Attempts to understand recent changes in the canon of American literature through the aid of psychoanalytic theory.

We all know that speech can be harmful. But how? Mary Kate McGowan argues that speech constitutes harm when it enacts a norm that prescribes that harm. She investigates such harms as oppression, subordination, and discrimination in such forms of speech as sexist remarks, racist hate speech, pornography, verbal triggers, and micro-aggressions.

This paper argues that an addressee's failure to recognize a speaker's authority can constitutes another form of silencing.

Despite creating vast inequalities and propping up reactionary world regimes, capitalism has many passionate defenders—but not because of what it withholds from some and gives to others. Capitalism dominates, Todd McGowan argues, because it mimics the structure of our desire while hiding the trauma that the system inflicts upon it. People from all backgrounds enjoy what capitalism provides, but at the same time are told more and better is yet to come. In this paper, I present a new (i.e., previously overlooked) breed of exercitive speech act (the conversational exercitive). I establish that any conversational contribution that invokes a rule of accommodation changes the bounds of conversational permissibility and is therefore an (indirect) exercitive speech act. Such utterances enact permissibility facts without expressing the content of such facts, without the speaker intending to be enacting such facts and without the hearer recognizing that it is so. Because of the peculiar nature ofthe rules (...) of accommodation that generate them, conversational exercitives have importantly different felicity conditions and therefore constitute a new breed ofexercitive speech act. This paper criticizes Langton's speech act account of MacKinnon's claim about (the subordinating force of) pornography and offers a different account of how speech might enact harmful norms and thus constitute harm.

Catharine MacKinnon claims that pornography silences women in a way that violates the right to free speech. This claim is, of course, controversial, but if it is correct, then the very free speech reasons for protecting pornography appear also to afford reason to restrict it. For this reason, it has gained considerable attention. The philosophical literature thus far focuses on a type of silencing identified and analyzed by Jennifer Hornsby and Rae Langton (H&L). This article identifies, analyzes, and argues for (...) the importance of a different type of silencing. As we shall see, there are compelling reasons in favor of regarding H&L silencing as a free speech violation and, as I argue here, the same can be said for sincerity silencing. Although additional work needs to be done to show that either one actually is a free speech violation, I demonstrate here that both types of silencing equally warrant this further attention. Moreover, I show that sincerity silencing is a fairly widespread phenomenon; so, therefore, is the harm it constitutes. As a result of these considerations, then, we can safely conclude that sincerity silencing also requires our attention. (shrink)

This paper argues that linguistic oppression is coherent; speech can oppress. Moreover, even though oppression is a structural phenomenon, a single utterance can nevertheless be an act of oppression. This paper also argues that ordinary utterances can oppress. That is, speakers do not need to have and be exercising authority in order for their speech to be oppressive. Furthermore, ordinary speech can oppress even though the speakers do not intend to oppress, even though the hearers do not take it to (...) oppress, even though the oppressed do not hear it, and even though the oppressed are unaware of being oppressed. On the account offered here, linguistic oppression is sneaky, hidden, and surprisingly widespread. (shrink)

ABSTRACT This paper argues for a hidden way in which speech constitutes harm by enacting harmful norms. The paper then explores the potential legal consequences of uncovering such instances of harm constitution. In particular, the paper argues that some public racist speech constitutes harm and is thus harmful enough to warrant legal remedy. Such utterances are actionable, it is contended, because they enact discriminatory norms in public spaces.

