correctly determine the act-tokens required of them. In this chapter, I argue that these modest epistemic reflections have important implications for a theory of legal content that have been largely ignored. Holistic theories of legal content, such as Greenberg’s and Dworkin’s, are inconsistent with an adequate account of epistemic access. After demonstrating the same problem in two mainstream non-holistic theories of legal content -- the view that legal content is set entirely by official interpretive conventions, and the view that legal content is set entirely by official intentions – I propose a theory of legal content that meets the epistemic access challenge. On my approach, law is, at its core, centered upon the understandings of law subjects. (This view is meant to exempt constitutional provisions.) More precisely, the legal content of statutes and judicial decisions is built around, and preserves, a core of understandings and meaning-assignments that is the province of anyone with sufficient linguistic ability and relevant socialization. The details of this view are, roughly: (1) in the case of judicial decisions in a common law system, the social salience of the example the decision sets concerning behavior sets the default legal content; (2) in the case of statutory directives, the set of socially salient applications (behavior in situations) sets the default legal content. I say `default’ because my account of legal content is a two-stage account beginning with the default content and permitting a second stage in which considerations from other sources can operate on the default. Yet if a certain amount of efficacy in guiding lay law subjects’ behavior is a requirement for the existence of a legal system, there must be a core of legal content undistorted from its default social salience by a second stage operation. This paper will examine the effects of gender, age, work experience, academic status and legality on certain ethical decisions. Six scenarios representing ethical dilemmas were presented to both undergraduate and MBA students in an attempt to determine if various demographic factors influenced ethical decision making. While some past studies have suggested that gender has an important effect on ethical decision making, this study does not completely support this conclusion and suggests that age and/or length of work experience should be included (...) in any study of ethical decision making.The legality of the decisions was determined and compared to the reason given by the students for their decisions. In some cases the choice made by a majority of the students was not the one that was supported by the legal authorities which suggests that there may be conflicts between the ethical system of the respondents and the behavior expected of them by society. Many contemporary philosophers of law agree that a necessary condition for a decision to be legally justified, even in a hard case, is that it coheres with established law. Some, namely Sartorius and Dworkin, have gone beyond that relatively uncontroversial claim and described the role of coherence in legal justification as analogous to its role in moral and scientific justification, on contemporary theories. In this, I argue, they are mistaken. Specifically, coherence in legal justification is sometimes specific to a branch (...) of law, and there is nothing isomorphic to this in the models of moral and scientific justification. Although Dworkin and Sartorius rely on the concept of coherence, they do not explicate it. In the course of examining their views, this essay offers a partial analysis of coherence on their models. Finally, two canons of relevance, governing when global coherence considerations are appropriate to legal justification, are presented. (shrink)

Food security policy, programs, and infrastructure have been incorporated into Public Health and other areas of the Provincial Government in British Columbia, including the adoption of food security as a Public Health Core Program. A policy analysis of the integration into Public Health is completed by merging findings from 48 key informant interviews conducted with government, civil society, and food supply chain representatives involved in the initiatives along with relevant documents and participant/direct observations. The paper then examines the results within (...) the context of historic and international trends and theoretical models of food policy, community food security, and applied policy research. Public Health re-emerged as a driver of food security in BC—both as a key player and in positing the public’s health as a driver in food security and food systems. While Public Health’s lead role supported an increase in legitimacy for food security in BC, interviewees described a clash of cultures between Public Health and civil society. The clash of cultures occurred partly as a result of Public Health’s limited food security mandate and top down approach. Consequently civil society voice at the provincial level was marginalized. A social policy movement toward a new political paradigm—regulatory pluralism—calls for greater engagement of civil society, and for all sectors to work together toward common goals. A new, emerging policy map is proposed for analyzing the dynamics of food security and health promotion initiatives in BC. (shrink)

Senior molecular geneticists were interviewed about their perceptions of the ethical and social implications of genetic knowledge. Inductive analysis of these interviews identified a number of strategies through which the scientists negotiated their moral responsibilities as they participated in generating knowledge that presents difficult ethical questions. These strategies included: further analysis and application of scientific method; clarification of multiple roles; negotiation with the public through public debate, institutional processes of funding, ethics committees and legislation; and personal responsibility.

