Using an event-study framework, we examine the stock market reaction to the announcement of firm withdrawal from countries designated as “State Sponsors of Terrorism” by the U.S. Department of State. We find that such announcements are, on average, linked to a statistically significant increase in firm value—an effect which already kicks in a few days before the announcement date. The observed abnormal returns are positively associated with the U.S. domicile, the intensity of a firm’s hitherto existing engagement in a designated (...) country, the number of countries that it withdraws from, as well as with a withdrawal from Iran compared to a withdrawal from other countries. Evidence suggests an increase in demand for stocks of withdrawing firms as a plausible cause of the positive stock price reaction. Pension and endowment funds are significantly less likely to own strategic stakes in firms with intensive involvements in countries designated as “State Sponsors of Terrorism.” We find some statistical evidence that firms remaining active in such countries have abnormally positive returns in the long run. The current chapter provides an overview of research on responses in moral dilemmas where maximization of outcomes for the greater good (utilitarianism) conflicts with adherence to moral norms (deontology). Expanding on a description of the traditional paradigm to study moral-dilemma judgments (i.e., the trolley problem), the chapter reviews the most prominent dual-process account of moral-dilemma judgments, normative conclusions that have been derived from this account, and criticisms raised against this line of work. The following sections review advances in the development (...) of alternative approaches that aim to address shortcomings of the traditional dilemma paradigm as well as the implications of this work for psychological theories of moral-dilemma judgments and philosophical inferences about the normative implications of moral-dilemma research. This article explores several entanglements between human judgments of intentionality and morality (blame and praise). After proposing a model of people’s folk concept of intentionality I discuss three topics. First, considerations of a behavior’s intentionality a ff ect people’s praise and blame of that behavior, but one study suggests that there may be an asymmetry such that blame is more affected than praise. Second, the concept of intentionality is constitutive of many legal judgments (e.g., of murder vs. manslaughter), and one (...) study illustrates people’s subtle considerations of intentionality in making those judgments. Third, controversial recent studies suggest that moral considerations can affect judgments of intentionality, and an asymmetry may exist such that blame a ff ects those judgments more than praise. I report two new studies that may shed light on these recent findings, and I discuss several theoretical models that might account for the impact of moral considerations on intentionality judgments and for the relationship between the two more generally. Robot ethics encompasses ethical questions about how humans should design, deploy, and treat robots; machine morality encompasses questions about what moral capacities a robot should have and how these capacities could be computationally implemented. Publications on both of these topics have doubled twice in the past 10 years but have often remained separate from one another. In an attempt to better integrate the two, I offer a framework for what a morally competent robot would look like and discuss a number (...) of ethical questions about the design, use, and treatment of such moral robots in society. Instead of searching for a fixed set of criteria of a robot’s moral competence I identify the multiple elements that make up human moral competence and probe the possibility of designing robots that have one or more of these human elements, which include: moral vocabulary; a system of norms; moral cognition and affect; moral decision making and action; moral communication. Juxtaposing empirical research, philosophical debates, and computational challenges, this article adopts an optimistic perspective: if robotic design truly commits to building morally competent robots, then those robots could be trustworthy and productive partners, caretakers, educators, and members of the human community. Moral competence does not resolve all ethical concerns over robots in society, but it may be a prerequisite to resolve at least some of them. (shrink)

Central to this framing is the concept of intentionality, which distinguishes intentional action (caused by the agent’s intention and decision) from unintentional behavior (caused by internal or external events without the intervention of the agent’s decision). A second important distinction separates publicly observable from publicly unobservable (i.e., mental) events. Together, the two distinctions define the kinds of events in social interaction that people attend to, wonder about, and try to explain. A special focus of this chapter is the powerful tool of behavior explanation, which relies on the folk theory of mind but is also intimately tied to social demands and to the perceiver’s social goals. A full understanding of social cognition must consider the folk theory of mind as the conceptual underpinning of all (conscious and unconscious) perception and thinking about the social world. This paper examines the negative response to Dalton’s atomic symbols by situating them in the context of the normative eighteenth-century representational system of affinity tables. Aesthetic analysis of the affinity tables reveals them as schema embedded with a potent functionalist empiricism. In contrast, the aesthetics of Dalton's symbols is associated with hypothetico-deductivism and alchemical iconicism.

