Ethics instructors often use cases to help students understand ethics within a corporate context, but we need to know more about the impact a case-based pedagogy has on students’ ability to make ethical decisions. We used a pre- and post-test methodology to assess the effect of using cases to teach ethics in a finance course. We also wanted to determine whether recent corporate ethics scandals might have impacted students’ perceptions of the importance and prevalence of ethics in business, so we (...) used in-depth case studies of several of the major scandals (e.g., Enron, Tyco, Adelphia). Our results are somewhat surprising since studying ethics scandals positively impacts students’ ethical decision making and their perceptions of the ethics of businesspeople. (shrink)

This article pursues the hypothesis that there is a structural affinity between the case study as a genre of writing and the question of gendered subjectivity. With John Forrester’s chapter ‘Inventing Gender Identity: The Case of Agnes’ as my starting point, I ask how the case of ‘Agnes’ continues to inform our understanding of different disciplinary approaches to theorizing gender. I establish a conversation between distinct, psychoanalytically informed feminisms to move from the mid-20th century to contemporary cultural debate.

There is a long history of women being underrepresented in biomedical and health research. Specific women’s health needs have been, and in some cases still are, comparatively neglected areas of study. Concerns about the health and social impacts of such bias and exclusion have resulted in inclusion policies from governments, research funders, and the scientific establishment since the 1990s. Contemporary understandings of foregrounding sex and gender issues within biomedical research range from women’s rights to inclusion, to links between human rights, (...) women’s health and sustainable development, and the increasing scientific and funding expectation for studies to consider the sex and gender implications of research design, results and impact. However, there are also exploitation issues to consider when foregrounding the inclusion of women as research participants, especially for research ethics committees and institutional review boards. A hidden risk is that exploitative research designs and practices may be missed, particularly by reviewers who may not have a nuanced understanding of gender-based harm. Utilizing contemporary case studies of ethics dumping, this paper highlights some of the concerns, and makes recommendations for IRBs/research ethics reviewers to help ensure that essential research is undertaken to the highest ethical standards. Most of the world’s constitutions contain clauses guaranteeing sex equality, and many also extend the special protection of the state to mothers. The constitutional protection of motherhood is undertheorized and neglected in global constitutional discourse, perhaps because jurisdictions like the United States view the special protection of women as contrary to gender equality. This Essay explores the feminist meanings and possibilities of constitutional motherhood clauses, by focusing on Germany, where they originated in 1919. While motherhood clauses have had complex relationships (...) with a range of feminist agendas, they solidified the notion that social reproduction was a subject for constitutional lawmaking. Addressing twenty-first century gender inequalities requires a more robust engagement of women’s disproportionate burdens in social reproduction. Having opened up a constitutional discourse around the challenges of social reproduction, motherhood clauses and gender equality guarantees can drive the search for new solutions. (shrink)

The present research aimed to provide a more holistic analysis of stressful experiences in sport by examining how stress appraisal, coping and emotion are dynamically inter-related constructs and the extent to which their dynamic relationship is associated with objective performance. Based on process-oriented methods, two studies were conducted with elite athletes in order to investigate the dynamic relationship between these constructs and performance in highly demanding sport situations (Study 1: simulated competitive fencing matches during a training session; Study 2: real-life (...) competitive fencing matches during an international competition). The results of the random coefficient regression models emphasise the dynamic nature of the relationship between stress appraisal, coping behaviour, emotion and objective performance over the course of fencing matches. They allowed identification of additional mediating effects of coping and emotion within dynamic relationships between stress appraisal and performance. These studies contribute to a deeper understanding of psychological adaptation in performance environments. The implications of the findings are discussed in relation to the design of effective coping interventions to support the learning of performance-related coping skills and the attainment of performance goals among individuals in highly demanding environments. Axel Honneth distinguishes between recognitive practices according to the social domain in which they occur and this allows him to theorise the relationship between power and recognition. 'Love-based recognition', which suggests the centrality of recognition to the relationships that nurture us in the first instance, is located in the family. Honneth argues that relationships encompassed by this category are pre-political, thereby repeating the distinction between the public and the private common to much political theory. This article explores the structure of (...) this delineation in his thinking. I argue that Honneth's analysis marginalises feminist concerns with how power functions through recognition in the private sphere. Honneth also robs himself of a rejoinder to recognition sceptics, who suggest that the desire for recognition is a condition of subordination. This paper treats a heretofore-unnoticed concept in the history of the philosophical discussion of human freedom, a kind of freedom that is not defined solely in terms of the causal power of the agent. Instead, the exercise of freedom essentially involves the non-occurrence of something. That being free involves the non-occurrence, that is, the absence, of an act may seem counterintuitive. With the exception of those specifically treated in this paper, philosophers tend to think of freedom as intimately involved with (...) volition, the judging or deciding activity of the will that votes in favor of or against a proposed action. However, there are two thinkers who endorse a view where not willing constitutes human freedom. Our analysis focuses on the views of Malebranche and Locke. Both invoke a notion dubbed here as ‘absential suspension.’ On this view, freedom is associated not with the power of volition, but rather with this kind of suspension. (shrink)

