慶応義塾大学法学部のゼミナール「伊東乾民事訴訟法研究会」の卒業生の会「乾会」による論文集。今回はテーマを民事訴訟法に限ることなく、現在関心を持っている法律分野について執筆した。.

Reinforcement learning is very effective for robot learning. Because it does not need priori knowledge and has higher capability of reactive and adaptive behaviors. In our previous works, we proposed new reinforcement learning algorithm: “Q-learning with Dynamic Structuring of Exploration Space Based on Genetic Algorithm (QDSEGA)”. It is designed for complicated systems with large action-state space like a robot with many redundant degrees of freedom. And we applied it to 50 link manipulator and effective behavior is acquired. However optimality and (...) fault tolerance of the proposed algorithm were not considered and to demonstrate effectiveness of the proposed algorithm other applications are necessary. Acquiring of locomotion patterns by a multi-legged robot is a very interesting problem. As it has many redundant degrees of freedom, application of usual reinforcement learning is difficult and an optimal locomotion has not been acquired using previous reinforcement learning algorithm. And the redundancy of the robot is effective to the fault tolerance and various locomotion patterns can be acquired for adapting the faults of the legs. In this paper, we applied QDSEGA to acquiring of locomotion pattern by the multi-legged robot and considered the optimality and fault tolerance. Effective behavior has been obtained by using our proposed algorithm. (shrink)

For a theory T in L, T σ is the theory of the models of T with an automorphism σ. If T is an unstable model complete theory without the independence property, then T σ has no model companion. Let T be a strongly minimal theory with quantifier elimination. We show that the class of existentially closed models of T{“σ is an automorphism”} is an elementary class if and only if T has the definable multiplicity property, as long as T is a finite cover of a strongly minimal theory which does have the definable multiplicity property. We obtain cleaner results working with several automorphisms, and prove: the class of existentially closed models of T{“σi is an automorphism”: i=1,2} is (...) an elementary class if and only if T has the definable multiplicity property. The applicability of the existing reinforcement learning algorithms are effective for simple tasks with relatively small action-state space. In this paper, we propose a new reinforcement learning algorithm: “Q-learning with Dynamic Structuring of Exploration Space (...) Based on Genetic Algorithm ”. The algorithm is applicable to systems with high dimensional action and interior state spaces, for example a robot with many redundant degrees of freedom. To demonstrate the effectiveness of the proposed algorithm simulations of obstacle avoidance by a 50 links manipulator have been carried out. It is shown that effective behavior can be learned by using the proposed algorithm. (shrink)

The target article offers a game-theoretical analysis of primitive intergroup aggression (i.e., raiding) and discusses difficulties in achieving peace. We argue the analysis does not capture the actual strategy space, missing out “do-nothing.” Experimental evidence robustly shows people prefer doing nothing against out-group members over cooperating with/attacking them. Thus, the target article overestimates the likelihood of intergroup aggression.

The aim of this article is to examine the theory of “self-affection” in the Transcendental Deduction of the Categories in the second edition of Kant's Critique of Pure Reason. I propose that the self-affection, identified with transcendental synthesis of imagination, should be considered as a condition of all reception of the manifold of intuition in the spatio-temporal order. In other words, spontaneity of the subject is required for the reception of materials for cognition. Analyzing some interpretations on Kant's notions such (...) as temporality, inner sense and synthesis, I try to show the necessity to avoid supposing materials that would be given independently of spontaneity and regarded as antecedent conditions of self-affection. This paper re-envisions the personhood of severely disabled children, who are often excluded from the category of human beings in the academic literature due to their perceived lack of mental faculties, based on Japanese philosopher Watsuji Tetsuro’s concept of human beings. It begins with Carl Elliott’s claim that personhood should be used as a thick ethical concept. This concept has two features. First, it represents a fusion of fact and value. Second, it is embedded in our rich and culturally specific (...) forms of life. This paper suggests that Watsuji’s concept of ningen also has these features. Watsuji criticizes how Western ethicists take individual consciousness or will as their starting point for determining personhood. Instead, he argues that neither a subject nor a community exists as an entity in itself, but that the relationality between them is essential to their identity and that our communication is embedded within rich and social contexts. Through his etymological study of Japanese word ari, Watsuji points out that in making statements, one both discloses the world and becomes aware of the attitude one should take toward other beings. Some commentators, such as Sakabe Megumi, have suggested that such self-awareness entails the transformation of our sense of relationality. This paper leverages Watsuji’s concept of ningen to re-envision the relationship between caregivers and severely disabled children as relationality-based and therefore open to complex and rich communication. After the publication of Strawson’s “The Bounds of Sense”, the Transcendental Deduction in Kant’s Critique of Pure Reason has been widely regarded as a proof of the objectivity of knowledge as a condition of unity of self-consciousness. Nevertheless, many interpreters accept that there are passages which cannot be easily integrated into such a strategy. The Transcendental Deduction in the second edition of Kant’s Critique of Pure Reason is divided in two parts. Nevertheless, the role of the second half is not immediately clear. This article intends to examine the argument presented in the second half after clarifying its purpose. Based on this approach, we sustain an interpretation according to which Kant tries to establish the validity of categories for all intuition given through sensibility. This article deals with Kant’s intentions in adding § 12 of the second edition of the Critique of Pure Reason. Here, Kant remarks on the so-called transcendentals (unum, verum, bonum) in the metaphysical or ontological tradition. This article focuses on their trans-categorial character to clarify their role in the system formation of Kant’s three critiques. In order to clarify Kant’s difficult terminology in § 12, fragments from his reflections and transcripts of his lectures are analyzed. Furthermore, an examination of Kant’s (...) references to qualitative unity, plurality, and perfection reveals that these logical criteria of cognition in general help him to organize the content of the three critiques. This article attempts to answer why some countries experience the recurrence of civil war and others do not. One of the most significant differences between civil war onset and its recurrence is that the latter has once experienced termination of civil war, while the former has not. To find the cause of recurrence, this article examines how different war termination types influence the duration of post-civil war peace. Duration analysis of the civil wars between 1944 and 1999 shows that military (...) victory, supported by peacekeeping operations or power-sharing arrangements, leads to the most durable peace in a post-civil war country. Contrary to the accepted wisdom, negotiated peace settlement, even when supported by peacekeeping operations or power-sharing arrangements, is not positively related to post-conflict peace. (shrink)

