La crisis socio-sanitaria generada por la proliferación acelerada del Covid-19 está produciendo una recentralización del estado en la sociedad mundial. El mismo movimiento está recreando dos formas estatales novedosas: la del estado protector y la del estado agresor. La expansión de la función protectora, a su vez, está co-produciendo en tiempo récord una nueva legitimidad política de excepción. Esta última tiende a alterar en algún grado las dinámicas de legitimación de los órdenes estatales que venían progresando de modo tendencial en (...) la gran mayoría de las sociedades de occidente desde la década de 1980. A partir del empleo de fuentes secundarias, el presente trabajo se propone avanzar en el análisis sociológico de este proceso general de transformación del estado y de la legitimidad política en la presente coyuntura, tanto en América Latina como en el conjunto de la sociedad mundial. En el presente artículo analizo la principal fórmula del poder de Manuel Castells asociada con su noción de flujo, y una de las piezas centrales de su teoría sociológica del poder a partir de 1986: el vínculo entre flujos del poder y poder de los flujos. Se trata de una forma conceptual no definida por el autor, llamativamente críptica e inasible, a la vez que absolutamente clave para la comprensión de su visión contemporánea del poder y del Estado. El estudio (...) permite descubrir, entre otros aspectos, la relación que finalmente propone el sociólogo español entre economía y política. De tal vínculo se desprende una versión en extremo radical de la tesis del declive irreversible del poder del Estado-nación, aún vigente en la teoría social contemporánea pase a los cambios sociopolíticos registrados en América Latina en los últimos años. Closed-loop administration of propofol for the control of hypnosis in anesthesia has evidenced an outperformance when comparing it with manual administration in terms of drug consumption and post-operative recovery of patients. Unlike other systems, the success of this strategy lies on the availability of a feedback variable capable of quantifying the current hypnotic state of the patient. However, the appearance of anomalies during the anesthetic process may result in inaccurate actions of the automatic controller. These anomalies may come from the (...) monitors, the syringe pumps, the actions of the surgeon or even from alterations in patients. This could produce adverse side effects that can affect the patient postoperative and reduce the safety of the patient in the operating room. Then, the use of anomaly detection techniques plays a significant role to avoid this undesirable situations. This work assesses different one-class intelligent techniques to detect anomalies in patients undergoing general anesthesia. Due to the difficulty of obtaining real data from anomaly situations, artificial outliers are generated to check the performance of each classifier. The final model presents successful performance. La politique et l’histoire de Louis Althusser con el fin de señalar el modo en el que las primeras menciones a Spinoza en la obra de Althusser se producen junto a Montesquieu y reflexionar sobre el sentido crítico de esas menciones. Con un estudio como este quisiera, primero y en general, señalar la importancia no siempre del todo reconocida que tuvo Montesquieu en el desarrollo teórico de Althusser. Durante la Edad Moderna y Contemporánea numerosos retos se han abordado, de manera ideal o real, desde una perspectiva cosmopolita. El descubrimiento de América, las guerras entre Estados europeos en el siglo XVIII o la Segunda Guerra Mundial, son ejemplos de ello. This article investigates the notion that there is an asymmetry in openness between the past and the future. The following questions are considered: How exactly is this asymmetry in openness to be understood? What is the relation between an open future and various ontological views about the future? Is an open future a branching future? What is the relation (...) between an open future and the question of whether contingent statements about the future are true or false? Putting feelings into words, or “affect labeling,” can attenuate our emotional experiences. However, unlike explicit emotion regulation techniques, affect labeling may not even feel like a regulatory process as it occurs. Nevertheless, research investigating affect labeling has found it produces a pattern of effects like those seen during explicit emotion regulation, suggesting affect labeling is a form of implicit emotion regulation. In this review, we will outline research on affect labeling, comparing it to reappraisal, a form of explicit emotion regulation, (...) along four major domains of effects—experiential, autonomic, neural, and behavioral—that establish it as a form of implicit emotion regulation. This review will then speculate on possible mechanisms driving affect labeling effects and other remaining unanswered questions. (shrink)

