There is a burgeoning scientific and ethical literature on the use of biomarkers—such as genes or brain scan results—and biological interventions to predict and prevent crime. This literature on biopredicting and biopreventing crime focuses almost exclusively on crimes that are physical, violent, and/or sexual in nature—often called blue-collar crimes—while giving little attention to less conventional crimes such as economic and environmental offences, also known as white-collar crimes. We argue here that this skewed focus is unjustified: white-collar crime is likely (...) far costlier than blue-collar crime in money, health, and lives lost. Moreover, attempts to biopredict and bioprevent blue-collar crime may entail adopting potentially unfair measures that target individuals who are already socio-economically disadvantaged, thus compounding pre-existing unfairness. We argue, therefore, that we ought to extend the study of bioprediction and bioprevention to white-collar crime as a means of more efficiently and fairly responding to crime. We suggest that identifying biomarkers for certain psychopathic traits, which appear to be over-represented among senior positions in corporate and perhaps political organisations, is one avenue through which this research can be broadened to include white-collar crime. Ice Cube "What's a brother gotta do to get a message through to the Red, White, and Blue?" Ice-T Rap music has emerged as one of the most distinctive and controversial music genres of the past decade. A significant part of hip hop culture, [1] rap articulates the experiences and conditions of African-Americans living in a spectrum of marginalized situations ranging from racial stereotyping and stigmatizing to struggle for survival in violent ghetto conditions. In this cultural context, rap provides (...) a voice to the voiceless, a form of protest to the oppressed, and a mode of alternative cultural style and identity to the marginalized. Rap is thus not only music to dance and party to, but a potent form of cultural identity. It has become a powerful vehicle for cultural political expression, serving as the "CNN of black people", or upping the high-tech ante, as their "satellite communication system". It is an informational medium to tune into, one that describes the rage of African-Americans facing growing oppression, declining opportunities for advancement, changing moods on the streets, and everyday life as a matter of sheer survival. In turn, it has become a cultural virus, circulating its images, sounds, and attitude throughout the culture and body politic. (shrink)

This paper presents an experimental study investigating artificial grammar learning (AGL) in monolingual and bilingual children, with and without dyslexia, using an original methodology. We administered a serial reaction time (SRT) task, in the form of a modified Simon task, in which the sequence of the stimuli was manipulated according to the rules of a simple Lindenmayer grammar (more specifically, a Fibonacci grammar). By ensuring that the subjects focused on the correct response execution at the motor stage in presence of (...) congruent or incongruent visual stimuli, we could meet the two fundamental criteria for implicit learning: the absence of an intention to learn and the lack of awareness at the level of resulting knowledge. The participants of our studies were four groups of 10-year-old children: 30 Italian monolingual typically developing children, 30 bilingual typically developing children with Italian L2, 24 Italian monolingual dyslexic children and 24 bilingual dyslexic children with Italian L2. Participants were administered the modified Simon task developed according to the rules of the Fibonacci grammar and tested with respect to the implicit learning of three regularities: (i) a red is followed by a blue; (ii) a sequence of two blues is followed by a red and (iii) a blue can be followed either by a red or by a blue. Results clearly support the hypothesis that implicit learning took place, since participants of all groups became increasingly sensitive to the structure of the input, implicitly learning the sequence of the trials and thus appropriately predicting the occurrence of the relevant items, as manifested by faster reaction times in predictable trials. Moreover, group differences were found, with bilinguals being overall faster than monolinguals and dyslexics less accurate than controls. Finally, an advantage of bilingualism in dyslexia was found, with bilingual dyslexics performing consistently better than monolingual dyslexics and, in some conditions, at the level of the two control groups. These results are taken to suggest that bilingualism should be supported also among linguistically impaired individuals. (shrink)

Commonsense Consequentialism is a book about morality, rationality, and the interconnections between the two. In it, Douglas W. Portmore defends a version of consequentialism that both comports with our commonsense moral intuitions and shares with other consequentialist theories the same compelling teleological conception of practical reasons. Broadly construed, consequentialism is the view that an act's deontic status is determined by how its outcome ranks relative to those of the available alternatives on some evaluative ranking. Portmore argues that outcomes should (...) be ranked, not according to their impersonal value, but according to how much reason the relevant agent has to desire that each outcome obtains and that, when outcomes are ranked in this way, we arrive at a version of consequentialism that can better account for our commonsense moral intuitions than even many forms of deontology can. What's more, Portmore argues that we should accept this version of consequentialism, because we should accept both that an agent can be morally required to do only what she has most reason to do and that what she has most reason to do is to perform the act that would produce the outcome that she has most reason to want to obtain.Although the primary aim of the book is to defend a particular moral theory, Portmore defends this theory as part of a coherent whole concerning our commonsense views about the nature and substance of both morality and