In _Beyond Animal Rights_, Josephine Donovan and Carol J. Adams introduced feminist "ethic of care" theory into philosophical discussions of the treatment of animals. In this new volume, seven essays from _Beyond Animal Rights_ are joined by nine new articles-most of which were written in response to that book-and a new introduction that situates feminist animal care theory within feminist theory and the larger debate over animal rights. Contributors critique theorists' reliance on natural rights doctrine and utilitarianism, which, they suggest, (...) have a masculine bias. They argue for ethical attentiveness and sympathy in our relationships with animals and propose a link between the continuing subjugation of women and the human domination of nature. Beginning with the earliest articulation of the idea in the mid-1980s and continuing to the theory's most recent revisions, this volume presents the most complete portrait of the evolution of the feminist-care tradition. Consent remains a crucial, yet challenging, cornerstone of clinical practice. The ethical, legal and professional understandings of this construct have evolved away from a doctor-centred act to a patient-centred process that encompasses the patient’s values, beliefs and goals. This alignment of consent with the philosophy of shared decision-making was affirmed in a recent high-profile Supreme Court ruling in England. The communication of information is central to this model of health care delivery but it can be difficult for doctors to gauge (...) the information needs of the individual patient. The aim of this paper is to describe ‘core information sets’ which are defined as a minimum set of consensus-derived information about a given procedure to be discussed with all patients. Importantly, they are intended to catalyse discussion of subjective importance to individuals. The model described in this paper applies health services research and Delphi consensus-building methods to an idea orginally proposed 30 years ago. The hypothesis is that, first, large amounts of potentially-important information are distilled down to discrete information domains. These are then, secondly, rated by key stakeholders in multiple iterations, so that core information of agreed importance can be defined. We argue that this scientific approach is key to identifying information important to all stakeholders, which may otherwise be communicated poorly or omitted from discussions entirely. Our methods apply systematic review, qualitative, survey and consensus-building techniques to define this ‘core information’. We propose that such information addresses the ‘reasonable patient’ standard for information disclosure but, more importantly, can serve as a spring board for high-value discussion of importance to the individual patient. The application of established research methods can define information of core importance to informed consent. Further work will establish how best to incorporate this model in routine practice. Critical Theory and Animal Liberation is the first collection to look at the human relationship with animals from the critical or 'left' tradition in political and social thought. The contributions in this volume highlight connections between our everyday treatment of animals and other forms of oppression, violence, and domination. Breaking with past treatments that have framed the problem as one of 'animal rights,' the authors instead depict the exploitation and killing of other animals as a political question of the first (...) order. Background There is broad international agreement from clinicians and academics that healthcare rationing should be undertaken as explicitly as possible, and the BMA have publicly supported the call for more accountable priority setting for some time. However, studies in the UK and elsewhere suggest that clinicians experience a number of barriers to rationing openly, and the information needs of patients at the point of provision are largely unknown. Methodology In-depth interviews were undertaken with NHS professionals working at the community level (...) of provision, and with patients and professionals receiving or providing treatment for morbid obesity and breast cancer (n=52). Results Nearly all patients wanted to know about healthcare rationing and had high expectations of their clinical professionals to provide all relevant information about treatment options. However, professionals did not always understand these information requirements, and cases of implicit rationing were common. The existence of relevant national guidance was not always known about, meaning that patients were often reliant on other sources of information about treatment options, which included the popular media, the internet, patient advocacy groups and informal networks of support. Discussion Clinical professionals need to understand patients' need for detailed information when it comes to rationing, and to understand that they are the main gateway for this to be provided. However, disclosure could be distressing for both patients and professionals, and thus the most sensitive and acceptable ways to make this information available requires further investigation. Abstract:Natural law theory has a long history, going back to the Stoics. Ernst Bloch, a twentieth-century Marxist theorist, offered a compelling radical reconstruction of natural law, locating its source in the resistance of those whose natural law entitlements are being denied. That resistance, Bloch held, constitutes a critical standpoint, which forms the basis for radical natural law. Bloch restricted the concept to humans, but it is here proposed that animals too have critical standpoints which constitute the basis for radical natural (...) law. (shrink)

