This two-part article offers a defense of a libertarian doctrine that centers on two propositions. The first is the self-ownership thesis according to which each individual possesses original moral rights over her own body, faculties, talents, and energies. The second is the anti-egalitarian conclusion that, through the exercise of these rights of self-ownership, individuals may readily become entitled to substantially unequal extra-personal holdings. The self-ownership thesis remains in the background during Part I of this essay, while the anti-egalitarian conclusion is (...) supported in two ways. First, I offer a reconstruction of Robert Nozick's well-known `How Liberty Upsets Patterns' argument against all end-state and pattern theories of distributive justice; and I defend this reconstructed stance against what might seem to be telling criticisms. Second, I defend the two key principles of Nozickian historical entitlement theory against criticisms offered by G.A. Cohen. Part II will center on Cohen's contention that the crucial basis for the anti-egalitarian conclusion is the self-ownership thesis. There I argue that Cohen is correct to hold that he must reject the self-ownership thesis if he is to avoid the anti-egalitarian conclusion; but he is wrong to think that he has an adequate basis for rejecting this thesis. Thus, both elements in the libertarianism under consideration are vindicated. And, the self-ownership thesis plays a surprisingly direct role in vindicating the anti-egalitarian conclusion. (shrink)

Part I of this essay supports the anti-egalitarian conclusion that individuals may readily become entitled to substantially unequal extra-personal holdings by criticizing end-state and pattern theories of distributive justice and defending the historical entitlement doctrine of justice in holdings. Part II of this essay focuses on a second route to the anti-egalitarian conclusion. This route combines the self-ownership thesis with a contention that is especially advanced by G.A. Cohen. This is the contention that the anti-egalitarian conclusion can be inferred from (...) the self-ownership thesis without the aid of additional controversial premises. Cohen advances this contention, not because he wants to support the anti-egalitarian conclusion, but rather because he wants to emphasize the need for one to reject the self-ownership thesis if one is to reject the anti-egalitarian conclusion. In Part II of this essay, I support this second route to the anti-egalitarian conclusion by reinforcing Cohen's special contention while rejecting his challenges to the self-ownership thesis. Cohen's special contention is reinforced by way of an explanation of why the redistributive state must trench upon some people's self-ownership rights. One important challenge to the self-ownership thesis is answered through the articulation of a new and improved Lockean proviso. Another challenge offered by Cohen is answered by arguing that the philosophical costs of denying the self-ownership thesis are as great as the self-ownership libertarian maintains. Thus, I defend both of the key elements of self-ownership libertarianism, the self-ownership thesis and the anti-egalitarian conclusion. (shrink)

My goal in this essay is to say something helpful about the philosophical foundations of deontic restraints, i.e., moral restraints on actions that are, roughly speaking, grounded in the wrongful character of the actions themselves and not merely in the disvalue of their results. An account of deontic restraints will be formulated and offered against the backdrop of three related, but broader, contrasts or puzzles within moral theory. The plausibility of this account of deontic restraints rests in part on how (...) well this account resolves the puzzles or illuminates the contrasts which make up this theoretical backdrop. Despite the recent wave of scholarship on intersectionality, as well as a surge in feminist scholarship on Islam in German feminist studies, feminist research has yet to adequately engage with the role of religion in intersectionality. In this article the author draws on the work of the Aktionsbündnis muslimischer Frauen in Germany to explore the possibility for incorporating religion and faith into intersectional frameworks, which requires attention to women of color theorizing in German feminisms, recognition of ways in which religions (...) and forms of secularism have been racialized, and recognition of affective attachment to faith. We recognize today's deep neural network (DNN) models of language behaviors as engineering achievements. However, what we know intuitively and scientifically about language shows that what DNNs are and how they are trained on bare texts, makes them poor models of mind and brain for language organization, as it interacts with infant biology, maturation, experience, unique principles, and natural law.