The idea that an utterance of a basic (nondeviant) declarative sentence expresses a single true-or-false proposition has dominated philosophical discussions of meaning in this century. Refinements aside, this idea is less of a substantive theses than it is a background assumption against which particular theories of meaning are evaluated. But there are phenomena (noted by Frege, Strawson, and Grice) that threaten at least the completeness of classical theories of meaning, which associate with an utterance of a simple sentence a truth-condition, (...) a Russellian proposition, or a Fregean thought. And it may well be the case that a framework within which utterances express sequences of propositions provides much of what is needed to account for the relevant phenomena, a better overall picture of the way language works, and an enticingly uniform perspective on a variety of semantic problems. I do not myself take to theories that multiply propositions by appealing to propositions “presupposed” or to pairs of Fregean and Russellian propositions, or theories that show no respect for a distinction between semantics and pragmatics— where the former is the study of propositions whose general form and character is determined by word meaning and syntax—or for theories that blithely abandon general principles of composition and semantic innocence. I would like to sketch a package based on four interconnected ideas: (i) the meaning of an individual word is a sequence of instructions for generating a sequence of propositions (in conjunction with compositional instructions (syntax) and elements of context); (ii) utterances themselves are not bearers of truth or falsity; (iii) judgements of truth, falsity, commitment, and conflict are shaped, in part, by the weights attached to individual 1 propositions that occur in sequences expressed by utterances, weights that may be set (and reset) by contextual considerations; (iv) Fregean senses are superfluous; propositions might as well be Russellian (Mont Blanc and all its snow fields will do as well as any mode of presentation).. In this paper, we argue that to properly understand our commitment to a principle of free speech, we must pay attention to what should count as speech for the purposes of such a principle. We defend the view that ‘speech’ here should be a technical term, with something other than its ordinary sense. We then offer a partial characterization of this technical sense. We contrast our view with some influential views about free speech , and show that our view has (...) distinct advantages. Finally, we consider racist hate speech. Here, we argue that if certain theorists are right about what some racist hate speech does, then such speech should fall outside the scope of the free speech principle, and so, should be as regulable as any non-speech action. John Martin Fischer and Mark Ravizza have constructed a theory of moral responsibility according to which agents are responsible only if they take responsibility in a particular way. Crucial to taking responsibility is coming to adopt a certain set of beliefs about oneself, such as the belief that one is a legitimate target of attitudes like gratitude and resentment, praise and blame. Moreover, agents must come to adopt this belief in a way that is ‘appropriately based’ upon their evidence, if (...) they are to be genuinely responsible for what they do. In this paper I argue that agents need not meet these conditions in order to be morally responsible. I offer a case in which the agent thinks of himself as responsible, appears to be responsible, but fails to take responsibility in Fischer and Ravizza’s sense. I then argue that Fischer and Ravizza’s account of responsibility for consequences is in conflict with their contention that individuals who reject the justifiability of responsibility ascriptions fail, thereby, to be morally responsible agents. According to pancomputationalism, all physical systems – atoms, rocks, hurricanes, and toasters – perform computations. Pancomputationalism seems to be increasingly popular among some philosophers and physicists. In this paper, we interpret pancomputationalism in terms of computational descriptions of varying strength—computational interpretations of physical microstates and dynamics that vary in their restrictiveness. We distinguish several types of pancomputationalism and identify essential features of the computational descriptions required to support them. By tying various pancomputationalist theses directly to notions of what counts as (...) computation in a physical system, we clarify the meaning, strength, and plausibility of pancomputationalist claims. We show that the force of these claims is diminished when weaknesses in their supporting computational descriptions are laid bare. Specifically, once computation is meaningfully distinguished from ordinary dynamics, the most sensational pancomputationalist claims are unwarranted, whereas the more modest claims offer little more than recognition of causal similarities between physical processes and the most primitive computing processes. The idea that earthly actions have consequences for the afterlife mirrors the notion of karma, “the moral law of cause and effect” believed by both Hindus and Buddhists. (...) In The Good Place, each character, in his or her own way, prepares for their release from the cycle of samsara, and each has come to accept reality as it is, accepting whatever their afterlives throw at them. He examines the ways in which the narrators’ uncertainty leads to collaboration from interlocutors in conversational remembering and how such co‐construction of memories can instantiate instances of distributed cognition (Hutchins, 1995).

