This paper reassesses the domain of the business ethics curriculum and, drawing on recent shifts in the business environment, maps out some suggestions for extending the core ground of the discipline. It starts by assessing the key elements of the dominant English-language business ethics textbooks and identifying the domain as reflected by those publications as 'where the law ends' and 'beyond the legal minimum'. Based on this, the paper identifies potential gaps and new areas for the discipline by drawing on (...) four main aspects. First, it argues that the domain of business ethics requires extensions dependent on the particular geographic region where the subject is taught. A second factor for broadening the scope is the impact of recent scandals, which arguably direct the focus of ethical inquiry towards the nature of the business systems in which individuals and corporations operate. Third, the impact of globalization and its result on growing corporate involvement in regulatory processes is discussed. Fourth and finally, business ethics reaches beyond the traditional constituencies of 'economic stakeholders' as new actors from civil society enter the stage of ethical decision making in business. We conclude by suggesting that a reconsideration of the domain of business ethics, especially in Europe, is timely, but that to do so represents a major challenge to business ethics educators. The United Nations Global Compact – which is a Global Public Policy Network advocating 10 universal principles in the areas of human rights, labor standards, environmental protection, and anticorruption – has turned into the world's largest corporate responsibility initiative. Although the Global Compact is often characterized as a promising way to address global governance gaps, it remains largely unclear why this is the case. To address this problem, we discuss to what extent the initiative represents an institutional solution to exercise (...) global governance. We suggest that new governance modes, which have arisen in the context of globalization, often adopt a multiactor, multilevel, and network-based approach. We then analyze how far the Global Compact's institutional design reflects this multiactor, multilevel, and network-based steering mode. Drawing on this discussion, we offer suggestions regarding how the initiative can be further developed. (shrink)

Dedicated to Dana Scott on his sixtieth birthday.It is common knowledge that for a short while Hermann Weyl joined Brouwer in his pursuit of a revision of mathematics according to intuitionistic principles. There is, however, little in the literature that sheds light on Weyl's role and in particular on Brouwer's reaction to Weyl's allegiance to the cause of intuitionism. This short episode certainly raises a number of questions: what made Weyl give up his own program, spelled out in “Das Kontinuum”, (...) how did Weyl come to be so well-informed about Brouwer's new intuitionism, in what respect did Weyl's intuitionism differ from Brouwer's intuitionism, what did Brouwer think of Weyl's views,…? To some of these questions at least partial answers can be put forward on the basis of some of the available correspondence and notes. The present paper will concentrate mostly on the historical issues of the intuitionistic episode in Weyl's career.Weyl entered the foundational controversy with a bang in 1920 with his sensational paper “On the new foundational crisis in mathematics”. He had already made a name for himself in the foundations of mathematics in 1918 with his monograph “The Continuum” [18]; this contained in addition to a technical logical-mathematical construction of the continuum, a fairly extensive discussion of the shortcomings of the traditional construction of the continuum on the basis of arbitrary—and hence also impredicative—Dedekind cuts. Brouwer and Weyl recognized that the intuitive continuum requires a mathematical analysis of a kind that set theory is not able to provide. As an alternative, Brouwer introduced choice sequences. We first describe the features of the intuitive continuum that prompted this development, focusing in particular on the flow of internal time as described in Husserl's phenomenology. Then we look at choice sequences and their logic. Finally, we investigate the differences between Brouwer and Weyl, and argue that Weyl's conception of (...) choice sequences is defective on several counts. (shrink)

This article argues that Hayden White's vision of historiography can be appropriated for the “public use of history” in many ethnic and nationalist conflicts today. That is, it can be used to provide the theoretical arguments that justify the instrumentalization of historical memory by nationalist elites in their sometimes genocidal struggles with their opponents. Historians so far have not adequately understood the implications or possible uses of White's historiography, and therefore to that extent his case remains unrefuted. In the event, (...) White has anticipated and held his ground against possible counter-arguments. The only way to answer him is to ask the question that he poses of historians: what is the purpose of history for “life”? The essay argues that Max Weber's advice to scholars to pose difficult questions and demand clarity about the implications and consequences of specific commitments is morally more responsible than White's in the current climate of ethnic and national conflict. The historical is not opposed to the ethical, as White maintains; the historical is the ethical. Historians should engage in “strong evaluations” in the construction of “bridging” narratives between historical communities, rather than redemptive narratives of liberation that often entail zero-sum claims