Economic growth and development remain embedded in the very core of our current international economic system and the so called “material economy”. However, depleting natural resources and environmental degradation, which now threaten the well-being of future generations, has challenged this premise, and placed sustainable development as a necessary objective of business activity and expansion. Environmental impact assessments (EIAs) have emerged as a key tool for governments, businesses, and NGOs to manage the negative impact of their activities on the environment. Businesses (...) in particular play a key role in averting or mitigating current environmental trends given that the economic growth they have stimulated has serious consequences for both the environment and social well-being. However, research on the use of EIAs has been conducted mostly from a governmental perspective producing a clear gap between research development and business (corporate) practice. To bridge this gap in knowledge, we develop a new EIA process tailored to real world business constraints and provide a range of propositions which we hope will stimulate future research efforts toward understanding and guiding how businesses integrate environmental issues into their decision-making processes. Current UK legislation is impacting upon the feasibility and cost-effectiveness of medical record-based research aimed at benefiting the NHS and the public heath. Whereas previous commentators have focused on the Data Protection Act 1998, the Health and Social Care Act 2001 is the key legislation for public health researchers wishing to access medical records without written consent. The Act requires researchers to apply to the Patient Information Advisory Group for permission to access medical records without written permission. We present a (...) case study of the work required to obtain the necessary permissions from PIAG in order to conduct a large scale public health research project. In our experience it took eight months to receive permission to access basic identifying information on individuals registered at general practices, and a decision on whether we could access clinical information in medical records without consent took 18 months. Such delays pose near insurmountable difficulties to grant funded research, and in our case £560 000 of public and charitable money was spent on research staff while a large part of their work was prohibited until the third year of a three year grant. We conclude by arguing that many of the current problems could be avoided by returning PIAG’s responsibilities to research ethics committees, and by allowing “opt-out” consent for many public health research projects. PurposeThe purpose of this paper is to demonstrate that libraries do not inevitably arise from the aggregation of information, and to apply this result to critique the meaningfulness of the idea of a “digital library.”Design/methodology/approachThree independent arguments demonstrate that libraries are more than the sum of the books that they contain: first, the logical argument, which analyses the internal consistency of claims for the superiority of electronic formats; second, the semantic argument, which examines ordinary language to isolate the core requirements (...) of what it means to be a “library”; and third, the ethical argument, which identifies the source of the unique phenomenological experience of encounter with the library.FindingsIt is found that the three arguments each refute the view that “library” is the collective noun for “book,” and argue instead that it is an emergent concept that offers to its community a reflection of the local cultural knowledge through the ordinary selection and organization practices that distinguish libraries from other book accumulations. Against that understanding the idea of a comprehensive and universal digital library fails on the essential criteria of selectivity and organization. While such products can be powerfully useful, they offer something distinct from libraries. When we lose sight of this difference we risk losing the inherent and irreducible values embodied by libraries.Originality/valueThe paper's arguments provide a reasoned infrastructure to several beliefs that are both common and unexamined. Animals, Mind, and Matter challenges the current ascription of object status to animals in the law, commerce, and science, where they are conceived as property and commodities. Instead, Donovan establishes that animals are living subjects, have minds and opinions, and care about what happens to them.

In response to the discussion between William W. Morgan and Annette Kolodny in the Summer 1976 issue of Critical Inquiry I would like to address the issue of separating judgments based on feminism as an ideology from purely aesthetic judgments. Peripherally this included the issue of "prescriptive criticism," so labeled by Cheri Register in Feminist Literary Criticism: Explorations in Theory.1 In the same book, as Kolodny points out,2 I called for criticism that exists in the "prophetic mode." Kolodny indicates reservations (...) about both concepts without fully exploring the issue. I would like to explain my statement here and to explore further the issue of feminism and aesthetics. When I called for criticism in the prophetic mode, I did not intend to promote an idea of the critic as ideological prophet. Rather, as I explain in the context from which the term is taken,3 I am speaking of the engaged scholar who is concerned to influence the future by her/his work today. S/he chooses her/his work with an eye to encourage political and social changes. Obviously, for a feminist this translates into a concern for a future in which women will be free from many of the restrictions that have held them down in the past. Much feminist criticism is thus corrective criticism designed to redress the imbalance in current literary curricula, and more generally to reintroduce "the feminine" into the public culture. · 1. The relationship of peasants and villagers with their animals in the premodern era is a missing chapter in the history of human-animal relations. Works on peasant culture ignore animals, and works on animals neglect their place in rural lives. This article, based on the depiction of premodern peasant and village life in hundreds of local-color novels and stories of the early nineteenth century, begins to fill in this gap in animal studies scholarship. It reveals that many of the defining boundaries (...) between humans and animals introduced in the ideologies of modernity are fuzzy, fluid, or indeed nonexistent in premodernity, where animals are seen as subjects, companions, and, often, parts of the family. In recent years, critics sensitive to animal issues have begun to theorize a new direction in literary criticism, an animal-centric or animal-standpoint criticism. Such a criticism seeks to examine works of literature from the point of view of how animals are treated therein, often looking to reconstruct the standpoint of the animals in question. This article examines a selection of short stories by Leo Tolstoy considering them exemplary from the point of view of animal-standpoint criticism.

The section dealing with the "phenomenology of consciousness" is finally dominated by the question, How does consciousness become self-consciousness, or how does consciousness become conscious that it is self-consciousness? This assertion, however, that consciousness is self-consciousness, is a central teaching of modern philosophy since Descartes. To this extent, Hegel’s idea of phenomenology lies in the Cartesian line. Contemporary parallels show how much this is the case, especially the quite unknown book of Sinclair, the friend of Hölderlin and Hegel, which deals (...) with the Sphragis in the Rhein hymn, and is entitled Truth and Certitude. The work attempts, beginning quite explicitly with the Cartesian concept cogito me cogitare, to lead one along the path from certitude to truth in two rather similar fashions, through Fichte, and, almost contemporaneously, in Hegel. Ecofeminism, a new vein in feminist theory, critiques the ontology of domination, whereby living beings are reduced to the status of objects, which diminishes their moral significance, enabling their exploitation, abuse, and destruction. This article explores the possibility of an ecofeminist literary and cultural practice, whereby the text is not reduced to an "it" but rather recognized as a "thou," and where new modes of relationship-dialogue, conversation, and meditative attentiveness-are developed.