Since it is Hume who famously asked how an "ought" can ever possibly be deduced from an "is," it is Hume who is typically cast as the representative of empiricism's inadequacy for doing the work of ethics. Yet, as I will show, in his description of the proper functioning of the passions that necessarily involve other persons and their evaluations of us, Hume provides a naturalistic description that is not reductive of value, but rather incorporates values into the very ground (...) of empirical description. Contemporary moral philosophers who dismiss Hume's complex account of the passions as unnecessary for understanding his account of morals, and then fault the account of morals for its failure to move beyond mere description to any kind of normative assessment, ignore how the detail of Hume's own account of the passions suggests a way that an empirical account can in fact be value-laden, as we shall see. Considering the close relation between language and theory of mind in development and their tight connection in social behavior, it is no big leap to claim that the two capacities have been related in evolution as well. But what is the exact relation between them? This paper attempts to clear a path toward an answer. I consider several possible relations between the two faculties, bring conceptual arguments and empirical evidence to bear on them, and end up arguing for a version (...) of co-evolution. To model this co-evolution, we must distinguish between different stages or levels of language and theory of mind, which fueled each other’s evolution in a protracted escalation process. (shrink)

By way of conclusion, I have tried to show that rights do not come from nowhere, that is, rights are not sui generis. They come from claims. Rights do not make claims possible; rather claims make rights possible. For out of claims come claims to rights and from the welter of such claims to rights a legal system is established which, after sifting and refining, accepts some claims to rights and dignifies these as deeds, titles, rights and rejects others; and (...) provides rules enabling persons to exercise their rights. A system of rights and rules thus generated gives one the right to make strong claims. Although having a right is not a condition for making a claim, having a right is necessary to sustain and appraise a claim. Appealing to rights enables us to distinguish weak from strong claims. For rights may sustain or rebut claims though they are not themselves claims.How can we appraise claims? A claim to implies a claim that, the latter being an outcome of the former. If the resulting claim is open to appraisal of the sustain/reject or true/false kind, then it is a claim in a sense other than a primitive cry in the wild. If one can go on to say of a claim that is open to appraisal that one has a right to make such a claim or that one has a strong claim, this is to give favorable, initial appraisal to a claim thus made; and is a claim not in a primitive but in a secondary and ultimately more significant sense. Attribution theory has played a major role in social-psychological research. Unfortunately, the term attribution is ambiguous. According to one meaning, forming an attribution is making a dispositional (trait) inference from behavior; according to another meaning, forming an attribution is giving an explanation (especially of behavior). The focus of this paper is on the latter phenomenon of behavior explanations. In particular, I discuss a new theory of explanation that provides an alternative to classic attribution theory as it dominates the textbooks and (...) handbooks—which is typically as a version of Kelley’s (1967) model of attribution as covariation detection. I begin with a brief critique of this theory and, out of this critique, develop a list of requirements that an improved theory has to meet. I then introduce the new theory, report empirical data in its support, and apply it to a number of psychological phenomena. I finally conclude with an assessment of how much progress we have made in understanding behavior explanations and what has yet to be learned. (shrink)

The article deals with research on framing effects. First, I will start with classifying different approaches on framing. Subsequently, I will provide a definition of the concepts of frame, schema and framing, expand on framing research conducted so far – both theoretically and operationally. Having this equipment at hand, I will initiate a discussion on studies of framing-effects in terms of theory, methods and empirical results. This discussion leads to the conclusion that studies on framing effects are insufficiently concerned with (...) the more recent psychological constructs and theories. In merely focusing on the activation of schemata, most studies ignore the more elaborate types of framing-effects. Therefore, several empirical questions remain unanswered and some methodical chances seem to be wasted. (shrink)

