Rae Langton and Caroline West famously argued that pornography operates like a language game, in that it introduces certain views about women into the common ground via presupposition accommodation. While this pragmatic model explains how pornography has the potential to change its viewers’ beliefs, it leaves open how pornography changes people’s desires. Our aim in this paper is to show how Langton and West’s discourse theoretic account of pornography can be refined to close this lacuna. Using tools from recent developments (...) in discourse theory, we propose that pornography issues implicit directives, and thereby introduces bouletic components into the discourse. (shrink)

I offer some responses to Prosser’s ‘Experiencing Time’, one of whose goals is to debunk a view of temporal experience somewhat prevalent in the metaphysics literature, which I call ‘Perceptualism’. According to Perceptualism: it is part of the content of perceptual experience that time passes in a metaphysically strong sense: the present has a metaphysically privileged status, and time passes in virtue of changes in which events this ‘objective present’ highlights, and moreover this gives us evidence in favor of strong (...) passage. Prosser argues that perception cannot be sensitive to whether the strong passage obtains, and therefore cannot represent strong passage in a way that gives us evidence of its truth. Although I accept this conclusion, I argue that Prosser’s argument for it is problematic. It threatens to over-generalize to rule out uncontroversial cases of perceptual knowledge, such as our knowledge that we live in a spatial world. Furthermore, a successful argument ruling out perceptual evidence for strong passage would have to give constraints on the theory/observation distinction of a kind not provided by Prosser’s discussion. Public health emergencies expose social injustice and health disparities, resulting in calls to address their structural causes once the acute crisis has passed. The COVID-19 pandemic is highlighting and exacerbating global, national, and regional disparities in relation to the benefits and burdens of undertaking critical basic public health mitigation measures such as physical distancing. In the United States, attempts to address the COVID-19 pandemic are complicated by striking racial, economic, and geographic inequities. These synergistic inequities exist in both urban and (...) rural areas but take on a particular character and impact in areas of rural poverty. Rural areas face a diverse set of structural challenges, including inadequate public health, clinical, and other infrastructure and economic precarity, hampering the ability of communities and individuals to implement mitigation measures. Public health ethics demands that personnel address both the tactical, real-time adjustment of typical mitigation tools to improve their effectiveness among the rural poor as well as the strategic, longer-term structural causes of health and social injustice that continue to disadvantage this population. Where Taber and Lodge view belief polarization to indicate a “partisan motivation,” Lord et al. (1979) believed it to be consistent with a desire for accuracy: A “weak” study articulating an opposing viewpoint might simply sharpen participants' initial belief of the wisdom of their prior beliefs. This polarization, Taber and Lodge show, correlates with political sophistication: The more partisan a participant, the more time spent reading the opinions of the other side—in order to critically refute them. Taber and Lodge attribute (...) such findings to people's personal identification with their beliefs. However, participants may have spent so much time reading opinions of the other side because the arguments are unfamiliar. Further, Lord et al. (1984) were able to induce people to act with “skepticism” toward their own views by simply suggesting that they “consider the other side.”. (shrink)

The structural representation (S-representation) account provides an increasingly popular way of understanding the role and value of representation in cognitive science. Yet critics remain unconvinced that the account has the resources to rescue representationalism. This paper reviews problems faced by the S-representation account. In doing so, it offers a novel taxonomy that divides objections into two broad camps that ought to be disambiguated: ‘conceptual’ and ‘empirical’. It further shows how these objections can be met, bolstering existing responses in the literature (...) with novel solutions, thus strengthening the S-representation account. Finally, this paper suggests that the types of objections identified provide a generalisable taxonomy for a better understanding of any version of anti-representationalism. Thus, this review is of value to the representation debate more broadly. (shrink)

Moral thinking and communication are critical competencies for confronting social dilemmas in a challenging world. We examined these moral competencies in 70 college students and graduates from Taiwan, the United Kingdom, and the United States. Participants were assessed through semi-structured written interviews, Facebook group discussions, and a questionnaire. In this paper, we describe the similarities and differences across cultural groupings in (1) the social issues of greatest importance to the participants; (2) the factors influencing their approaches to thinking about social (...) issues and communicating with others; and (3) the characteristics of their moral functioning in terms of moral awareness, moral judgment, moral discourse, and moral decision-making. The overturn of Roe v. Wade has resulted in fewer rights and resources for people seeking abortion care, particularly in the South. The Hyde Amendment has historically restricted abortion access for those enrolled in Medicaid. We argue here that its guarantees of minimum abortion coverage should be leveraged to offset harms where possible.