In Singapore, the law holds that one person may constitute an illegal assembly. This makes each person, individually and at all times, latently assembled if not actually so. But where exactly does the permissible, non-assembled one end and the unlawful, gathered one begin? How and when does one become more than one, that is, some? For here an excess of one is not many, but rather an indeterminate some. Of what does this someness consist? This essay draws on Foucault and (...) This article investigates the ways in which individuals assume two distinct viewpoints in both speech and gesture - both simultaneously and sequentially - when they represent the uncertain knowledge that characterizes risk. In the mimetic viewpoint, individuals represent events as characters in their own narrative or mimic the character viewpoint of an Other. In the analytic viewpoint, individuals move outside of embodied experience to analyze events from a distance. As part of a larger study investigating viewpoint in discourses of risk, (...) this study suggests the important role of viewpoint in understanding individual accounts of risk. Together, speech and gesture provide a richer representation of risk than either speech or gesture alone. But viewpoints represented in gesture may be rendered invisible in written accident reports and investigations. This study suggests that individual accounts of risk ultimately reflect highly local sensory experiences that are situated - literally and physically - by an individual's position in institutional and material sites. Within these institutions, individuals can access a range of analytic and mimetic viewpoints in both speech and gesture in order to represent their experiences. This research has important implications for rhetorical theory and risk and decision science. (shrink)

1. Introduction This essay deals with the hard topic of the permissible killing of the innocent. The relevance of this topic to the morality of war is obvious. For even the most defensive and just wars, i.e., the most defensive and just responses to existing or imminent large-scale aggression, will inflict harm upon – in particular, cause the deaths of – innocent bystanders. 1 The most obvious and relevant example is that of innocent Soviet noncombatants who would be killed by (...) even the most precise defensive strike against Soviet strategic weapons or troop formations that is now possible. Should there be no vindication or, at least, no excuse for some killings of such innocent bystanders, morality would dictate that even defensive counterforce measures against largescale attacks should be renounced. In this essay I propose to explicate and defend a new and improved version of a Lockean proviso—the self-ownership proviso . I shall presume here that individuals possess robust rights of self-ownership. I shall take it that each individual has strong moral claims over the elements which constitute her person, e.g., her body parts, her talents, and her energies. However, in the course of the essay, I shall be challenging what I take to be the standard conception of self-ownership and (...) proposing an enrichment of that conception. The SOP is presented and in part justified as an implication of the right of self-ownership as it is more richly conceived—hence its designation as the self-ownership proviso. As an implication of the right of self-ownership which is also compatible, in theory and practice, with extensive and robust private property rights, the SOP is offered as an integral element of classical-liberal political theory. This article analyzes through a linguistic lens three official documents of the Roman Catholic Church on women’s ordination; it also identifies various discursive tactics utilized by text creators to reinforce gender hierarchy within the Church. Drawing from Fairclough’s three dimensional discourse framework, we examine the ideological message embedded in the linguistic features and the role each text plays within a matrix of power relations. Through close readings of Inter Insigniores: On the Question of Admission of Women to the Ministerial Priesthood, (...) Ordinatio Sacerdotalis of John Paul II, and Women and the Priesthood, we demonstrate how discourse analysis can serve as a useful tool for identifying logical fallacies, inconsistencies, dilemmas, and manipulative tactics in religious discourses. ObjectivesThe end of life is an ethically challenging time requiring complex decision-making. This study describes ethical frameworks among physician trainees, explores how these frameworks manifest and relates these frameworks to experiences delivering end-of-life care.DesignWe conducted semistructured in-depth exploratory qualitative interviews with physician trainees about experiences of end-of-life care and moral distress. We analysed the interviews using thematic analysis.SettingAcademic teaching hospitals in the United States and United Kingdom.ParticipantsWe interviewed 30 physician trainees. We purposefully sampled across three domains we expected to be (...) associated with individual ethics in order to elicit a diversity of ethical and experiential perspectives.ResultsSome trainees subscribed to a best interest ethical framework, characterised by offering recommendations consistent with the patient’s goals and