Weltweit entstehen Eigenrechte der Natur. Ecuador verankert die Anerkennung von Rechten der Natur 2008 in der Verfassung (Art. 71-74, ECU Constitucion 2008). Gerichte in Kolumbien, Australien, Indien und Neuseeland sprechen Flüssen eigene Rechte zu (vgl. Gutmann 2021). Seit 2022 verleiht ein spanisches Gesetz auch in Europa der Lagune „Mar Menor“ rechtlichen Eigenstatus (ESP Ley 30.09.2022, 237 BOE I 135131). Diese Entwicklung resultiert aus starken kollektiven Protesten und interveniert tiefgreifend in bestehende soziale Strukturen und Weltsichten: (I) Was ist das Verhältnis des (...) Menschen zur Natur und zum Recht? (II) Wo knüpfen Rechte der Natur an bestehende rechtliche Formen an? (III) Welches Verhältnis besteht zwischen Recht und Natur? Die vorliegende Gedankenskizze will theoretische Linien der Figur von „Rechten der Natur“ abstecken. Philosophische und juristische Ansatzpunkte werden nur angerissen. Der Wert des Abrisses ist nicht vertiefte Argumentation, sondern Abtasten von Zusammenhängen und Fragen. Eigen-Rechte der Natur rütteln an Grundpfeilern des modernen, subjektiv geprägten Rechtsverständnisses (mindestens westlicher Kultur) und gehen konstruktiv gleichzeitig genau daraus hervor. In the educational strand of cosmopolitanism, much attention has been placed on theorizing and describing who is cosmopolitan. It has been argued that cosmopolitan sensibilities negotiate and/or embody such paradoxes as rootedness and rootlessness, local and global concerns, private and public identities. Concurrently, cosmopolitanism has also been formulated as a globally-minded project for and ethico-political responsibility to human rights and global justice. Such articulations underscore cosmopolitanism in anthropocentric terms. People can be cosmopolitan and cosmopolitan projects aim to cultivate cosmopolitan subjectivities. (...) What is striking about scholarship in educational cosmopolitanism is its lack of serious attention placed on the greatest global threat facing not only but largely created by human beings: environmental degradation. In this paper, I provide an overview of key texts written on the who in educational cosmopolitanism which helps lay the groundwork for an analysis of what is cosmopolitan. Regarding the what, I examine a range of boundary-defying emergencies described in cosmopolitan terms including climate change, radioactive poisoning of the planet, and bioinvasion. In the last analysis, I consider what it would take and what the possibilities are for our species to be truly committed to caring not only for the human world. (shrink)

In conclusion, I have tried to show that if there are any rights at all, legal, moral and political, there are at least the sorts of human rights cited in the Universal Declaration, rights which extend beyond the slender base provided by Hart's right to be free and which include the right to an adequate human life for everyone, rights shared by all, rights that, as rights, imply correlative duties. Even though the duties thus implied are admittedly imperfect, as rights, (...) they confer upon right-holders, the authority to obligate others.I have argued for the most part against regarding any rights, even some human, rights (interchangable here with manifesto rights, welfare rights, rights of recipience, social and economic rights, “programme rights,” Fawcett calls them, positive in rem rights) as claims to rights or proposals for adoption as rights. I have argued that to have a right of any kind, including especially a human right, one shared by and held equally by all human beings,while not “unconditional” or “unalterable,” is “fundamentally important, ” - to return once again to Feinberg's definition at the opening of this paper. A human right is fundamentally important, however, only if it, too, implies an obligation on the part of other people, one in which other people are obligated to use their power and resources “to make things happen.” To havea right is to be in a position to impose corresponding obligations on others. As Kant pointed out, a right of any kind gives a right holder “a title to compel.” From Kant's Philosophy of Law, in C. This article deals with frames and schemata in news reporting. It distinguishes frames and schemata in newsroom discourse and news reports. On the individual cognitive level, a frame is defined as a set of schemata for different aspects of reality. They emerge in newsroom discourse and in exchange with other discourses, i. e., they are not idiosyncratic but shared among those working in a newsroom. It is supposed that news report structures correspond to these newsroom frames and schemata. The article (...) discusses these considerations in regard to related explanations of news production, especially attitudinal approaches such as news bias. While the latter assume that journalists prefer information consistent with their own attitudes or that news reporting is ‘synchronized’ with editorial tendencies, the framing approach proposes that information in routine news reports correspond to newsroom frames. In this study I will use xenophobia as an example to identify newsroom frames in a qualitative frame analysis. In the second part of the study, quantitative analysis of news framing examines whether news report information correlates with newsroom frames. Finally, I will present empirical evidence that shows that newsroom frames play a role in news reporting. (shrink)