A central claim in Kantian ethics is that an agent is properly morally motivated just in case she acts from duty alone. Bernard Williams, Michael Stocker, and Justin Oakley claim that certain emotionally infused actions, such as lending a compassionate helping hand, can only be done from compassion and not from duty. I argue that these critics have overlooked a distinction between an action's manner, how an action is done, and its motive, the agent's reason for acting. Through a range (...) of examples I demonstrate how an emotion can determine an action's manner without also serving as the motive. Thus, it is possible for an agent to act compassionately from duty alone. This distinction between the manner and the motive of an action not only restores a central claim in Kantian ethics but it also allows for an expanded role of emotions in moral action. (shrink)

Since the mid-1970s, some artists have portrayed Jesus Christ in female form. The depiction of a female Christ crucified is a particularly controversial representation that challenges theological orthodoxies and upsets the gender symbolism ingrained upon the Christian cross. The controversy and ecclesiastical censure that such works often provoke indicates the emotive power of gender subversion. This study provides a detailed account of five images of the female-Christ form in art, considers their function as theological symbols, and assesses their contribution to (...) feminist theology. It will be suggested that the Christa offers a subversive feminist strategy of representation. And—while such representations do not remove the unanswered theological difficulties associated with divine suffering, the problem of evil and the mystery of salvation—the graphic portrayal of female suffering powerfully exposes the reality of the cross as a site of patriarchal violence. The neuro-enhancement Modafinil promises to dramatically increase users' waking hours without much sacrifice to clarity of thought and without serious side effects (inducing addiction). For Modafinil to be advantageous, its usage must enable access to goods that themselves improve the quality of one's life. I draw attention to a variety of conditions that must be met for an experience, activity or object to improve the quality of one's life, such as positional, relational, and saturation conditions, as well as it's being (...) good for its own sake. I discuss and describe the contexts in which widespread usage (legal or not) of Modafinil would undermine these conditions being met, and thus users would fail to significantly improve the quality of their lives and would in fact potentially make both themselves and nonusers worse off in important respects thus far overlooked by critics. In the right contexts, where free time is protected and prolonged, Modafinil does have a variety of potential benefits including, most interestingly, a distinctive form of agency possible only in free time. The potential disadvantages and advantages highlighted in this article are relevant not only to public institutions deciding whether to legalize Modafinil's use as an enhancement but also to individuals deciding whether to use it illegally, as well as to the questions of how and whether to alter key features of one's context (e.g. regulating work hours or extending social services) rather than, or in addition, to regulating the use of enhancement drugs such as Modafinil. In this Article, Professor Suk defends the moral legitimacy of liberal states’ legal protection of minority languages. Many opponents of minority language protection have argued or assumed that legal intervention denies individuals the right to choose the majority language and the economic opportunities often attached to the dominant language. This Article argues that such arguments overlook another category of goods that are necessary to individual autonomy: relational resources. Individuals have an interest in maintaining their ancestral languages because doing so is (...) essential to maintaining one’s relationship to one’s family and community. The relational interest cannot easily be compared with economic opportunities, because these two dimensions of autonomy are incommensurable. As a result, a liberal state should avoid forcing its citizens to choose between these incommensurable goods. By adopting policies that protect minority languages, while also ensuring individuals’ access to economic and political participation in the majority language, a liberal state can manage and balance the conflict between these important competing aspects of autonomy. BackgroundRecurrent Major Depressive Disorder is one of the most disabling mental disorders in modern society. Prior research has shown that self-compassion protects against ruminative tendencies, a key feature of recurrent MDD. In addition, self-compassion has been found to be positively related to higher psychophysiological flexibility in young, healthy adults. To our knowledge, there is a lack of studies on how self-compassion relates to vmHRV in patients with recurrent MDD. The aim of the current study was to investigate whether higher self-compassion (...) would associate with lower ruminative tendencies and higher vmHRV in a sample of adults with recurrent MDD.MethodsWe included a sample of 63 patients between 20 and 71 years old with a history of three or more depressive episodes. They filled out the Self-Compassion Scale, Beck Depression Inventory, and Rumination Rating Scale. ECG was acquired while resting and the square root of the mean squared differences of successive RR interval values was calculated as measure of vmHRV.ResultsAs hypothesized, self-compassion was associated with lower ruminative tendencies. However, self-compassion was not associated with level of vmHRV. Several confounding variables were controlled for in the statistical analyses, and higher age predicted lower vmHRV across all statistical analyses.ConclusionThe results confirmed our hypothesis that higher self-compassion would be associated with lower ruminative tendencies in recurrent MDD. Contrary to our expectation, we did not find that the tendency to be more self-compassionate was associated with higher vmHRV. As such, higher self-compassion seems to relate with a lower tendency to ruminate about past mistakes and events but does not seem to relate to a flexible autonomic stress response. Other potential explanatory factors for lower vmHRV in recurrent MDD is suggested as focus for exploration in future studies. (shrink)

