A partir de las categorías que emergieron, se procedió a realizar entrevistas a los profesores del nivel, para confrontar la congruencia de los lineamientos con las concepciones y prácticas descritas por ellos.Se constató la existencia de un enfoque académico-racionalista de las concepciones y actividades curriculares, concepciones (...) reduccionistas del pensamiento complejo y la metacognición, trasladando la responsabilidad de la falta de logro a sus estudiantes. A partir de las dimensiones definidas previamente, se levantaron categorías que emergieron del discurso, aplicadas a la conversación y a los actos de habla. Las principales conclusiones dan cuenta del reconocimiento de la importancia de esta perspectiva, en el reconocimiento de aulas diversas para las cuales se (...) tienen intuitivas, o desde lo aprendido autónomamente, pero no desde lo adquirido en la formación inicial como profesores. Surgical devices are often marketed before there is good evidence of their safety and effectiveness. Our paper discusses the ethical issues associated with the early marketing and use of new surgical devices from the perspectives of the six groups most concerned. Health Canada, which is responsible for licensing new surgical devices, should amend their requirements to include rigorous clinical trials that provide data on effectiveness and safety for each new product before it is marketed. Industry should comply with all Health (...) Canada requirements to obtain licenses for new products. Until Health Canada requires effectiveness and safety data, industry should cooperate with physicians in appropriate studies before releasing new products and should make balanced presentations of all the available evidence. Surgeons should, before using a new surgical device, assess the evidence on its effectiveness and safety and ensure they are properly trained and competent in using the device. Surgeons should provide their patients with an evaluation of the available evidence and inform them about possible complications and the surgeon's level of experience with the new device. Patients, who should be given an honest evaluation of the available evidence, possible complications, and the surgeon's experience, should be encouraged to evaluate the evidence and information to their own satisfaction to ensure that fully informed consent is given. Health institutions, responsible for regulating practice within their walls, should review new devices for safety, effectiveness, and economic impacts, before allowing their use. They should also limit the use of new surgical devices to surgeons trained and competent in the new technology. Professional societies should provide guidance on the early adoption of new surgical devices and technologies. We urge all those involved in the development, licensing, and use of new surgical devices to aim for higher ethical standards to protect the health and safety of patients requiring surgery. The lowest acceptable ethical standard would require device manufacturers to provide surgeons with accurate and timely information on the efficacy and safety of their products, allowing surgeons and patients to evaluate the evidence (and the significance of information not yet available) before surgery. During much of U.S. history, Black women had higher employment rates than white women. But by the late twentieth century, women in more privileged racial/ethnic, national origin, and education groups were more likely to work for pay. The authors compare the employment of white women to Blacks and three groups of Latinas—Mexicans, Cubans, and Puerto Ricans—and explain racial/ethnic group differences. White women work for pay more weeks per year than Latinas or Black women, although the gaps are small for all (...) groups but Mexicans. In all groups, education encourages and children reduce employment. Having a husband does not reduce employment, and husbands’ earnings have little effect. The higher fertility of Mexicans and the large number of recent immigrants among Mexican women reduce their employment relative to that of white women. The higher education of white women explains large shares of the employment gap with each group of women of color because, in today’s labor market, education strongly predicts employment. (shrink)

In the wake of the collapse of the Soviet bloc, it is timely to ask what continuing role, if any, the concept of sovereignty can and should play in the emerging "new world order." The aim of _Law, Power, and the Sovereign State_ is both to counter the argument that the end of the sovereign state is close at hand and to bring scholarship on sovereignty into the post-Cold War era. The study assesses sovereignty as status and as power and (...) examines the issue of what precisely constitutes a sovereign state. In determining how a political entity gains sovereignty, the authors introduce the requirements of de facto independence and de jure independence and explore the ambiguities inherent in each. They also examine the political process by which the international community formally confers sovereign status. Fowler and Bunck trace the continuing tension of the "chunk and basket" theories of sovereignty through the history of international sovereignty disputes and conclude by considering the usefulness of sovereignty as a concept in the future study and conduct of international affairs. They find that, despite frequent predictions of its imminent demise, the concept of sovereignty is alive and well as the twentieth century draws to a close. (shrink)

