Clinical ethics consultations exist to support patients, families and clinicians who are facing ethical or moral challenges related to patient care. They provide a forum for open communication, where all stakeholders are encouraged to express their concerns and articulate their viewpoints. Ethics consultations can be requested by patients, caregivers or members of a patient’s clinical or supportive team. Althoughpatientsand by extension their families (especially in cases of decisional incapacity) are the common denominators in most ethics consultations, these constituents are theleastlikely (...) to request them. At many healthcare organisations in the USA, ethics consultations are overwhelmingly requested by physicians and other clinicians. We believe it is vital that healthcare institutions bridge the knowledge gaps and power imbalances over access to ethics consultation services through augmented policies, procedures and infrastructure. With enhanced education and support, patients and families may use ethics consultation to elevate their voices and prioritise their unique characteristics and preferences in the delivery of their healthcare. Empowering patients and families to request ethics consultation can only strengthen the patient/family–clinician relationship, enhance the shared decision-making model of care and ultimately lead to improved patient-centred care. Curnow, Rohan This article is concerned with the beginning of the trajectory of thought that links two events: Vatican II and the emergence of an explicit doctrine of the Preferential Option for the Poor in the official documents of the Latin American Episcopal Conference's (CELAM) meetings at Puebla, Mexico in 1968, and Medell n, Columbia in 1979. Specifically, this article concentrates on a group that formed early in proceedings at Vatican II, known as both the 'Group of the Church (...) of the Poor' or the 'Belgian College Group' (after the place in which it met). The group, albeit an informal one, championed the issue of poverty in work that was conducted largely behind the scenes and outside official Conciliar structures. This article illustrates that, via the work of the Group of the Church of the Poor, the poor broke into the Church's consciousness at the Council in a new - if limited - way. To demonstrate this point, this article focuses on the Group of the Church of the Poor's: (a) origins and complexion; (b) aims and activities; and, (c) achievements and shortcomings at the Council. It is a truism that some industries are controversial either because the processes employed or the resulting products, for instance, can potentially harm the well-being of people. The controversy that surrounds certain industries can sharply polarise public opinion and debate. In this article, we employ legitimacy theory and morality policy to show how one industry sector (the electronic gaming machine sector as part of the wider gambling industry) is subject to this reaction. We suggest that the difficulty in establishing legitimacy (...) surrounding CSR practices in this sector is related to morality policy, whereby ideology and personal values play important roles in dividing opinion. Thus, gambling is often framed as an activity that is morally and ethically problematic. To show how this can manifest, we examine the veracity of two state-funded studies in Australia used in the development of gambling policy and their subsequent adoption in academic research. We highlight methodological, analytical and reporting issues in these studies that normally should be identified by those using such findings. The significance is that when morality policy and conflict surrounding legitimacy are involved, then it can explain why adherence to normative research standards is potentially lowered. Our theoretical posture leads us to further speculate that the adoption and communication of CSR in electronic gambling will be contested by opponents of the industry. (shrink)

According to Amie Thomasson’s modal normativism, the function of modal discourse is to convey semantic rules. But what is a "semantic rule"? I raise three worries according to which there is no conception of a semantic rule that can serve the needs of a modal normativist. The first worry focuses on de re and a posteriori necessities. The second worry concerns Thomasson's inferential specification of the meaning of modal terms. The third worry asks about the normative status of semantic rules.

According to the plurivaluationist, our vague discourse doesn’t have a single meaning. Instead, it has many meanings, each of which is precise—and it is this plurality of meanings that is the source of vagueness. I believe plurivaluationist positions are underdeveloped and for this reason unpopular. This paper attempts to correct this situation by offering a particular development of plurivaluationism that I call supersententialism. The supersententialist leverages lessons from another area of research—the Problem of the Many—in service of the plurivaluationist position. (...) The Problem reveals theoretical reasons to accept that there are many cats where we thought there was one; the supersententialist claims that we are in a similar situation with respect to languages, propositions and sentences. This study offers a new interpretation of Hegelian recognition – a central tenet of German Idealism – focusing on positive ethical behaviours, such as love and forgiveness. Building on the work of Simone de Beauvoir and Jean-Paul Sartre, Disley reassesses Hegel’s approach to the subject/object dialectic and explores the previously neglected theological dimensions of his writings. Her new interpretation offers an innovative reading of Hegel’s stance on the relationship between intersubjectivity, forgiveness and repentance in his social theory.0.

