In the wake of the collapse of the Soviet bloc, it is timely to ask what continuing role, if any, the concept of sovereignty can and should play in the emerging "new world order." The aim of _Law, Power, and the Sovereign State_ is both to counter the argument that the end of the sovereign state is close at hand and to bring scholarship on sovereignty into the post-Cold War era. The study assesses sovereignty as status and as power and (...) examines the issue of what precisely constitutes a sovereign state. In determining how a political entity gains sovereignty, the authors introduce the requirements of de facto independence and de jure independence and explore the ambiguities inherent in each. They also examine the political process by which the international community formally confers sovereign status. Fowler and Bunck trace the continuing tension of the "chunk and basket" theories of sovereignty through the history of international sovereignty disputes and conclude by considering the usefulness of sovereignty as a concept in the future study and conduct of international affairs. They find that, despite frequent predictions of its imminent demise, the concept of sovereignty is alive and well as the twentieth century draws to a close. (shrink)

Surgical devices are often marketed before there is good evidence of their safety and effectiveness. Our paper discusses the ethical issues associated with the early marketing and use of new surgical devices from the perspectives of the six groups most concerned. Health Canada, which is responsible for licensing new surgical devices, should amend their requirements to include rigorous clinical trials that provide data on effectiveness and safety for each new product before it is marketed. Industry should comply with all Health (...) Canada requirements to obtain licenses for new products. Until Health Canada requires effectiveness and safety data, industry should cooperate with physicians in appropriate studies before releasing new products and should make balanced presentations of all the available evidence. Surgeons should, before using a new surgical device, assess the evidence on its effectiveness and safety and ensure they are properly trained and competent in using the device. Surgeons should provide their patients with an evaluation of the available evidence and inform them about possible complications and the surgeon's level of experience with the new device. Patients, who should be given an honest evaluation of the available evidence, possible complications, and the surgeon's experience, should be encouraged to evaluate the evidence and information to their own satisfaction to ensure that fully informed consent is given. Health institutions, responsible for regulating practice within their walls, should review new devices for safety, effectiveness, and economic impacts, before allowing their use. They should also limit the use of new surgical devices to surgeons trained and competent in the new technology. Professional societies should provide guidance on the early adoption of new surgical devices and technologies. We urge all those involved in the development, licensing, and use of new surgical devices to aim for higher ethical standards to protect the health and safety of patients requiring surgery. The lowest acceptable ethical standard would require device manufacturers to provide surgeons with accurate and timely information on the efficacy and safety of their products, allowing surgeons and patients to evaluate the evidence (and the significance of information not yet available) before surgery. During much of U.S. history, Black women had higher employment rates than white women. But by the late twentieth century, women in more privileged racial/ethnic, national origin, and education groups were more likely to work for pay. The authors compare the employment of white women to Blacks and three groups of Latinas—Mexicans, Cubans, and Puerto Ricans—and explain racial/ethnic group differences. White women work for pay more weeks per year than Latinas or Black women, although the gaps are small for all (...) groups but Mexicans. In all groups, education encourages and children reduce employment. Having a husband does not reduce employment, and husbands’ earnings have little effect. The higher fertility of Mexicans and the large number of recent immigrants among Mexican women reduce their employment relative to that of white women. The higher education of white women explains large shares of the employment gap with each group of women of color because, in today’s labor market, education strongly predicts employment. (shrink)

The evolution of humans required performing increasingly hierarchically complex tasks within multiple domains. Hierarchical complexity increases task by task. Tasks occur within, and differ by, determinable domains, their stages of performance measurable using the Model of Hierarchical Complexity. How well one performs within single and multiple domains is considered to indicate intelligence. Original task-initiation is more difficult than imitational learning and can create new domains. Levels of support reduce task difficulty, increasing performance. Task-performance may be generalized to other domains. InDemocracy in America, Tocqueville described the ideal wife of a democratic citizen as a capable domestic helpmeet who enables the citizen‐husband to endure the daily trials of political activity. Tocqueville's biographers have presented Tocqueville's own wife Mary Mottley as having approximated this ideal. Mottley's importance, it is claimed, lay in providing the domestic calm and psychological support that Tocqueville needed to think, act, and write as he did. My aim in this article is to challenge this interpretation by offering (...) an overdue reassessment of Mottley's life and work, uncovering the hidden labors she performed in Tocqueville's circle and giving scope, where possible, to her own political views and activities. Mottley, I argue, refused to confine herself to the domestic‐management and emotional‐support roles typical of a Tocquevillian citizen‐wife. Instead, she carved out a role for herself as Tocqueville's political and intellectual interlocutor. (shrink)

