There are many reports about the digital divideand many discrepant interpretations of what thereports indicate. This pattern of competinganalyses, often in relation to identical datasets, has endured for a good part of the lastdecade. It is argued here that a major problemwith much of the digital divide research is afailure to include ethical concerns as anexplicit part of analyzing and interpretingdigital divide gaps. If researchers includemore recognition of ethics with their findingsabout divide gaps, it is likely that they willproduce better (...) research and findings as well asmore defensible linkages between study reportsand policy deliberations. In this article we consider some of the implications of the UK Human Rights Act 1998 for nurses in practice. The Act has implications for all aspects of social life in Britain, particularly for health care. We provide an introduction to the discourse of rights in health care and discuss some aspects of four articles from the Act. The reciprocal relationship between rights and obligations prompted us to consider also the relationship between guidelines in the United Kingdom Central Council’s Code (...) of professional conduct and the requirements of the Human Rights Act 1998. We conclude with the recommendation that the new legislation should be welcomed for its potential to support good practice and to urge critical and reflective practice rather than as yet another burdensome bureaucratic imposition. Despite being a collection of holistic assessment tools, the comprehensive geriatric assessment primarily focuses on the social category of age during the assessment and disregards for example gender. This article critically reviews the standardized testing process of the comprehensive geriatric assessment in regard to diversity-sensitivity. I show that the focus on age as social category during the assessment process might potentially hinder positive outcomes for people with diverse backgrounds of older patients in relation to other social categories, such as race, (...) gender or socio-economic background and their influence on the health of the patient as well as the assessment and its outcomes. I suggest that the feminist perspective of intersectionality with its multicategorical approach can enhance the diversity-sensitivity of the comprehensive geriatric assessment, and thus improve the treatment of older patients and their quality of life. By suggesting an intersectional-based approach, this article contributes to debates about justice and diversity in medical philosophy and advocates for the normative value of diversity in geriatric medicine. Although we are enthusiastic about a Darwinian approach to culture, we argue that the overview presented in the target article does not sufficiently emphasize the crucial explanatory role that psychology plays in the study of culture. We use a number of examples to illustrate the variety of ways by which appeal to psychological factors can help explain cultural phenomena. (Published Online November 9 2006).

Si en autores como José Ramón Castro hay coherencia entre su producción historiográfica profesional y escolar (su fidelidad al régimen es inquebrantable), Jaime Vicens Vives o Antonio Domínguez Ortiz, como autores de manuales representan la cultura oficial (legitiman al régimen); como historiadores profesionales, la denominada cultura establecida, al distanciarse más de él y de sus valores. Hume after arguing for the compatibility of liberty and necessity, a view now known as soft determinism or compatibilism , noted that it is not ‘possible to explain distinctly, how the Deity can be the mediate cause of the actions of sin and moral turpitude’. It seems that Hume is correct if the explanation must show specifically why an omnipotent and omnibenevolent deity must permit certain actions that to human reason seem to be unnecessary evils. On the other hand if (...) such specifity is not required, the soft determinist who also happens to be a theist can argue that it is possible that the actual world is the best of all possible worlds even though the reason for any specific apparent evil cannot be known. If seemingly evil choices are free in the soft determinist's sense but determined by an omnipotent and omniscient deity, then either that deity is not omnibenevolent or that deity has determined the world to have the maximum possible goodness through including seemingly evil choices in the scheme of things. Consequently if, as the traditional theist believes, the creator is omnibenevolent as well as omnipotent and omniscient, the occurrence of seemingly evil choices are necessary for maximizing the goodness of the whole. The nature of conceptual analysis is elucidated by a proposed solution to moore's paradox of analysis. Occurrent, Dispositional, And property concepts are distinguished, And the notion of epistemic gain is introduced and explained. It is shown that although a correct analysis equates property concepts this is done with epistemic gain. It is argued that in a correct analysis there must be no identity between analysans and analysandum in respect to occurrent concepts. The relevance of thought experiments to conceptual analysis is (...) discussed and it is concluded that conceptual analysis consists of a transformation of knowledge how into knowledge that. Background: Medical decision making is based on patient autonomy and informed consent, which is an integral part of medical ethics, risk management and clinical governance. Consent to treatment has been extensively discussed, but the viewpoint of patients is not well represented. A new consent form was introduced by the Department of Health in 2001.Aims: To determine the information most important to patients, to facilitate evidence-based guidelines and to provide a valid and reliable consent-procedure-satisfaction questionnaire.Methods: An anonymous quantitative survey was carried (...) out, asking 100 patients 15 questions regarding procedures they may need to undergo, using a Visual Analogue Scale to test the importance of each question.Results and discussion: In total there were 77 respondents and the mean age was 48.8 years. There were 52% women and 48% men. Major complications, such as not undergoing the procedure, future management and long-term effect on work, all scored a median of 95%. Least concerns were related to technical details of the procedure and minor complications . All other questions were still considered important . No significant differences were observed between sex, age and professional groups, but a significant difference was observed between the education groups. Qualifications of the doctor did not correlate to any other question.Conclusions: This questionnaire is proposed as a basis for informed consent guidelines to health workers and for measures of satisfaction with the consent procedure. La epistemología histórico-filosófica de la "visión de los vencidos" suponía la existencia de una verdad, complementaria a la del vencedor. Sin embargo, esa perspectiva conduce, sin proponérselo, a un debilitamiento de la idea de verdad en relación con el continente americano. Eso abre la puerta a la desrealización de éste, evolucionando hacia la idea de que América es un juego de lenguaje dentro de otros juegos de lenguaje, sin remitir a una realidad o a una verdad epistemológico-filosófica. El análisis de (...) algunos aspectos de la obra de Miguel León Portilla, Peter Mason, Peter Sloterdijk y de la Jornada de Omagua de Dorado, escrita en 1561, sirven de apoyo para lo aquí planteado. The historical-philosophical epistemology of the vision of the vanquished supposed the existence of a true, complementary to the defeated's one, in all discourse on America. Nevertheless, that perspective leads, unwillingly, to a weakening of the idea of truth in relation to the continent. This opens the path to its derealisation and leads to the idea that America is a speech game within another speech games, and does not address a reality or a philosophical-epistemological truth. Our statements are supported by analysis of some aspects of the work of Peter Sloterdijk and Peter Mason and of the Journey of Omagua y Dorado, written in 1561. (shrink)

Unlike antilogy (ἀντιλογία), which refers to a type of argumentation where two arguments are pitted against each other in a contradictory manner, eristic takes on in Aristotle an exclusively pejorative meaning, as is made clear, for example, by this passage fromSoph. el.: ‘For just as unfairness in a contest is a (...) definite type of fault, and is a kind of foul fighting, so the art of contentious reasoning is foul fighting in disputation.’. Immunization plays a crucial role in global health security, preventing public health emergencies of international concern and protecting individuals from infectious disease outbreaks, yet these critical public health benefits are dependent on immunization law. Where public health law has become central to preventing, detecting, and responding to infectious disease, public health law reform is seen as necessary to implement the Global Health Security Agenda. This article examines national immunization laws as a basis to implement the GHSA and promote the public's (...) health, analyzing the scope and content of these laws to prevent infectious disease across Sub-Saharan Africa. Undertaking policy surveillance of national immunization laws in 20 Sub-Saharan African countries, this study: developed a legal framework to map the legal attributes relevant to immunization; created an assessment tool to determine the presence of these attributes under national immunization law; and applied this assessment tool to code national legal landscapes. An analysis of these coded laws highlights legal attributes that govern vaccine requirements, supply chains, vaccine administration standards, and medicines quality and manufacturer liability. Based upon this international policy surveillance, it will be crucial to undertake legal epidemiology research across countries, examining the influence of immunization law on vaccination rates and disease outbreaks. Honor walks are ceremonies that purportedly honor organ donors as they make their final journey from the ICU to the OR. In this paper, we draw on Ronald Grimes’ work in ritual studies to examine honor walks as ceremonial rituals that display medico-technological power in a symbolic social drama (Grimes, 1982). We argue that while honor walks claim to honor organ donors, ceremonies cannot primarily honor donors, but can only honor donation itself. Honor walks promote the quasi-religious idea of donation (...) as a “good death,” and mask the ambiguity and discomfort inherent in organ donation to promote greater acceptance by the medical community. While some goods may be achieved through honor walks, particularly for donor families, it is still important to examine the negative work done by this practice. (shrink)

Domestic litigation has become a principal strategy for realizing international treaty obligations for the human right to health, providing causes of action for the public’s health and empowering individuals to raise human rights claims for HIV prevention, treatment, and care. In the past 15 years, advocates have laid the groundwork on which a rapidly expanding enforcement paradigm has arisen at the intersection of human rights litigation and HIV/AIDS policy. As this enforcement develops across multiple countries, human rights are translated from (...) principle to practice in the global response to HIV/AIDS, transforming aspirational declarations into justiciable obligations and implementing human rights through national policies and programs. In August, Amnesty International and the World Medical Association expressed concern at reports that a judge in Saudi Arabia had asked several hospitals in the country whether they could perform an operation to damage a man's spinal cord as punishment for attacking another man and leaving him paralysed. The man had already been sentenced to seven months imprisonment for the crime, the injured victim requested the further sentence under Sharia Law, which is strictly enforced across Saudi Arabia. According to reports, (...) one of the hospitals approached declined on ethical grounds. Another hospital stated that it was possible to damage the spinal cord in the way requested, but that the procedure would have to be done at a specialised hospital. 1In its statement, Amnesty International urged the authorities not to carry out the sentence, which it argued would be a grave violation of international human rights law and contravene the United Nations convention against Torture, to which Saudi Arabia is a state party. 2 The WMA expressed its support for the physicians who refused to carry out the request by the Saudi court, participation in which would constitute a severe breach of medical ethics. 