The association of colour, sensation and the body, which is noted by Jacqueline Lichtenstein and Merleau-Ponty through their insights on colour as the disturbing of structure and form, offers a way in which to foreground a series of questions about embodiment and the discourse of vision. An analysis of the chromatics of Red Road, which features a female protagonist who works as a surveillance officer in a CCTV control room, offers a way to echo and disrupt the ‘mechanisms and techniques (...) of reality-control’ and to challenge what constitutes socially acceptable bodies and the cinematic institution of the image of woman. In Red Road the legible architecture of the film image emerges through the myriad colours of light reflected by a camera lens and the effacement of details in areas affected by shadow and variations in focus. The camera is almost always in motion and responsive to the gestures of the protagonist's body, signalling the potential of the chromatics of Red Road to trouble the structures of seeing familiar to cinematic representation. Colour and perception remain open to contingency and change, fostering alternative subject positions that trace the interrelations of the body — its senses and sensations — and the discourse of vision. The unsettling of perception refigures the encounter between the self and others through the imaginary or fictional worlds that remind us of the uncertainties and vulnerability of such interactions. Does moral vagueness require ontic vagueness? A central challenge for nonontic treatments of moral vagueness arises from the referential stability of moral terms across small changes in how they are applied: if moral vagueness is not ontic vagueness, it’s hard to explain this referential stability. Pointing to this challenge, Miriam Schoenfield has argued that moral vagueness is ontic vagueness, at least for a moral realist. I disagree. I argue that a moral realist can use a conceptual role semantics for moral (...) terms to give a purely semantic treatment of moral vagueness. (shrink)

In this article I describe the development of my collaboration with the textile artist Susie Freeman in the production of the visual arts project Pharmacopoeia. Over the last 3 years we have created a body of work that aims to provide information about common medical treatments in a way that engages the public imagination. The work is dominated by the use of active pharmaceuticals, both pills and capsules, which are incorporated into dramatic fabrics by a process known as pocket knitting. (...) These fabrics are then made into clothing and accessories, making their individual messages easier to ‘read’. The work aims to encourage people to think about their own medical and pharmacological history, and to reflect on their relationship with commonly prescribed drugs. It also reveals how dependent our society is on pharmaceuticals, how ambivalent we feel about them and yet how casually we use them. (shrink)

Previous works have proposed and utilized unsupervised lexical and semantic similarity techniques based on vector space models, latent semantic analysis and topic models. However, these techniques were evaluated on a small multilingual corpus of directives and NIMs. In this paper, we utilize word and paragraph embedding models learned by shallow neural networks from a multilingual legal corpus of European directives and national legislation (...) to develop unsupervised semantic similarity systems to identify transpositions. We evaluate these models and compare their results with the previous unsupervised methods on a multilingual test corpus of 43 Directives and their corresponding NIMs. We also develop supervised machine learning models to identify transpositions and compare their performance with different feature sets. Rituals are able to transform ordinary objects into extraordinary objects. And while rituals typically do not cause physical changes, they may imbue objects with a particular specialness – a simple gold band may become a wedding ring, while an ordinary dessert may become a birthday cake. To treat such objects as if they were ordinary then becomes inappropriate. How does this transformation take place in the minds of observers, and how do we recognize it when we see it? Here, we (...) suggest that two under-examined elements of ritual need deeper consideration within the context of ritual cognition. We propose a fully integrated operational definition in which these two critical ritual elements – causal opacity and goal demotion – are included. In a pre-registered experiment one-hundred and one adults, in a 2 × 2 mixed-within participants design observed actions performed upon profane objects. These actions were either ordinary or ritualized, and were described as a blessing, a curse, or were not described at all. Contrary to established findings and pre-registered predictions, we found that ritualized actions alone are not enough to influence perceptions of, and attributions towards, objects, and that positive goal information are more behaviorally persuasive than negative information. However, we found that participants recalled ritualized action in greater detail and with more specificity than ordinary actions. In effect, we demonstrate that causal opacity and goal information interact to allow us to recognize a ritual as a ritual. (shrink)

Adam Elga (Philosophers’ Imprint, 10(5), 1–11, 2010) presents a diachronic puzzle to supporters of imprecise credences and argues that no acceptable decision rule for imprecise credences can deliver the intuitively correct result. Elga concludes that agents should not hold imprecise credences. In this paper, I argue for a two-part thesis. First, I show that Elga’s argument is incomplete: there is an acceptable decision rule that delivers the intuitive result. Next, I repair the argument by offering a more elaborate diachronic puzzle (...) that is more difficult for imprecise Bayesians to avoid. (shrink)