The close association of particular races with particular classes invites a means to exhibit disdain for a race via class. Class and race do not simply occupy a list of social problems, because generally, specific races correlate with particular classes. Racism is presently unacceptable, but not classism. We may feel sympathy for the poor, but we do not refrain from disdain. The disdain of the poor centers on Neoclassical economics’ insistence on choice in regards to class. The language of choice (...) does not circumscribe race. Michel Foucault’s work illustrates that the persistent correlation of race and class is not merely sociological but conceptual. Such close associations of particular races with particular classes serve as a means to generate essentialisms that express racism through classism. (shrink)

This reconsideration of the descriptive and normative components of my earlier comparisons of Mencius and Aquinas suggests that the strengths of Aquinas’s account were highlighted while some of his shortcomings and the corresponding strengths in Mencius were missing. This is made clear by considering the treatment of their respective ideas about optimal human fulfillment and even clearer by considering their understanding of the relationship between theoretical and literary accounts of that fulfillment. The third subject, their different treatments of people’s failure (...) to attain fulfillment, is more complicated, however, and involves a set of truly vexing issues. (shrink)

This paper was motivated by what we see as an inconsistency between a 1988 paper by Brennan and Buchanan expressing concern that public choice might erode public confidence in government and previous work by Buchanan, in particular Buchanan. The one advantage we saw with the 1988 paper was that it, all by itself, is all one needs to dismiss MacLean’s depiction of Buchanan as an ideologically rigid extremist. We also found the same inconsistency occurring simultaneously in Buchanan’s writing in 1979. (...) Yet, based on Wagner, we conclude that such inconsistencies may reflect a strength in Buchanan’s scholarship. (shrink)

The study of illiberal constitutions has recently generated enormous scholarly interests. Few, however, have focused on whether democracies may still embrace constitutionalism mixed with illiberal elements. This article explores mixed constitutions of South Korea and Taiwan, the two democracies with vibrant civil societies in East Asia. Three distinctive features in both constitutions have demonstrated illiberal elements, including duty clauses imposed upon citizens, directives requiring the State to enact laws to fulfill the goals of governance, and constitutional cultures that exhibit high (...) deference to political elites based on the Confucian tradition. This article further examines the impacts of such mixed constitutions on three challenging issues: managing pandemic crisis, applying artificial intelligence, and combating fake news. This article finds mixed features of illiberal and democratic constitutions in the two countries by giving their governments more space in managing urgent crises, showing higher deference to experts who are generally trusted by the public, and making compromises to individual rights for greater public good. However, this does not imply that the government is not made democratically accountable, or rights and freedoms are not asserted or valued by individuals. To the contrary, nongovernmental organizations and courts in the two countries continue to act as a counterbalancing force, challenging the government’s policies and decisions if not reasonably balanced, weakening the tendency of power concentration that has been seen in other countries where democratic backsliding or authoritarian governance is gradually revived. Social enterprises, promising organizations for solving societal problems with innovative approaches, rely upon their members’ active roles for workplace innovation. However, we still have a limited understanding about how social enterprises can foster employees’ endeavors for innovation. By focusing on employee learning and innovative behavior, we investigate the influences of perceived social mission, value congruence, and human resource management (HRM) practices in social enterprises. We conducted two complementary studies to answer our research questions. In Study 1, with a survey of (...) 369 employees from 68 social enterprises, we examined a multilevel moderated mediation model with firm‐level and individual‐level data. We found that perceived social mission promoted learning and innovative behavior by increasing value congruence, and that commitment‐based HRM practices enhanced the overall process from mission to employee efforts for innovation. In Study 2, with 300 daily surveys from 60 employees participating in an experience sampling study, we found that those with high‐value congruence showed a significantly more stable pattern with less variance in innovative behavior than in learning behavior. Our study adds novel implications to the underdeveloped literature on employee innovation and HRM in social enterprises by uncovering the positive effects of social mission and value facets for boosting learning and innovative behaviors. Our research also suggests that social enterprises should benefit from pursuing and emphasizing the social mission and commitment‐based HRM bundle together, which will promote the prosperity and well‐being of business and society. Sexual and racial differences matter. Indeed, facile assumptions of sameness born from the desire to claim universal truths persist as a dangerous tendency. Difference matters and we have yet to fully understand what difference means. But claims of absolute difference have a history of justifying colonization and recently can justify slipping into indifference about people with different embodiment. In philosophy of race’s emphasis that race has ontological significance, such emphasis on difference can leave differently racialized and sexualized people living in (...) isolation from each other. Absolute sameness and absolute difference are not true to phenomenological experience. Philosophy has long debated the relation between identity and difference, from its metaphysical origin in the relation between monism and dualism, to Hegel’s formulation of a dialectical relation between identity and difference. But the idea of an identity-in-difference explores a more immediate relation between the two. Maurice Merleau-Ponty’s work explores the idea of an identity-in-difference throughout his phenomenology in both its epistemic and ontologic senses. This paper explores at least four instantiations of the relation of identity-in-difference in Merleau-Ponty’s work to argue for upholding the value of both difference and sameness in developing our understanding of race. Barbour, Hawking, Misner and others have argued that time cannot play an essential role in the formulation of a quantum theory of cosmology. Here we present three challenges to their arguments, taken from works and remarks by Kauffman, Markopoulou and Newman. These can be seen to be based on two principles: that every observable in a theory of cosmology should be measurable by some observer inside the universe, and all mathematical constructions necessary to the formulation of the theory should be (...) realizable in a finite time by a computer that fits inside the universe. We also briefly discuss how a cosmological theory could be formulated so it is in agreement with these principles. (shrink)