to contested land. In the Phaedrus, Socrates insists that every proper logos must have the unity of an organic living thing. And yet it is hard to say what imposes any such unity on the various speeches and topics that are dealt with in this very dialogue. This chapter situates the view of Hermias of Alexandria in relation to modern debates about what, if anything, unifies the Phaedrus. For the ancient Neoplatonists, the question of unity was bound up with the question of each (...) dialogue's "skopos". We argue that Hermias' answer to this question -- that the skopos of the Phaedrus is 'beauty at every level' -- is not as wildly implausible as Neoplatonic readings of Plato's dialogues are often thought to be. Propositional dynamic logic (PDL) is one of the most successful variants of modal logic. To make it even more useful for applications, many extensions of PDL have been considered in the literature. A very natural and useful such extension is with negation of programs. Unfortunately, as long-known, reasoning with the resulting logic is undecidable. In this paper, we consider the extension of PDL with negation of atomic programs, only. We argue that this logic is still useful, e.g. in the context (...) of description logics, and prove that satisfiability is decidable and EXPTIME-complete using an approach based on Büchi tree automata. Foundational Texts in Modern Criminal Law presents essays in which scholars from various countries and legal systems engage critically with formative texts in criminal legal thought since Hobbes. It examines the emergence of a transnational canon of criminal law by documenting its intellectual and disciplinary history and provides a snapshot of contemporary work on criminal law within that historical and comparative context. Criminal law discourse has become, and will continue to become, more international and comparative, and in this sense global: (...) the long-standing parochialism of criminal law scholarship and doctrine is giving way to a broad exploration of the foundations of modern criminal law. In "Literary Forms of Argument in Early China," Gentz and Meyer explore a new analytical approach to the study of written thinking by focusing on the argumentative function of literary patterns in early Chinese texts.

This commentary records, through notes taken by Hermias, Syrianus' seminar on Plato's Phaedrus, one of the world's most influential celebrations of erotic beauty and love. It is the only Neoplatonic commentary on Plato's Phaedrus to have survived in its entirety. Further interest comes from the recorded interventions by Syrianus' pupils - including those by Proclus, his eventual successor as head of the Athenian school, who went on to teach Hermias' father, Ammonius. Philosophy gives rhetoric something to say. They are mutually indispensable, and their rivalry at times descends into enmity. Those are the overarching dynamics of Verene's book.There is an introduction, then two parts, "Prolegomena Philosophiae," comprising four chapters, and "Three Rhetorics," comprising three chapters, followed by an epilogue, notes, and an index.Though Verene does not mention Hume in the introduction—and only twice in the book otherwise—it is difficult not to think of him when Verene speaks of philosophy as "a theater of memory," as if correcting Hume's "theater of the mind." It is also corrective to presentism, often attributed to Hume, when Verene claims that a chief task of the philosopher "is to keep us from always living in the present. For this labor to be accomplished the philosopher must go to school with both the poets and the orators." Modern philosophy rejects rhetoric and memory in its pursuit of novelty as progress. Verene introduces the concept of ingenium, "a power philosophy shares with rhetoric." There are two principles that lend Brouwer's mathematics the extra power beyond arithmetic. Both are presented in Brouwer's writings with little or no argument. One, the principle of bar induction, will not concern us here. The other, the continuity principle for numbers, occurs for the first time in print in [4]. It is formulated and immediately applied to show that the set of numerical choice sequences is not enumerable. In fact, the idea of the continuity property can be dated fairly (...) precisely, it is to be found in the margin of Brouwer's notes for his course on Pointset Theory of 1915/16. In the following study we shall investigate the ancient Greek ‘(all-)day runners’ (ήμεροδρόμοι) 2 from a historical as well as from a modern physiological perspective. Hemerodromoi were of some importance in Greek interstate communication, in particular in military long-distance communication, and are, accordingly, a subject of some interest for the study of interaction in the ancient Greek city-state culture. The investigation begins by considering the ancient evidence on these ‘(all-)day runners’ and moves on to a physiological consideration of this evidence, (...) with particular reference to the feat of the Athenian hemerodromos Pheidippides 3 who ran from Athens to Sparta in 490 BC, shortly before the famous battle of Marathon. With the proliferation of networked electronic communication came daunting capabilities to collect, process, combine and store data, resulting in hitherto unseen transformational pressure on the concepts of trust, security and privacy as we know them. The Future Internet will bring about a world where real life will integrate physical and digital life. Technology development for data linking and mining, together with unseen data collection, will lead to unwarranted access to personal data, and hence, privacy intrusion. Trust and identity lie at (...) the basis of many human interactions and transactions, and