Raz holds that necessarily all legal authorities, even de facto authorities, make a claim to legitimate authority. He does not say that legitimacy is a necessary property of law. This view, which I call the claim view, constitutes my focal point in this paper. Many commentators have criticized this view. I discuss and dismiss three critiques of the claim view: the verification critique (the claim view is not empirically confirmed), the legalistic critique (law claims legal authority, not moral authority), and (...) the semantic critique (legal obligations are semantically distinct from moral obligations). I submit that Raz equates the meaning of legal duties with that of moral duties and yet denies that legal statements entail moral propositions. In other words, I distinguish the semantic identity thesis from the semantic entailment thesis. Instead of a semantic interpretation of the claim view, I defend a presuppositional ascription of a general claim to moral authority to authoritative duty‐imposing and normatively committed uses of legal language by official spokesmen. I show that law’s claim to authority does not prove the truth of the sources thesis, because conceptual confusion or insincerity can affect the epistemic reliability of the propositions embodied in the claim, and because blatant immorality can altogether cancel law’s pragmatically presupposed claim to moral authority. I also argue that the claim view can only warrant two qualified versions of exclusive legal positivism, one of which is almost tautological, the other self‐contradictory. Finally, I suggest that exclusive legal positivism cannot be defended on conceptual grounds. (shrink)

O Espírito das leis faria do modelo inglês o regime mais conforme à natureza humana, aquele que garantiria melhor a segurança dos indivíduos. Many forays have been made by psychoanalysts into the aesthetic realm, particularly in the form of interpretations of works of art and discussions of the particular or general pathology that may predispose individuals toward artistic creativity. Likewise, occasional philosophers have commented on the usefulness of psychoanalysis as a way of approaching areas of mutual interest. This study aims to contribute to this ongoing interdisciplinary dialogue, primarily through a focus on pathography, the term and method originated by Freud in his 1910 (...) monograph on Leonardo da Vinci. ;The thesis begins with an attempt to establish grounds for a dialogue between aesthetics and psychoanalysis by offering a selective review of the literature, identifying three fundamental problems in aesthetics and three basic approaches within psychoanalytic theory, and presenting a discussion of the application of these three modes of psychoanalytic thought to problems of form and content in modern art. ;Next, it is established that pathography, which attempts to probe associations between works of art and the minds that created them, derives from the nineteenth century critical tradition to which Freud was heir. Pathography is subjected to a critique in terms of the ongoing debate in aesthetics concerning problems of intention and expression; finally, its special contributions and limitations are explored. Three models of pathography are presented in detail. Each model with its differing context, motive for interpretation and methodology is scrutinized from an interdisciplinary perspective. ;Beyond pathography, we consider finally the contribution of several post-Freudian theorists who have emphasized the importance of preoedipal development and illuminated certain more general problems of aesthetic interest, i.e., issues centering on response to works of art, creativity and the importance of the external object. The possibility of a developmental line for aesthetic experience is considered, and relevant contemporary infant research is summarized. ;The Appendix offers, beyond pathography, yet another approach of psychoanalysis to art in which the work of art is considered sui generis, not, as in pathography, tied inextricably to the mind of its creator. Summary In this contribution, I reassess the opposition between Saint-Pierre's idealism and Rousseau's realism. Rousseau accuses Saint-Pierre of having a defect in his analysis and political judgement which, if he had been consistent, would have led to a revolutionary position in the strong sense ? a position of which the author of The Social Contract himself disapproved. In short, not only was Saint-Pierre far from being a convinced absolutist; Rousseau's own writings on the Abbé do not advocate a ?republican solution?, (...) which he regarded as impracticable for the Europe of his time. In this paper I argue that Locke's account of personal identity is a perspectival theory of how persons appear from different temporal and personal points of view. I sketch some principles governing the use of the phrase „I thinkײ in order to show how „it is by the consciousness it [viz.the self] has of its present Thoughts and Actions that it is self to it self now, and so will be the same self as far as the same consciousness can (...) extend to Actions past or to comeײ. Locke's thesis that my own picture of my future identity depends upon my concern for happiness is shown to be insufficient. The discussion of how another person's identity appears from my point of view finally leads to the author's suggestion that it is our common will which is constitutive of how I conceive of the other's as well as of my own future identity. In this paper I make a new attempt to interpret Locke's fascinating theory of primary and secondary qualities. The function of primary qualities, I argue, is to provide us with an idea of what the insensible corpuscles are like, of which every portion of matter is composed. Therefore, these qualities must be common both to sensible bodies and insensible corpuscles, and their ideas must resemble them. The function of secondary qualities is to make the primary qualities of the corpuscles accessible (...) to us. Secondary qualities are called immediately perceivable if they can be read off from the very body whose corpuscles they make appear; and they are called mediately perceivable, or bare powers, if they must be read off from another body. The classes of primary and secondary qualities depend upon the acuteness of our senses, and membership in them can be ascertained by ' Locke's method of division'. Despite all its ingenious calibration in experience, his distinction must be acknowledged, eventually, to go far beyond the bounds of sense allowed within by his type of empiricism. (shrink)