Will it rain tomorrow? Will there be a sea battle tomorrow? Will my death be painful? Wondering about the future plays a central role in our cognitive lives. It is integral to our inquiries, our planning, our hopes, and our fears. The aim of this paper is to consider various accounts of future contingents and the implications that they have for wondering about the future. I argue that reflecting on the nature of wondering about the future supports an Ockhamist account (...) of future contingents according to which many of them are true. Alternative accounts which maintain that no future contingents are true, either by claiming that they are all false or by claiming that they are neither true nor false, face difficulties concerning why it is appropriate to wonder about them. Reflecting on wondering in general, and wondering about the future in particular, suggests that in wondering how the future will go, we implicitly assume that there is a determinate fact of the matter. After presenting an attractive account of interrogative attitudes that has been recently proposed by Jane Friedman and outlining some norms governing wondering, I argue that all accounts of future contingents except Ockhamism face difficulties concerning why it is appropriate to wonder about them. Input/output logics are abstract structures designed to represent conditional obligations and goals. In this paper we use them to study conditional permission. This perspective provides a clear separation of the familiar notion of negative permission from the more elusive one of positive permission. Moreover, it reveals that there are at least two kinds of positive permission. Although indistinguishable in the unconditional case, they are quite different in conditional contexts. One of them, which we call static positive permission, guides the citizen (...) and law enforcement authorities in the assessment of specific actions under current norms, and it behaves like a weakened obligation. Another, which we call dynamic positive permission, guides the legislator. It describes the limits on the prohibitions that may be introduced into a code, and under suitable conditions behaves like a strengthened negative permission. (shrink)

In Nothing to Come, Fabrice Correia and Sven Rosenkranz provide a sophisticated, compelling, and thoroughly defended account of the growing block theory. This note critically evaluates two aspects of this account. First, it evaluates Correia and Rosenkranz’s attempt at providing a grounding principle for future truths and argues that this principle fails to make progress in explaining why future truths are true. Second, it evaluates Correia and Rosenkranz’s construal of the open future arguing that the asymmetry in openness with respect (...) to the past and future is not plausibly understood in terms of determinism and indeterminism, and in the final section, it evaluates their claim that a growing block theorist is able to maintain that the future is open in a stronger sense than the block theorist. This chapter provides a critical overview of various influential accounts of de se attitudes including those proposed by Frege, Lewis and Perry. It also addresses the charge that there is nothing distinctive about de se attitudes. The second half outlines a widely accepted and influential model of communication and various complications that arise in applying this model to the communication of de se thoughts. The final section provides an overview of the papers in this volume.

La Doctrina penal contemporánea recurre al principio de ultima ratio para satisfacer la tarea principal de reducir al máximo la arbitrariedad del Derecho penal, pues a través de su significado, la legitimidad del delito y de la pena se somete a la condición de la inexistencia axiológica y empírica de otros recursos jurídicos menos drásticos para solventar idóneamente el conflicto que genera su apertura. No obstante, la deriva punitivista en que ha degenerado la necesaria expansión del Derecho penal en la (...) sociedad del riesgo, pone en duda su verdadera capacidad limitadora, especialmente por su escasa vinculación a los poderes públicos. Pero nada más lejos de la realidad, el desarrollo actual de la Dogmática de los Derechos Fundamentales permite a la Doctrina penal afirmar que, en el Estado constitucional, el Derecho penal mínimo es a su vez el Derecho penal máximo permitido por la Constitución. In a previous paper we developed a general theory of input/output logics. These are operations resembling inference, but where inputs need not be included among outputs, and outputs need not be reusable as inputs. In the present paper we study what happens when they are constrained to render output consistent with input. This is of interest for deontic logic, where it provides a manner of handling contrary-to-duty obligations. Our procedure is to constrain the set of generators of the input/output system, (...) considering only the maximal subsets that do not yield output conflicting with a given input. When inputs are authorised to reappear as outputs, both maxichoice revision in the sense of Alchourr6n/Makinson and the default logic of Poole emerge as special cases, and there is a close relation with Reiter default logic. However, our focus is on the general case where inputs need not be outputs. We show in what contexts the consistency of input with output may be reduced to its consistency with a truth-functional combination of components of generators, and under what conditions constrained output may be obtained by a derivation that is constrained at every step. In this paper I consider two strategies for providing tenseless truth-conditions for tensed sentences: the token-reflexive theory and the date theory. Both theories have faced a number of objections by prominent A-theorists such as Quentin Smith and William Lane Craig. Traditionally, these two theories have been viewed as rival methods for providing truth-conditions for tensed