I defend the claim that Avicenna explains the creation of the universe in terms of emanation modeled on Neoplatonic emanation by exploring Avicenna’s account of creation by emanation in detail. I address what appears to be an obvious problem for the application of this model to creation—namely, that creation as emanation seems to be non-voluntary and has been understood to be non-voluntary by several prominent interpreters. I explore how Avicenna contends that God emanates voluntarily and non-necessarily. Avicenna is able to (...) make this claim because of his distinction between an action done of natural necessity, done voluntarily, and done with an intention. I then address whether this means that God creates freely—without any constraint whatsoever—and I conclude that God is not free not to create because God has an immutable will and has already acted to create. While God is not under any initial compulsion to create, from the fact that the universe now exists, God cannot act otherwise than to create. (shrink)

A part of Aquinas’s argument against occasionalism is that creatures like human beings must be true causes in order to be able to grow and be perfected. Were humans not true causes, God’s promises and exhortations to humankind are for naught. Here, I explore the role of virtue in habit and the perfection of human beings in Aquinas, with the larger goal of using this discussion of virtue to address secondary causation. Virtue is relevant because a) creatures can act as (...) secondary causes because of the powers God has imbued in their nature and b) humans must be secondary causes or else they could not strive toward the good by attaining proper habits. To pursue a clearer understanding of Aquinas’s theory of secondary causes, then, it is necessary to further explore how virtue acquisition works. To that end, I will discuss the role of habit, which is the basis of virtue, the notion of virtue itself and how it is acquired by these secondary causes, the importance of the acquisition of virtues through proper habits, and the connection virtue has to secondary causes. In this article, I explore Aquinas’s account of divine creative activities as a type of efficient causation. I propose that Aquinas’s works hold a framework for understanding God as an efficient cause and creating as an act of divine efficient causation that makes explicit what Aquinas views to be implicit in Aristotle’s account of efficient causation. I explore Aristotelian efficient causation in depth, offering a detailed analysis of the components of Aristotelian efficient causation. After this exploration, it is necessary to (...) address what reasons Aquinas has for viewing creation as efficient causation. I explore Aquinas’s understanding of creation and relate it to Aristotle’s analysis of efficient causation, analyzing how, precisely, Aquinas’s conception of efficient causation—which includes change, creation, and conservation—aligns with Aristotle’s. Because Aquinas’s account is derivable directly from elements in Aristotle’s account, Aquinas’s account can be understood to be implied by Aristotle’s account. (shrink)

I explore methods for the explicit instruction of critical thinking in a topics-based philosophy course. These methods make the classroom more experiential and less didactic and involve students in the philosophical process, allowing them to learn content while using the methods of philosophy to work through, explain, or produce similar content. Experiential learning—approaching learning as a “continuous process grounded in experience” involving the acquisition of practices, the specialization in those practices, and the integration of oneself into the learning process—enhances traditional (...) philosophy classrooms, and explicitly teaching critical thinking skills involves the methods of experiential learning. After an overview of relevant aspects of experiential learning and addressing how experiential learning methods can be used for the explicit teaching of critical thinking skills, I explain four methods I use to explicitly teach critical thinking in my introductory classes. The Mental Capacity Act 2005 has stipulated that in England and Wales the ethical implications of carrying out research with people who are unable to consent must be considered alongside the ethical implications of excluding them from research altogether. This paper describes the methods that were used to enable people with severe and profound intellectual disabilities, who lacked capacity, to participate in a study that examined their experience of receiving intimate care. The safeguards that were put in place to protect (...) the rights and well-being of participants are described, and it is argued that the approaches used in this study met the requirements set out in the Mental Capacity Act 2005. Although this paper is based on research involving people with intellectual disabilities, it has implications for research involving other groups who may also lack capacity to consent, including people with mental health problems, head injuries and dementia. This article proposes that the French performance artist Orlan, has, by undertaking a series of surgical interventions on her face and body, radically challenged current standards of beauty. By engaging with Judeo-Christian iconography, Greek mythology and French literature in her operations/performances, she has established an oeuvre that aligns her not only with corporeality and the abject body through images of the sacrificial, but also with aberrant body forms associated with the carnival. Although seduced by the rhetoric that surrounds the body (...) in technology, she has turned to excess as a strategy against the benign and controlled nature of the screen, and the media's homogenization of body images. Her new identity, although not extreme, is a site of resistance in a society bent on eliminating forms that threaten the status quo. (shrink)