The evolution of humans required performing increasingly hierarchically complex tasks within multiple domains. Hierarchical complexity increases task by task. Tasks occur within, and differ by, determinable domains, their stages of performance measurable using the Model of Hierarchical Complexity. How well one performs within single and multiple domains is considered to indicate intelligence. Original task-initiation is more difficult than imitational learning and can create new domains. Levels of support reduce task difficulty, increasing performance. Task-performance may be generalized to other domains. Objective To develop an ethically, legally, and clinically appropriate ventilator allocation policy for AdventHealth Tampa and AdventHealth Carrollwood in Tampa, Florida, which could be enacted swiftly during the Covid-19 pandemic. Methods During Spring 2020, a subcommittee of the Medical Ethics Committee established consensus on the fundamental principles of the policy, then built on existing ethical, legal, and clinical guidance. Results The plan was finalized in May 2020. The plan triages patients based on exclusion criteria, prognosis and expected benefit of ventilation, (...) and change in prognosis over time. Decisions are made by committee in order to minimize moral distress among individual patient care providers. Conclusions Due to international concerns about healthcare resource shortages during the Covid-19 pandemic, hospitals need allocation policies informed by the crisis standard of care, the hospital’s ethical duty to plan for an emergency, and federal civil rights laws Policy Implications: This type of policy can serve as a model for other institutions to develop crisis standards of care resource allocation policies, which are a necessary component of disaster planning. Several of the most compelling anti-materialist arguments are motivated by the supposed existence of an unbridgeable epistemic gap between first-person subjective knowledge about one’s own conscious experience and third-personally acquired knowledge. The two with which this paper is concerned are Frank Jackson’s ‘knowledge argument’ and David Chalmers’s ‘modal argument’. The knowledge argument and the modal argument are often taken to function as ‘two sides of the same coin … in principle each succeeds on its own, but in practice they work (...) best in tandem’. This paper disagrees with the above claim, and argues that when considered together the knowledge argument and modal arguments illuminate each other’s weaknesses. These weaknesses become apparent when we acknowledge the epistemic richness of the cognitive aspect of perceptual experience, and question the epistemic role that any non-cognitive aspect might play. Closer examination of judgments about what it’s like to have a perceptual experience reveals fundamental problems with the knowledge argument, and when these problems are exposed, the two arguments can no longer ‘buttress each other where help is needed’. It becomes clear that neither is likely to succeed on its own, and when taken together both are destabilized. (shrink)

InDemocracy in America, Tocqueville described the ideal wife of a democratic citizen as a capable domestic helpmeet who enables the citizen‐husband to endure the daily trials of political activity. Tocqueville's biographers have presented Tocqueville's own wife Mary Mottley as having approximated this ideal. Mottley's importance, it is claimed, lay in providing the domestic calm and psychological support that Tocqueville needed to think, act, and write as he did. My aim in this article is to challenge this interpretation by offering an (...) overdue reassessment of Mottley's life and work, uncovering the hidden labors she performed in Tocqueville's circle and giving scope, where possible, to her own political views and activities. Mottley, I argue, refused to confine herself to the domestic‐management and emotional‐support roles typical of a Tocquevillian citizen‐wife. Instead, she carved out a role for herself as Tocqueville's political and intellectual interlocutor. (shrink)

In her Vindication of the Rights of Men, Mary Wollstonecraft accused Edmund Burke of having contempt for his political opponents. Yet she herself expressed contempt for Burke and did so unapologetically. Readers have long regarded Wollstonecraft’s decision to match Burke’s contempt with one of her own as either a tactical blunder or evidence that she sought merely to ridicule Burke rather than argue with him. I offer an interpretation and defence of Wollstonecraft's rhetorical choices by situating the Vindication within eighteenth-century (...) debates about the dangers of elite contempt and the best methods for stifling it. Rather than countering Burke’s contempt with more of the same, Wollstonecraft’s Vindication marks a distinction between two forms of contempt. The first expresses the false sense of superiority experienced by elites who owe their social elevation to arbitrary differences of wealth or family. As such, it represents both an abuse of privilege and an anxious recognition among elites that their... (shrink)