Drawing on theories of institutional evolution, this article contends that despite the centrality of occupationally based social insurance in postwar Korea and Taiwan, the welfare state has in fact deepened considerably. The analysis is structured around three distinct eras of social policy reform in Korea and Taiwan: the developmental state, democratic transition, and postindustrialism. The authors contend that during each of these eras, the institutional purposes of social policy were altered to meet certain socioeconomic objectives. New institutional purposes were grafted (...) onto the prevailing social insurance model, changing the outcomes of social policy. The developmental state era was productivist in purpose, democratic reform during the 1980s reoriented social insurance toward universalist and redistributive principles, and the post-1997 era refocused social insurance to meet the imperatives of flexible labor markets, demographic shifts, and economic globalization. Intelligent humanoid robots (IHRs) are becoming likely to be integrated into nursing practice. However, a proper integration of IHRs requires a detailed description and explanation of their essential capabilities, particularly regarding their competencies in replicating and portraying emotive functions such as empathy. Existing humanoid robots can exhibit rudimentary forms of empathy; as these machines slowly become commonplace in healthcare settings, they will be expected to express empathy as a natural function, rather than merely to portray artificial empathy as a replication (...) of human empathy. This article works with a twofold purpose: firstly, to consider the impact of artificial empathy in nursing and, secondly, to describe the influence of Affective Developmental Robotics (ADR) in anticipation of the empathic behaviour presented by artificial humanoid robots. The ADR has demonstrated that it can be one means by which humanoid nurse robots can achieve expressions of more relatable artificial empathy. This will be one of the vital models for intelligent humanoid robots currently in nurse robot development for the healthcare industry. A discussion of IHRs demonstrating artificial empathy is critical to nursing practice today, particularly in healthcare settings dense with technology. (shrink)

This study investigated the circumstances and problems that departments of forensic medicine encounter with bereaved families regarding samples obtained from medico-legal autopsies. A questionnaire was posted to all 76 departments of forensic medicine performing medico-legal autopsies in Japan, and responses were received from 48 . Of the respondents, 12.8% had approached and communicated with bereaved families about collecting samples from the deceased person during an autopsy and the storage of the samples. In addition, 23.4% of these had informed families that (...) samples might be used in research. Eighteen departments had received enquiries and requests from families about the samples, with most requests concerning their return. The response to such requests varied according to the department. Few departments interacted with the bereaved families regarding the procedure for obtaining autopsy samples, and their methods for handling family concerns differed depending on the person within the department authorised to contact the family. Moreover, the procedures for engaging in such communication have long been unclear, and no legal or ethical consensus or agreement with the general public has been established. It is important for researchers to further discuss the correct way for forensic medicine departments to communicate with bereaved families. (shrink)

In this article we compare Fine’s theory of arbitrary objects with the theory of variables that Russell formulated in his Principles of Mathematics. We argue that Russell’s early theory of variables can be seen as a prefiguration of Fine’s theory of arbitrary objects. The main difference between Russell’s theory and Fine’s account lies in their account of dependence relations between variables. Fine develops a stable view of dependence between arbitrary objects, whereas no such view is presented in Principles of Mathematics. (...)
