Autonomous artificial intelligence (AI) systems can lead to unpredictable behavior causing loss or damage to individuals. Intricate questions must be resolved to establish how courts determine liability. Until recently, understanding the inner workings of “black boxes” has been exceedingly difficult; however, the use of Explainable Artificial Intelligence (XAI) would help simplify the complex problems that can occur with autonomous AI systems. In this context, this article seeks to provide technical explanations that can be given by XAI, and to show how (...) suitable explanations for liability can be reached in court. It provides an analysis of whether existing liability frameworks, in both civil and common law tort systems, with the support of XAI, can address legal concerns related to AI. Lastly, it claims their further development and adoption should allow AI liability cases to be decided under current legal and regulatory rules until new liability regimes for AI are enacted. Allen Newell (1973) once observed that psychology researchers were playing “twenty questions with nature,” carving up human cognition into hundreds of individual phenomena but shying away from the difficult task of integrating these phenomena with unifying theories. We argue that research on cognitive control has followed a similar path, and that the best approach toward unifying theories of cognitive control is that proposed by Newell, namely developing theories in computational cognitive architectures. Threaded cognition, a recent theory developed within the ACT-R (...) cognitive architecture, offers promise as a unifying theory of cognitive control that addresses multitasking phenomena for both laboratory and applied task domains. The purpose of this study was to examine the perceptions of American history among adolescent Mexican Americans at the eight-grade level in a mid-west town's middle school. This qualitative study shows that multiple contexts influenced the process of teaching and learning history between and among a white teacher and adolescent Mexican Americans at Atkinson Middle School. Those overlapping contexts (the context of the education of minority language students, the context of social studies education, and the school's culture) created a unique (...) totality responsible for shaping the experiences of learning American history by Mexican-American students. These experiences were detrimental for the appreciation by Mexican-American students of American history's potential meanings and significance. (shrink)

In this article, we show how postphenomenology can be used to analyze the Affinity Map: a data visualization that reveals the hidden dynamics that exist between individuals within large organizations. We make use of the Affinity Map to expand the classic postphenomenology that privileges a ‘linear’ understanding of technological mediations and introduce the notions of ‘iterativity’ and ‘collectivity.’ In the first section of the paper, we discuss both classic and more recent descriptions of human-technology-world relations in order to transcendentally approach (...) the discipline of data visualization. In the second section, we use the Affinity Map case study to consider three elements: 1) the collection of data and the design process; 2) the visual grammar of the data visualization, and 3) the process of self-recognition for the map ‘reader.’ In the third section, we introduce the hermeneutic circle of data visualization. Finally, we suggest that the Affinity Map, because of its ethical and political multistability, might be seen as a material encounter between postphenomenology, actor-network theory (ANT), and hermeneutics. This paper considers whether the category of sovereign “decision,” as it is used in Carl Schmitt’s Political Theology, has analogies with the paradigm of “choice,” as it is theorized in neoliberalism. Both decision and choice belong to that mode of judgement that “cuts” the field of alternatives into two, into two “extreme” alternatives. This mode of judgment not only presupposes the subject of the decision, but also sets up the terms of the choice, clearly indicating the optimal option. For Schmitt, (...) a political decision arises in a “case of necessity”: in the “serious case” of war. And yet, it is precisely the neoliberal depoliticization of war that reduces it to a rule, and every choice fundamentally to a stance for or against. To escape from the neoliberal reduction of political decision in the form of a choice, I examine another mode of decision, absent from Schmitt’s texts: “disclosedness.”. (shrink)

