Online dispute resolution (ODR) is an alternative to traditional litigation that can both significantly reduce the disadvantages suffered by litigants unable to afford an attorney and greatly improve court efficiency and economy. An important aspect of many ODR systems is a facilitator, a neutral party who guides the disputants through the steps of reaching an agreement. However, insufficient availability of facilitators impedes broad adoption of ODR systems. This paper describes a novel model of facilitation that integrates two distinct but complementary (...) knowledge sources: cognitive task analysis of facilitator behavior and corpus analysis of ODR session transcripts. This model is implemented in a decision-support system that (1) monitors cases to detect situations requiring immediate attention and (2) automates selection of standard text messages appropriate to the current state of the negotiations. This facilitation model has the potential to compensate for shortages of facilitators by improving the efficiency of experienced facilitators, assisting novice facilitators, and providing autonomous facilitation. Legal decision-support systems have the potential to improve access to justice, administrative efficiency, and judicial consistency, but broad adoption of such systems is contingent on development of technologies with low knowledge-engineering, validation, and maintenance costs. This paper describes two approaches to an important form of legal decision support—explainable outcome prediction—that obviate both annotation of an entire decision corpus and manual processing of new cases. The first approach, which uses an attention network for prediction and attention weights to highlight salient case (...) text, was shown to be capable of predicting decisions, but attention-weight-based text highlighting did not demonstrably improve human decision speed or accuracy in an evaluation with 61 human subjects. The second approach, termed semi-supervised case annotation for legal explanations, exploits structural and semantic regularities in case corpora to identify textual patterns that have both predictable relationships to case decisions and explanatory value. Engaging this debate through an examination and critique of Serene Jones’ ‘eschatological essentialism’, this essay suggests that Jones mistakenly characterizes constructivism, and thus turns too quickly to an essentialist paradigm without considering its risks. Using Judith Butler and Karl Barth, this essay proposes an account of identity that the author calls a ‘Christological constructivism’. Suggesting that the person and work (...) of Christ instantiates a grace that disrupts nature, Daniels argues for an account of identity as ‘more-than’, suggesting that this anthropology engenders healing for women, and men, within communities religious and otherwise. Much recent work in metaontology challenges the so-called ‘Quinean tradition’ in metaphysics. Especially prominently, Amie Thomasson argues for a highly permissive ontology over ontologies which eliminate many entities. I am concerned with disputing not her ontological claim, but the methodology behind her rejection of eliminativism – I focus on ordinary objects. Thomasson thinks that by endorsing the Quinean criterion of ontological commitment eliminativism goes wrong; a theory eschewing quantification over a kind may nonetheless be committed to its existence. I argue (...) that, contrary to Thomasson's claims, we should retain the Quinean criterion. Her arguments show that many eliminativist positions are flawed, but their flaws lie elsewhere: the Quinean criterion is innocent. Showing why reveals the importance of pragmatism in ontology. In §1 I compare Thomasson's account and the eliminativist views to which it stands in opposition. In §2 I re-construct Thomasson's reasons for rejecting the Quinean criterion. In §3 I defend the Quinean criterion, showing that the eliminativists’ flaws are not consequences of applying the Quinean criterion, before explaining the criterion's importance when properly understood. I conclude that Thomasson, though right to criticise the methodology of ordinary-object eliminativists, is wrong to identify the Quinean criterion as the source of their mistake. (shrink)

In a recent article in this journal, Anna Christensen raises an ‘Epicurean challenge’ to Don Marquis’ much-discussed argument for the immorality of abortion. According to Marquis’ argument, abortion is pro tanto morally wrong because it deprives the fetus of ‘a future like ours’. Drawing on the Epicurean idea that death cannot harm its victim because there is no subject to be harmed, Christensen argues that neither fetuses nor anyone else can be deprived of a future like ours by dying. Thus, (...) Christensen suggests, the moral wrongness of abortion cannot be grounded in the relevant individual’s being deprived of a future like ours. In this reply, I argue that on no interpretation of Christensen’s Epicurean challenge does it succeed. (shrink)

In this paper, we contest Peter Kivy’s claim that there is a clear opposition between ‘absolute music’ and programme music and between musical form and musical expressiveness. We argue, on the contrary, that much music falls somewhere between absolute and programme music as Kivy conceives the categories, and that such music is often primarily organized not on purely formal principles but by means of the overall ‘expressive trajectory’ or ‘poetic idea’ of the piece. Kivy is dismissive of all ‘narrativist’ interpretations (...) of what he considers absolute music, arguing that they add an ‘extraneous’ story to music that neither has nor needs one. We argue on the contrary that the history of the ‘heroic’ plot type in the tradition from Beethoven to Shostakovich demonstrates that composers in the Russian Romantic tradition conceived of their music as unified by ‘poetic ideas’, which were handed down and elaborated by one composer after another. Two of the most brilliant German thinkers of the twentieth century were Karl Jaspers and Rudolf Bultmann. Jaspers, the philosopher, and Bultmann, the theologian, were both influenced by the philosophy of Martin Heidegger and the rise of the existentialist movement. Late in their careers they interacted on the subject of Bultmann's attempt to divest Christianity of its mythical components and make sense of it in more modern terms. This work is a compilation of articles by Jaspers and Bultmann that (...) formed a running debate originally published in various scholarly journals. The first half of the book is Jaspers' lengthy and critical analysis of Bultmann's interpretation of Christianity, in which Jaspers essentially rejects the premise that Christianity or any other religion can or should be understood without its mythical framework. Jaspers charges that Bultmann has radically misunderstood the nature of myth and that myth is an irreplaceable form of symbolic communication. In the second part, Bultmann defends his approach, suggesting that Jaspers has not really understood his intent or meaning. Contemporary people today, schooled in the scientific tradition, are likely to reject the biblical texts because of their miraculous claims and supernatural content. Bultmann insists that the scholarly, scientific study of the Bible is a legitimate way to reveal its true message, apart from all the supernatural trappings. Finally, in response, Jaspers accepts some of Bultmann's clarifications but takes him to task on the subject of justification by faith, which he feels Bultmann defines too narrowly and too exclusively. This stimulating work by two penetrating minds will give anyone interested in perennial philosophical and theological questions much to ponder. (shrink)
