Adam Smith rejected Mandeville's invisible-hand doctrine of 'private vices, publick benefits'. In The Theory of Moral Sentiments his model of the 'impartial spectator' is driven not by sympathy for other people, but by their approbation. The innate capacity for sympathy makes approbation credible. Approbation needs to be authenticated, and in Smith's model authentication relies on innate virtue, which is not realistic. An alternative model of 'regard' makes use of signalling and is more pragmatic. Modern versions of the invisible hand in (...) rational choice theory and neo- liberalism are shown to be radical departures from the ethical legacy of Enlightenment and utilitarian economics, and are not consistent with Adam Smith's own position. A comprehensive compilation of legal rulings about children, one of particular historical utility and yet largely overlooked, is Muḥammad al-Asrūshanī’s Jāmiʿ aḥkām al-ṣighār. It offers a rather holistic view of the legal status of Muslim children and, more importantly, insight into common concepts of childhood and attitudes to children in premodern Muslim societies. Moreover, although drawing on the written heritage of middle-class urban scholars, the normative yet multilayered text of Jāmiʿ provides many precise details on children’s lives and their social (...) environment. This article introduces al-Asrūshanī’s unique work—its structure, contents, and sources—and offers, as a case study, an analysis of the chapter the author dedicates to enslaved children. While al-Asrūshanī intended some, or even the majority, of instances discussed in this chapter to address theoretical legal debates, others, particularly those drawn from fatwas, mirror the real experiences of enslaved minors, concubines, and enslavers. Together they provide a picture of a moderate form of domestic slavery in the Islamic world, particularly in Central Asia of the Mongol period. (shrink)

My plan in this article is to begin by raising the question of the point of judgements of beauty, and then to examine Kant's account of beauty in the third Critique from the perspective opened up by that question. Having raised the question of the point, I will argue, first, that there is an implied answer to it in Kant's text, and, second, that the answer is ultimately unsatisfying in that it falsely assumes that there is a ‘need’, or ‘task’, (...) or ‘purpose’, that we all necessarily share, to conceptualize all that encounters us in our experience, and fit it into one unified and comprehensive system. It is only against this assumption of our transcendental cognitive interest that Kant can so much as seem to have a real story to tell about where the value that we claim for things in calling them ‘beautiful’ derives from. This, in effect, means that to the extent that Kant offers us any answer at all to the question of the point of judgements of beauty, that answer testifies to his general neglect of the question of the point of judgements. And my purpose is to draw attention to that neglect, and to begin to assess its significance for Kant's transcendental project in general and for his conception of beauty in particular. (shrink)

The dissertation consists of three separate but related papers. The papers investigate various ways in which questions of value bear on questions of intelligibility, and vice versa. The guiding idea is the Wittgensteinian insight, explored by Stanley Cavell, that our intelligibility, to ourselves and to others, and in particular our saying anything with our words, is a matter of making a point. In the first paper I offer a reading guided by this insight, of Wittgenstein's remarks on 'seeing aspects'. (...) In the second and third papers I use this insight for criticizing Kant's ethics and Kant's aesthetics, respectively; and as a starting point for developing alternative conceptions of ethical discourse and of beauty. ;Each one of the three essays picks a certain moment of human expression and communication, and asks for the point of what we say in such a moment. I take what may be called, after Wittgenstein, 'a language-game', and I ask for the source and nature of the comprehensibility we earn for ourselves in playing the game---a comprehensibility that depends on the game's having a point. ;No less important than the answer I offer in each case to the question of the point of a particular language-game is the fact---which I try in each case to establish---of philosophy's neglect of that question. In the opening section of the third essay I try to say something more systematic about the nature, and about the significance, of this neglect. (shrink)

