It is no longer a revelation that companies have some responsibility to uphold human rights. However, delineating the boundaries of the relationship between business and human rights is more vexed. What is it that we are asking corporations to assume responsibility for and how far does that responsibility extend? This article focuses on the extent to which economic, social and cultural rights fall within a corporation's sphere of responsibility. It then analyses how corporations may be held accountable for violations of (...) such rights. Specifically, the article considers the use of soft law as a protective mechanism; it also details how victims of harmful corporate behaviour are using litigation (pursuant to ATCA and common law domestic causes of action) to seek redress and recognition of the harms they have directly or indirectly experienced. The article concludes with an analysis of Professor Ruggie's (the United Nations Special Representative on the issue of transnational corporations and human rights) 2008 and 2009 Reports in which it is suggested that a respect-based framework must be interpreted as imposing proactive requirements on companies to prevent the infringement of human rights. Future efforts must also be directed towards the recognition of a specialised complementary corporate responsibility to protect human rights. (shrink)

This study attempts to answer the question of the origins of the non-biblical features of the Essenes' way of life. It is clear that their project was founded in biblical and Jewish realities. Where did those elements come from that appear not to have been derived from these sources? That they have their origins in Greek, and specifically Pythagorean, customs is an idea that recurs regularly in the history of scholarship and has had some notable supporters in the 19th and (...) first half of the 20th centuries, including E Zeller, E Schuer, I Levy, F C Cumont and M J Lagrange. Recent scholars seem more reluctant to accept such views. The inquiry will take the reader through the available sources, then a series of comparative studies with possible parallels in Greece and elsewhere, to see whether and in what terms the question of Pythagorean influences on Essenism can be answered. Ranchers and pastoralists worldwide manage and depend upon resources from rangelands across Earth’s terrestrial surface. In the Great Plains of North America rangeland ecology has increasingly recognized the importance of managing rangeland vegetation heterogeneity to address conservation and production goals. This paradigm, however, has limited application for ranchers as they manage extensive beef production operations under high levels of social-ecological complexity and uncertainty. We draw on the ethics of care theoretical framework to explore how ranchers choose management actions. We used (...) modified grounded theory analysis of repeated interviews with ranchers to compare rancher decision-making under relatively certain and uncertain conditions and describe a typology of practices used to prioritize and choose management actions that maintain effective stewardship of these often multi-generational ranches. We contrast traditional decision-making frameworks with those described by interviewees when high levels of environmental and market uncertainty or ecological complexity led ranchers toward use of care-based, flexible and relational frameworks for decision-making. Ranchers facing complexity and uncertainty often sought “middle-ground” strategies to balance multiple, conflicting responsibilities in rangeland social-ecological systems. For example, ranchers’ care-based decision-making leads to conservative stocking approaches to “manage for the middle,” e.g. to limit risk under uncertain weather and forage availability conditions. Efforts to promote heterogeneity-based rangeland management for biodiversity conservation through the restoration of patch burn grazing and prairie dog conservation will require increased valuation of ranchers’ care work. Iris Murdoch was a notable philosopher before she was a notable novelist and her work was brave, brilliant, and independent. She made her name first for her challenges to Gilbert Ryle and behaviourism, and later for her book on Sartre, but she had the greatest impact with her work in moral philosophy—and especially her book The Sovereignty of Good. She turned expectantly from British linguistic philosophy to continental existentialism, but was dissatisfied there too; she devised a philosophy and a style (...) of philosophy that were distinctively her own. Murdoch aimed to draw out the implications, for metaphysics and the conception of the world, of rejecting the standard dichotomy of language into the 'descriptive' and the 'emotive'. She aimed, in Wittgensteinian spirit, to describe the phenomena of moral thinking more accurately than the 'linguistic behaviourists' like R. M. Hare. This 'empiricist' task could be acheived, Murdoch thought, only with help from the idealist tradition of Kant, Hegel, and Bradley. And she combined with this a moral psychology, or theory of motivation, that went back to Plato, but was influenced by Freud and Simone Weil. Murdoch's impact can be seen in the moral philosophy of John McDowell and, in different ways, in Richard Rorty and Charles Taylor, as well as in the recent movements under the headings of moral realism, particularism, moral perception, and virtue theory. This volume brings together essays by critics and admirers of Murdoch's work, and includes a longer Introduction on Murdoch's career, reception, and achievement. In a series of recent papers, Justin Capes and Philip Swenson and Michael Robinson have proposed new versions of the flickers of freedom reply to Frankfurt-style cases. Both proposals claim, first, that what agents in FSCs are morally responsible for is performing a certain action on their own, and, second, that agents in FSCs retain robust alternative possibilities—alternatives in which the agent freely omits to perform the pertinent action on their own. In this paper, I argue that, by attending to (...) the details of the omissions in question, it becomes clear that agents in FSCs lack robust alternatives of this sort, for in the alternative sequences such agents do not freely omit. Since the problem for these recent proposals arises from their attempt to show that agents in FSCs retain robust alternatives, I go on to consider whether the flicker theorist might be better off either revising or rejecting the robustness requirement on alternative possibilities. I argue that neither alternative is available to the flicker theorist, and yet I also point out that the reasons why these alternatives are unavailable serve to highlight what exactly is at issue in the debate between leeway and sourcehood theorists, namely the grounds of our freedom. Drawing from contemporary blog data, this article examines an emerging project termed “neuroqueer.” Neuroqueer is a collaboration of activists, academics, and bloggers engaging in online community building. Neuroqueer requires those who engage in it to disidentify from both oppressive dominant and counterculture identities that perpetuate destructive medical model discourses of cure. It is a queer/crip response to discussions about gender, sexuality, and disability as pathology that works to deconstruct normative identity categories. Blog members employ neuroqueer practices to subversively combat exclusion (...) through rejection of able-hetero assimilation and counteridentification in favor of disidentification. Of particular interest for this special issue are the ways in which neuroqueer perspectives build more fluid conceptualizations of both gender and intersectionality through conscious disidentification from neurotypical norms and medical notions of cure on which they are often unconsciously based. Employing Critical Autism Studies and Narrative Analysis, this project examines how autistic Twitter users engage in narrative meaning-making through social media. By analyzing the hashtags #ActuallyAutistic and #AskingAutistics this project broadly explores how individuals construct identity when lacking access to positive representations and identity communities. Answering the research question, “How do autistic people construct individual and collective identity narratives through Twitter?,” findings indicate that autistic Twitter users use their social media presence to build virtual learning communities. Common knowledge about autism (...) is often oversimplified and highly medicalized. Therefore, autistics use Twitter to make meaning of their experiences that are not represented within cultural notions of what it means to be autistic. Autistic Twitter users reject medicalized narratives by contesting stereotypes, flipping negative narratives into positive stories, re-inscribing “deficiencies” as beneficial, and resisting rehabilitation and “cure.” Users do important social activist work by building strong autistic communities in ways that counter current negative representation, constructing positive self-affirming individual and community identities and resisting eugenic notions that autistic people are “less valuable.”. Adults and children spontaneously produce gestures while they speak, and such gestures appear to support and expand on the information communicated by the verbal channel. Little research, however, has been carried out to examine the role played by gesture in the listener's representation of accumulating information. Do listeners attend to the gestures that accompany narrative speech? In what kinds of relationships between gesture and speech do listeners attend to the gestural channel? If listeners do attend to information received in gesture, (...) how is this information represented— is it 'tagged' as originating in the gestural channel? In this article research is described that addresses these questions. Results show that listeners do attend to information conveyed in gesture, when that information supplements or even contradicts the information conveyed by speech. And information received via gesture is available for retelling in speech. These results are taken to demonstrate that gesture is not taken by the listener to be epiphenomenal to the act of speaking, or a simple manual translation of speech. But they also suggest that the information conveyed in a discourse may be represented in a manner that is neither gesture nor language, although accessible to both channels. (shrink)