3 The WMA reminded doctors that the Declaration of Tokyo clearly states that no physician should participate in the practice of torture or any other forms of cruel, inhuman or degrading procedures, whatever the offence of which the victim of such procedures is suspected, accused or guilty of. The Declaration also includes a prohibition of participation in the planning or advising for such a procedure. The United Nations (UN) General Assembly High-Level Meeting (HLM) on pandemic prevention, preparedness and response (PPPR) was a missed opportunity to bring high-level commitment and momentum to the global governance of health emergencies. Intended to bring much-needed attention to a policy issue that is rapidly slipping down the international agenda, the fraught diplomacy among member states, lack of consensus on key issues, and weak UN Political Declaration in New York foreshadow a difficult road ahead for upcoming negotiations under the World (...) Health Organization (WHO) in Geneva. This column chronicles the evolving engagement of the UN in global health governance, examines the diplomatic process leading to the UN HLM on PPPR, and assesses the contributions and missed opportunities of its resulting Political Declaration. Dobbs v. Jackson Women’s Health continues a trajectory of U.S. Supreme Court jurisprudence that undermines the normative foundation of public health — the idea that the state is obligated to provide a robust set of supports for healthcare services and the underlying social determinants of health. Dobbs furthers a longstanding ideology of individual responsibility in public health, neglecting collective responsibility for better health outcomes. Such an ideology on individual responsibility not only enables a shrinking of public health infrastructure for reproductive (...) health, it facilitates the rise of reproductive coercion and a criminal legal response to pregnancy and abortion. This commentary situates Dobbs in the context of a long historical shift in public health that increasingly places burdens on individuals for their own reproductive health care, moving away from the possibility of a robust state public health infrastructure. La Masonería es una organización que ha estado presente en España, como en el mundo, en los períodos liberales y que ha sido perseguida y ha desaparecido casi en los totalitarismos, sean comunistas o fascistas. La masonería española, tradicionalmente vinculada el modelo europeo continental, ha concedido gran importancia a la participación activa en los grandes debates sociales. El cometido fundamental de la masonería es la formación de sus miembros como individuos y como ciudadanos. Desde tal perspectiva, los talleres masónicos han (...) sido reconocidos como auténticas escuelas de formación de elites democráticas y constituyen un capítulo tan importante como ignorado de nuestra cultura política. Además, la masonería ha mostrado un sobresaliente interés hacia la enseñanza, llegando con frecuencia a reducir las grandes cuestiones sociales a un problema educacional. Dentro del marco ético-jurídico laicista, la reflexión sobre la acción formativo-democrática de la masonería se centra con intensidad creciente en ¿educar para la paz¿. Un ejemplo relevante del legado cultural pacifista de la masonería histórica lo constituye los siete insignes masones distinguidos con el Premio Nobel de la Paz. La masonería debe considerase pues, por derecho propio, como una escuela de formación laica para la democracia y para la paz. (shrink)

The famous Allen's interval relations constraint propagation algorithm was intended for linear time. Its 13 primitive relations define all the possible mutual locations of two intervals on the time-axis. In this paper an application of the algorithm for non-linear time is suggested. First, a new primitive relation is added. It is called excludes since an occurrence of one event in a certain course of events excludes an occurrence of the other event in this course. Next, new composition rules for relations (...) between intervals are presented: some of the old rules are extended by the relation excludes, and entirely new ones are formulated for composing the relation excludes with the other relations. Four different composition tables are considered. The choice of a composition table depends on whether time is branching or not, and whether intervals can contain non-collinear subintervals or not. Codified seminally in Article 12 of the International Covenant on Economic, Social and Cultural Rights, the right to health proclaims that states bear an obligation to realize the “highest attainable standard” of health for all. However, in pressing for the highest attainable standard for each individual, the right to health has been ineffective in (...) compelling states to address burgeoning inequalities in underlying determinants of health, focusing on individual medical treatments at the expense of public health systems. This article contends that the paradigm of individual health, focused on a right to individual medical care, is incapable of responding to health inequities in a globalized world and thereby hampers efforts to operationalize health rights through public health systems. While the right to health has evolved in international discourse over time, this evolution of the individual right to health cannot address the harmful societal ramifications of economic globalization. Rather than relying solely upon an individual right to medical care, envisioning a collective right to public health – a right applied at the societal level to address underlying determinants of health – would alleviate many of the injurious health inequities of globalization. Following from sweeping law reforms across the global health landscape, there is a need to prepare the next generation to advance global health law to ensure justice for a healthier world. Educational programs across disciplines have increasingly incorporated the field of global health law, with new courses examining the law and policy frameworks that apply to the new set of public health threats, non-state actors, and regulatory instruments that structure global health. Such interdisciplinary training must be expanded throughout the world (...) to prepare future practitioners to strengthen global health law — ensuring a foundation for global health in legal studies and law and global health studies. Meeting this imperative for global health law teaching — establishing academic courses and textbooks on global legal responses to shared health threats — will be necessary to support students to address the global health challenges of the future. When we look around us, some things look “alive,” others do not. What is it to “look alive”—to perceive animacy? Empirical work supports the view that animacy is genuinely perceptual. We should construe perception of animacy as perception of agents and behavior. This proposal explains how static and dynamic animacy cues relate, and explains how animacy perception relates to social cognition more broadly. Animacy perception draws attention to objects that are apt to be well‐understood folk psychologically, enabling us to marshal (...) our folk psychological resources efficiently. (shrink)