rationality. Thus, it will be of interest not only to those working on consequentialism and other areas of normative ethics, but also to those working in metaethics. We describe an error type that we call the naturalizing error: an appeal to nature as a self-justified description dictating or limiting our choices in moral, economic, political, and other social contexts. Normative cultural perspectives may be subtly and subconsciously inscribed into purportedly objective descriptions of nature, often with the apparent warrant and authority of science, yet not be fully warranted by a systematic or complete consideration of the evidence. Cognitive processes may contribute further to a failure to notice the (...) lapses in scientific reasoning and justificatory warrant. By articulating this error type at a general level, we hope to raise awareness of this pervasive error type and to facilitate critiques of claims that appeal to what is “natural” as inevitable or unchangeable. Media argumentation is a powerful force in our lives. From political speeches to television commercials to war propaganda, it can effectively mobilize political action, influence the public, and market products. This book presents a new and systematic way of thinking about the influence of mass media in our lives, showing the intersection of media sources with argumentation theory, informal logic, computational theory, and theories of persuasion. Multimorbidity, the presence of multiple health conditions that must be addressed, is a particularly difficult situation in patient management raising issues such as the use of multiple drugs and drug-disease interactions. Clinical Guidelines are evidence-based statements which provide recommendations for specific health conditions but are unfit for the management of multiple co-occurring health situations. To leverage these evidence-based documents, it becomes necessary to combine them. In this paper, using a case example, we explore the use of argumentation schemes to reason (...) and combine evidence-based recommendations from clinical guidelines, expected effects, conflicts stemming from said recommendations, and preferences regarding treatment goals. We compare the results of reasoning using the schemes for practical reasoning and argument from negative consequences in the Carneades Argumentation System with those of ASPIC-G, an extension of the artificial intelligence system ASPIC+. Amphiboly has been widely recognized, starting from the time of Aristotle, as an informal fallacy arising from grammatical ambiguity. This paper applies the profiles of dialogue tool to the fallacy of amphiboly, providing a five-step evidence-based procedure whereby a syntactically ambiguous sentence uttered in a natural language text can be evaluated as committing a fallacy of amphiboly. A user applies the tool to a natural language text by comparing a descriptive graph, representing how the argumentation actually went, to a normative (...) graph, representing how the argumentation should ideally have proceeded. Douglas N. Walton considers the question of whether the conventions of informal conversation can be articulated more precisely than they are at present. Specifically, he addresses the problem of the fallacy of ad hominem argumentation as it occurs in natural settings. Can rules be formulated to determine if criticisms of apparent hypocrisy in an argument are defensible or refutable? Walton suggests that they can, and ultimately defends the thesis that ad hominem reasoning is not fallacious per se. He carries (...) his analysis to the core of action--theoretic reasoning--by examining a number of specimen arguments. As suggested by the title, the conclusion of ad hominem argument is demonstrated to be relative to the arguer's position. In the appendixes of the book, articles by Gerald McAuliffe and Gordon R. In this paper, we argue that a rich phenomenological description of ?sweet tension? is an important step to understanding how and why sport is a meaningful human endeavour. We introduce the phenomenological concepts of intersubjectivity and horizon and elaborate how they inform the study and understanding of human experience. In the process, we establish that intersubjectivity is always embodied, developing and ethically committed. Likewise, we establish that our horizons are experienced from an embodied, developing and ethically committed perspective that serves (...) as the possibility for new intersubjective engagement. What follows is a discussion of the explanatory role of intersubjectivity and horizon in elucidating experiences of sweet tension in and through sport. The phenomenological account of sweet tension provides insights into the significance of our sporting experiences. Indeed, taking phenomenology seriously represents a commitment to descriptively elucidate what makes such experiences of sport significant and why we long for them. Recognising that sweet tension is a form of intersubjective horizon opens up new avenues for addressing ethical issues in sport as well as in crafting well-balanced games. (shrink)

The answer to this question depends on how the reasons that we have for living in various different ways combine and compete. To illustrate, suppose that I've just received a substantial raise. What should I do with the extra money? I have most moral reason to donate it to effective charities but most self-interested reason to spend it on luxuries for myself. Arguments from popular opinion have long been regarded with suspicion, and in most logic textbooks the _ad populum _argument is classified as a fallacy. Douglas Walton now asks whether this negative evaluation is always justified, particularly in a democratic system where decisions are based on majority opinion. In this insightful book, Walton maintains that there is a genuine type of argumentation based on commonly accepted opinions and presumptions that should represent a standard of rational decision-making on important issues, especially (...) those of a personal and political nature. He shows how to judge arguments based on appeals to popular opinion in a more balanced way, identifying eleven subtypes of the _ad populum_ argument and providing a pragmatic method to