Although prescription drugs play a prominent and essential role in pediatric health care delivery, health care providers often must make prescribing decisions for their young patients based on imperfect or absent safety and efficacy data for pediatric populations. Until relatively recently, the Food and Drug Administration made surprisingly little effort to improve the quality or quantity of clinical research data for this patient group. Despite recent agency efforts to improve the situation, only one-third of drugs (...) prescribed to children currently have been studied for safety and efficacy in pediatric populations. Moreover, recent agency initiatives to encourage pediatric drug research have generated mixed results and unintended consequences. The complex of issues surrounding the testing and prescribing of prescription drugs used for children will require that pharmaceutical companies, the FDA, and health care providers examine current practices, acknowledge their shortcomings, and consider cooperative, creative solutions. The exclusive emergence of value and abstract human labour through exchange of mere products is a fundamental principle within the ‘New Reading of Marx’, especially that of Michael Heinrich. He invokes both Capital and the manuscript Additions and Changes, where Marx revised his value-form analysis for the second edition of Capital. However, this manuscript does not support Heinrich’s view. In the same handwritten manuscript, Marx drafted the subsection on the fetishism of the commodity with two passages that Heinrich claims as (...) evidence for his interpretation. Against this, we elaborate Marx’s understanding of abstract human labour as the specific social character of private labour; it does not result from exchange but rather is its prerequisite. Heinrich’s attempt fails to include demand in the magnitude of value. Finally, he does not explain the value-formation by circulation and production. Rather, his one-sided view of exchange means, by way of its logical implications, that the capitalist production process is no longer the unity of the labour process and the valorisation process, but mere production of use-values. According to Pliny, he noted, grammarians did not believe the noun vita had a plural. More to the point, although "there is a diversity (...) of merits and virtues among [the saints], … the one life of the body sustains them all in this world."1 Just as the Church, the body of Christ, is one, so too the saints. Their project of imitatio Christi re-presents the one and only life of Christ for each new generation. As a literary genre, hagiography fleshes out this insight, for no other genre is so steeped in self-citation. Every vita is such a tissue of biblical verses that, to edit a saint's Life before Google, one had to know Scripture by heart or spend endless hours with a concordance. After the Bible, quotations from a few classic vitae were constantly recycled: Athanasius' Life of St. Antony, Sulpicius Severus' Life of St. Martin, Gregory the Great's Life of St. Benedict. With the passage of time, newer classics joined older ones to produce one vast, self-referential monument, incarnate in the Acta Sanctorum: Gregory's vita sanctorum multiplied ad infinitum. So deep did this tendency run that, when an obscure saint needed a vita to justify a cult, shameless hagiographers would plagiarize whole paragraphs, plundering stories and miracles from earlier vitae to serve their turn.2 [End Page 169]It is small wonder, then, that the hagiographic genre is so often characterized as "traditional" or "conservative." It is nostalgic, too, in the sense that each saint's words and deeds bring a glorious Golden Age back to life—most often the apostolic age or the time of the Desert Fathers, but sometimes the graced beginnings of a religious order. Such memorials enabled later generations to idealize their glorious founders. This tendency to exalt the new as a renovation of the old has deep roots in Christianity; even the evangelist Matthew systematically represents Jesus as a new Moses. In the same vein, it is not unusual to find a saint identified as a new Jacob or a second David. On the other hand, many saints' Lives make an insistent claim to newness, renovatio. For the saints were, and are, extraordinary—not merely good men and women, but radical figures whose words and deeds shocked those around them, beginning with their parents. Like Jesus, they had not only admirers, but detractors in plenty. If their publicists held them up as exemplars of virtue, theirs was no ordinary kind, for the heroic virtue that gave saints their charisma could look much like madness. Despite the precedents of earlier vitae, their ascetic feats and challenging behavior often struck observers as new and unheard-of. In hagiography, therefore, claims of novelty play a key role that balances the familiar topoi. Sometimes the newness of a saint's charism is cause for joyful celebration. Jesus, after all, had declared ecce nova facio omnia (Rev 21:5). But "novelties" also had to be handled with care, for they could easily be condemned as heresies or extreme practices deviating from the tradition of the elders.This tension between novelty and nostalgia emerges most clearly in the vitae of saints who founded genuinely new forms of religious life. In this paper I will explore the way it plays out in two early Lives of Francis of Assisi, perhaps the most popular saint of all time. After his death in 1226, Francis set a speed record for canonization—one that would be surpassed in the Middle Ages only by his disciple, St. Anthony of Padua, and by the Dominican martyr Peter of Verona.3 Aside from his charisma and the exponential growth of the Franciscan Order, the fast-track canonization is due to Pope Gregory IX, who as Cardinal Hugolino had been personally close to Francis and supported his movement. I defend the claim that posthumous harm is possible against a simple but powerful and appealing argument for the impossibility of harm from posthumous events. I produce a counterargument against one of its assumptions. My conclusion is that the boundaries of welfare-affecting events may extend beyond the existence of the person whose welfare is in question. My case for rejecting the contrary claim avoids an objection to some familiar arguments for posthumous harm and is superior to another argument for posthumous (...) harm. To my knowledge, the case for posthumous harm presented here is a novel one, though it is of the same form as arguments made in 1984 by Feinberg and Parfit. My case for posthumous harm is not complete, for I argue for the satisfaction of what many people regard as only a necessary condition for harm. United Kingdom Transplant reported that, during 2007—2008, a total of 7655 people were awaiting a transplant; however, only 3235 organs were available via the current `opt in' approach. To address this shortfall, new UK legislation sought to increase the number of organs available for donation. The Chief Medical Officer for England and Wales supports the adoption of `presumed consent' legislation, that is, an `opt out' approach, as used in much of Europe. Little research, however, has explored the impact on bereaved (...) relatives, nurses and medical staff of introducing presumed consent legislation. Adopting a phenomenological approach, this study used responses to an initial questionnaire combined with selected interviews with health care professionals to capture their direct experience of presumed consent legislation in three European countries: Portugal, Norway and Belgium. Rips et al.'s critique is misplaced when it faults the induction model for not explaining the acquisition of meta-numerical knowledge: This is something the model was never meant to explain. More importantly, the critique underestimates what children know, and what they have achieved, when they learn the cardinal meanings of the number words through.

The paper demonstrates that Parmenides’ monism is a logical consequence of his criteria for philosophy, in conjunction with the logical operators he uses, and their holistic connection. Parmenides, I argue, is the first philosopher to set out explicit criteria for philosophy, establishing as criterion not only consistency, but also what I call rational admissibility, the requirement when giving an account of something that the account be based on rational analysis and can withstand rational scrutiny. I give a detailed account of (...) the logical operators Parmenides uses in his argument and of the way in which his notion of being is tailored to fit both them and his criteria for philoso-phy.