In the concluding lines of Part Three of The Claim of Reason, Stanley Cavell writes: ‘If the moralist is the human being who best grasps the human position, teaches us what our human position is, better than we know, in ways we cannot escape but through distraction and muddle, then our first task in subjecting ourselves to judgment is to tell the moralist from the moralizer’. Cavell then proceeds to characterize the moralizer as one who is ‘speaking in the name (...) of a position one does not occupy, confronting others in positions of which one will not imagine the acknowledgement’. Beginning with an exposition of Cavell’s notion of ‘moral position’, I will offer an interpretation of the distinction he draws between the moralist and the moralizer; I will then explain how the moral philosopher’s use of morally significant words may come to resemble the moralizer’s; and then I will argue that contemporary English-speaking moral philosophy as represented by the recent debates concerning ‘moral testimony’, or ‘moral deference’, has been failing its moralist aspirations, and that, by Cavell’s lights, the morality reflected in those debates is, in essence, that of the moralizer. In Mind and World and related works, John McDowell attempts to offer us an understanding of the relation between our experience of the world and our wording of it. In arguing for this understanding, McDowell sees himself as engaged in a Wittgensteinian exorcism of a philosophical puzzlement; and his aim is to recover for us a truly satisfying way of conceiving of the relation between our words and our world. Taking my bearing from Stanley Cavell's reading of Wittgenstein, in (...) which, as I argue, the notion of 'the point of an utterance' plays a central role, I develop a criticism of McDowell on two levels. First, I try to show that McDowell fails to lead his words - 'experience', 'seeing', 'judging', 'claiming', and others - back from their metaphysical to their everyday use. His use of these words is still controlled by a particular picture of our relation to the world, rather than by our everyday criteria. Second, I argue that the picture controlling McDowell's account of our wording of our world is one in which the question concerning the point of putting something into words is being repressed. McDowell proposes that our experience 'contains claims', in the sense that it provides us with the very same content that a claim, or a judgment, might have. I argue that, given the philosophical work that McDowell intends such formulations to perform, the 'innocent' understanding that he aims to recover for us betokens a failure to attend to the conditions that allow our words to express, or otherwise carry, any determinate content.Not: 'How can I describe what I see?' but 'What does one call "description of what is seen"'? This paper argues for two interrelated claims. The first is that the most innovative contribution of Timothy Williamson, Herman Cappelen, and Max Deutsch in the debate about the epistemology of thought experiments is not the denial of intuition and the claim of the irrelevance of experimental philosophy but the claim of epistemological continuity and the rejection of philosophical exceptionalism. The second is that a better way of implementing the claim of epistemological continuity is not Deutsch and Cappelen’s argument view or (...) Williamson’s folk psychological view. This is so because while the argument view makes the basis of the relevant classificational judgement evidentially too demanding; the folk psychological view makes it too weak and error-prone to count as an adequate explanation. Drawing from a certain reading of Aristotle’s Nichomachean Ethics that flowers in Miranda Fricker and John McDowell, I argue for the reason-responsiveness view. Like the extant views, the reason-responsiveness view vindicates the claim of epistemological continuity. But unlike the extant views, it does not share those problematic features. Further, I show that the reason-responsiveness view offers a way for champions of the claim of epistemological continuity to resist Avner Baz’s objection to the claim of epistemological continuity and his objection to the philosophical use of thought experiments while taking on board some attractive elements of his view. I offer a critical reconstruction of Kant's thesis that aesthetic judgement is founded on the principle of the purposiveness of nature. This has been taken as equivalent to the claim that aesthetics is directly linked to the systematicity of nature in its empirical laws. I take issue both with Henry Allison, who seeks to marginalize this claim, and with Avner Baz, who highlights it in order to argue that Kant's aesthetics are merely instrumental for his epistemology. My solution (...) is that aesthetic judgement operates as an exemplary presentation of our general ability to schematise an intuition with a concept at the empirical level. I suggest that this counts as an empirical schematism. Although aesthetic judgement is not based on empirical systematicity, it can nevertheless offer indirect support for the latter in so far as it is a particular revelation of purposiveness in general. Democratic theory offers robust resources in order to defend the claim that noncitizens are, in many cases, entitled to the right to vote in their place of residence, regardless of their citizenship. On this, Avner de Shalit and I are in broad agreement. But the route we take to justify this right rests on substantially different argumentation: whereas I believe that residence is necessary and sufficient to justify the right to vote at the municipal and, more controversially, at the (...) national level, de Shalit believes that noncitizens must also intend to reside in a city over the longer term in order to merit the right to vote on city matters. I will argue that this focus on intention is dangerous for the most vulnerable of city dwellers, who are most in need of the right to vote, even if only at the city level. In particular, I argue that the only way that the right to vote can play its protective role is if it is available to migrants on the basis of residence, regardless of their stated intention. Avner Baz presents a critique of the working practices of analytic philosophy in recent decades. He challenges the assumptions on which the philosophical 'method of cases' rests, and he presents a pragmatist conception of language on which the method of cases as used both 'armchair' and 'experimental' philosophers is fundamentally misguided.

The basic conflict: an initial characterization -- The main arguments against ordinary language philosophy -- Must philosophers rely on intuitions? -- Contextualism and the burden of knowledge -- Contextualism, anti-contextualism, and knowing as being in a position to give assurance -- Conclusion: skepticism and the dialectic of (semantically pure) "knowledge" -- Epilogue: ordinary language philosophy, Kant, and the roots of antinomial thinking.