Gender and social inclusion efforts in agricultural development are focused on making uptake of agricultural technologies more equitable. Yet research looking at how gender relations influence technology uptake often assumes that men and women within a household make farm management decisions as individuals. Relatively little is understood about the dynamics of agricultural decision-making within dual-adult households where individuals’ management choices are likely influenced by others in the household. This study used vignettes to examine decision-making related to maize plot management in (...) 698 dual-adult households in rural Kenya. The results indicated a high degree of joint management of maize plots (55%), although some management decisions—notably those related to purchased inputs—were slightly more likely to be controlled by men, while other decisions—including those related to hiring of labor and maize end uses—were more likely to be made by women. The prevalence of joint decision-making underscores the importance of ensuring that both men’s and women’s priorities and needs are reflected in design and marketing of interventions to support maize production, including those related to seed systems, farmer capacity building, and input delivery. This is an ambitious book. Onora O'Neill argues for an interpretation of the Critical philosophy as a whole which recognizes the categorical imperative as the first principle of theoretical as well as practical reason. She offers an interpretation of Kantian ethics which attempts to answer the central charges that have been brought against it since the critiques of Mill and Hegel: empty formalism and moral rigorism. She enters into dialogue with contemporary positions both hostile and sympathetic to Kant's practical philosophy. (...) Pinkard characterizes his interpretation of Hegel's philosophy as "by no means a straightforward and noncontroversial" reading. This is a fair characterization as his recent exchange with Robert Pippin indicates. The book presents Hegelian philosophy as essentially an explanatory project aiming at achieving a coherent set of beliefs about experience: "A philosophical problem arises when two basic beliefs both seem to be true but seem also to be inconsistent with each other; both seem to be true, but it also seems that (...) both cannot be true". Philosophical problems on this reading have the form of Kantian antinomies. Philosophical explanation takes the form of transcendental as opposed to metaphysical argumentation. Metaphysical explanations answer the question "how is x possible?" by positing the existence of some entity. Transcendental explanations claim that we must conceive of experience in terms of certain categories if we are to think about it in an intelligible way. What distinguishes a Hegelian speculative argument from a Kantian transcendental argument, in Pinkard's view, is that it cannot claim to present the conditions of the possibility of experience. A Hegelian speculative argument "cannot claim its solutions are unique or necessary". (shrink)

Hegel on Logic and Religion is a collection of previously published essays which have been arranged under three general headings: “Logic,” “Logic Applied,” and “Christianity.” It proposes a Hegelian response to Lessing’s well-known rejection of the claim of Christian apologetics to provide an adequate “rational theology.” Such apologetics held that the reliability of the historical testimony to Christ’s miracles and resurrection is cogent evidence to warrant claims for his divinity. Lessing concedes the assertions of historical veracity but denies their cogency (...) for drawing rational conclusions about divinity. There is, he argues an “ugly broad ditch” separating the necessary truths of reason from the contingent truths of history. Lessing’s attack, moreover, did more than strike at the heart of traditional Christian apologetics. It also rendered a central project of the German Enlightenment problematic. Thinkers such as Mendelssohn held that metaphysics could provide a new rational basis for the claims of historical religion. So—according to Lessing—whether one approached historical faith from the perspective of a metaphysical system, or began on the opposite site side and used history as evidence for conceptions of divinity, one was brought to a halt before the “ugly, broad ditch.”. This book is a critique of the impact that systematic ideological distortions have on social life. This critique is developed through a study of the "relationship between philosophical thought and religious dogma in general", since religious dogma is an obvious instance of authoritarian ideology. Moreover, Shanks is especially concerned with the recovery of the Christian tradition, which he argues has been "superficially deformed by such ideology".

McCarthy discusses the central issues in Marx interpretation--for example, the relationship of the young Marx to the author of Capital, Marx's view of ethical theory in general and justice in particular, the meaning of praxis as a criterion of truth, the significance of Marx's atheism, and the positivistic and transcendental interpretations of Marxist Wissenschaft-from the perspective of a retrieval of his classical scholarship. His contention is that a study of Marx's doctoral dissertation, The Difference between the Democritean and Epicurean Philosophy (...) of Nature--together with the 1838-40 Notebooks on Epicurean Philosophy-yields the outlines of a fundamental intellectual project which is developed throughout the rest of his writings. That project, rooted in the humanism of the late classical period, gives a distinctive character to Marx's dialogue with modern political economists and with the liberal natural rights tradition. McCarthy thus stresses the fundamental coherence of Marx's writings, and at the same time disassociates him from modern positions--such as Ricardo's understanding of the labor theory of value--with which Marx's thought has been conflated. He does this by presenting Marx's interpretive interests as being distinctively premodern, and concludes that his classical formulation of the problems of social ethics affords Marx the critical distance to be "the most forceful opponent of modernity...