Objective To develop an ethically, legally, and clinically appropriate ventilator allocation policy for AdventHealth Tampa and AdventHealth Carrollwood in Tampa, Florida, which could be enacted swiftly during the Covid-19 pandemic. Methods During Spring 2020, a subcommittee of the Medical Ethics Committee established consensus on the fundamental principles of the policy, then built on existing ethical, legal, and clinical guidance. Results The plan was finalized in May 2020. The plan triages patients based on exclusion criteria, prognosis and expected benefit of ventilation, (...) and change in prognosis over time. Decisions are made by committee in order to minimize moral distress among individual patient care providers. Conclusions Due to international concerns about healthcare resource shortages during the Covid-19 pandemic, hospitals need allocation policies informed by the crisis standard of care, the hospital’s ethical duty to plan for an emergency, and federal civil rights laws Policy Implications: This type of policy can serve as a model for other institutions to develop crisis standards of care resource allocation policies, which are a necessary component of disaster planning. In the summer of 2008, the Spanish legislature resolved to grant great apes (though not all simians) basic human rights. While the decision to grant such rights came about largely through the lobbying efforts of the Great Ape Project (GAP), the decision has potential reverberations throughout the scientific world and beyond in its implications for shaping determinations of “what is human.” Such implications do not appear to be lost on various groupings of scientists who have spoken about their opinions about (...) the case and the project in general. These groupings of scientists, I argue, using the work of Mary Douglas and others, can be compared to “tribes” actively advancing and defending their classifications of the “human” in a bid for a retention or expansion of power. Several of the most compelling anti-materialist arguments are motivated by the supposed existence of an unbridgeable epistemic gap between first-person subjective knowledge about one’s own conscious experience and third-personally acquired knowledge. The two with which this paper is concerned are Frank Jackson’s ‘knowledge argument’ and David Chalmers’s ‘modal argument’. The knowledge argument and the modal argument are often taken to function as ‘two sides of the same coin … in principle each succeeds on its own, but in practice they work (...) best in tandem’. This paper disagrees with the above claim, and argues that when considered together the knowledge argument and modal arguments illuminate each other’s weaknesses. These weaknesses become apparent when we acknowledge the epistemic richness of the cognitive aspect of perceptual experience, and question the epistemic role that any non-cognitive aspect might play. Closer examination of judgments about what it’s like to have a perceptual experience reveals fundamental problems with the knowledge argument, and when these problems are exposed, the two arguments can no longer ‘buttress each other where help is needed’. It becomes clear that neither is likely to succeed on its own, and when taken together both are destabilized. (shrink)

In her Vindication of the Rights of Men, Mary Wollstonecraft accused Edmund Burke of having contempt for his political opponents. Yet she herself expressed contempt for Burke and did so unapologetically. Readers have long regarded Wollstonecraft’s decision to match Burke’s contempt with one of her own as either a tactical blunder or evidence that she sought merely to ridicule Burke rather than argue with him. I offer an interpretation and defence of Wollstonecraft's rhetorical choices by situating the Vindication within (...) eighteenth-century debates about the dangers of elite contempt and the best methods for stifling it. Rather than countering Burke’s contempt with more of the same, Wollstonecraft’s Vindication marks a distinction between two forms of contempt. The first expresses the false sense of superiority experienced by elites who owe their social elevation to arbitrary differences of wealth or family. The #metoo movement has forced many fans to consider what they should do when they learn that a beloved artist has acted immorally. One natural thought is that fans ought to give up the artworks of immoral artists. In Why It's OK to Enjoy the Work of Immoral Artists, Mary Beth Willard argues for a more nuanced view. Enjoying art is part of a well-lived life, so we need good reasons to give it up. And it turns out good (...) reasons are hard to find. Willard show that it's reasonable to believe that most boycotts of artists won't succeed, so most of the time there's no ethical reason to join in. Someone who manages to separate the art from the artist isn't making an ethical mistake by buying and enjoying their art. She then considers the ethical dimensions of canceling artists and so-called "cancel culture," arguing that canceling is ethically risky because it encourages moral grandstanding. Willard concludes by arguing that the popular debate has overlooked the power of art to change our lives for the good. It's of course OK to decide to give up the artwork of immoral artists, but--as Willard shows in this provocative little volume--it's OK to continue to enjoy their art, as well. In this paper I further elucidate and defend a metaontological position that allows you to have a minimal ontology without embracing an error-theory of ordinary talk. On this view 'there are Fs' can be strictly and literally true without bringing an ontological commitment to Fs. Instead of a sentence S committing you to the things that must be amongst the values of the variables if it is true, I argue that S commits you to the things that must exist as (...) truthmakers for S if it is true. I rebut some recent objections that have been levelled against this metaontological view. (shrink)