The article considers the nature of series as a narrative, focusing especially on its chronotope, i.e. its spatiotemporal coordinates. The concept of chronotope can be applied at at least two different levels of the interpretation of a narrative: the real world of reception and the expressive form of narration. The impact of series entails both aspects. It is for this reason that series, once on television then on the internet, represented a revolutionary turn in the modern experience of storytelling. Series (...) are therefore bound to the progressive spread of a new form of sociality known as a digital “total mobilisation”. Since the era of TV series up to the emergence of web series, seriality has been able to regulate the increase of interaction in the use of visual devices. Series play the role of a dietetical regulator, which designs the spectators’ attention. An artistic, i.e. experimental, exploitation of this new form of storytelling is possible when one considers the emergence of a new narrative genre, which we propose to call the “short form”. The author will look at aspects of thinking about the idea of Europe at the crossroads of the digital and post-digital epochs – through Edgar Morin’s text Thinking Europe and Guy Debord’s Comments on the Society of the Spectacle, published in the late 1980s, in an attempt to understand their fundamental positions and implicit views on how to approach and pursue something like the political and supranational union of European countries in parallel with the rapid development of digital technologies and (...) new media, which fundamentally change our experience of the world. The very idea of a united Europe appears here as a Kantian “suspicious pleonasm”, whose value is questioned today, especially with the development of new global policies and post-cultural virtual environments that make – notions such as Europe, the Mediterranean, and the Western world – only artifacts of decadent Occidental cultures whose real ruins are overshadowed by an overly real spectacle of virtual abundance. Self-recognition is an intimate act performed by people. Inspired by Paul Ricoeur, we reflect upon the action of self-recognition, especially when data visualization represents the observer itself. Along the article, the reader is invited to think about this specific relationship through concepts like the personal identity stored in information systems, the truthfulness at the core of self-recognition, and the mutual-recognition among community members. In the context of highly interdisciplinary research, we unveil two protagonists in data visualization: the designer and the (...) observer - the designer as the creator and the observer as the viewer of a visualization. This article deals with some theoretical aspects behind data visualization, a discipline more complex than normally expected. We believe that data visualization deserves a conceptual framework, and this investigation pursues this intention. For this reason, we look at the designer as not just a technician in the visualization production, but as a contemporary ethnologist - the designer as a professional working in a social environment to comprehend the context and formulate a specific inquiry with the help of appropriate visual languages. The notion of individualised evidence holds the key to solve the puzzle of statistical evidence, but there’s still no consensus on how exactly to define it. To make progress on the problem, epistemologists have proposed various accounts of individualised evidence in terms of causal or modal anti-luck conditions on knowledge like appropriate causation, sensitivity and safety. In this paper, I show that each of these fails as satisfactory anti-luck condition, and that such failure lends abductive support to the following conclusion: (...) once the familiar anti-luck intuition on knowledge is extended to individualised evidence, no single causal or modal anti-luck condition on knowledge can succeed as the right anti-luck condition on individualised evidence. This conclusion casts serious doubts on the fruitfulness of the move from anti-luck conditions on knowledge to anti-luck conditions on individualised evidence. I expand on these doubts and point out further aspects where epistemology and the law come apart: epistemic anti- luck conditions on knowledge do not adequately characterise the legal notion of individualised evidence. Copy of a copy of a copy of a copy of a copy of … Trent Reznor’s formula sounds so much more exciting and seductive than two millennia-old formula of representation and identity also known as A=A. Oversubscribed to central perspective, concerned with clarity and distinctness too content with the content of the image and strongly bonded with its apparatus, photography of the past century repeatedly failed to see the invisible, still acting as a copy of some ideal original, assuming (...) this role from painting. If the painting managed to free itself from representation, what can photography do? With new technologies of image production and dissemination, the pillars of the image of thought begin to crack, with identity and recognition losing the centre stage to difference and repetition. Through the emergence of the ability to photograph everywhere, automated camera and ubiquitous digital dissemination of images, photography is suddenly revealed as the medium of a copy, of uncountable recurrences of the same, and with all of its subjects and objects becoming simulacra, rendering only difference as real and originary. In the debate on the heritage of the Council an careful study focusing the figures of the Fathers who had an important influence on the Council is still missing. Mons. Luigi Maria Carli is one of these: bishop of Segni during the Council, one of the most heard and feared of the minority, that he was considered the 'informal' voice of the Council. Carli was noted for 14 interventions during the four sessions of the Council. Theologian, expert in Canon law, (...) and excellent apologist, in his interventions he always asked that the doctrine be formulated in the fidelity of the Tradition and the Magisterium of the Church. His participation in the Council deserves to be remembered not only for his interventions but also because, after the end of the Council, he carried out its decisions and recommendations with commitment and fidelity first in the diocese of Segni and then in the diocese of Gaeta. Previous accounts of cognitive skill acquisition have demonstrated how procedural knowledge can be obtained and transformed over time into skilled task performance. This article focuses on a complementary aspect of skill acquisition, namely the integration and reuse of previously known component skills. The article posits that, in addition to mechanisms that proceduralize knowledge into more efficient forms, skill acquisition requires tight integration of newly acquired knowledge and previously learned knowledge. Skill acquisition also benefits from reuse of existing knowledge across disparate (...) task domains, relying on indexicals to reference and share necessary information across knowledge components. To demonstrate these ideas, the article proposes a computational model of skill acquisition from instructions focused on integration and reuse, and applies this model to account for behavior across seven task domains. This article compares two philosophers who have a different theoretical origin: respectively, Arthur C. Danto and Jean-François Lyotard. Both of them are interested in the revolutionary character of Andy Warhol’s art. Danto as well as Lyotard argues that Warhol conceives the work of art as a machine: according to the former, it is a philosophical machine; according to the latter, it is a consumerist machine. Nonetheless, the two hypotheses converge on judging Warhol’s art as a turn in the history of (...) art and its relationship to the world. According to Danto, who follows Hegel here, Warhol at the same time interprets and transcends the 1960s and their Zeitgeist. But paradoxically, Warhol’s historical gesture, epitomized by his work Brillo Box, initiates the age of the “end of art”. According to Lyotard, on the contrary, Warhol represents the end of the critical power of modern art, to which the sublime alone can remediate. The two perspectives converge in the idea that the investigation of repetition is the very center of Warhol’s art. Art has now become the pivot of the Western capitalism and consumerist society. Warhol actually explores the different forms and modes of repetition (commodities, icons, symbols) and, in this way, anticipates the confrontation of contemporary art with the “finite infinite” represented by the media world. En este artículo intentaré reflexionar acerca del pedido de respeto y de reconocimiento que los estudiantes les demandan a los actores de la institución escolar. Las referencias empíricas están centradas en observaciones etnográficas y entrevistas a alumnas y alumnos que concurren a escuelas y Centros de Educación de Jóvenes y Adultos, localizados en la ciudad de La Plata, Argentina. Se podrán observar algunas dimensiones de la relativa insuficiencia de los métodos de disciplinamiento y cuáles son algunos de los modos de (...) expresión juvenil de los conflictos. Además es interesante problematizar la exigencia de reciprocidad que los jóvenes les solicitan a los agentes de los ámbitos institucionales educativos. Muchas de estas cuestiones relevan el carácter ficcional que suelen caracterizar a las situaciones intersubjetivas en la escuela, pero que pueden ser extendidas a otros escenarios que regulan lo social. Despite the substantial appeal of the safety condition, Kelp (J Philos Res 34:21–31, 2009; Am Philos Q 53:27–37; Good Thinking. A Knowledge First Virtue Epistemology, Routledge, London, 2018) has raised a difficult challenge for safety-theoretic accounts of knowledge. By combining Gettier-style fake barn cases with epistemic Frankfurt cases, he concludes that no formulation of safety can be strong enough to predict ignorance in the former and weak enough to accommodate knowledge in the latter. In this note, my contribution is two-fold. (...) Firstly, I take up Kelp’s challenge and I show that, once properly understood, safety successfully rises to it. Secondly, I draw a more general lesson on the safety condition: a satisfactory solution to Kelp’s challenge calls for a revision of the standard formulation of safety, which must be indexed to both methods and environments. My conclusion will be that an environment-relative version of safety not only meets Kelp’s challenge, but it also advances our understanding of the safety condition on knowledge. (shrink)