The great political ideas and movements of the modern world were founded on a promise of universal emancipation. But in recent decades, much of the Left has grown suspicious of such aspirations. Critics see the invocation of universality as a form of domination or a way of speaking for others, and have come to favor a politics of particularism—often derided as “identity politics.” Others, both centrists and conservatives, associate universalism with twentieth-century totalitarianism and hold that it is bound to lead (...) to catastrophe. This book develops a new conception of universality that helps us rethink political thought and action. Todd McGowan argues that universals such as equality and freedom are not imposed on us. They emerge from our shared experience of their absence and our struggle to attain them. Suppose a diner says, 'Can you pass the salt?' Although her utterance is literally a question (about the physical abilities of the addressee), most would take it as a request (that the addressee pass the salt). In such a case, the request is performed indirectly by way of directly asking a question. Accordingly this utterance is known as an indirect speech act. On the standard account of such speech acts, a single utterance constitutes two distinct speech acts. On this account (...) then, 'Can you pass the salt?' is both a question and a request. In a provocative essay, Rod Bertolet argues that there are no indirect speech acts. According to Bertolet, 'Can you pass the salt?' is only a question. It is a question that merely functions as a request (without also being one). In this paper we respond to Bertolet's skeptical argument. Appealing to Searle's theory of speech acts and to certain features of linguistic communication, we argue that, despite Bertolet's challenge, there is good reason to countenance indirect speech acts. In this study, we test the interactive effect on ethical decision-making of (1) personal characteristics, and (2) personal expectanciesbased on perceptions of organizational rewards and punishments. Personal characteristics studied were cognitive moral developmentand belief in a just world. Using an in-basket simulation, we found that exposure to reward system information influenced managers’ outcome expectancies. Further, outcome expectancies and belief in a just world interacted with managers’ cognitive moral development to influence managers’ ethical decision-making. In particular, low-cognitive moral development managers who (...) expected that their organization condoned unethical behavior made less ethical decisions while high cognitive moral development managers became more ethical in this environment. He examines these ideas from a broadly Afrocentric framework in which the concerns, interests, and perspectives of Africans--whether they reside on the continent or live in the African diaspora--are the legitimate and central subjects of scholarly study. This approach warrants Neal’s interpretation of Thurman’s and Newton’s writings as fitting within the “African Freedom Aesthetic,” in which (...) the aesthetic expressions of transcendence, transformation, human consciousness, and collective will have become the means by which Africans living under oppressive conditions during the modern period could work to liberate themselves from those conditions. Neal’s latest book uses Howard Thurman as a window through which to view concepts that shaped black thought in the Modern Era of the African-American Freedom Struggle. Thurman’s grasp of black culture and religious ideas during the period of enslavement allowed him to produce a body of work grounded in the musings and traditions of his ancestors.

While provisions of youth sports concussion laws are very similar, little is known as to how they are being implemented, factors that promote or impede implementation, or the level of compliance in each jurisdiction. We aimed to describe state experiences with implementation in order to inform ongoing efforts to reduce the harm of sports-related traumatic brain injury and to guide future evaluations of the laws’ impacts and the development of future public health laws. We conducted key-informant interviews in 35 states (...) with recently enacted concussion legislation. States varied considerably in their readiness and capacity for implementation. Factors facilitating implementation included existing partnerships, procedures, and resources; centralized implementation authority; prior related efforts; and involvement in the policymaking process by those now charged with implementation. Inhibitors included ambiguous statutory language, unclear delegation of authority, and compliance difficulties. Ongoing challenges persist, including primary prevention; determining which providers are qualified to make return-to-play assessments and contents of those assessments; compliance difficulties in rural and under-served areas; and unclear responsibility for enforcement. Despite the similarity of youth sports concussion laws, early evidence suggests there is considerable variation in their implementation. These findings are critical for ongoing empirical investigations to accurately evaluate the laws’ provisions and to identify successful legal approaches to protecting young athletes. (shrink)

In this encyclopedia entry I sketch the way contemporary theorists understand moral responsibility -- its varieties, its requirements, and its puzzles.

In this chapter I articulate the threat that time travel to the past allegedly poses to the free will of the time traveler, and I argue that on the traditional way of thinking about free will, the incompatibilist about time travel and free will wins the day. However, a residual worry about the incompatibilist view points the way toward a novel way of thinking about free will, one that I tentatively explore toward the end of the chapter.