When there is truth, there must be some thing (or things) to account for that truth: some thing(s) that couldn’t exist and the true proposition fail to be true. That is the truthmaker principle. True propositions are made true by entities in the mind-independently existing external world. The truthmaker principle seems attractive to many metaphysicians, but many have wanted to weaken it and accept not that every true proposition has a truthmaker but only that some important class of propositions require (...) truthmakers.1 Let us, following Armstrong, call the claim that all true propositions, without exception, have a truthmaker, Truthmaker Maximalism. Why might one be tempted to the spirit of truthmaker theory but reject Truthmaker Maximalism? Well, you might deny that necessary truths need truthmakers, for one, and insist that only contingent truths have truthmakers. But I think it’s fair to say that the most common motivation for rejecting maximalism concerns negative truths. The thought that negative truths are exempt from the demand for truthmakers could be justified in one of two ways: there is the claim that we don’t need truthmakers for negative truths, and there is the claim that we can’t have.. In _The Ethical Primate_, Mary Midgley, 'one of the sharpest critical pens in the West' according to the _Times Literary Supplement_, addresses the fundamental question of human freedom. Scientists and philosophers have found it difficult to understand how each human-being can be a living part of the natural world and still be free. Plato famously promised to complement the Sophist and the Statesman with another work on a third sort of expert, the philosopher--but we do not have this final dialogue. Mary Louise Gill argues that Plato promised the Philosopher, but did not write it, in order to stimulate his audience and encourage his readers to work out, for themselves, the portrait it would have contained. The Sophist and Statesman are themselves members of a larger series starting with the Theaetetus, Plato's investigation (...) of knowledge, and the whole series relies on the Parmenides, the second part of which presents a philosophical exercise, introduced as the first step in a larger philosophical program. Gill contends that the dialogues leading up to the missing Philosopher, though they reach some substantive conclusions, are philosophical exercises of various sorts designed to train students in dialectic, the philosopher's method; and that a second version of the Parmenides exercise, closely patterned on it, spans parts of the Theaetetus and Sophist and brings the philosopher into view. This is the exercise about being, the subject-matter studied by Plato's philosopher. Plato hides the pieces of the puzzle and its solution in plain sight, forcing his students (and modern readers) to dig out the pieces and reconstruct the project. Gill reveals how, in finding the philosopher through the exercise, the student becomes a philosopher by mastering his methods. She shows that the target of Plato's exercise is internally related to its pedagogical purpose. (shrink)

I argue that the truthmaker theorist should be a priority monist if she wants to avoid commitment to mysterious necessary connections. In section 1 I briefly discuss the ontological options available to the truthmaker theorist. In section 2 I develop the argument against truthmaker theory from the Humean denial of necessary connections. In section 3 I offer an account of when necessary connections are objectionable. How can we critique political theory when all we have to use are its own conceptual tools? As Hannah Arendt observed, it can only be done through leaps, inversions, and the turning of concepts upside-down. This is the first critically evaluative study of Gaston Bachelard's philosophy of science to be written in English. Bachelard's professional reputation was based on his philosophy of science, though that aspect of his thought has tended to be neglected by his English-speaking readers. Dr Tiles concentrates here on Bachelard's critique of scientific knowledge. Bachelard emphasised discontinuities in the history of science; in particular he stressed the ways of thinking about and investigating the world to be found in modern science. This, (...) as the author shows, is paralleled by those debates among English-speaking philosophers about the rationality of science and the 'incommensurability' of different theories. To these problems Bachelard might be taken as offering an original solution: rather than see discontinuities as a threat to the objectivity of science, see them as products of the rational advancement of scientific knowledge. Dr Tiles sets out Bachelard's views and critically assesses them, reflecting also on the wider question of how one might assess potentially incommensurable positions in the philosophy of science as well as in science itself. I begin by contrasting three approaches one can take to the distinction between the essential and accidental properties: an ontological, a deflationary, and a mind‐dependent approach. I then go on to apply that distinction to the necessary a posteriori, and defend the deflationist view. Finally I apply the distinction to modal truth in general and argue that the deflationist position lets us avoid an otherwise pressing problem for the actualist: the problem of accounting for the source of modal truth.