Beccaria’s penal philosophy hinges on the doctrinal paradigm of liberty through law. Inconceivable in the absence of laws and unattainable in the presence of arbitrary powers, liberty is profiled as the legal situation of the person who may act, within the sphere of what is not forbidden and not bound, without suffering illicit interference from private individuals or organs of the state. Thus, the form of law becomes an essential matter in the construction of the political space suitable for free (...) living. In the analysis proposed in this article, the notion of “political liberty”–which Beccaria takes from Montesquieu–is declined in relation to the legal order, criminal law and the social contract. This article describes the path‐mapping theory of how humans integrate analogical mapping and general problem solving. The theory posits that humans represent analogs with declarative roles, map analogs by lower‐level retrieval of analogous role paths, and coordinate mappings with higher‐level organizational knowledge. Implemented in the ACT‐R cognitive architecture, the path‐mapping theory enables models of analogical mapping behavior to incorporate and interface with other problem‐solving knowledge. Path‐mapping models thus can include task‐specific skills such as encoding analogs or generating responses, and can (...) make behavioral predictions at the level of real‐world metrics such as latency or correctness. We show that the path‐mapping theory can successfully account for the major phenomena addressed by previous theories of analogy. We also describe a path‐mapping model that can account for subjects' incremental eye‐movement and typing behavior in a story‐mapping task. We discuss extensions and implications of this work to other areas of analogy and problem‐solving research. (shrink)