Schorske’s seminal Fin-de-Siècle Vienna: Politics and Culture 1 is frankly exposed. The argument—which may have single-handedly changed the discipline of cultural history—is an apparently simple one, and it is reasserted in this series of essays on diverse areas of cultural activity through the use of recurring metaphors. Schorske’s famous (...) thesis (modern culture as political surrogate for a marginalized liberal bourgeoisie) is represented through constantly resurfacing dichotomies: liberal political engagement and (vs.) the aesthetic “garden” of modern art; history and (vs.) desire and “the psyche”; politics and (vs.) culture. All of this is well known. In this essay I want both to assess our necessary debt to Schorske’s powerful work and to suggest what lies beyond it. If at the end of our own century we want to rethink Schorske’s founding project of an interdisciplinary cultural history of Central Europe, we cannot limit this initiative to the obviously important question of extending the contents of cultural inquiry (from high culture to popular culture, from the hegemonic nationality to non-German-speaking cultures, from patriarchy to the voices of women). The formal question packed up in the image of refuge from the historico-political in the aesthetic garden or the fortress of the psyche may offer most productive access to rethinking the Schorskean paradigm, instead of merely expanding its scope. For these reasons I want to focus on the rhetorical structure of Schorske’s essay collection against that of aesthetic and critical works from the Central European turn of the century. 2 Schorske’s historical analysis seems to be at odds [End Page 691] with these projects seen on their own terms—but to utter this is ironically to reiterate the tension between history or politics and aesthetic modernism articulated in the essays.The question at hand is hence two-fold. First of all, what is ideologically at stake in a historiographical construction that identifies Central European modernist aesthetic innovation as an escape from history and politics? Schorske’s interdisciplinary project of contextualization (his significant subtitle “Politics and Culture” has become an unshakable legacy for cultural history) is peculiar insofar as his diagnosis is that culture became increasingly isolated from political life. I have chosen to focus on the rhetorical opposition of “center” and “margin” in this essay because of Schorske’s implicit claim that the very class which was central to nineteenth-century Austrian liberalism—the German-speaking bourgeoisie—was “marginalized” by the rise of hostile anti-liberal ideologies (the “culture-makers” were “alienated along with their class in its extrusion from political power”). 3 As I hope to show, this geometry of center and margins was at the heart of the most innovative and potentially explosive play within so-called aestheticist texts around 1900. This brings us to the second half of this two-fold question: how might the “aesthetic moment” of the Central European fin de siècle be seen if we wish to go beyond Schorske’s diagnosis of a forced retreat into the temple of art, the fortress of the psyche, or the aesthetic garden? To get at both sides of this question—the ideological valence of the aesthetic moment and of its histories—I will focus on literary products, in particular on essays, for several reasons. One of these is that Schorske’s synthetic work is, after all, itself a collection of essays published over two decades.The privileging of the essay genre in coming to terms with the problem of turn-of-the-century aestheticism was established long before Schorske’s work. Since Kant, many philosophers have struggled to overcome the problems of an empiricist conception of the self. In this paper I argue that Heidegger’s