sentences. I argue that the debate over whether the token-reflexive theory or the date theory is true has arisen from a failure to distinguish between conditions (...) for the truth of tensed tokens and conditions for the truth of propositions expressed by tensed tokens. I demonstrate that there is a true formulation of the token-reflexive theory that provides necessary and sufficient conditions for the truth of tensed tokens, and there is a true formulation of the date theory that provides necessary and sufficient conditions for the truth of propositions expressed by tensed tokens. I argue that once the views are properly formulated, the A-theorist’s objections fail to make their mark. However, I conclude by claiming that even though there is a true formulation of the token-reflexive theory and a true formulation of the date theory, the New B-theory nonetheless fails to provide a complete account of the truth and falsity of tensed sentences. I consider whether the self-ascription theory can succeed in providing a tenseless (B-theoretic) account of tensed belief and timely action. I evaluate an argument given by William Lane Craig for the conclusion that the self-ascription account of tensed belief entails a tensed theory (A-theory) of time. I claim that how one formulates the selfascription account of tensed belief depends upon whether one takes the subject of selfascription to be a momentary person-stage or an enduring person. I provide two different formulations (...) of the self-ascription account of tensed belief, one that is compatible with a perdurantist account of persons and the other that is compatible with an endurantist account of persons. I argue that a self-ascription account of tensed beliefs for enduring subjects most plausibly involves the self-ascription of relations rather than properties. I argue that whether one takes the subject of self-ascription to be a momentary personstage or an enduring person, the self-ascription theory provides a plausible B-theoretic account of how tensed belief and timely action are possible. The number of women occupying male-dominated blue-collar jobs continues to be very low. This study examines segregation in the blue-collar trades, taking into consideration both structural and individual factors. Using nationally representative data for 25 countries, the study shows that segregation in the blue-collar sector does not vary with the strength of vocational education and training programs. At the individual level, findings reveal higher degrees of social reproduction among working-class families, but parental background alone does not fully account for the (...) gender composition of the sector in which children end up working. Overall, the findings point to the existence of a socializing mechanism that entrenches horizontal segregation in the blue-collar sector. The study indicates that to reduce segregation in the blue-collar fields, policies must address this prior mechanism, both at the structural and individual level. (shrink)

When do objects at different times compose a further object? This is the question of diachronic composition. The universalist answers, ‘under any conditions whatsoever’. Others argue for restrictions on diachronic composition: composition occurs only when certain conditions are met. Recently, some philosophers have argued that restrictions on diachronic compositions are motivated by our best physical theories. In Persistence and Spacetime and elsewhere, Yuri Balashov argues that diachronic compositions are restricted in terms of causal connections between object stages. In a recent (...) article, Nikk Effingham argues that the standard objections to views that endorse restrictions on composition do not apply to a view that restricts composition according to compliance with the laws of nature. On the face of it, such restrictions on diachronic composition preserve our common-sense ontology while eliminating from it scientifically revisionary objects that travel faster than the speed of light. I argue that these attempts to restrict diachronic composition by appealing to either causal or nomological constraints face insurmountable difficulties within the context of special relativity. This paper takes the dichotomy between “exclusive” and “inclusive” positivism and applies it by analogy to natural-law theories. With John Finnis, and with Beyleved and Brownsword, we have examples of “exclusive natural-law theory,” on which approach the law is valid only if its content satisfies a normative monological moral theory. The discourse theories of Alexy and Habermas are seen instead as “inclusive natural-law theories,” in which the positive law is a constitutive moment in that it identifies moral rules and specifies (...) their meaning. The article argues that inclusive theories of natural law are better suited to expressing an authentic “republican” attitude.*In the seed of the city of the just, a malignant seed is hidden, in its turn: the certainty and pride of being in the right. Formal arguments are often represented by pairs, but in this paper we consider normative arguments represented by sequences of triples, where constitutive norms derive institutional facts from brute facts, and regulative norms derive deontic facts like obligations and permissions from institutional facts. The institutional facts may be seen as the reasons explaining or warranting the deontic obligations and permissions, and therefore they can be attacked by other normative arguments too. We represent different aspects of normative reasoning by different kinds of (...) consistency checks among these triples, and we use formal argumentation theory to resolve conflicts among such normative arguments. In particular, we introduce various requirements for arguing about norms concerning violations, contrary-to-duty obligations, dilemmas, conflict resolution and different kinds of norms, and we introduce a formal argumentation theory satisfying the requirements. In order to illustrate our framework, we introduce a running example based on university regulations for prospective and actual students. (shrink)