National, European, and international institutions should implement social policies to help the persons with disabilities. Strategic sectors include education, training, and work, with the equal protection of the laws. In addition, this essay is focused on another crucial “sector" that is part of the primary law, which include tourism along with public transportation and non-discrimination. In conclusion, legislators, and public institutions, as well as transport companies must comply the principles of accessibility, equality, and social justice for the social inclusion of (...) persons with disabilities. Recent programs aimed at the independent living of persons with disabilities, allow them to be costumers of sectors in which they have never had full access in the past. The Lisbon Treaty has distinctly recognized the existence of a community tourist area within the primary law, and CRPD has defined the principles of accessibility and accessible tourism as tools for the inclusion. In addition, tourism and transportation stakeholders must guarantee non-discriminatory services; they must approach persons with disabilities as every other (...) customer, by taking in consideration their needs and rights, especially when it comes to their accessibility, assistance, and information. Companies of transportation must cooperate with DPOs in order to define disability-related training procedures. (shrink)

This report is an attempt to reread the event of Revelation in view of DV 8: «Ecclesia, volventibus saeculis, ad plenitudinem divinae veritatis iugiter tendit, donec in ipsa consummentur verba Dei». The text aims at clarifying the eschatological character of Revelation, raising however a theological problem of great importance: if and in what measure is it possible to think of Revelation as a never concluded process, if the theological tradition asserts that Revelation is concluded with the death of the last (...) Apostle and Dei Verbum speaks of Christ as the fullness of Revelation? The eschatological character of Revelation is investigated in the light of the dynamism of the Tradition, in particular of DV 8, which gives indications of great interest to resolve the matter of the persistence of Revelation in the time of the Church. The report affirms that the Tradition does not limit itself to the understanding of the revealed fact, but it points out the participation of the Church in the dynamism of Revelation itself. The conclusion is reached by means of a description of the constitutive relationship between Christian experience and knowledge - described in Dei Verbum as intima spiritualium rerum quam experiuntur intelligentia - which has it most clear and most pertinent expression in the sensus fidei. The starting-point of this article is the fact that within the language of theology it is a widespread usage to identify public opinion with sensus fidelium. The Author is convinced that the two formulas cannot be directly superposed. An accurate examination of similarities and differences is necessary otherwise the undifferenciated use of the two locutions could bring elements of confusion and groundless conflict into the theological debate. As a matter of fact the difference does not only concern the difference of (...) field or disciplines - sociology for public opinion, theology for the sensus fidelium - so that it would be a matter of the same phenomena interpreted by different points of view. Even if similar dynamics in the two functions can be gathered, sensus fidelium and public opinion are of a different kind so that also subject, object, conditions and way of practice are different. On the basis of these differences the two dynamisms -both utterly important for the life of the Church - can be correctly applied in theology as well as in the more concrete praxis of the Church. Recent epistemology has witnessed a substantial opposition between two competing approaches to capturing the notion of non-accidentality in the analysis of knowledge: the explanationist and the modalist. According to the latest advocates of the former, S knows that p if and only if S believes that p because p is true. According to champions of the latter, S knows that p if and only if S's belief that p is true in a relevant set of possible worlds. Because Bogardus and (...) Perrin's explanationism promises to deliver a plausible analysis of knowledge without any need for modal notions, it is an elegant proposal with prima facie appeal. However, such version of explanationism ultimately does not live up to its promises: in this paper, I raise some objections to their explanationist analysis of knowledge while showing that modalism is in much better shape than they think. In particular, I argue that their explanationist condition generates the wrong results in Gettier cases and fake-barn cases. I also offer and defend a novel version of modalism: I introduce a refined safety condition which is shown to successfully handle the same Gettier cases that beset Bogardus and Perrin's version of explanationism. The paper concludes with a reassessment of the explanationist's initial ambition to provide an analysis of knowledge without modal notions. The upshot will be that even if the prospects for such analysis remain dim, our money should be on the modalist, not the explanationist. (shrink)

We present computational modeling results based on a self‐paced reading study investigating number attraction effects in Eastern Armenian. We implement three novel computational models of agreement attraction in a Bayesian framework and compare their predictive fit to the data using k‐fold cross‐validation. We find that our data are better accounted for by an encoding‐based model of agreement attraction, compared to a retrieval‐based model. A novel methodological contribution of our study is the use of comprehension questions with open‐ended responses, so that (...) both misinterpretation of the number feature of the subject phrase and misassignment of the thematic subject role of the verb can be investigated at the same time. We find evidence for both types of misinterpretation in our study, sometimes in the same trial. However, the specific error patterns in our data are not fully consistent with any previously proposed model. (shrink)

The Covid-19 pandemic has put a strain on the health system, as well as the social, economic, and cultural ones at the Global level. After the pandemic, the risk is that the process of inclusion of persons with disabilities is grinding to a halt. But the chance is to find new ideas. This paper will define a brief but significant framework of principles that should be taken into consideration in order to support strategies of inclusion of people with disabilities in (...) the fields of health care and cultural life, especially through the research.