Many accept David Lewis's (1983) claim that, among the candidate meanings for our predicates, some are more natural than others -- they do better or worse at ``carving nature at its joints''. Call this claim predicate naturalism. Disagreement remains over whether the notion of naturalness extends ``beyond the predicate'' (à la Sider, 2011). Are the candidate meanings of logical vocabulary also more or less natural? Call this claim logical naturalism. -/- One motivation for predicate naturalism comes from its supposed ability (...) to help rebut various radical indeterminacy arguments associated with Hilary Putnam (1977, 1980, 1981). It does so in combination with a popular meta-semantic theory called reference magnetism. I argue that the same threats of Putnam-style radical indeterminacy rearise for proponents of predicate naturalism -- threats which logical naturalism helps rebuts. So, if we accept predicate naturalism because it helps fend off threats of indeterminacy, we should also accept logical naturalism. (shrink)

As Big Data, the Internet of Things and insurance collide, so too, do the best and the worst of our futures. Insurance is summoned as an example of the interference in our private lives that is already underway everywhere. In this paper, we pause to reflect on this argument. Can changes in the way insurance measures the value of behaviour really serve as an example of the individual and social harms of datafication? How do we know? Insurance is a mathematical (...) relationship staged between individuals and groups, between risk and uncertainty, between distribution and assessment, between the value of sharing and the sharing of value. We use the case study of Discovery International, owner of Vitality, the market leading brand in behavioural insurance to consider how behaviour is being branded and how the brand behaves. (shrink)

In a paper from the 1980s, Byrd claims that the logic of "eventual permanence" for linear time is KD5. In this note we take up Byrd's novel argument for this and, treating the problem as one concerning translational embeddings, show that rather than KD5 the correct logic of "eventual permanence" is KD45.

Although ethics instruction has become an accepted part of the business school curriculum at both the undergraduate and graduate levels, some scholars have questioned its effectiveness, and research results have been mixed. However, studies yield interesting results regarding certain factors that influence the ethicality of business students and may impact the effectiveness of business ethics instruction. One of these factors is gender. Using personal and business ethics scenarios, we examine the main and interactive effects of gender and business ethics education (...) on moral judgment. We then analyze the relationships between gender and business ethics education on personal ethical perspectives. Our results indicate that women are generally more inclined to act ethically than men, but paradoxically women who have had business ethics instruction are less likely to respond ethically to business situations. In addition, men may be more responsive to business ethics education than women. Finally, women’s personal ethical orientations may become more relativistic after taking a business ethics class. Duty of care is the core ethical responsibility of healthcare workers. Getting the workforce vaccinated will provide safety to the public, protect the vulnerable population and provide a safe working environment. While most agree that healthcare workers should be prioritised in the vaccination programme, mandatory vaccination remains a complicated and contentious issue with political, legal and ethical dimensions. This study aims to determine the ethical considerations associated with mandatory vaccinations among healthcare workers. A total of 152 abstracts were identified of (...) which, 142 were excluded based on abstracts because they did not meet the inclusion criteria. The remaining ten articles were further evaluated with three articles that fit the inclusion criteria specifically discussing mandatory vaccination among healthcare workers and the ethical issues. Benefits, risks, effectiveness, equity and justice, autonomy, reciprocity and trust were used as a framework to discuss the ethical considerations which resonated both directly from the included papers, as well as more generally from the other literature associated with this search. There is limited literature on the topic of ethical considerations associated with COVID-19 mandatory vaccination of healthcare workers, as a systematic review identified only 3 papers. Benefits, risks, effectiveness, equity and justice, autonomy, reciprocity and trust were among the seven ethical considerations identified and discussed. (shrink)

BackgroundThe COVID-19 pandemic has presented extraordinary challenges to worldwide healthcare systems, however, prevalence remains low in some countries. While the challenges of conducting research in high-prevalence countries are well published, there is a paucity from low COVID-19 countries.MethodsA PRISMA guided systematic review was conducted using the databases Ovid-Medline, Embase, Scopus and Web of Science to identify relevant articles discussing ethical issues relating to research in low prevalence COVID-19 countries.ResultsThe search yielded 133 original articles of which only 2 fit the inclusion (...) criteria and aim, with neither specific to low prevalence. Most of the available literature focused on clinical management and resource allocation related to high prevalence countries. These results will be discussed under the ethical dimensions of equity, individual liberty, privacy and confidentiality, proportionality, public protection, provision of care, reciprocity, stewardship and trust..ConclusionsA systematic review failed to identify articles relating to COVID-19 research ethics, specific to low prevalence countries. It shows that there is a significant gap in the literature that warrants further investigation. Common ethical principles were used to present a distinct set of challenges experienced by a country with a low prevalence of COVID-19. This unique perspective of some of the common ethical problems surrounding research, may help guide further discussion and guide research in similar countries. (shrink)