This paper embraces the view that we have substantial knowledge of the future and investigates how such knowledge fundamentally differs from knowledge of the past and present. I argue for a new source of context-sensitivity with respect to knowledge attributions arising from presuppositions about reliable belief-forming processes. This context sensitivity has important consequences for knowledge of the future, as well as the appropriateness of assertions about the future. I argue that not only is knowledge of future events typically brought about (...) by fundamentally different processes from those that bring about knowledge of past events, that this is the case is often presupposed in attributing knowledge. I argue that this new source of context sensitivity naturally extends to explaining the recent puzzle of `easy foreknowledge'. (shrink)

The work of Anthony J. Steinbock on emotions―particularly moral emotions―and on religious experience is closely related to a methodological claim. This claim is that the concepts of “experience” and “manifestation” should be understood in a broader manner than that of classical phenomenology, particularly Edmund Husserl’s phenomenology. In this paper, I examine the way in which Steinbock understands and conceptualizes the kind of givenness to which he refers with the notion of “vertical experience”. I focus on his claim that vertical experiences (...) are irreducible to the kind of experiences that can be described in terms of what he calls “provocation”, “presentation” and the “noesis-noema structure”. Even though I make a criticism of his assertion that the latter implies that they should not be understood as forms of givenness founded on the above-mentioned structure, I agree with some major implications that he draws from them. In the last part of the paper, I discuss his suggestion that the Husserlian conceptualization of emotional givenness should be revised to set forward their structure in terms of what he calls “evocation” and try to give additional reasons, drawn from Husserl himself, to support this claim. The paper comes concludes by stressing the relevance of Steinbock’s analyses concerning what he calls “idolatry”. I argue that his analyses of attitudes that negate the vertical dimension of experience have far reaching implications that go beyond the field of philosophy of religion and open new, promising paths for phenomenological research on social and moral problems. In this paper, we introduce the methodology and techniques of meta-argumentation to model argumentation. The methodology of meta-argumentation instantiates Dung’s abstract argumentation theory with an extended argumentation theory, and is thus based on a combination of the methodology of instantiating abstract arguments, and the methodology of extending Dung’s basic argumentation frameworks with other relations among abstract arguments. The technique of meta-argumentation applies Dung’s theory of abstract argumentation to itself, by instantiating Dung’s abstract arguments with meta-arguments using a technique called flattening. (...) We characterize the domain of instantiation using a representation technique based on soundness and completeness. The object of this research is gentleness, a construct maybe not treated enough in the literature, but just in the area of the so called Positive Psychology. And precisely from his representative Martin Seligman, the inspiration for the construction of a questionnaire and of a specific hypothesis has been born, including the use of a precise terminology. In general terms, maybe the most interesting result lies in the fact of having found a correlation between the various items, therefore between the (...) various constructs, in accordance with the idea of gentleness proposed as a synergy of “quality”. This idea has also been supported from recent research in which has emerged a very tight bond between optimism and a particular character trait that is extroversion. Being placed at a higher, transcendental level, the “gift of oneself” could become the “jump of quality” to fulfil ourselves in the relation with the other. (shrink)