Building Information Modelling (BIM) is a process for managing construction project information in such a way as to provide a basis for enhanced decision-making and for collaboration in a construction supply chain. One impediment to the uptake of BIM is the limited interoperability of different BIM systems. To overcome this problem, a set of Industry Foundation Classes (IFC) has been proposed as a standard for the construction industry. Building on IFC, the ifcOWL ontology was developed in order to facilitate representation (...) of building data in a consistent fashion across the Web by using the Web Ontology Language (OWL). This study presents a critical analysis of the ifcOWL ontology and of the associated interoperability issues. It shows how these issues can be resolved by using Basic Formal Ontology (ISO/IEC 21838-2) as top-level architecture. A set of competency questions is used as the basis for comparison of the original ifcOWL with the enhanced ontology, and the latter is used to align with a second ontology – the ontology for building intelligent environments (DOGONT) – in order to demonstrate the added value derived from BFO by showing how querying the enhanced ifcOWL yields useful additional information. Ruth Millikan’s teleological theory of mental content is complex and often misunderstood. This paper motivates and clarifies some of the complexities of the theory, and shows that paying careful attention to its details yields answers to a number of common objections to teleological theories, in particular, the problem of novel mental states, the problem of functionally false beliefs, and problems about indeterminacy or multiplicity of function.