In the summer of 2008, the Spanish legislature resolved to grant great apes (though not all simians) basic human rights. While the decision to grant such rights came about largely through the lobbying efforts of the Great Ape Project (GAP), the decision has potential reverberations throughout the scientific world and beyond in its implications for shaping determinations of “what is human.” Such implications do not appear to be lost on various groupings of scientists who have spoken about their opinions about (...) the case and the project in general. These groupings of scientists, I argue, using the work of Mary Douglas and others, can be compared to “tribes” actively advancing and defending their classifications of the “human” in a bid for a retention or expansion of power. The question about truth, experience and sharing of truth can be addressed from the viewpoint of a shared sense of community. The search for truth is related to the sensus communis and the conscience – con scientia – that is formed in the community. The sensus communis is not only a general faculty in all men, but also the sense that founds community. Thereby the knowledge is true only in front of the other. Truth reveals itself in conversation. By conversation (...) it means that there are both someone who asks questions and someone who answers them, and that they change their roles. In order to understand each other, they have to share a common field of experience. The approach to the concept of truth as a representation of things loses its place and gives way to the understanding of truth as something where meaning as sense and truth as open and exposed concept appears in the foreground. Phenomenology reveals that community correlates and imposes a set of senses to the consciousness and conscience of the individual. This lets phenomenologists focus on life, culture and language. The truth transforms from meaning into sense. It becomes a dynamic determination of a human being. (shrink)

Devant le constat du déclin toujours plus rapide de la diversité biologique et les limites des res- sources disponibles pour l’enrayer, il est nécessaire de déterminer quels moyens devraient être engagés dans sa protection. Pour ce faire, une méthode efficace serait d’évaluer les bénéfices tirés de la biodiversité afin d’estimer rationnellement les coûts légitimes de sa protection. L’évaluation économique, qui se présente d’emblée sur un mode quantitatif, serait alors un outil précieux. Dans ce texte, nous présentons différentes méthodes d’évaluation économique (...) de la biodiversité ainsi que certaines de leurs limites méthodologiques. Par la suite, nous montrons qu’en dépit de ses avantages pratiques, l’évaluation économique échoue à représenter l’ensemble des valeurs en jeu dans la protection de la biodiversité. Nous décrivons alors trois types de valeurs incommen- surables avec des bénéfices économiques : la valeur de legs, qui renvoie aux obligations de trans- mission du patrimoine naturel dont nous avons hérité ; la valeur d’existence, qui renvoie à la considération morale d’intérêts autres que ceux des êtres humains ; la valeur de transformation, qui renvoie à la capacité d’examiner et de critiquer nos préférences et inclinaisons afin d’inclure celles-ci dans une vision du monde rationnelle et cohérente. Pour conclure, nous plaidons en faveur de l’élaboration de méthodes de concertation et d’évaluation participatives et pluralistes permettant de rendre compte de la diversité et de l’hétérogénéité des valeurs de la biodiversité. This article discusses two complementary themes that play an important role in contemporary South African political philosophy: (1) the racist tradition in Western philosophy; and (2) the role of ubuntu in regaining an authentic African identity, which was systematically suppressed during the colonial past and apartheid. These are also leading themes in Mogobe Ramose’s African Philosophy Through Ubuntu. The first part concentrates on John Locke. It discusses the thesis that the reprehensible racism of many founders of liberal political philosophy has (...) lethally infected liberal theory. This view neglects the distinction between genesis and justification. Political liberalism has since cleansed itself of the prejudices of its spiritual ancestors. Liberal human rights exclude racism as a matter of principle. The second part discusses the claim that the ubuntu philosophy provides a better basis for a constitution in a modern society than political liberalism. A major problem is that ubuntu is an essentially contested concept. Some philosophers consider ubuntu to be a moribund notion (Matolino); others see it as a vital concept par excellence. In the latter case, it is elaborated from sundry incompatible political views, ranging from African nationalism (Ramose) via humanist communitarianism (Metz) to liberalism (Mboti). Conclusion: as an essentially contested ideological concept, ubuntu should not be a decisive constitutional standard for the application of state force. In contrast, the constitutional model of political liberalism provides a reasonable alternative, as it is designed precisely to solve the problem of social plurality and ideological contest. Du simple devoir d’assistance dans des situations ponctuelles à des projets de transformation des conditions de vie animale à grande échelle, la défense de l’interventionnisme entre en conflit avec la pensée conservationniste qui valorise la naturalité ou l’autonomie des systèmes écologiques. Dans cet article, nous tentons de mettre en dialogue les intuitions interventionnistes et la pensée conservationniste. Nous (...) exposons tout d’abord l’argument interventionniste et ses limites épistémiques. Nous mitigeons ensuite le constat selon lequel les conditions de vie des animaux sauvages justifient notre intervention en replaçant le problème de la souffrance dans un cadre évolutif et écologique plus large puis en insistant sur d’autres obligations vis-à-vis des animaux sauvages comme le respect de leur autonomie ou de leur souveraineté. Enfin, nous défendons une conception pluraliste de nos relations au monde naturel dans laquelle le souci pour les animaux s’équilibre avec d’autres valeurs écocentrées. Nous concluons en présentant les ressources encore peu explorées d’une conservation compassionnelle qui intègre le souci pour les individus et le souci pour les collectifs écologiques dans les normes de ses actions. | : The ubiquity of suffering in the wild raises the question of our obligation to intervene. From a simple duty of assistance in particular situations to large-scale projects aimed at transforming animal living conditions, the defense of interventionism often conflicts with conservationist values, which emphasize the naturalness or autonomy of ecological systems. In this article, we attempt to open a dialogue between interventionist intuitions and the conservationist school of thought. We first expose the interventionist argument and its epistemic limitations. We subsequently mitigate the statement according to which the living conditions of wild animals justify human intervention by replacing the problem of suffering in a broader ecological and evolutionary framework, as well as by insisting on other obligations that we may have towards wild animals, such as the respect of their autonomy and sovereignty. Finally, we defend a pluralistic conception of our relationships to the natural world, in which care for animals has to be balanced with other, eco-centered, values. We conclude by presenting the resources of a compassionate conservation approach, which remains largely unexplored and integrates care for individual animals as well as for ecological entities in its norm for action. The nineteenth-century pioneer and only expert in Byzantine Studies in the territory of presentday Latvia, the Baltic German classical philologist Eduard Kurtz, was born in Mitau (Mītava, Jelgava) on December 20, 1845 into the family of a local teacher, Johann Heinrich Kurtz and Wilhelmine Auguste (née Jacobi), as the seventh of eleven children.