values, presenting only medically appropriate choices and supporting shared decision-making between the patient/family and medical team. Others endorsed an autonomy framework, characterised by presenting all technologically feasible choices, refraining from offering recommendations and prioritising the voice of patient/family as the decision-maker.ConclusionsThis study describes how physician trainees conceptualise their roles as being rooted in an autonomy or best interest framework. Physician trainees have limited clinical experience and decision-making autonomy and may have ethical frameworks that are dynamic and potentially highly influenced by experiences providing end-of-life care. A better understanding of how individual physicians’ ethical frameworks influences the care they give provides opportunities to improve patient communication and advance the role of shared decision-making to ensure goal-aligned end-of-life care. This essay seeks to set to work on the question of race and the futures of the postcolonial in post-apartheid South Africa through abiding by the site of the indeterminacy between problem and critique. Arguing that reading, in the robust sense offered by Gayatri Spivak and Stuart Hall, is a necessary and urgent response to the question, the paper examines the interventions of three key figures for thinking radical black thought in our time, namely Achille Mbembe's Critique of Black Reason, (...) Nahum Chandler's X: The Problem of the negro as a Problem for Thought, and Qadri Ismail's Culture and Eurocentrism. Through abiding by the stakes of the work of reading in this conjuncture, I argue that it is through resisting the easy route of cultural and relativized difference that the pedagogical work of reading, and teaching reading, for the future, becomes possible. As an exposition of the title statement, distinctions are made between opinion and truth, and the speculative, productive and practical sciences. Sources of opinion and truth are described and a discussion follows that truth can be achieved through knowing principles and causes of the natural kind behind phenomena. This paper provides new theoretical insights into the interconnections and relationships between women, management and globalization in the Middle East (ME). The discussion is positioned within broader globalization debates about women’s social status in ME economies. Based on case study evidence and the UN datasets, the article critiques social, cultural and economic reasons for women’s limited advancement in the public sphere. These include the prevalence of the patriarchal work contract within public and private institutions, as well as cultural and ethical (...) values which create strongly defined gender roles. The discussion examines the complexities of conceptualizing women’s equality and empowerment in Islamic states. The paper reveals that there have been significant achievements in advancing women in leadership and political roles, but that there are still institutional and cultural barriers embedded in business systems. Linking feminist, development and management theoretical strands a development framework is proposed which is sensitive to the Islamic Shar’ia encompassing government, organization and individual level strategies. It is suggested that scholars should integrate literatures from gender and management, development and Middle East studies, and in particular that critical scholars of gender and organization should consider the interrelations of the national and transnational in critiques of contemporary global capitalism to understand the complexity of women and social change in the ME. Preparing to lecture on Aristotle's contribution to Nursing at the International Philosophy of Nursing Conference August 22, 2016, in Quebec City, Quebec, Canada, I came upon the recently published article by my IPONS colleague, Allmark (2016), “Aristotle for Nursing.” Allmark (2016) provides a comprehensive and understandable overview of Aristotle's philosophical system including the substantial nature of being and the four causes of change. Nurses using Aristotle to support practice and theoretical research will benefit from a careful reading of Allmark to (...) enrich their use of the realist understanding of knowledge of nature (epistemology) and the matter–form causal relationships within natural being (ontology and teleology). Allmark carefully displays the distinction between good health and flourishing; a distinction sometimes hard to grasp. Nurses are concerned with the end of health, but cannot achieve for others, the fullness of living which is flourishing.We will limit ourselves to expanding three areas that seem important, first, that nursing is much more than a productive science or craft, second, that Aristotle does provide an important note on the persistence of the soul, and, third, while Aristotle does not address the possibility of a personal creative highest being as Allmark says, his references to the divine are worth considering. When Paul writes about God’s power in Romans 1:16, he takes us to the heart of his understanding of the gospel. His understanding centers on power, the divine power that rescues humanity from captivity to Sin and Death, the power by which God pursues God’s own purposes even as it empowers the creatures it redeems.