My paper addresses a topic--the implications of Rawls's justice as fairness for affirmative action--that has received remarkably little attention from Rawls's major interpreters. The only extended treatments of it that are in print are over a quarter-century old, and they bear scarcely any relationship to Rawls's own nonideal theorizing. Following Christine Korsgaard's lead, I work through the implications of Rawls's nonideal theory and show what it entails for affirmative action: viz. that under nonideal conditions, aggressive forms of formal equality of (...) opportunity (e.g., sensitivity training, outreach efforts, external monitoring and enforcement) and compensating support (e.g., special fellowship programs, childcare facilities, mentoring, co-op opportunities, etc.) can be justified, but that "hard" and even "soft" quotas are difficult to defend under any conditions. I conclude the paper by exploring the implications of these surprising results for contemporary liberalism more broadly and for constitutional law and public policy. (shrink)

Conceived to commemorate the victims of South Korea’s participation in the Vietnam War, the statue of the Vietnam Pieta invites us to question who shapes the memory of this neglected facet of the conflict. The present article analyzes the various actors involved in this contentious process in and across both countries, starting with the South Korean activists behind the statue’s making and the movement for recognizing the crimes committed by their army. Examining these activists’ advocacy work since the late 1990s, (...) the article argues that they are triply situated in the fight over remembering South Korea’s intervention in Vietnam. Truth advocates first appear in a position of privilege and leadership vis-à-vis Vietnamese victims of South Korean military wrongdoings, which raises the issue of the material and political asymmetries at stake in the construction of memory. Simultaneously, the same advocates occupy a position of marginality vis-à-vis the dominant public discourse held on the war by Hanoi and Seoul, whose common interest lies in deepening their mutually beneficial but unequal economic partnership. Thirdly, the memory of the conflict pits truth activists against another group within their own civil society: veterans’ organizations aggressively denying all war crimes accusations. Ultimately, remembering the war is not the object of a bilateral dispute between the South Korean and Vietnamese states, but rather a site of domestic tensions within South Korea itself. (shrink)

Fragmented social relations, the twin demise of authority and tradition, the breakdown of behavioural norms and constraints: all these are the outcome, according to their critics, of the uses and abuses of human rights in contemporary democratic societies. We are, they say, seeing the perverse effects of a 'religion of human rights' to which Europe has rashly devoted its heart and mind; and the supposed burgeoning of rights, which goes hand in hand with an unchecked rise of expectations, is catapulting (...) Western democracies into an age of never-ending demands. This emerged clearly in France in Spring 2013 during the demonstrations against equal marriage ('mariage pour tous') whose opponents deplored the excesses of a movement-driven left striving for an unbounded extension of rights - from the right to same-sex marriage to the enfranchisement of non-nationals or the right of same-sex couples to adopt. We focus on yes-or-no questions, which always carry information about the questioner's strategy, but never about the state of Nature, and show how strategic information reduces uncertainty through inferences about other players' goals and strategies. This uncertainty cannot always be captured by information structures of classical game theory. In the longstanding debate between liberals and libertarians over the morality of redistributive labor taxation, liberals such as John Rawls and Ronald Dworkin have consistently taken the position that such taxation is perfectly compatible with individual liberty, whereas libertarians such as Robert Nozick and Murray Rothbard have adopted the (very) contrary position that such taxation is tantamount to slavery. In this paper, I argue that the debate over redistributive labor taxation can be usefully reconstituted as a debate over the incidents (...) (or components) of self-ownership, with liberals arguing for a narrow definition of the concept and libertarians arguing for a broad one. By using what Alan Ryan has called the “language of proprietorship,” I pinpoint precisely the source of the disagreement between liberals and libertarians and assess the relative strengths of their arguments. I also show that the respective definitions of self-ownership used by liberals and libertarians are deeply problematic—though for strikingly different reasons. (shrink)

, Derek Matravers defends a new version of the arousal theory of musical expressiveness. In this paper it is argued that for various reasons, including especially what the theory implies about the inappropriateness of certain kinds of response to music, we should reject Matravers's theory in favour of some form of cognitivism.

The place of religion in society has changed profoundly in the last few centuries, particularly in the West. In what will be a defining book for our time, Taylor takes up the question of what these changes mean, and what, precisely, happens when a society becomes one in which faith is only one human possibility among others.

The authors focus on the European Union both as a regional organization with distinctive norms and practices, and as a grouping of states that reflect specific individual traditions and views. The chapter describes two core paradigms: the national and the post‐national. The national paradigm is recognizably realist and state‐centric in approach. It suggests that the focus of external behaviour should be the promotion of order via traditional power‐political means and for traditional state‐based normative ends. The post‐national paradigm, however, reflects a (...) more cosmopolitan understanding of global society in which Europe's institutional and substantive understanding of justice questions can be reflected in its policies beyond EU borders. These propositions are tested in three issue areas. Michael Haneke's film Hidden ( Caché, 2005) raises questions about responsibility and guilt in the context of post-colonial inequities that are profoundly discomfiting for the viewer, framing a meditation on identity, consciousness and responsibility that is at once visceral and intellectual. On the reading presented here, this film makes visible and palpable some of the effects of the ' strange suppositions' about personal responsibility and memory that were first articulated by a philosopher who also felt called upon to justify colonialism: (...) John Locke. The perspective provided by the film casts light both on the unpleasant emotional resonances of Locke's theory of personal identity and points to the likely source of its structure in his celebrated theory of private property.