As recently as 1970 about one-fifth of the children living in single-parent households resided in ones created by the death of a father. In colonial and nineteenth-century America, death was a much more important factor in disrupting parent-child relationships than it is today. Past societal reaction to the death of a parent continues to influence social policy; for example, widows and their dependent children receive more public assistance than divorced mothers or single mothers with children born out-of-wedlock. Although the material (...) conditions for widows have improved over time, the social network available to help them cope with the emotional distress caused by the death of a husband probably has diminished. Animals and Business Ethics is an edited book that applies business ethical theory to nonhuman animals. It explores the ethics of commodifying animals in a business context, how stakeholder and social contract theories relate to animals, how business can be regulated to improve conditions for animals, how to create more humane jobs for humans and animals, and the linkages between human and animal well-being, in the context of human workers and consumers who interact with animals in business. Business ethics literature (...) has underrepresented animals, although this is beginning to change. This book is an introduction to how business ethics theory can be applied, through a range of theoretical chapters and case studies. Animals and Business Ethics is a valuable contribution to the literature, which opens space for additional research. (shrink)

This book presents a collection of philosophical essays on freedom and tolerance in the Netherlands. It explores liberal freedom and its limits in areas such as freedom of speech, public reason, sexual morality, euthanasia, drugs policy, and minority rights. The book takes Dutch practices as exemplary test cases for the principled discussions on these subjects from the perspective of political liberalism. Indeed, the Netherlands may be viewed as a social laboratory in human tolerance. During the Cultural Revolution of the 1960s, (...) Holland took the lead in a global emancipation process towards a society based on equal freedom. It was the first country to legalize euthanasia, soft drugs and gay marriage. In the final sections, the book examines the question of whether the political murders on the politician Pim Fortuyn and the film director Theo van Gogh, the reactions to Ayaan Hirsi Ali’s film Submission, as well as the success of the populist politician Geert Wilders are signs of the end of Dutch tolerance. Although it recognizes that the political climate has taken a conservative turn, the book shows that the Netherlands still shows remarkable tolerance. (shrink)