philosophy in Being and Time has to be considered as one of the most powerful attempts to gain an anti-empiricist conception of the self and its unity. I highlight the power of Heidegger’s conception by contrasting it with contemporary empiricist conceptions, namely those of Dennett and Velleman. :A good deal of contemporary moral nonconsequentialism assumes that agents have perfect knowledge about the various features and consequences of their options. This assumption is unrealistic. More often than not, moral agents can only assess with a certain degree of probability the factual circumstances that are morally relevant for their decision making. My aim in this essay is to discuss the problem of moral decisions under risk from the point of view of nonconsequentialism. Basically, I analyze how objective moral principles (...) can be transformed into subjective, decisional prescriptions, and argue that the standard nonconsequentialist approach to moral decision making, which focuses on probability thresholds, is wrong. In accordance with the fundamental postulates of nonconsequentialism, I seek to solve the problem of risk in moral choice by proposing a theory about the marginal moral value of various options. Actions can vary along various dimensions, and each of these dimensions can offer a different moral value function. Nonconsequentialist marginalism can level the playing field with consequentialism. Whereas consequentialism can simply borrow the notion of expected utility from economics, nonconsequentialism must introduce the notion of expectational obligation to formulate a general principle of moral choice under risk. I finally suggest that further empirical work is needed to delineate the shape of various moral value functions that are critical for applying the general principle of moral decision making under risk to well-known cases. Der Aufsatz verfolgt die Frage, welche Bedeutung Literatur im Sinne von künstlerischem Sprachgebrauch für Sprache überhaupt zukommt. Inwiefern ist für Sprache und sprachliches Verstehen künstlerischer Sprachgebrauch konstitutiv? Ich mache den Vorschlag, diese Frage durch die Unterscheidung von sprachlicher Artikulation (von Strukturen der Welt) und sprachlicher Explikation (der sprachlichen Thematisierung von Sprache) zu beantworten. Diese Unterscheidung versetzt uns in die Lage, die Irreduzibilität von Explikation für Sprache zu begreifen. Auf dieser Grundlage kann dann künstlerischer Sprachgebrauch als eine spezifische Form von Explikation (...) verstanden werden, der eine besondere Relevanz für Sprache insgesamt zukommt. Diese besondere Relevanz lässt sich mit der These umreißen, dass literarische Texte eine Distanzierung von artikulativen Zusammenhängen in der Sprache eröffnen. So erweist sich Literatur als eine dem Medium der Sprache eingeschriebene Form der Freiheit. The paper addresses the question of how to determine the significance of literature – i.e. the artistic use of language – for language. Is the artistic use of language constitutive for language and linguistic understanding more generally? I seek to answer these questions by, first, distinguishing between linguistic articulation (of structures in the world) and linguistic explication (understood as the linguistic thematization of language itself). This makes it possible to, second, view linguistic explication as an irreducible dimension of language. Against this background, we can conceive the artistic use of language as a specific type of explication that has genuine relevance for the use of language more generally, because literary texts enable us to distance ourselves from the structures of articulating language. In this sense, literature has to be understood as a means of realizing freedom that is inscribed into language as such. (shrink)