There are different ways in which imaginings can involve the first-person. I can imagine skiing down a mountain, looking down the slope, the wind whipping me in the face. I can also imagine myself skiing down a mountain from the outside, adopting the point of view of a spectator watching myself fly down the mountain. I can also imagine that I am someone else entirely, say Angela Merkel, skiing down a mountain. In this paper I develop and defend a new (...) account of the content of first-person imaginings. I first look at two existing accounts, one proposed by Francois Recanati (2007a, 2007b) and the other proposed by Dilip Ninan (2008), and I argue that they lack the resources to model the rich and distinct types of first-person imaginings that we can have. I then present and defend a new account that reconstrues the imagining from the inside vs. imagining from the outside distinction and can accommodate the various ways in which imaginings involve the first-person. Law is traditionally related to the practice of command and hierarchy. It seems that a legal rule should immediately establish a relation between a superior and an inferior. This hierarchical and authoritharian view might however be challenged once the phenomenology of the rule is considered from the internal point of view, that is, from the stance of those that can be said to “use” rather than to “suffer” the rules themselves. A practice oriented approach could in this way open up (...) a more liberal, and also somehow less parochial and ideological, road for legal theory. This is – it is argued in the paper – the programme, or better, the promise we can find in Herbert Hart’s main work, The Concept of Law. The article tries to render this promise more transparent while, nonetheless, not eschewing the blind sides of its narrative and argumentative strategy. (shrink)

In this dissertation I provide a tenseless account of tensed sentences and tensed belief. I begin by distinguishing tensed theories of time from tenseless theories of time. Tensed theories of time hold that there is a time that is objectively present, and that the moment that is objectively present changes from one moment to the next. I reject tensed theories of time. I deny that there is a time that is objectively present that changes from one moment to the next. (...) Instead, time is in many ways analogous to space and 'now' is in many ways analogous to 'here'. Just as there is no one location that is objectively here, there is no one moment that is objectively now. Nothing metaphysically distinguishes the present moment from past and future moments. ^ There are two major challenges facing the tenseless theory of time. The first challenge is: can a tenseless theory of time provide a plausible account of the truth-conditions for tensed sentences? Tensed sentences such as 'The meeting is now!' provide a prima facie reason in favor of irreducibly tensed properties: the sentence is true if and only if the meeting has the tensed property of being now. I examine existing attempts by tenseless theorists for providing tenseless truth-conditions for tensed sentences. I argue that they are unable to provide a complete account of what makes tensed sentences true. I formulate and defend a new tenseless account of the truth-conditions for tensed sentences, the type-context theory, which makes use of David Kaplan's theory of indexicals. ^ The second challenge facing the tenseless theory of time is: can a tenseless theory of time provide a plausible account of our tensed psychological attitudes? Most of our psychological attitudes such as belief, desire, relief, regret and anticipation are irreducibly tensed: we cannot adequate describe such attitudes without appealing to tensed language. I do not take relief in the tenseless fact that I got my wisdom teeth out in 1998. I take relief in the tensed fact that my wisdom teeth were extracted in the past. I do not run to the bus stop merely because I believe that the bus arrives at 8:45. I run to the bus stop because I believe that the bus is arriving now. How can the tenseless theory of time explain the central role that tense plays in our psychological attitudes? I claim that the objects of tensed beliefs are properties. The account I defend is a version of the self-ascription accounts defended by Roderick Chisholm and David Lewis. Diagnosis theory reasons about incomplete knowledge and only considers the past. It distinguishes between violations and non-violations. Qualitative decision theory reasons about decision variables and considers the future. It distinguishes between fulfilled goals and unfulfilled goals. In this paper we formalize normative diagnoses and decisions in the special purpose formalism DIO2 as well as in extensions of the preference-based deontic logic PDL. The DIagnostic and DEcision-theoretic framework for DEontic reasoning DIO2 formalizes reasoning about violations and fulfillments, and is used to (...) characterize the distinction between normative diagnosis theory and decision theory. The extension of the preference-based deontic logic PDL shows how normative diagnostic and decision-theoretic reasoning — i.e. reasoning about violations and fulfillments — can be formalized as an extension of deontic reasoning. En las pocas ocasiones en que Kant aborda el tema de la verdad, lo suele hacer en función de los problemas implicados en la definición nominal de verdad y en la búsqueda de un criterio de verdad. El objetivo de este trabajo es ofrecer una visión sinóptica del modo en que Kant plantea estas dos cuestiones. En la primera sección del trabajo se aborda el tema de la definición de la verdad. Primero explico qué es una definición y qué implica (...) esto para el caso de la verdad. Tras esto, expongo las consecuencias y problemas que Kant extrae al respecto. En la segunda sección del trabajo se desarrolla el tema del criterio de verdad. Para comenzar expongo las expectativas de Kant respecto de dicho criterio y los límites con que se encuentra. Tras esto ofrezco una clasificación y explicación de los criterios de verdad que menciona a lo largo de su obra. (shrink)