There is general agreement among ecofeminists regarding the desirability of a variety of expressions of ecofeminism, but this pluralism is under threat with the emergence of an approach that emphasizes the primacy of a philosophical ecofeminism which claims the authority to prescribe what ecofeminism should be. The recent anthology Ecological Feminism is symptomatic of this trend, with contributors who affirm the philosophical significance of ecological feminism by privileging philosophers’ voices over those of other ecofeminists, rather than by engaging in critical (...) dialogue with, and exploring connections between, different ecofeminist discourses. This colonizing strategy actively excludes many women’s voices from the creation of an environmental ethic, including those of activist, spiritual, and “Third World” ecofeminists, but fails to offer any adequate philosophical grounds for doing so. ABSTRACT:In 1740, Joanna Stephens (fl. 1720–1741) produced a recipe for a tonic that she claimed cured bladder stones. Although she had the support of some notable and powerful men in the medical community and empirical evidence that her tonic worked, it took two years of petitioning, discussing, and even (unsuccessfully) crowd-sourcing before Parliament relented and awarded her the sum she requested to take her tonic public. Stephens’s interaction with the scientific community serves as a case study for how epistemic credibility (...) shapes how communities hear, interpret, and react to testimonies of knowledge claims from marginalized community members. Stephens’s position as an outsider, both qua woman and qua experimentalist, meant that she was effectively and almost immediately written out of her own story by learned and powerful men with who had both vested interests in the cure for the stone and epistemic prejudices that made it impossible for them to hear Stephens’s claim that she had made a discovery. Ivancovsky et al.'s Novelty-Seeking Model suggests several mechanisms that might underlie developmental change in creativity and curiosity. We discuss how these implications both do and do not align with extant developmental findings, suggest two further elements that can provide a more complete developmental account, and discuss current methodological barriers to formulating an integrated developmental model of curiosity and creativity.

One of the longest and most acrimonious polemics in the history of philosophy is between Antoine Arnauld and Nicolas Malebranche. Their central disagreements are over the nature of ideas, theodicy, and, the topic of this paper, grace. We offer the most in-depth English language treatment of their discussion of grace to date. Our focus is one particular aspect of the polemic: the power of finite agents to assent to grace. We defend two theses. First, we show that as the debate (...) progresses, the differences between Arnauld and Malebranche become, surprisingly, less pronounced—despite mutual accusations of Pelagianism and Calvinism. Our second thesis is developed to explain the outcome of the first. We argue that the employment of different methodologies to interrogate the relationship between efficacious grace and human power prohibits any possibility of reconciliation between Arnauld and Malebranche. The moral status of human-animal chimeras that have human brain cells is especially concerning. The concern is that such animals have the same high moral status as human beings. Why? Julian Koplin suggests that support for this concern is based on this claim: capacities unique to humans gives one a high or full moral status. Koplin then proceeds to convincingly object this claim. However, I argue that the concern is instead based on a different claim: for those humans who do (...) have a high moral status, it is their (or some of their) mental capacities that confer this high moral status. Since having a human brain that is not too impaired is sufficient for having these mental capacities, and human-animal chimeras -- with brains composed of a sufficient number, type, and structure of human cells -- will have a human brain that is not too impaired, it follows that such animals would have the same moral status as human beings. Globalizing Feminist Bioethics is a collection of new essays on the topic of international bioethics that developed out of the Third World Congress of the International Association of Bioethics in 1996. Rosemarie Tong is the primary editor of this collection, in which she, Gwen Anderson, and Aida Santos look at such international issues as female genital cutting, fatal daughter syndrome, use of reproductive technologies, male responsibility, pediatrics, breast cancer, pregnancy, and drug testing.