In this paper, I discuss Adorno’s critique of jazz to develop a metacritique. I explain the basic objection of Adorno against jazz which states that jazz performances do not realize a law of form and therefore are not able to challenge subjects. According to my diagnosis, Adorno’s assessment of jazz is based on his conception of art for, firstly, Adorno excludes interactions of contributing to a law of form and, secondly, has a one-sided account of how art reflects subjectivity. If (...) one works out a conception of art that avoids these shortcomings it is possible to conceive of jazz as a paradigmatic form of art. (shrink)

Usually, the ontology of art is executed as an ontology of artworks. This has the consequence that the answer to the question what art is says nothing about why art is valuable. But it is, I argue, necessary to determine the value of art if one wants to say what art is. In order to account for the value of art, I start with the claim that art is a practice of transformation. Thus, I propose to develop the ontology of (...) art as the ontology of a practice of transformation. The practice in question has four elements: first artworks, second interpretive activities through which recipients and producers follow the constellations realized in artworks, third ordinary practices which are reflected through interpretive activities, and fourth practices of art criticism. By way of these four elements art is realized. According to the proposed conception, art is a profoundly unstable practice which challenges human beings and their self-understandings in such a way that they and their self-understandings develop further. Both the phenomenon of presupposition and that of vagueness have motivated the use of one form or another of trivalent logic, in which a declarative sentence can not only receive the standard values true and false , but also a third, non-standard truth-value which is usually understood as ‘undefined’ . The goal of this paper is to propose a multivalent framework which can deal simultaneously with presupposition and vagueness, and, more specifically, capture their projection properties as well as their different (...) roles in language. Now, there is a prima facie simple way of doing this, which simply consists in assimilating the two phenomena, and using an appropriate type of trivalent logic. On this view, we just need a compositional system that deals with the ‘undefined’ truth-value, and does not care about whether the source of undefinedness is ‘presuppositional’ or related to vagueness. I will argue that such a simple solution cannot succeed, and point out a number of desiderata that any successful approach must meet. I will then present and discuss two seven-valued semantics, inspired, respectively, by the Strong Kleene semantics and by supervaluationism, which meet these desiderata. (shrink)

How is aesthetic autonomy to be conceived if one does not want to lose an explanation of the connection between art and human practice in general? The starting point of the present paper is the claim that Hegel overlooks aesthetic autonomy because he wants to explain how art is operative within human practice. He does not conceive the sensuous-material aspects of art- works in their independence. Goodman’s notion of exemplification corrects this shortcoming. But his explanation of the relevance of independent (...) sensuous-material aspects of artworks fails to give us an understanding of aesthetic autonomy, too. I argue that it is possible to avoid such a negative conclusion if one understands the self-referential constitution of sensuous-material shapings in an artwork as the basis of aesthetic autonomy. At the same time, such an under- standing allows for a conception of the potency of art within human practice. (shrink)

Are works of art to be conceived as thought experiments? To answer this question one has to explain what thought experiments are. I argue that thought experiments consist of contrafactual scenarios which are conceptually articulated, whereby the scenarios in question are developed in a concise way. In the case of works of art this is not so. If works of art consist of contrafactual scenarios these scenarios are not developed concisely, even if works of art present a constellation of just (...) a few elements. The reason for this is that each work of art establishes a specific language. Such a language cannot be simply grasped, like a scenario in a thought experiment – it has to be followed mimetically by the recipients. So works of art function differently from thought experiments and are – even though closely related – not to be conceived as thought experiments. (shrink)

If one wants to determine the relationship between ordinary life and art one has to start with the groundbreaking Kantian insight that the beautiful reflects the working of the human faculties of the understanding. However, I argue that the Kantian conception of aesthetic reflection is not satisfying, for Kant doesn’t succeed in explaining the objective purport of the aesthetic reflection. I resort to Hegel to resolve this problem. But his explanation, too, falls short of grasping the multiplicity of ways in (...) which works of art make a contribution to a self- determined way of life. However, in Hegel there is a hint how to deal with this problem: Re- flection has to be understood as practical and not as cognitive. A conception of aesthetic reflexivity in terms of practical self-determination allows grasping that there is no gap between ordinary life and art. (shrink)