The Organization of Economic Co-operation and Development’s (OECD) global governance of education has been gradually increasing. Its field of interest is currently expanding from educational evaluation through the Program for International Student Assessment (PISA) to curriculum reform through the Education 2030 project. Here, it is interesting to note that the nature of the terms the OECD has been creating reveals a ‘humanistic turn’. This shows up well in the frequent occurrence of terms such as ‘well-being’, ‘attitudes and values’, ‘inclusiveness’, ‘responsibility’, (...) and ‘sustainability’ in the ongoing Education 2030 project. Perhaps this new humanistic discourse increases the likelihood of the smooth adoption of the OECD’s proposed curriculum redesign in more countries. If the OECD’s new discourse captures and transforms contemporary people’s ways of thought and practice about education, then this is related to the problem of colonialism in our era. It is also worth noting that language plays a vital role in colonization. In particular, the need for translation between different languages serves as a useful means for colonization. Conversely, it is also seen as having a potential decolonizing power. In this context, I would like to examine the new language the OECD has adopted, specifically regarding student experience and the nature of knowing. Next, I shall attempt to criticize the underlying educational assumptions in the OECD’s pronouncements. Following this, I shall explore how the OECD’s new discourse has been translated in South Korea, taking this as an example of wider experience in the East Asian context and possibly elsewhere. Finally, I shall conclude by considering the direction of curriculum decolonization in terms of translation. (shrink)

In recent work, Christopher Peacocke has argued for a kind of realism (or anti-reductionism) about magnitudes such as temperature and spatial distance. Peacocke’s argument is that magnitudes are an ineliminable commitment of scientific and everyday explanations (including high-level explanations), and that they are the natural candidates for semantic values of our ordinary magnitude talk, and for contents of our mental states. I critique these arguments, in particular focusing on whether the realist has a satisfactory account of how high-level magnitude facts (...) are grounded in lower-level facts. I argue that a less realist (i.e., more reductionist approach) is preferable, or at least viable. I also aim to substantially clarify what is at stake in the debate. (shrink)

Gertler argues that, in some introspective judgments about experience, phenomenal reality intersects with one's grasp of that reality to the effect that one can have knowledge by acquaintance. This new version of the acquaintance theory depends on the idea that some introspective judgments about experience can be justified by the fact that the phenomenal property of an experience is a component of the introspective judgment about the experience. The goal of this paper is to show that even this most promising (...) version of the acquaintance theory is not successful. For this goal, in particular, I argue that even if we grant that, in the relevant cases, the phenomenal property of an experience is a component of an introspective judgment, this fact can hardly play the epistemic role that Gertler envisions. I establish this on the basis of two internalist requirements for reasons, namely, the evaluability condition and the endorsement condition. On the former condition, a reason for justifying a judgment must be the kind of thing that can be evaluated as correct or incorrect. And on the latter condition, having a reason for justifying a judgment requires that the subject endorse the reason as correct. (shrink)

Trusting relationships are both valuable and risky. Where the risks are high and the fears of betrayal are also high, it might seem rational to try to mitigate the risks, while still enjoying the benefits of the trusting relationship, by forming a contingency plan. A contingency plan—in the sense I am interested in—involves contingent punishments for defection, which are primarily meant to encourage the trusted partner to act trustworthily. I argue, however, that such contingency plans suffer from an internal tension (...) wherein the contingency planner both seeks and undermines a particular level (or kind) of trust. There are two problems in particular, either of which is sufficient to undermine trusting relationships: one, the planner fails to see the trusted partner as sincerely engaged in the trusting relationship, and two, the planner separates herself out from the trusting relationship by seeing her flourishing as separate from her partner’s (or, even worse, as dependent on her partner’s harm). Continency plans, then, are not just about the future; they cast a moral shadow on what we are doing now. (shrink)

The “social-political-hierarchical” qualifications have long been identified as the essential features of the Confucian golden rule. This essay challenges this prevailing characterization by revealing the relation and differences between Confucius’ original shu 恕 and a series of post-Confucius reformulations in ancient Confucianism. Specifically, the premise of equality, which underlies Confucius’ formulation of shu in correlation with ren 仁, rendered shu incompatible with asymmetrical relationships. Besides the advantage of overcoming this limitation by adapting the golden rule structure of shu to specified (...) asymmetrical relationships, the post-Confucius formula, especially “the measuring square” in the Great Learning, was devised to guide one to infer universalizable rules of conduct for various roles in diverse relationships. On this basis, I demonstrate a pivotal shift in the golden rule practice of ancient Confucianism—a shift of focus from its correlation with ren to its conformity with li 禮 as the system of rules of conduct and the principle of “discriminations.”. I reply to Steven Jensen’s article, “Phoenix Rising from the Ashes: Recent Attempts to Revive New Natural Law Action Theory,” which appeared in this journal in 2020. His arguments helpfully clarify where the disagreements between the strict and broad views of intention lie but, I argue, fail to refute the arguments and explanations he criticizes. I argue he misinterprets the strict view’s reference to necessity in its criterion for what is intended. I also argue against what he labels as the (...) “identity thesis,” and against his attempt to show that the strict view (or New Natural Law theory of action) leads to the absurdity that most acts of adultery are not actually adultery.