societies have developed legitimate concern for privacy being essential for freedom and creativity. The burgeoning development of the Information Society, particularly during the past fifteen years, transcended the societal readiness to respond to the transformational change evoked by ICT. We have reached the eleventh hour for the preservation of trust and privacy as elements that can be transposed into our digital future. Europe has been at the forefront in recognizing the importance of privacy protection in relation to digital data, witness the advanced European legislation in this domain. The European Commission recognizes that appropriate measures need to combine technology development with legal means, user awareness and tools supporting data controllers to comply with law in an accountable and transparent way, and that empower users with a controlling stake in managing their personal data. Activities are underway at many levels. European RTD programmes play their role in supporting research in trustworthy ICT, privacy enhancing technologies, privacy-by-design in service layers as well as in networks, enabling technologies such as cryptography, and in generalized frameworks for trust and privacy-protective identity management. In deze nieuwe geschiedenis van de natuurkunde wordt dan ook ruim aandacht besteed aan de zoektocht en wederwaardigheden van grote figuren, maar ook (...) van collega's uit de tijd dat Andriesse in Groningen werkte. This article explores the relation between innovation and resources that are governed as commons by looking at the governance of potato genetic resources, especially in the context of the emergence ofhybrid diploid potato breedingthat will enable potato propagation through true seeds. As a new breeding tool, hybrid diploid potato breeding may not only revolutionize traditional potato breeding practices, it may also strongly affect current governance modes of potato genetic resources as a commons. Contrary to conventional accounts of the commons that (...) treat technological innovation mainly as an exogenous factor, we argue that technological innovation can better be understood as an endogenous factor. In particular, we develop aco-production frameworkof innovation and the commons that draws attention to the different ways in which innovation, commons and its governance interact. Using this framework, we demonstrate that the constitution of potato genetic resources as a commons cannot be understood without considering the various ways in which technological innovation affects resources and mediate how these are governed. While reversely, technological innovations themselves are also enabled and constrained by users who govern potato genetic resources as a shared resource. We argue that changes in the governance of genetic resources can be understood as a change from one socio-technical constellation to another, whereby innovations, resources, and institutions are continuously co-produced. In this paper, I develop the concept ofaffective milieusby building on the recently established notion ofaffective arrangements. Affective arrangements bring together the more analytical research of situated affectivity with affect studies informed by cultural theory. As such, this concept takes a step past the usual synchronic understanding of situatedness toward an understanding of the social, dynamic, historical, and cultural situatedness of individuals in relation to situated affectivity. However, I argue that affective arrangements remain too narrow in their scope of analysis (...) since their focus mainly lies on local, marked-off, and unique constellations of affect relations. They neglect the more mundane and day-to-day affect dynamics of social life. Hence, I introduce the notion of affective milieus, which brings to light the everyday, ubiquitous affective engagements of individuals with their socio-material surroundings. Affective milieus specifically call attention to how commonplace affect relations create territories in the social universe which form and mold individuals all the time. In that way, this paper apprehends and advances recent developments in the research on situated affectivity. (shrink)

In this paper, we explore a rationalistic orientation in Western society. We suggest that this orientation is one of the predominant ways in which Western society tends to frame, understand and deal with a majority of problems and questions – namely in terms of mathematical analysis, calculation and quantification, relying on logic, numbers, and statistics. Our main goal in this paper is to uncover the affective structure of this rationalistic orientation. In doing so, we illustrate how this orientation structures the (...) way not only individuals but society as a whole frames and solves problems. We firstly point towards some exemplary instances of the rationalistic orientation, specifically regarding science, society, and lifeworld practice. Crucially, we argue that the rationalistic orientation is not merely based on a set of beliefs we could easily correct; but rather, that it is an affective condition tacitly shaping our engagement with the world in an encompassing way. Relating to the work of Martin Heidegger, we argue that what we have called an orientation in the beginning is in fact a rationalistic attunement. This attunement fundamentally shapes the pre-reflective level of how individuals approach the world. We elaborate this claim by showing how the rationalistic attunement concretely manifests in tangible socio-material affect dynamics. In the end, we motivate a critical stance towards this attunement, providing the ability to reflect upon and question instances where this way of framing and solving problems is counterproductive.