De nombreuses études se sont en effet attachées à en souligner la portée, notamment dans ses rapports avec l'art rhétorique et son application pratique dans le cadre de la πόλις athénienne du Ve siècle où la parole — sous forme d'ἀγών, de débat contradictoire à l'assemblée ou au tribunal — prévalait sur tous (...) les autres instruments de pouvoir, violence et contrainte physique notamment. Dans un monde où « l’art politique, pour l'essentiel, maniement du langage », selon les mots de Jean-Pierre Vernant, analyser les mécanismes du logos, en connaître les règles, permettait de se rendre maître en persuasion, de posséder un instrument privilégié de victoire. Néanmoins, en marge de cet intérêt manifeste pour l'analyse du pouvoir du λόγος dans le corpus sophistique, on ne trouve, de manière assez paradoxale, qu'un nombre très limité de travaux s'attachant à questionner le sens, le statut et, in fine, la légitimité d'une « psychologie » au sens plein du terme. Et pourtant, la question se pose : peut-on parler d'une psychologie sophistique ou faut-il considérer que pour ces penseurs la ψυχή se donnait comme un état de fait dont il suffisait de connaître empiriquement le mécanisme? Y a-t-il quelque chose en-deçà de la psychagogie chez les sophistes? Dans cet article, nous tenterons de montrer qu’il est possible de voir en Alcidamas, disciple de Gorgias et auteur du Sur ceux qui composent des discours par écrit ou Sur les Sophistes, un éloge paradoxal, puisqu’écrit, de l’improvisation, un penseur de la ψυχή et non plus seulement de la potentialité psychagogique du λόγος. En effet, le développement d'une réflexion riche et complexe sur l’organisation logique et syntactique du discours d’une part, et sur l'âme et ses opérateurs d’autre part – réflexion qui conduit Alcidamas à réévaluer les modalités de relation entre l'orateur et son auditoire — permet de mettre en évidence une redéfinition (bien qu'en filigrane) de l'art rhétorique qui, ne pouvant plus dès lors reposer sur une revendication du pouvoir de la persuasion a maxima, devra accorder à la notion de vraisemblance une place centrale. I identify issues of philosophical concern in Eldred v. Ashcroft, the U.S. Supreme Court’s decision on copyright extension, and encourage the participation of philosophers in these public policy debates. Philosophers have contributions to make to the dialogue not captured exclusively by the technical and often narrow legal debate in the courts.

Philosophical writing is challenging for students new to philosophy. Many philosophy classes are populated, for the most part, by students who have never taken philosophy before. While many institutions offer general writing support services, these services tend to be most beneficial for helping to identify problems with style and grammar. They are not equipped to help students with the particular challenges that come with writing philosophy for the first time. We implemented the “Home Base” Mentoring Program in two introductory level (...) philosophy courses to target the specific challenges that novice learners have when learning how to write philosophy. Through the program, students had access to writing mentors who were undergraduate senior philosophy majors. Based on surveys given to the students who have participated in this program, we found that the program boosted student confidence in writing and also worked to develop a welcoming, judgment-free, and encouraging environment in the philosophy department more generally. Richard Watson’s Descartes’s Ballet engages three main questions uncommon to traditional Cartesian scholarship: Did Descartes script La Naissance de la Paix, the ballet performed in honor of Queen Christina’s twenty-third birthday in December 1649? Did Descartes have a political philosophy? Did Descartes read the French dramatist Pierre Corneille? Watson answers no, yes, and yes.By emphasizing the complete lack of evidence that Descartes wrote La Naissance de la Paix, Watson disarms the suggestion made by Adrien Baillet, Descartes’s seventeenth-century biographer, that Descartes (...) authored the ballet. Watson further suggests that only someone who was immersed in the subtleties of political culture in the Swedish court and was in Christina’s confidence could have written it. And Descartes, he argues, could not have met this description. Had it been written by Descartes, the ballet could have provided a foundation on which to build an interpretation of Cartesian political philosophy. Without it, explicit textual support for the construction of Descartes’s political philosophy is nonexistent. Undaunted by the lack of texts, Watson nevertheless constructs one based largely on the. Motivated by disparities in gun violence, sharp increases in gun ownership, and a changing gun policy landscape, we conducted a nationally representative survey of U.S. adults (n=2,778) in 2021 to compare safety-related views of white, Black, and Hispanic gun owners and non-owners. Black gun owners were most aware of homicide disparities and least expecting of personal safety improvements from gun ownership or more permissive gun carrying. Non-owner views differed. Health equity and policy opportunities are discussed.