evaluate each of these types. Walton has examined dozens of logic texts and drawn on a wide range of literature to reveal the many uses and misuses of popular opinion. He contrasts the traditional discussion of _ad populum _in Greek rhetoric with recent textbook treatment, then contrasts these contemporary views with his own dialectical perspective in order to clarify often confused appeals to prejudice and appeals to common knowledge. Although appeal to popular opinion has long been a powerful argumentative tactic, this is the first book to systematically describe and evaluate it as a well-defined type of argument with its own special characteristics. Acupuncture, the traditional Chinese practice of needling to alleviate pain, offers a striking case where scientific accounts in two cultures, East and West, diverge sharply. Yet the Chinese comfortably embrace the apparent ontological incommensurability. Their pragmatic posture resonates with the New Experimentalism in the West--but with some provocative differences. The development of acupuncture in China further suggests general research strategies in the context of discovery. In lieu of an abstract, here is a brief excerpt of the content:Philosophy and Rhetoric 34.2 (2001) 93-112 [Access article in PDF] Enthymemes, Common Knowledge, and Plausible Inference Douglas Walton The study of enthymemes has always been regarded as important in logic, critical thinking, and rhetoric, but too often it is the formal or mechanistic aspect of it that has been in the forefront. This investigation will show that there is a kind of plausibilistic script-based reasoning, of a kind (...) that has mainly been studied in artificial intelligence, that should have a much more important role to play in the study of enthymemes. But then curiously, as will also be shown, this plausibilistic type of reasoning was familiar in the ancient world, to the Sophists, as well as to leading philosophers such as Plato and Aristotle. By linking this ancient notion of plausibility to the modern notion used in computer science, this investigation reveals an important basis for the enthymeme that has a type of logical structure in its own right, but also has an informal aspect.An enthymeme, in current usage, is an argument that has one or more premises, or possibly a conclusion, not explicitly stated in the text, but that needs to have these propositions explicitly stated to extract the complete argument from the text. Sometimes enthymemes are described as arguments with "missing premises." That vocabulary is awkward, however, because the nonexplicit statement that needs to be added can be a conclusion, at least in a minority of cases. To make the exposition below smoother, the term nonexplicit assumption will be used to cover either the case of a nonexplicit premise or that of a nonexplicit conclusion. The problem with enthymemes is that if the nonexplicit assumptions in an argument are supposed to be propositions used by the arguer (as opposed to just the propositions needed to make the argument structurally correct, according to some standard), reasonable people can have differences of opinion on what the nonexplicit assumptions are supposed to be. The problem is that filling in the missing parts of enthymemes depends on interpreting the natural language [End Page 93] in which the argument was put forward to try to determine what the speaker meant to say.The solution to the problem comes through the recognition that enthymemes rest not only on formal (structural) criteria, but also on informal criteria. One of the most important of these informal criteria is something often called "common knowledge" (Govier 1992; Freeman 1995). But as shown below in a set of selected case studies of enthymemes, "common knowledge" is not really a kind of knowledge at all. It is really plausibility, or eikos, something well known in the ancient world and often misleadingly translated as "probability." Curiously, Aristotle's original doctrine of the enthymeme was based on this notion of plausibility. This historical fact has often been a source of puzzlement and confusion, and sometimes it has even been taken to indicate a defect or contradiction in Aristotle's treatment of the enthymeme. However, the goal of this investigation is not primarily historical. It is to work out one of the most important required steps toward a solution to the problem of enthymemes. But to do this, it is necessary to come back to the ancient notion of plausible inference. 1. The problem with enthymemes Once you have any formal theory of inference, like syllogistic, for example, you will be confronted by cases of arguments in everyday discourse that meet all the requirements for a structurally correct inference except that some part or parts, usually a premise or a conclusion, is missing. By "missing" is meant that the proposition in question has not been explicitly stated in the text of discourse, even though it may be clear enough that the speaker (writer) was relying on it, or including it, as part of the argument. The classic example is the following inference: All men are mortal; therefore, Socrates is mortal. To evaluate such an argument, surely some account of the "hidden" or "missing" assumption needs to be taken. Perceptual experience seems to involve distinct intentional and qualitative features. Inasmuch as one can visually perceive that there is a Coke can in front of one, perceptual experience must be intentional. But such experiences seem to differ from paradigmatic intentional states in having introspectible qualitative character. Peacocke argues that a perceptual experience’s qualitative character is determined by intrinsic, nonrepresentational properties. But and also argues that perceptual experiences have nonconceptual representational content in addition to conceptual content and nonrepresentational sensational properties. He (...) thus distinguishes between conceptual, nonrepresentational, and nonconceptual but representational aspects of perceptual experience. I will argue that Peacocke posits too much. Contrary to his arguments, the sensational properties Peacocke claims are nonrepresentational are best construed as representational; they are best explained