What does it mean to be disadvantaged? Is it possible to compare different disadvantages? What should governments do to move their societies in the direction of equality, where equality is to be understood both in distributional and social terms? Linking rigorous analytical philosophical theory with broad empirical studies, including interviews conducted for the purpose of this book, Wolff and de-Shalit show how taking theory and practice together is essential if the theory is to be rich enough to be applied to (...) the real world, and policy systematic enough to have purpose and justification. The book is in three parts. Part 1 presents a pluralist analysis of disadvantage, modifying the capability theory of Sen and Nussbaum to produce the 'genuine opportunity for secure functioning' view. This emphasises risk and insecurity as a central component of disadvantage. Part 2 shows how to identify the least advantaged in society even on a pluralist view. The authors suggest that disadvantage 'clusters' in the sense that some people are disadvantaged in several different respects. Thus identifying the least advantaged is not as problematic as it appears to be. Conversely, a society which has 'declustered disadvantaged' - in the sense that no group lacks secure functioning on a range of functionings - has made considerable progress in the direction of equality. Part 3 explores how to decluster disadvantage, by paying special attention to 'corrosive disadvantages' - those disadvantages which cause further disadvantages - and 'fertile functionings' - those which are likely to secure other functionings. In sum this books presents a refreshing new analysis of disadvantage, and puts forward proposals to help governments improve the lives of the least advantaged in their societies, thereby moving in the direction of equality. ‘Rabbi’ is the title of Jewish scholars and teachers. Yet, in the sixteenth century, the word was sometimes employed in Christian discourse, when Christian scholars referred to their Christian peers as rabbis. How could non-Jews be called rabbis? This article explores the meaning of the term ‘rabbi’ in sixteenth-century intra-Christian polemics and discourse. It shows how the image of the ‘rabbi’, a figure of (negative) intellectual authority, penetrated the speech of Christian intellectuals and polemicists. It suggests that this ‘rabbinic’ figure (...) was not necessarily Jewish. Although ‘rabbi’ is a Jewish term – the incarnation of Jewish intellectual life – the term also denotes Jesus as well as his opponents, the Pharisees. Thus, polemical ‘rabbinising’ of Christian scholars potentially involved very different images of scholarly authority. (shrink)

ABSTRACT Facing heretofore unknown waves of new immigrants, the Israeli Government and the mayor of Jerusalem issued a comprehensive development programme, including rapid and massive construction. Cities with historical and aesthetic uniqueness, particularly Jerusalem, are likely to lose their special features and beauty. A question is raised: how can an argument in favour of conservation of the special beauties of such cities be advanced in light of the urgent need to supply shelter and jobs for their inhabitants? The paper has (...) two aims: to analyse the reasons for environmental ethics'failure to discuss urban preservation so far, and to put forward a rationale for urban preservation. The latter derives from the political wisdom of King Solomon and from the notion of anthropocentric intrinsic value. (shrink)

The perception of what he calls 'aspects' preoccupied Wittgenstein and gave him considerable trouble in his final years. The Wittgensteinian aspect defies any number of traditional philosophical dichotomies: the aspect is neither subjective nor objective; it presents perceivable unity and sense that are not conceptual; it is 'subject to the will', but at the same time is normally taken to be genuinely revelatory of the object perceived under it. This Element begins with a grammatical and phenomenological characterization of Wittgensteinian 'aspects'. (...) It then challenges two widespread ideas: that aspects are to be identified with concepts; and that aspect perception has a continuous version that is characteristic of human perception. It concludes by proposing that aspect perception brings to light the distinction between the world as perceived and the world as objectively construed, and the role we play in the constitution of the former. The purpose of this paper is to use Kant's Critique of Judgement in order to raise and motivate the question of the point of judgements of beauty, to illustrate the philosophical tendency to neglect or even repress it, and to begin to look for an answer to that question. On the way, I will consider Kant's implied answer to the question and will argue that it is unsatisfactory in that it relies on a false picture of the everyday subject's relation (...) to his or her world. The argument of this chapter proceeds in the form of constructive criticism of Charles Travis’s recent work on perception. Travis has presented a powerful argument against the idea that perception, as such, provides us with true-or-false representations of the world. The representationalist view, Travis argues, fails to respect the fundamental Fregean distinction between "the conceptual" and "the nonconceptual." According to Travis, what perception presents us with is nonconceptual; hence, perception is indeterminate as far as representational content goes. Travis argues that (...) determinate representational content, on the other hand, is only created when things are judged to be some particular way or another. In this chapter, Avner Baz finds himself in substantial agreement with Travis, but argues that something important also goes missing in the latter’s account, namely what Baz calls "the phenomenal world"; that is, the world as perceived and responded toprior to becoming the object of true or false judgments. In particular, Baz shows how Travis consistently represses the phenomenal world in his account of perception whenever he attempts to explain the perception of what Wittgenstein calls "aspects"; for any respectable account of the perception of such aspects, Baz argues, ought to bring the phenomenal world into view. In this paper I develop a critique of Kantian ethics, and more precisely a critique of a particular conception of moral reasoning. The fundamental assumption that underlies the conception that I am targeting is that to justify (morally or otherwise) an action is (perhaps with an ‘all things being equal’ clause) to settle its value, in such a way that all rational participants would have to acknowledge that value. As an alternative to the Kantian conception, I propose a conception in (...) which the basic unit of moral reasoning is not an action but rather what I call an ‘ethical position’—where an ethical position is where, at any given moment and with respect to the matter at hand, you stand, and where moral reasoning consists in the articulation of ethical positions. This paper develops particular Strausian-like themes on the formation and structure of the Cartesian problematic. Particularly, my interest is to link the Cartesian ‘invention’ of consciousness (or ‘the mental’) in the philosophy of mind with the issues of representation and ‘the problem of the external world’ in epistemology. The Cartesian novelty becomes clear by comparing Cartesian scepticism with Greek classical scepticism.