Feminism’s contribution to homiletics so far has arguably been restricted to exploring gender difference in preaching. In 2014, however, Jennifer Copeland identified a need not merely to ‘include women “in the company of preachers” but to craft a new register for the preaching event’. This article considers what that new register might be and how it might be taught in the academy. It defines preaching as ‘the art of engaging the people of God in their shared narrative by creatively and (...) hospitably inviting them into an exploration of biblical text, by means of which, corporately and individually, they might encounter the divine’ and proposes that in both the Church and the Academy, women’s voices are suppressed by a rationalist hegemony. For the stories of women to be heard, a new homiletic is needed, in which would-be preachers first encounter themselves, then the Bible as themselves and finally their congregation in communality. Findings of researchers in practical preaching discover that women preachers are being influenced by feminist methodology, while the teaching of preaching is not. In order to achieve a hospitable preaching space, it is proposed that the Church and the Academy work together towards a new homiletic. (shrink)

There is a long history in science and technology studies of tracking problematic objects, such as controversies, matters of concern, and issues, using various digital tools. But what happens when public problems do not play out in these familiar ways? In this paper, we will think through the methodological implications of studying “problems” in relation to recent events surrounding the sharing of patient data in the National Health Service in the United Kingdom. When a data sharing agreement called care.data was (...) announced in 2013, nearly 1.5 million citizens chose to opt out. Yet, in subsequent years, there has been little evidence of a robust public mobilising around data sharing. We will attempt to track this elusive ‘non problem’ using some digital tools developed in STS for the purpose of mapping issues and problem definitions within science. Although we find these digital tools are unable to capture the “problem,” the process of searching helps us map the terrain of the case and forces us to consider wider definitions. (shrink)

We present four classical theories of counterpossibles that combine modalities and counterfactuals. Two theories are anti-vacuist and forbid vacuously true counterfactuals, two are quasi-vacuist and allow counterfactuals to be vacuously true when their antecedent is not only impossible, but also inconceivable. The theories vary on how they restrict the interaction of modalities and counterfactuals. We provide a logical cartography with precise acceptable boundaries, illustrating to what extent nonvacuism about counterpossibles can be reconciled with classical logic.

This paper argues that adopting a particular dialogical account of logical consequence quite directly gives rise to an interesting form of logical pluralism, the form of pluralism in question arising out of the requirement that deductive proofs be explanatory.

This paper asks: Is the quantifier variantist committed to metaphysical vagueness? My investigation of this question goes via a study of vague existence. I’ll argue that the quantifier variantist is committed to vague existence and that the vague existence posited by the variantist requires a puzzling sort of metaphysical vagueness. Specifically, I distinguish between (what I call) positive and negative metaphysical vagueness. Positive metaphysical vagueness is (roughly) the claim that there is vagueness in the world; negative metaphysical vagueness is (roughly) (...) the claim that there is vagueness that is not in our language or thought. I’ll argue that the quantifier variantist’s commitment to vague existence comes with positive metaphysical vagueness -- even if it doesn't require negative metaphysical vagueness. (shrink)

This paper argues that a prominent—and oft-thought to be persuasive—argument against general validity as the best account of validity for languages containing the actuality operator is flawed, the flaw arising out of inadequate attention to the formalisation of mood distinctions.

The present note investigates the connection between nonreflexive and nontransitive logics from a bounds-theoretic perspective. What will emerge is one way in which, if we focus on the ways in which strict and tolerant acts constrain one another, nonreflexive and nontransitive notions of consequence can be seen as simply reflecting different aspects of the same underlying reality.

The strong continuity thesis postulates that the properties of mind are an enriched version of the properties of life, and thus that life and mind differ in degree and not kind. A philosophical problem for this view is the ostensive discontinuity between humans and other animals in virtue of our use of symbols—particularly the presumption that the symbolic nature of human cognition bears no relation to the basic properties of life. In this paper, we make the case that a genuine (...) account of strong continuity requires the identification of some sort of correlate of symbol-use in basic life properties. Our strategy is three-fold: 1) we argue that examples of proto-symbolism in simple living systems would be consistent with an evolutionary trajectory that ultimately produced symbolic cognition in humans; 2) we introduce Gordon Tomkins’ biological notion of ‘symbol’ as something that represents to the organism a feature of its environment that is significant to its survival; and 3) we employ this biological understanding of symbol-use to suggest that the symbolic nature of human cognition can be understood as an enriched version of the basic symbolic properties of life, thus preserving life-mind continuity in this context.