in terms of their relation to the perceptible properties they enable us to perceive. Since sensational properties are arguably nonconceptual, they are best construed as nonconceptual representational properties. I offer the Homomorphism View of sensory qualities, pioneered by Sellars , as a unified account of qualitative character and nonconceptual sensory representation. According to this view, a sensory quality represents a perceptible stimulus property in virtue of resembling and differing from other sensory qualities in ways parallel to the ways the stimulus property resembles and differs from other perceptible properties. Controversy has arisen of late over the claim that deflationism about truth requires that we explain meaning in terms of something other than truth-conditions. This controversy, it is argued, is due to unclarity as to whether the basic deflationary claim that a sentence and a sentence that attributes truth to it are equivalent in meaning is intended to involve the truth- predicate of the object language for which we develop an account of meaning, or is intended to involve the truth- (...) predicate of the metalanguage in which we develop an account of meaning. The former view is compatible with the truth-conditional theory of meaning for the object language, the latter is incompatible with it. However, the former view is also trivially true; hence we should endorse the claim that any form of deflationism worth being interested in is incompatible with understanding meaning truth-conditionally. This volume of Philosophy, Psychiatry, & Psychology is devoted to questions about the unconscious mind. The philosophical complexities and difficulties associated with the unconscious are many and, despite widespread confusion and disagreement as to the nature of the (...) unconscious mind, it is used as a concept informing psychotherapy. It is therefore not surprising that papers in a special edition on the unconscious might be weighted heavily toward uncovering a justifiable conceptual niche for the unconscious and elaborating on some of the main conceptual connections. Although this makes for a slightly more philosophical edition of PPP than usual, those perhaps less interested in philosophy and more interested in actual psychiatric practice can incorporate the concepts and insights developed in these papers into their practice as they see fit.The three main articles take three quite distinct approaches to the unconscious. Schechtman (2005) addresses the need for a theory of personal identity to incorporate the unconscious and presents one that does so by developing some central Lockian intuitions. Church (2005) investigates whether the kinds of things happening in the unconscious can be explained by cognitive operations not normally associated with consciousness, specifically, spatial structuring of experience. McConnell and Gillett (2005) clarify some of Lacan's ontology of the mind where the language encountered and used by the subject provides the structure for their unconscious.The aim of this introduction is to ask and try to answer a question that logically precedes those raised in the articles in the light of the therapeutic use of the unconscious. When dealing with psychoanalysis or psychoanalytic concepts in an Anglo-American context, the struggle that psychoanalysis has had and continues to have in a psychiatric domain ruled by science is never far from the spotlight. Indeed Hinshelwood (2005) also picks up the importance of this conflict when replying to McConnell and Gillett. It seems to be historically true that the unconscious has fallen out of favor in scientific and psychiatric circles (it is no surprise that psychiatric training is largely based in "hard," that is, biological and biochemical science) particularly over the last 50 years or so. But is the scientific skepticism to be found about the use of the unconscious well-founded? And how does the continued utilization [End Page 1] of the unconscious by the therapist fit into current practice given this skepticism? Psychotherapy and the Unconscious In psychotherapy, the therapist and the client together construct a story that explains why the client is having some form of difficulty in his or her life. The stated aim is to enable the client to overcome this difficulty by gaining an understanding of what has generated it. Doing so may be a first step to dealing with that conflict. For example, an office worker who is scared of the boss and whose life at work is a misery as result may come to think that the boss is a reminder of some threatening figure from childhood and that the reaction is a regression to infantile behavior. Knowing this, the fear of the boss can be revisited—perhaps reconfigured, perhaps overcome—and life may improve. In the process of therapy, the relation of the figure from childhood to the boss is made conscious. But it was still operative before it was made explicit, even though the client did not realize it and some would say that the client's unconscious had somehow buried the memory from childhood or hidden from the client the relation of this memory of a threatening figure to the boss.A description of the content of the unconscious is, then, an intentional description involving the client's thought life, one made to help an individual understand otherwise unintelligible (to that individual) feelings, beliefs, desires, actions, and so on. Subjects' intentions are their normatively structured mental representations of, and attitudes toward, the world (e.g., "He is my boss"; "I am afraid of him"). When philosophers speak of direct perceptual knowledge, they obviously mean to suggest that such knowledge is unmediated ? but unmediated by what? This is where we find evidence of violent disagreement. To clarify matters, I want to identify and briefly describe several important senses of "direct" that have helped shape our understanding of perceptual knowledge. They are (1) "Direct" as Non-Inferential Perception; (2) "Direct" as Unmediating by Objects of Perception; (3) "Direct" as Conceptually Unmediated Perception; (4) "Direct" as Independent Verification (...) of Perceptual Beliefs; and (5) "Direct" as Perception of What is Epistemically Prior.
